The Quick Read: A divorcing retiree qualifies for a line on a rental by clearing two gates: written permission to place a new lien on the property, and a personal file that passes on its own, meaning the retiree’s own credit, documented retirement income, debts, and combined leverage after every existing lien, all subject to lender guidelines. The rent the property earns does not qualify the line. On this network, investment-property lines cap at 70% CLTV with a 700 minimum credit score and a $500,000 maximum line.
- Your own income counts, not the old household income. A pension split by court order counts only at the share you keep.
- Support you pay is a debt in the ratio. Joint loans stay on your file until they are paid off or refinanced.
- Combined leverage counts every lien already on the property, so the buyout draw has to fit under 70% CLTV.
- The borrower must hold title as an individual or in a revocable living trust. An LLC cannot hold title on this line.
- If the personal numbers fail, a rent-based cash-out refinance is the usual alternative.
Two Gates Before Any Lender Looks at the File
Divorce adds a gate that ordinary borrowers never face. Gate one is permission. Gate two is qualification. Passing one does not pass the other.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
The permission gate is about the court and the title. Many divorce cases restrict new liens on marital property without written consent from your spouse or approval from the court. The wording is state-specific, so your attorney has to confirm what applies to you. A lender will want that consent or order in the file before it places a lien.
The qualification gate is about you. A home equity line on a rental is a personal-credit product. The lender looks at your credit, your income, your debts, and how much total debt will sit on the property.
That is the opposite of a rent-based loan. A DSCR loan, which compares a rental’s income to its monthly obligation, qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. A line asks about you first.
Key Terms Defined
CLTV (combined loan-to-value): Every loan secured by the property, added together, divided by the property’s value.
DTI (debt-to-income): Your monthly debts, including support you pay, divided by your gross monthly income.
Draw period: The stretch when you can borrow from the line and pay interest only. On an investment line here, it runs 5 years.
QDRO (qualified domestic relations order): A court order that assigns part of a retirement plan’s benefits to a former spouse.
Vesting: The manner in which title to a property is held, such as in an individual’s name or in the name of an entity.
Quitclaim deed: A deed that moves ownership. It does not move or release the mortgage debt.
DSCR (debt service coverage ratio): A rental’s income divided by its full monthly obligation, which is principal, interest, taxes, insurance, and any HOA dues.
How Underwriting Treats a Retiree, Step by Step
Underwriting a divorcing retiree follows a set order, and a failure at any one step can stop the file.
1. Title is fixed. The lender confirms who is on title and who must sign. A property in your sole name or a revocable trust is the cleanest.
2. Lien permission is documented. The lender needs the court order or written spousal consent if your case restricts new liens.
3. Credit is pulled. An investment line needs at least a 700 score. Scores of 720 and above reach the same 70% CLTV, so a higher score buys eligibility, not extra leverage.
4. Income is documented. Social Security counts as income of the spouse who receives it, and pension income counts at the amount you actually keep.
5. Debts are totaled. Support you pay goes in. Joint loans go in at full size until they are cleared. Support you receive can count only if it is documented and likely to continue, and lenders differ on whether to use it.
6. DTI is tested. The maximum is 50%, and the payment is calculated as interest-only on the maximum draw, not on what you plan to borrow. A DTI above 45% requires a 680 minimum score, which an investment line already clears at 700.
7. Combined leverage is tested. The first mortgage plus the new line, divided by value, must stay at or under 70% CLTV. Value usually comes from an automated valuation, because an investment line tops out at $500,000.
8. Property and structure are reviewed. Eligible types include single-family, 2-4 units, PUDs, townhomes, and condominiums. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural zoning are not eligible.
Across the wholesale network where Lendmire places these files, three items need the closest attention in a divorce: a joint mortgage still carrying the ex-spouse, a pension that shrinks after the split, and title that is not in an eligible name.
Where You Are in the Divorce Changes What Is Possible
The stage of your case sets what you can document. Use this as a map, then confirm it with your attorney.
| Stage | What is usually possible | What you need |
|---|---|---|
| Before filing | Standard personal-income review | Clean title, credit, income letters |
| Case pending | Personal income only; file can stall | Written consent or court permission |
| Settlement signed | Support terms can be documented | Signed agreement, recorded deed |
| After decree | Fullest picture of income and debts | Final decree, QDRO or split letter |
A pending case is the hardest stage. With no decree, there is no support order to document, and unsettled obligations can stall the file. A property listed for sale within the past 60 days is also ineligible in NC, PA, TN, TX, and WA, which matters when listing the rental was your fallback plan.
Do not read a decree as the end of the story for the lender. A decree divides property between you and your spouse. It does not rewrite the first mortgage contract.
Title, Vesting, and the Quitclaim Trap
Title decides who signs and whether the line is available at all. These are the common cases.
| Title situation | What it means for the line |
|---|---|
| Your sole name | Cleanest path |
| Revocable living trust | Eligible |
| Ex-spouse still on deed | Their signature is typically needed |
| LLC, corporation, partnership | Not eligible on this line |
| Irrevocable, blind, or land trust | Not eligible |
A quitclaim moves ownership to you, but the loan stays in both names. The lender never agreed to release your ex. A line placed behind that mortgage therefore leaves your ex on the first note. Only a refinance, an assumption, or a payoff removes them.
That is the real tradeoff in a divorce buyout. A line keeps your existing first mortgage in place, which helps if that loan is a keeper. It does not clear your ex from it. If a rental already sits in an LLC, it needs a vesting change before this line works, or a DSCR cash-out refinance instead, subject to program terms.
If the equity came to you through an inheritance rather than a purchase, Lendmire’s piece How to Qualify for an Investment Property HELOC on an Inherited Home as a Retiree covers that separate angle.
Retirement Income: What Counts and What Shrinks
Retirement status does not disqualify you. Retirement income counts when it is documented. Underwriters read the following sources.
- Social Security: It counts as the income of the person who receives it. An award letter and bank deposits typically prove it.
- Pension: A pension letter and deposits show the amount. After a court-ordered split, only your net share counts.
- Retirement-account distributions: These need a documented, recurring pattern.
- Savings and investments: Savings are not income by default. Deposit analysis reads recurring deposits, not the balance.
The pension split is where divorcing retirees get surprised. Your qualifying figure therefore falls by the share you give up. Tax treatment varies; consult a qualified professional.
A Modeled Example: How the Split Changes the Ratio
Run the numbers on a hypothetical retiree. These are modeled assumptions, not market data.
Say the rental has a first mortgage at 45% of its value. The retiree wants a buyout line at 25% of value. Combined leverage lands at 70% CLTV, right at the investment ceiling, so there is no cushion.
Now the income side. Assume the retiree’s debts and support paid equal 38% of gross monthly income. The line’s interest-only payment, calculated on the maximum draw, adds roughly 9 points. DTI becomes about 47%. A DTI above 45% requires a 680 minimum score, which an investment line already clears at 700, and 47% sits under the 50% maximum.
Then the pension split lowers income by a fifth while the debts stay the same. The same obligations now sit against 80% of the old income. DTI climbs to nearly 59%, and the file fails.
The lesson: run the ratio on post-split income, not the income you had while married. Also size the line below the maximum if you can, because the payment is calculated as interest-only on the maximum draw, not on what you plan to borrow.
Stress-Test the Payment on a Fixed Income
The line’s payment will move over time, and a fixed income cannot flex with it. A home equity line is an open-end credit line you borrow against up to a limit. The CFPB notes that payments are often significantly higher once repayment begins, and some plans can require the full balance at that point.
On an investment line here, the structure is a 5-year interest-only draw followed by a 25-year fully amortizing repayment. Pricing floats during both stretches and never converts to a fixed structure. Plan for the step-up before the draw period ends, not after.
Ask a blunt question. Could your retirement income carry the repayment-period payment on the full balance, with the rental vacant for a few months? If the answer is no, shrink the draw or change the tool.
When the Line Is the Wrong Tool
Few depository lenders offer lines on rentals at all, and one experienced investor on BiggerPockets argues that a cash-out refinance often beats the terms of a line when you can find one.
| Your situation | Better path |
|---|---|
| Income thin after pension split | DSCR cash-out refinance |
| Need ex removed from first note | Refinance the first mortgage |
| Rental held in an LLC | DSCR loan, per program terms |
| Plan to live in the property | Owner-occupied line or refinance |
| Combined leverage above 70% | Smaller draw or a different structure |
| Need more than $500,000 | Not available on an investment line |
A DSCR cash-out refinance can pay off the old loan and release your ex. It tops out around 75% LTV on standard rentals, with about 6 months of seasoning as the common expectation. Credit floors vary by program, with a 620 score available in parts of the network, most programs wanting around 660, and 700 or more unlocking stronger leverage tiers. Reserves vary by lender, leverage, and loan size, commonly around 6 months of PITIA.
Two cautions apply. A DSCR loan reads rent against the payment, so clearing 1.00 does not mean positive cash flow, because repairs, vacancy, and management sit outside the calculation. Many select programs start at a 1.00 coverage ratio, though select lenders in the network offer coverage below 1.00 with leverage and terms adjusted. Both are covered in the complete DSCR loans guide.
DSCR loans are designed for non-owner-occupied investment properties. If you plan to move into the rental, it is the wrong lane.
Pre-Application Checklist
Gather these before you talk to any lender.
- The settlement agreement or decree, plus written lien consent or a court order where your case requires one.
- The recorded deed showing your name, or your revocable trust’s name.
- Pension letters, Social Security award letters, and any QDRO or split documentation.
- A list of every joint debt, and who is responsible under the settlement.
- Support obligations you pay, with the order that sets them.
- A current mortgage statement, so combined leverage can be calculated.
- Confirmation from your attorney that a new lien is allowed.
Two limits also apply to the borrower. A borrower is limited to three lines, and a borrower with more than 15 financed properties is not eligible. Lendmire’s home equity lines are offered in 16 states, a narrower footprint than its DSCR investor programs across 41 markets, including Washington, D.C.
Frequently Asked Questions
Can I get an investment property HELOC while my divorce is still pending?
Sometimes, but it is the hardest stage. Your case may restrict new liens without written consent or court permission, and the wording varies by state. With no decree, you also have no support order to document, so you qualify on personal income only. Confirm the restriction with your attorney first.
Does a pension count toward qualifying?
Yes, when it is documented, and it counts at the amount you actually keep. A court-ordered split lowers your qualifying income by the share assigned to your ex-spouse. Social Security counts as the income of the person who receives it.
Does the decree take my ex-spouse off the mortgage?
No. A decree and a quitclaim move ownership, but the mortgage contract stays as written. Only a refinance, an assumption, or a payoff removes your ex from the first note. Until then, that debt keeps counting against you.
Can a rental held in an LLC qualify?
Not on this line. An investment line requires title in an individual’s name or a revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title. A DSCR loan can fit an LLC-held rental, depending on program guidelines.
What if I plan to move into the rental after the divorce?
An investment line is the wrong product once the property becomes your home. Occupancy is disclosed and underwritten, and an owner-occupied line or refinance follows different tiers. Tell your lender the plan up front so the file starts in the right lane.
