The Quick Read: Yes, in many cases, because a property with no recorded mortgage leaves any new line of credit in first lien position, though approval still depends on the borrower’s personal profile and how title is held.
- Title decides lien position, not the product name. No recorded mortgage means first position.
- On an investment property, the network ceiling is 70% CLTV, with a $500,000 maximum line and a 700 minimum credit profile, subject to lender guidelines.
- The title must sit with an individual or a revocable living trust. An LLC cannot hold title on the line.
- The line is sized on personal credit and debt-to-income, not on rent coverage.
- Lendmire arranges these lines through select wholesale partners in its 16 full-service states only. It is not the lender.
Owning a duplex, triplex, or fourplex free and clear feels like it should make borrowing easy. It makes one thing easy: lien position. Everything else still gets tested. This article walks through the mechanics, the exceptions, and the decision between a line of credit and a DSCR cash-out.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
Key Terms Defined
Free and clear: A property with no recorded mortgage or other lien against it.
First lien position: The lender’s claim ranks ahead of every other claim because nothing else is recorded.
CLTV (combined loan-to-value): All loans secured by the property, divided by the property’s value.
Vesting: How the deed names the owner, such as an individual, a trust, or an LLC.
Draw period: The stretch of time when you can borrow against the line, usually with interest-only payments.
HELOC: An open-end line of credit that lets you borrow repeatedly against home equity, as the CFPB’s explanation of home equity lines describes it.
Why Does a Paid-Off Rental Get First Position?
A paid-off rental gets first position because lien order follows what is recorded against the title. If no mortgage is on record, a new line of credit is the first claim. Nothing ranks ahead of it.
The product label does not change this. A standalone line placed on a free-and-clear building is first lien whether the borrower documents income with traditional personal-income documentation or bank statements. Title work confirms it.
There is a wrinkle worth knowing. Some products marketed as an investment property HELOC are really a cash-out refinance that pays off an existing first mortgage. That is a different transaction. A true standalone line leaves the property otherwise untouched.
Does first position mean better terms on a rental? Not automatically. On an owner-occupied home, first position often helps. On an investment property, the lender’s caution about non-owner-occupied risk can offset the position advantage. Expect a tighter ceiling than a primary residence gets.
What Paid-Off Changes, and What It Doesn’t
| Factor | Paid-off changes it? | Notes |
|---|---|---|
| Lien position | Yes | First lien, confirmed by title |
| Leverage ceiling | No | 70% CLTV on investment property |
| Credit minimum | No | 700 on investment property |
| Title and vesting | No | Individual or revocable trust only |
| Line size cap | No | $500,000 on investment property |
| Personal DTI test | No | Up to 50% maximum |
The pattern is clear. Paid-off fixes the lien question and nothing else. A free-and-clear fourplex does not unlock 100% of value, because the leverage cap binds before the equity does.
Does Your Building Qualify as a 2-4 Unit?
Duplexes, triplexes, and fourplexes are eligible collateral. Across the select lenders in Lendmire’s network, eligible property types also include single-family homes, PUDs, townhomes, and condominiums, including non-warrantable condos. One program in the network sets a 640 minimum credit profile for 2-4 units on its longer-runway structure, so a 700 investment floor already clears it.
Not eligible: manufactured homes, co-ops, condotels, log homes, and commercial, mixed-use, or agricultural-zoned properties. A fourplex with a ground-floor shop under a commercial or mixed-use designation falls outside these lines. Those types are not offered.
Five or more units is a different world. Federal law treats residential property with fewer than five dwelling units differently, which is why 2-4 units are the natural fit for this product. A five-unit building is generally commercial and sits outside it.
Occupancy matters
Occupancy sets the tier. If you live in one unit, the deal works into the primary-residence tier, where ceilings and line sizes differ. If every unit is rented, it is an investment file, and the 70% CLTV ceiling applies. This article discusses the investment case.
Short-term rental use on a 2-4 unit adds its own questions. Lendmire’s piece Does a Short-Term Rental on a 2-4 Unit Qualify for a HELOC? covers that separately. Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.
Who Can Hold Title?
Title must be held by an individual borrower or an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title on the line. This is the sharpest structural difference from a DSCR loan.
If your duplex sits in an LLC, you have two realistic choices:
1. Re-vest title into your personal name or a revocable trust, then apply. Talk to your attorney and title company first, because moving title can have consequences outside the loan.
2. Pivot to a DSCR cash-out refinance, which can close in an LLC, subject to program terms.
This is the most common wall investors hit. Many experienced owners hold everything in entities for liability reasons. If that is you, the line of credit may simply not be your product.
How Much Line Can You Get?
The lender takes the property’s value, multiplies by the allowed CLTV, subtracts existing liens, and caps the result at the program maximum. On a paid-off property, existing liens are zero. So CLTV is just the line divided by value.
On an investment property, the allowed CLTV is 70% and the maximum line is $500,000. Both 720 and 700 credit tiers reach the same 70%, so a score above 700 buys eligibility rather than extra leverage. And 700 is a hard floor with no tier beneath it.
Picture a triplex valued at $600,000. At 70% CLTV, the formula yields a number below the $500,000 cap, so leverage is the binding limit. Now picture a high-value fourplex worth well over $700,000. There, the $500,000 dollar cap binds before the percentage does. You can find which limit applies to your building by running the property value through the calculator. It gives an illustrative estimate, not a quote.
Lines above $500,000 exist on the network, but only for primary residences, with a 700-or-better credit profile (720 on the longer-runway structure), a 75% CLTV cap, and a full appraisal. They are not available on investment property.
Because an investment line caps at $500,000 and full appraisals begin only above that, these lines run in the automated-valuation lane and commonly close with no traditional appraisal. A borrower may still request one. Compare that with a DSCR cash-out, which uses a full appraisal that includes a rent opinion, typically on the small residential income property form (1025) with the rent schedule (1007).
What the Lender Underwrites
The line is sized on the borrower. A free-and-clear building does not change that.
- Credit. A 700 minimum on investment property. The score model is a single-bureau score keyed to the primary wage earner, and the report can be no more than 90 days old at closing.
- Housing history. Mortgage payment history is reviewed across all financed properties, not just the subject.
- Debt-to-income. Up to 50% maximum, qualified on the interest-only payment calculated at the maximum draw. Above 45% requires a 680 minimum, which an investment file already exceeds.
- Exposure. A borrower can hold up to three lines, and combined exposure caps at $2,000,000 on the higher-leverage program and $750,000 on the longer-runway program. An owner of more than 15 financed properties is not eligible.
- Derogatory history. Bankruptcy needs 4 years of seasoning from discharge or dismissal. Investment files follow a 7-year path for foreclosure and 4 years for a deed-in-lieu, pre-foreclosure, or short sale.
Notice what is missing: rent coverage. DSCR compares rent to the full monthly payment, but a line of credit is not judged that way. A strong rent roll helps your overall financial picture. It does not size the line.
Is Your Title Really Clean?
“Paid off” in your head and “free and clear” on title are not always the same. Before you apply, check these:
- A recorded release exists for any old mortgage. A loan you paid off years ago but never had formally released can still show on title.
- No stray liens, such as old judgment, contractor, or tax liens.
- Vesting matches the borrower. The name on the deed must be the name on the application, or the revocable trust.
- Unit count and zoning match the eligible property types.
Lien position follows what is recorded. A title search before you apply costs little and saves a failed application. If something unreleased turns up, fix it first.
How the Line Works After Closing
The structure is worth understanding before you sign. Investment lines run a 5-year draw period followed by a 25-year fully amortizing repayment period. At least 75% of the line is drawn at closing. Pricing floats during both the draw and the repayment period and never converts to fixed.
That floating structure shapes who this product suits. It fits an investor who wants flexible access to equity, such as funding a renovation on a second building, or a down payment on the next purchase. It fits less well an investor who wants a fixed, predictable payment on a lump sum.
Two practical points. First, a minimum subsequent draw applies after closing, commonly $1,000 on the longer-runway program. Second, remember that a first-position line must later be paid off or subordinated if you do a cash-out refinance on the same building. Plan the sequence.
A caution on flexibility: lenders can freeze or reduce lines of credit. Investors treat a line as a tool for modest, near-term needs, not as permanent capital for a long project.
HELOC or DSCR Cash-Out: Which Fits?
| Factor | First-position HELOC | DSCR cash-out refinance |
|---|---|---|
| Underwritten mainly on | Borrower credit and DTI | Property rent vs full payment |
| Title | Individual or revocable trust | LLC allowed, subject to program terms |
| Leverage | 70% CLTV on investment | Around 75% LTV on cash-out |
| Payment | Floats, never fixed | Can be fixed |
| Valuation | Usually automated | Full appraisal with rent opinion |
| Max amount | $500,000 line | Up to $3,000,000 on standard programs |
Choose the line of credit if you hold title personally, have strong credit, a manageable personal DTI, and want flexible, modest draws. Choose the DSCR cash-out if your building sits in an LLC, your personal DTI is high but the rent covers the payment well, or you want a fixed structure and a larger sum.
On the DSCR side, most standard programs start at 1.00 coverage, with stronger ratios opening better pricing and leverage. A separate select-lender path goes below 1.00 with leverage and terms adjusted. Clearing 1.00 is not the same as positive cash flow, since repairs, vacancy, and management sit outside the calculation. For the full picture, see the complete DSCR loans guide.
One more honest observation: an investor who holds a paid-off building and wants to keep it that way, with no new fixed obligation, may prefer the line. Someone aiming to scale across many financed properties will likely run into the 15-property limit and the three-line limit, and DSCR becomes the more practical lane.
What About Federal Consumer Rules?
Whether federal consumer-credit rules attach depends on purpose and occupancy. Under the CFPB’s Regulation Z commentary on exempt transactions, credit to acquire, improve, or maintain non-owner-occupied rental property is treated as business purpose. The exception is an owner who expects to occupy the property more than 14 days in the coming year.
In practice, a purely non-owner-occupied rental generally falls outside consumer coverage, while a 2-4 unit owner-occupant can fall inside it. Ask any lender how it classifies your file.
For contrast, if a mortgage were still in place, the line would sit in second position. Federal law limits a lender’s ability to call a loan due when a subordinate lien is created, but only for residential property with fewer than five units, per 12 U.S.C. §1701j-3 at Cornell Law School. That does not matter for a free-and-clear first lien. It is simply why 2-4 units are covered and 5+ are not.
Common Misconceptions
“Paid off means I can borrow 100% of value.” No. The 70% CLTV ceiling binds first.
“A HELOC is always a second lien.” No. With nothing else recorded, it is first.
“Strong rent means I qualify.” Rent does not size the line. Personal credit and DTI do.
“I can use my LLC.” Not on this line.
“Calling it open-end makes it a HELOC.” Features decide, not labels.
How to Apply and What to Ask
1. Order a title search and confirm free-and-clear status. 2. Confirm vesting is personal or revocable trust. 3. Confirm the property is an eligible 2-4 unit type. 4. Check your credit profile against the 700 floor. 5. Ask whether a valuation will be automated or a full appraisal. 6. Ask how the lender classifies occupancy on your file. 7. Ask about exposure limits across your other financed properties.
Availability is limited to Lendmire’s 16 full-service states: AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA, and WA. That is narrower than the DSCR footprint. Ohio and New Mexico apply a CLTV cap that depends on the credit profile, and a property listed for sale recently is ineligible in several states. Tax treatment varies; consult a qualified professional.
If you are considering a home equity line and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals. Reach the team at 828-256-2183 or through the quote request page.
Frequently Asked Questions
Does a paid-off property guarantee approval?
No. Paid-off settles lien position only. The lender still reviews credit, housing history across all financed properties, DTI at the maximum draw, vesting, and property type. Approval is subject to lender guidelines and full file review.
Can I use my LLC to take the line?
No. An LLC-held building needs a vesting change or a DSCR cash-out instead, subject to program terms.
Do I need an appraisal?
Usually not. Investment lines cap at $500,000, and lines at or below that level ordinarily run automated valuation. A borrower may request a full appraisal, and a higher CLTV may call for a secondary valuation.
What if I live in one of the units?
Then the deal works into the primary-residence tier, which has different ceilings and a larger possible line size. Renting every unit puts it in the investment tier at 70% CLTV.
Is the payment fixed?
No. Pricing floats during both the draw and repayment periods and never converts to fixed. A DSCR cash-out can be fixed, which is a real reason some investors choose it.
