How to Qualify for an Investment Property HELOC Under Texas Homestead Rules

How to Qualify for an Investment Property HELOC Under Texas Homestead Rules

The Quick Read: Texas homestead rules attach to the home you live in, not to a rental you own, so qualifying for a rental line turns on the lender’s investment-property guidelines instead. Across Lendmire’s wholesale network, an investment-property line typically needs a 700 credit score and stops at 70% combined loan-to-value, with a maximum line of $500,000. Subject to lender guidelines and full file review, these are the points that matter most:

  • The collateral decides which rules apply. A rental is a non-homestead lien.
  • On an investment property, the network ceiling is 70% CLTV, and 700 is a hard credit floor.
  • The borrower, not the rent, is underwritten, with a 50% maximum DTI.
  • Title must sit in an individual’s name or a revocable living trust, never an LLC.
  • Texas collateral is limited to 10 acres, and a property listed within the past 60 days is ineligible.

Lendmire is a broker. It arranges these lines through select wholesale partners and is never the lender.

Editable Equity Scenario

How large a line the equity supports in Texas.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 80% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Does Texas Actually Ban a HELOC on a Rental?

No. Texas does not ban every credit line on a rental; it bars one specific product from being secured by one.

The Texas A&M Real Estate Research Center explains that home-equity loans under Section 50 of the Texas Constitution cannot be taken on a secondary residence or a rental or investment property. That covers cash-out refinances, home equity loans and HELOCs written as homestead products. The homestead version is unavailable on a rental. A standard line secured by a non-homestead property is a different transaction, and that is what a rental HELOC is.

This is why the topic confuses people. Many pages say “homestead only, so no.” Others say “yes, but the homestead rules still apply.” The accurate reading is narrower. The homestead rules govern the collateral that is your homestead. Point the lien at a rental and those rules do not attach.

What the Homestead Rules Actually Cover

The homestead rules protect the home you live in. They require you to keep at least 20% equity after the loan, cap fees at 2% of the original principal, and require a separate written notice before closing, per the same Texas A&M explainer. The Texas Office of Consumer Credit Commissioner adds that the waiting period starts only after you have applied and received the required disclosure.

Two more rules matter to investors. A Texas homestead can carry only one of these liens at a time. And a new one generally cannot close within a year of the prior one. In the network’s programs, the 12-day wait, the one-lien rule and the 12-month seasoning bind primary residences only. A Texas homestead also caps at 80% combined loan-to-value on this network.

Here is the part investors miss. Borrowing against your own home to buy a rental pulls the homestead rules back in, because your home is the collateral. The rules follow the lien, not the use of the money.

Which Property Secures the Line?

The property that secures the line decides everything, so classify it first.

Collateral Homestead rules apply? What governs
Your Texas primary residence Yes Constitutional limits; 80% CLTV cap here
A Texas rental you own No Lender investment guidelines
A Texas second home No Non-homestead guidelines
A former residence now rented It depends Title history and any prior equity lien

If you own a homestead and several rentals, you hold two separate pools of equity under two regimes. A line on the rental keeps the risk on the investment. A line on the home puts the residence on the table. Using the homestead lien slot on your home can also block a later line there, while a rental line does not use that slot.

How to Qualify, Step by Step

Qualifying follows a clear order. Work through it before you apply.

Step 1: Confirm the property is not your homestead. Lenders commonly ask you to identify where your homestead actually is, often through a sworn statement. That is typical practice, not a universal rule, so expect the question.

Step 2: Check title for a prior homestead equity lien. If the rental was once your residence and carries one, a payoff or refinance becomes a homestead-law matter. Bring in a Texas title company or attorney before you proceed.

Step 3: Fit the vesting. Title must be held by the individual borrower, in fee simple or leasehold, or by an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind or land trusts cannot hold title. That is the sharpest structural difference from a DSCR loan, which can be made to an entity, subject to lender program eligibility. A rental already deeded to an LLC needs a vesting change or a DSCR cash-out instead.

Step 4: Meet the credit and leverage tests. On an investment property, the credit floor is 700 and the ceiling is 70% CLTV. Both 720 and 700 reach that same 70%, so a higher score buys eligibility rather than extra leverage. The maximum line is $500,000. The minimum is $25,000.

Step 5: Clear DTI. The maximum debt-to-income ratio is 50%, and the line is qualified on the interest-only payment calculated on the maximum draw. Documented income under the applicable program, not rent, carries the file. A bank-statement path exists, but business accounts need a 680 minimum, so on an investment line the 700 floor binds first.

Step 6: Check property eligibility. Single-family, 2-4 unit, PUD, townhome and condominium properties, including non-warrantable condos, are eligible. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use and agriculturally zoned properties are not offered. Texas collateral is limited to 10 acres, and a property listed for sale, or listed within the past 60 days, is ineligible in Texas.

Step 7: Understand valuation. Because an investment line caps at $500,000 and full appraisals begin only above that, these lines commonly use an automated valuation with no traditional appraisal. A borrower may still request a full appraisal.

What the Line Looks Like After Closing

Investment lines run one structure only: a 5-year interest-only draw followed by a 25-year fully amortizing repayment. At least 75% of the line is drawn at closing. Pricing floats through both periods and never converts to fixed. In Texas, the minimum subsequent draw after closing is $4,000.

That draw requirement shapes the plan. This is not a flexible reserve you tap in small amounts. It suits an investor who already knows where the money goes, such as a down payment on the next rental or a major renovation. NerdWallet notes that an investment-property HELOC is possible but comes with fewer lenders and less borrowing capacity than a primary-home line, plus foreclosure risk on the property if payments are missed.

Exposure limits apply too. A borrower is limited to three lines, with combined exposure capped at $2,000,000 on the higher-leverage wholesale program and $750,000 on the longer-runway program. A borrower with more than 15 financed properties is not eligible.

Where the General Rule Breaks

Several edge cases change the answer.

A former homestead now rented. Conversion is not automatically clean. An old equity lien must be addressed, and the one-year spacing between those loans can come into play. A title professional should confirm the history.

An out-of-state owner. With no Texas homestead, Section 50 does not reach the Texas rental. The lender’s non-homestead guidelines still govern.

Two Texas properties. Only the one you live in is the homestead. The other is a second home or a rental.

A recently listed property. A listing within the past 60 days makes it ineligible in Texas.

Acreage. Rural collateral above 10 acres is out.

Entity-held rentals. If the property sits in an LLC, a HELOC does not fit unless you retitle it. A DSCR cash-out is the usual alternative, subject to lender program requirements.

HELOC or DSCR Cash-Out?

The two products answer different investors. A HELOC is underwritten on you: your credit, income and DTI. It suits a W-2 or documented-income borrower holding title personally who wants a smaller line at 70% CLTV.

A DSCR cash-out qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. That suits self-employed investors, entity-held portfolios, and anyone whose personal DTI is tight. Most cash-out files across the network top out around 75% LTV on a standard rental, with about 6 months of seasoning common, and 70% on short-term-rental collateral. Reserves commonly run around 6 months of PITIA, though they vary by lender, leverage and loan size.

The flip point is simple. If your title is personal and your income is clean, the line may cost less to hold. If you hold in an LLC, are near a DTI limit, or want more leverage, DSCR is the more practical lane. For the full picture, see Lendmire’s complete DSCR loans guide. A DSCR file compares rent to PITIA only, so clearing 1.00 does not mean positive cash flow after repairs, vacancy and management.

Key Terms Defined

Homestead: The home you live in as your primary residence, which Texas protects from forced sale.

Section 50 loan: A Texas home-equity loan secured by a homestead under the state constitution’s lending rules.

CLTV: Combined loan-to-value, which adds all liens on the property and divides by its value.

Non-homestead lien: A lien on a property that is not your residence, such as a rental, governed by ordinary lender guidelines.

Interest-only draw period: The stretch when payments cover interest on the balance before full repayment begins.

Vesting: How title to the property is held, whether by an individual, a trust or an entity.

Common Mistakes

  • Assuming the 80% homestead cap applies to a rental. On this network a rental line is capped at 70% CLTV.
  • Quoting 90% CLTV for investment properties. That tier exists only on second-home lines, and only at a 720-or-better credit profile.
  • Applying while the property is listed, or shortly after a listing, since lender timing rules vary by file and lender.
  • Leaving the rental in an LLC and expecting the line to fit.
  • Treating the line as a reserve account despite the $4,000 Texas minimum draw.

Frequently Asked Questions

Does the 12-day wait apply to my rental line?

No. The 12-day waiting period, the one-lien-at-a-time rule and the 12-month seasoning bind primary residences only. A Texas investment property is eligible as a non-homestead transaction, so those homestead timing rules do not attach to the rental.

Can I use my home’s equity to buy a rental?

Yes, but the homestead rules then apply, because your home is the collateral. A Texas primary residence caps at 80% combined loan-to-value on this network. Using the one homestead lien slot can also block a later line on that home, which is why some investors secure the line with the rental instead.

Can my LLC take the HELOC?

No. LLCs, corporations, partnerships, and irrevocable, blind or land trusts cannot hold title on these lines. An individual or a revocable living trust can. If the rental is already in an LLC, a vesting change or a DSCR cash-out is the practical path, subject to lender program requirements.

What credit score and leverage do I need on a rental?

A 700 minimum credit score, with a ceiling of 70% CLTV and a $500,000 maximum line. Both 700 and 720 reach 70%, so a higher score does not add leverage. Eligibility remains subject to lender guidelines and full file review.

Does a HELOC count as reserves for my next purchase?

Generally not. A drawn balance is debt, and a line is not treated as liquid reserves the way cash is. Plan the draw as acquisition capital, not as a cushion, and expect reserve rules on a later DSCR purchase to be assessed separately.
