Top Bank Statement HELOC Providers While a Divorce Is Pending

Top Bank Statement HELOC Providers While a Divorce Is Pending

The Quick Read: A pending divorce is mostly a court-and-title problem, not an income-paperwork problem, so the right provider depends first on whether a restraint order covers the property and who is on the deed, and only second on how the lender counts your deposits. No honest ranking of providers exists for this situation. What exists is a set of tests every lender runs, and you can check them before you apply.

  • A new lien during a case usually needs the other spouse’s written consent or a court order where a restraint is in force.
  • Bank statement documentation changes how income is proven. It does not change title, restraints, credit, or equity limits.
  • A decree splits debt between you and your ex, but it does not bind the lender on a joint line.
  • Equity limits through Lendmire’s network depend on occupancy, so check the ceiling for the property you would borrow against.
  • Confirm local restraint rules with a family-law attorney before you sign anything.

Why a Pending Divorce Is a Court Problem First

Many states restrain both spouses from borrowing against marital property once a case is filed or served. The flat claim that you can never get a HELOC mid-divorce is overstated, but a new lien often needs a signed consent or an order.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

South Dakota’s statute is a clean example. It bars both parties from transferring or encumbering marital assets without the other party’s written consent or a court order. It takes effect on filing plus personal service and runs until the final decree, dismissal, or further order. Other states word it differently and start the clock at different moments. Some orders also reach separate property, so a rental bought before the marriage is not automatically safe.

The exceptions are narrow. They usually cover ordinary business needs and necessities of life. Whether a rental-equity line fits that carve-out is a lawyer’s call, not a lender’s. One family-law practice makes the practical point that consent or an order can permit a single transaction, and a stipulation can waive the restraint for that one deal without waiving it generally.

So the first question for any provider is not “what’s your income method?” It is “what do you need to see about my court posture?”

How Underwriting Actually Treats a Pending Divorce File

Lenders work through the file in a fixed order, and the income method sits in the middle, not at the top. Here is the sequence.

1. Case status. The case is not filed, filed but not served, pending, or decreed. The restraint usually bites at filing or at service, depending on the state.

2. Restraint check. If an automatic or temporary order bars new liens, the lender wants signed consent or a court order in the file.

3. Title. The deed decides who must sign the lien. If both spouses are on title, expect both signatures. The lender may also ask for the vesting to be cleaned up.

4. Existing joint debt. Joint lines get frozen, closed, or refinanced first. The lender is not bound by your decree.

5. Income. Bank statements, or other documents, prove what you earn.

6. The normal tests. Credit, debt-to-income, combined loan-to-value after all recorded liens, and property type.

7. The deciding factors. Court posture and consent, title, joint-debt cleanup, and whether one income carries every debt still on file.

Support payments matter here too. After a decree, support you pay is counted as a debt. While the case is pending, no decree exists yet, so some lenders may qualify you on your own income with support left out. Lenders differ on this, so ask.

What Bank Statement Income Does (and Does Not) Change

Bank statement underwriting helps self-employed borrowers whose tax returns understate their cash flow. The lender totals eligible deposits, screens out items that are not income, applies an expense factor it sets, and averages the result over the statement period. Deposits never count dollar for dollar. Typical paper includes proof of business ownership, a mortgage statement, insurance, and a tax bill. Some programs add a profit-and-loss statement or a CPA letter.

The borrower is reviewed on documented income under the applicable program, subject to lender guidelines. That is a different paper trail, not a lighter one.

What it does not change matters more:

  • It does not remove a spouse from the deed.
  • It does not lift a court restraint.
  • It does not waive credit, debt-to-income, or equity limits.
  • It does not fix a joint account that mixes your deposits with your spouse’s.

Account hygiene deserves a plain word. If your business deposits land in a joint account, the lender has to sort out whose money is whose. Many borrowers open a separate business account early in a case so the statement history stays clean. Ask your attorney before moving money around, because transfers during a case can create their own problems.

What Lendmire’s Network Offers on an Investment Property

Lendmire is a mortgage broker. It places home equity lines through select wholesale lenders and does not lend itself. The parameters below come from that network and are subject to lender guidelines and full file review. They vary by occupancy, so the figure depends on which property you are borrowing against.

Investment property. The ceiling is 70% CLTV (combined loan-to-value, meaning all liens on the property divided by its value). Lines run from $25,000 to $500,000, and the minimum credit score is 700. These lines use a 5-year draw period followed by a 25-year repayment period, and at least 75% of the line is drawn at closing. Debt-to-income can reach 50%, tested on the interest-only payment at the maximum draw.

Primary residence and second home. Ceilings run higher. On a primary residence or second home the program reaches 90% CLTV, but only at a 720-or-better credit profile and on lines up to $500,000. Lower credit tiers step down from there. A line above $500,000 is primary-residence only. It needs a credit profile of 700 or better, or 720 on the program with the 5-year draw and 25-year repayment structure, and it requires a full appraisal.

Two structural limits catch divorcing investors:

  • Title. The line must be held by an individual or a revocable living trust. An LLC cannot hold title. A rental already deeded to an LLC needs a vesting change, or a different product.
  • Geography. The HELOC program is available in 16 states: AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA, and WA. That is narrower than the DSCR footprint.

Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural-zoned properties are not eligible. Lines at or below $500,000 usually run automated valuation instead of a full appraisal.

How to Choose Among Providers When No Honest Ranking Exists

You can sort providers by type and by the questions they answer well. Here is how the main types tend to differ.

Provider type Typical fit Ask them
Big banks Strong W-2 files, clean title Do you accept bank statements?
Credit unions Members with long history Do you lend on investment property?
Wholesale network via broker Self-employed, varied scenarios Which lender fits my court posture?
Non-QM lenders Alternative income files What consent do you require?

A broker that shops several wholesale lenders can match the file to the program, because guidelines differ on title, restraints, credit seasoning, and property type. The best program for your situation depends on the property, your credit, the leverage you need, and how your income is documented.

Run any provider through these questions:

  • What do you need to see to confirm no restraint blocks the lien?
  • Will you accept a spouse’s signed consent, or do you require a court order?
  • How do you treat joint accounts in the statement period?
  • Do you count support received or paid while the case is pending?
  • Does the lien go in first or second position, and what is the combined LTV?
  • What is the property’s vesting requirement?

Red flags are easy to spot. A provider that promises approval before reviewing your court posture is guessing. A provider that tells you to skip your attorney is worse.

Where the General Rule Breaks

The usual advice is wait, or get consent. These edge cases bend it.

Signature demands. A lender generally cannot require your spouse to sign if you qualify alone. Under the federal rule on spousal signatures in credit applications, a creditor may not demand the signature of an applicant’s spouse on any credit instrument when the applicant is reviewed on their own. Here is the catch. Where your spouse is a co-owner, or state law requires it, the lender may still require a signature on the document that creates a valid lien. The official supplement explains that a spouse who signs only to grant a security interest is not a borrower. So a signature demand usually traces to title and state property law, not lender preference.

Community-property states. A spouse’s consent can be required even when that spouse is off the deed.

Existing joint line. Your ex can keep drawing on it unless it is frozen or closed. A written freeze request is the housekeeping step. Divorce alone may not be a ground for a lender-initiated freeze, so do not count on the lender doing it for you.

Decree versus lender. Your decree can assign a joint line to your ex, but a Texas attorney answer on Justia notes that the lender is bound only by the original loan agreement. You stay liable to the lender until the line is paid off or refinanced.

Stranded liens. Equity you pull during the case may be counted in property division. A lien closed before the decree may have to be paid off or refinanced in the settlement.

Rental versus home. The same federal consumer rules apply differently to a primary home than to a business-purpose rental line. Ask your attorney which rules touch your file.

When a HELOC Is the Wrong Tool

Sometimes the answer is a different loan. A HELOC is underwritten on personal income and credit, not on rent. A DSCR cash-out refinance qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. DSCR (debt service coverage ratio) is the property’s rent divided by its full monthly debt payment, including principal, interest, taxes, insurance, and any association dues.

Factor Investment-property HELOC DSCR cash-out refinance
Reviewed on Personal income and credit Property rent coverage
Max leverage 70% CLTV Around 75% LTV, standard rental
Title Individual or revocable trust LLC possible
Credit floor 700 Often around 660
Existing first lien Stays in place Replaced

On a standard rental, 75% is the typical cash-out ceiling, while short-term-rental collateral generally tops out at 70%. About 6 months of seasoning is the common expectation. Coverage of 1.00 is where many select programs start, and a separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. Short-term-rental files add a hosting-history expectation. Rental rules can vary by city, county, HOA, and property type, so confirm local rules before relying on projected rental income.

Keep two cautions in view. First, clearing 1.00 is not the same as positive cash flow. Repairs, vacancy, management, and utilities sit outside the calculation. Second, a DSCR cash-out is also a new lien on the property. A restraint order that blocks a HELOC can block it too, so the consent-or-order question does not go away. LLC-held rentals may qualify for DSCR cash-out, depending on program guidelines.

Timing by Stage

Stage What is possible Main risk
Before filing Single borrower, clean title Later claims on the new lien
Filed, not served Depends on state restraint Order may already bind you
Pending Consent or order required Joint debt still on file
After decree Single borrower, known support Joint line may still be open

Waiting for the decree gives you a single borrower, clean title, and a known support amount. Borrowing early needs documented consent or an order. This one is a genuine tradeoff. Waiting is safer, but a self-employed investor with a stalled project may have good reasons not to wait.

Pre-Application Checklist

Gather these before you call anyone:

  • Your court filing status and any restraint or consent order.
  • A copy of the deed and the current vesting.
  • The decree or settlement draft, if one exists.
  • Statements for the full statement period, with business and personal deposits separated.
  • Mortgage statement, insurance declaration, and tax bill for the property.
  • A list of every joint account and line, with freeze status.
  • Proof of business ownership, and a profit-and-loss statement or CPA letter if the program asks.

A broker like Lendmire can walk through this list against the program parameters.

Key Terms Defined

Automatic restraining order. A court order, effective on filing or service in many states, that bars both spouses from moving or borrowing against marital assets without consent or approval.

Bank statement income. Income a lender calculates from your eligible deposits over a set period instead of from tax returns, after applying its own expense factor.

CLTV. Combined loan-to-value, meaning all recorded liens on a property divided by its value.

Vesting. How title is held on the deed, such as an individual or a revocable living trust.

Seasoning. The waiting period a lender wants between two events, such as buying a property and refinancing it.

Frequently Asked Questions

Can I get a bank statement HELOC while my divorce is pending?

Sometimes, but not on income alone. Where a restraint applies, the lender needs the other spouse’s written consent or a court order. Title, joint debt, and whether you qualify alone then decide the outcome, subject to lender guidelines. Not a commitment to lend.

Does my decree remove my ex from a joint HELOC?

No. A decree assigns responsibility between the two of you, but the lender is not bound by it. You stay liable on the original agreement until the line is paid off or refinanced. Ask for a written freeze on any joint line right away.

Can a lender make my spouse co-sign?

Not if you qualify alone. A spouse who is a titled co-owner may still have to sign the document that creates the lien, and that signature does not make them a borrower. Confirm the local requirement with your attorney.

Do support payments count against me?

It depends on timing and lender. Ask each provider how it treats support received or paid.

Is a DSCR cash-out a way around the restraint?

No. It is also a new lien, so the same consent-or-order question applies. It can fit better when the rental sits in an LLC, because it qualifies primarily on property rent coverage, subject to lender guidelines.
