Top Bank Statement HELOC Providers Without Your Spouse or Co-Owner Signing

Top Bank Statement HELOC Providers Without Your Spouse or Co-Owner Signing

The Quick Read: A spouse or co-owner can usually stay off the loan, so their credit, debts, and income stay out of the file. Almost no provider will skip the lien signature of every person on title, because that signature pledges the property. The best provider for your situation depends on how title is held, the property type, your credit profile, and how much leverage you need.

  • Borrowing alone is usually possible if you qualify on your own deposits, credit, and combined leverage.
  • Everyone on title typically signs the security instrument, even when they are not borrowing.
  • A non-borrowing owner’s income cannot help you qualify.
  • Investment lines through Lendmire’s network cap at 70% CLTV, with a 700 minimum credit score and a $500,000 maximum line.
  • Title held in an LLC is not eligible for these lines. A DSCR cash-out refinance is the usual alternative.

A broker cannot hand you a ranked list of companies. The right fit depends on your title situation. This article explains how the structure works, where it breaks, and how to screen for the right match. Availability and terms vary by lender, and every file is reviewed individually.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

What Does “Without Signing” Actually Mean?

“Off the loan” and “not signing anything” are two different things. A bank statement HELOC has two key documents. The note is the promise to repay. The security instrument is the document that puts a lien on the property.

A non-borrowing owner stays off the note. They do not owe the debt, and their credit is not pulled. But if they are on title, they typically still sign the security instrument. Many lenders also add a short acknowledgment form. The exact name and wording vary by lender.

So the realistic goal is “borrow alone.” The unrealistic goal is “have a titled owner sign nothing at all.”

Key Terms Defined

Bank statement HELOC: a revolving line of credit secured by your property, where income is estimated from 12 to 24 months of personal or business bank deposits rather than tax returns.

Note: the signed promise to repay the borrowed money.

Security instrument: the signed document that creates the lien on the property.

Non-borrowing owner: a person on title who is not on the loan and does not owe the debt.

CLTV: combined loan-to-value, which counts every lien on the property against its value.

Vesting: the legal form in which title is held, such as an individual, a revocable trust, or an LLC.

Why the Lien Needs Every Owner

One co-owner can pledge only their own share of a property. A lien from a single owner may attach to just that share. That leaves the lender with weak collateral, since they could not sell the whole property if the loan defaulted.

So lenders ask every record owner to sign the lien. This is simply how collateral works.

Federal law points the same direction. Regulation B under the Equal Credit Opportunity Act bars a creditor from requiring a spouse’s signature on the credit instrument when the applicant qualifies alone. The same rule lets a creditor require a signature on any instrument needed to make the collateral available if the borrower defaults, such as one that creates a valid lien. The eCFR text of the rule spells out both parts.

How Underwriting Treats a Solo Borrower, Step by Step

1. Title is reviewed first. The deed and title commitment show who the owners are. Anyone on title who is not borrowing becomes a non-borrowing owner.

2. Only the borrower’s profile counts. Because the other owner is not on the note, their deposits, credit, and debts are not counted. The tradeoff is that their income cannot help you qualify.

3. Combined leverage is calculated. Every lien on the property counts. The available line is roughly the value times the CLTV cap, minus existing liens.

4. Vesting is checked. Title must be held by an individual or a revocable living trust.

5. Closing documents are signed. The borrower signs the note and security instrument. Each non-borrowing owner signs the security instrument and any acknowledgment. Mobile notaries are common for owners who live elsewhere.

Four things decide the outcome: whether every titled owner will sign the lien, whether you qualify alone, how title is vested, and the property and occupancy type.

What Network Programs Look For

Lendmire is a mortgage broker. It places these lines through select wholesale partners and is never the lender. Across those partners, the parameters depend on occupancy. Every figure below is subject to lender guidelines and full file review.

Investment property. The ceiling is 70% CLTV on an investment property, with a 700 minimum credit score and a maximum line of $500,000. The draw structure is a 5-year interest-only period followed by a 25-year repayment period. The line is a standalone line in first or second lien position, and at least 75% of the line is drawn at closing.

Primary residence. The ceiling reaches 90% CLTV, and that figure exists only at a 720 or better credit profile and a line up to $500,000. Lines above $500,000 are available on primary residences only, need a 700 or better credit profile (720 on the longer-runway draw structure), cap at 75% CLTV, and require a full appraisal.

Second home. The ceiling also reaches 90% CLTV, again only at 720 or better, with a $500,000 maximum line.

Other parameters worth knowing:

  • Debt-to-income tops out at 50%, and it is qualified on the interest-only payment calculated on the maximum draw.
  • Lines at or below $500,000 ordinarily use an automated valuation rather than a traditional appraisal.
  • Eligible properties include single-family homes, 2-4 units, PUDs, townhomes, and condominiums, including non-warrantable condos. Manufactured homes, co-ops, condotels, log homes, and commercial or mixed-use properties are not offered.
  • A borrower is limited to three lines, and anyone with more than 15 financed properties is not eligible.
  • Availability is limited to Lendmire’s 16 full-service states, which is narrower than its 41-market DSCR footprint.

Who Signs What: A Scenario Table

State homestead and spousal-consent laws vary, and the title company and counsel make the final call. This table describes the general pattern.

Situation On the note? Signs the lien? Income counted?
Sole title, single borrower Borrower Borrower Borrower only
Spouse on title, not borrowing No Typically yes No
Spouse off title No Generally no No
Unmarried co-owners Borrower only Every record owner Borrower only
Revocable trust title Borrower Trustee signs Borrower only
LLC-held property Not eligible Not applicable Not applicable

Where the General Rule Breaks

Spouse on title versus off title. If the spouse is on title, the lender can require a lien signature but cannot make them a borrower when you qualify alone. If the spouse is off title, there is generally no basis to demand a signature. Community property states are the exception. The CFPB’s Regulation B text notes that a spouse’s signature may be required where the applicant relies on the spouse’s separate income. A credit union compliance explainer reads the rule the same way for reaching community property.

Unmarried co-owners. Siblings, partners, and heirs follow the same logic. Every record owner signs. If one holds out, a whole-property lien generally cannot close. If the lender needs another person on the note because your own interest is insufficient, it cannot insist that person be your spouse, per the Cornell text of the rule.

The quitclaim myth. A quitclaim deed moves title, but it does not release anyone from existing debt. An investor discussion on BiggerPockets makes a similar point about loans not transferring with a deed. A retitle can also trigger the first mortgage’s transfer clause and raise title-insurance questions, so get legal advice first.

An ex-spouse still on the deed. The ex is still a titled owner. Clean up title before you apply.

LLC title. Lines through this network cannot be held in an LLC, corporation, partnership, or irrevocable, blind, or land trust. A property already deeded to an LLC needs a vesting change or a DSCR cash-out refinance instead. The DSCR route qualifies primarily on property-level rental income covering the payment, subject to lender guidelines, and loans to an LLC are available depending on program guidelines. Guarantors are part of that structure.

What Kinds of Providers Write These Lines?

Large retail lenders rarely write bank statement lines. They come mainly from non-bank wholesale and non-QM lenders reached through brokers, plus some portfolio lenders.

Instead of a ranked list, screen by fit:

Provider type Bank statement income Shared-title flexibility
Broker-placed wholesale lenders Common Varies by program
Portfolio lenders Sometimes Often case by case
Large retail lenders Rare Usually standard rules
Online lenders Varies Varies by program

Flexibility on shared title mostly means a willingness to accept a non-borrowing owner’s signature on the lien alone. It rarely means skipping it. A broker that shops several wholesale lenders can match your title situation to the program that handles it, which is the real advantage of going through one.

A Worked Example

Picture a self-employed owner of a small rental whose tax returns understate cash flow. Title is held jointly with a spouse who works a W-2 job. The owner wants a line against the rental and prefers the spouse stay off the debt.

The owner qualifies alone on 12 to 24 months of business deposits. The spouse stays off the note, so their credit and debts are not reviewed. The investment-property ceiling of 70% CLTV applies, and the existing first mortgage counts toward it. At closing, the owner signs the note and security instrument, while the spouse signs the security instrument and any acknowledgment form.

The owner has gained a loan in a single name. The owner has not avoided the spouse’s signature.

If a Co-Owner Won’t Sign

A refusal usually ends a whole-property lien. The realistic options are:

  • Buy out the co-owner and take title alone.
  • Retitle with legal and tax advice, keeping the transfer-clause issue in mind.
  • Choose a different property where title is clean.
  • Use a different product, such as a DSCR cash-out refinance, though it may run into the same objection from a titled co-owner.

If preserving a low first mortgage matters, the line is the better structure because it sits behind the existing loan.

Pre-Application Screening Checklist

  • Pull the deed and confirm exactly who is on title.
  • Confirm the property is held by an individual or revocable trust, not an LLC.
  • Ask each titled owner whether they will sign the security instrument.
  • Check that your own deposits, credit, and DTI support the line alone.
  • Count every existing lien against the CLTV ceiling for your occupancy type.
  • Confirm the property type is eligible and the state is covered.
  • Ask any provider what their acknowledgment form says and who must sign it.

Short-term rental rules can vary by city, county, HOA, and property type, so confirm local rules before relying on projected rental income.

Business-purpose status also affects whether consumer rescission rights apply. Regulation Z generally exempts credit extended primarily for business purposes, though that status depends on the facts.

Frequently Asked Questions

Can a spouse stay completely off a bank statement HELOC?

Off the note, yes in most cases. Off the lien, only if they are not on title, with community property states as the main exception. A spouse on title typically signs the security instrument even when they are not borrowing.

Does a non-borrowing owner’s credit get pulled?

No. Only the borrower’s profile is reviewed. That also means the other owner’s income cannot be used to help the borrower qualify.

Can I use an LLC to keep my spouse out of it?

Not on these lines. A property already in an LLC needs a vesting change or a DSCR cash-out refinance instead, subject to lender guidelines.

What if my business and personal accounts are separate?

Programs generally accept either business or personal statements over 12 to 24 months. Which set fits depends on where your deposits actually land and what the lender’s program requires.

Is a bank statement HELOC the same as no documentation?

No. It is reviewed on documented income under the applicable program, subject to lender guidelines. The documents are bank statements rather than tax returns.
