Top HELOC Providers While a Divorce Is Pending

Top HELOC Providers While a Divorce Is Pending

The Quick Read: No ranked list of providers can tell you who will fund a line during a pending divorce, because a court order, the title on the property, and your ability to qualify alone decide the outcome before any lender’s appetite does. A broker that shops several wholesale lenders can match the file to the program once those three gates are clear.

  • A court order or written spousal consent often matters more than which lender you pick.
  • Every owner on title generally has to sign, even when only one spouse borrows.
  • The line is underwritten to you personally, not to the rent a property earns.
  • On this network, an investment-property line tops out at 70% CLTV. Title must be held by an individual or a revocable living trust, so a rental held in an LLC is not eligible for a HELOC.
  • When a line is blocked, a DSCR cash-out refinance is one alternative, including for a rental already deeded to an LLC.

Why a Static Ranking Goes Stale

A “top providers” list ignores the thing that matters most mid-divorce: your situation. The lenders that write this kind of file depend on your credit profile, the property type, how title is held, and whether a court has restrained new liens.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Lendmire is a mortgage broker, not a lender. It works with a network of wholesale HELOC lenders and matches the scenario to the program. That is a different job from naming a winner. The best program for your situation might be one lender’s longer draw period or another’s higher leverage tier. It might also be no HELOC at all.

Home equity lines are offered in Lendmire’s 16 full-service states only, which is narrower than its DSCR footprint of 41 markets, including Washington, D.C. Programs change, and every file is reviewed individually.

What Are the Three Gates Before Any Lender Says Yes?

The order is fixed: the court, the title, then the lender. Skip the first two and the third never matters.

Gate one: the court. Many states put automatic restraining orders in place once a divorce is filed. These can bar new liens on marital property without written consent or a court order. The rules differ by state and often by county. A family-law attorney should tell you what applies to you.

Gate two: title and signatures. If both spouses are on title, both generally must sign. A spouse who is not a borrower can still be asked to sign the lien. The federal credit-discrimination rule, Regulation B, bars a lender from requiring a spouse’s signature on the note when you qualify alone. But its secured-credit exception, reproduced in the Cornell Legal Information Institute’s copy of the rule, lets a lender require a signature on any instrument that state law makes necessary to create a valid lien. Homestead and community-property states are where this bites.

Gate three: the lender. Only now do credit, debt-to-income, and property eligibility come into play. Some lenders simply do not want a file with an open case, even when the first two gates are clear.

How Does Underwriting Treat You Mid-Divorce?

You qualify as a single applicant carrying your own income and debts, because a HELOC is personal underwriting. The lender looks at your credit and income, not the rent from a rental.

1. Confirm the court posture. Is a case filed? Is an automatic or temporary order in force? The lender will want written consent or a court order in the file if one is needed.

2. Confirm title. Both names on title usually means both signatures. A trust holding both spouses can require both to sign as trustees.

3. Check state spousal-consent law. Homestead, community-property, and dower states can require the non-titled spouse to sign the security instrument or a consent.

4. Qualify alone. During a pending case there may be no support order to document. Only your own income counts, and unsettled obligations can stall the file.

5. Read the disclosures. The CFPB’s HELOC booklet explains the terms and costs a lender must disclose.

6. Expect a second lien. The first mortgage stays as it is.

On this network the main qualifying numbers are these. Debt-to-income tops out at 50%, and it drops to 45% for credit profiles from 600 to 679. Any ratio above 45% requires a score of at least 680. The line is qualified on the interest-only payment calculated on the maximum draw. The score model is a single-bureau score keyed to the primary wage earner, and the report can be no more than 90 days old at closing.

What Do the Lender Programs Actually Look Like?

The network places files with two wholesale HELOC programs. One is a higher-leverage program with a 3-year interest-only draw and a 17-year repayment. The other is a longer-runway program with a 5-year draw and a 25-year repayment. Where they differ, each figure below applies only inside its own program. Everything is subject to lender guidelines and full file review.

Both are standalone lines in first or second lien position. Lines run from $25,000 to $750,000. On both programs, at least 75% of the line is drawn at closing, and later draws are made within the line’s draw period. Pricing floats and never converts to fixed.

The ceiling depends on how you occupy the property:

Property use Max CLTV Max line Minimum credit
Primary residence Up to 90% (720+ only) $500,000 at 90% CLTV; $750,000 at 75% CLTV, 700+ (720 on the longer-runway program) 600
Second home Up to 90% (720+ only) $500,000 640
Investment property 70% $500,000 700

On a primary residence, the 90% tier is available only at a 720-or-better profile and only up to $500,000. Any line above $500,000 is primary-residence only, so second homes and investment properties stop at $500,000. It requires a credit profile of 700 or better (720 on the longer-runway program), caps at 75% CLTV, and requires a full appraisal. Investment lines run the 5-year draw and 25-year repayment structure only.

Lines at or below $500,000 ordinarily use an automated valuation instead of a traditional appraisal. You can still request a full appraisal.

Title is the sharpest structural limit. Individuals and inter vivos revocable living trusts can hold title. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot. A property already deeded to an LLC needs a vesting change or a DSCR cash-out instead.

Where the General Rule Breaks

Mid-divorce, the usual guidance of “wait until the case is done” has real exceptions.

Before filing. Automatic orders generally attach only once a case is filed, so a line applied for earlier is possible. The risk is that the new lien is later examined in the divorce. Talk to your attorney first.

An existing joint line. A joint borrower can ask the lender to stop further advances where the agreement allows it. Regulation Z permits a lender to honor a specific request to suspend credit privileges. The line stays joint until it is paid off and closed. A divorce decree does not remove you from a lender’s contract.

Sole title, but bought during the marriage. The property may still be marital. A lis pendens is a notice that real estate may be divided in the case, and it can block a sale or refinance.

A rental held in an LLC. A consumer HELOC generally does not fit. The property qualifies instead through a DSCR cash-out refinance, subject to program terms.

A settlement buyout. A new line against the buyout property depends on clear title and a signed settlement, so settle both before you apply.

Can a lender freeze your line because you filed? Not on that ground alone. A creditor can suspend advances or cut the limit only while a listed circumstance exists, such as a significant drop in property value or a default on a material obligation. Filing for divorce is not a listed ground by itself.

When Is a HELOC the Wrong Tool?

A HELOC is the wrong tool when the file has to qualify on you instead of the property, or when the property sits in an entity.

Situation HELOC DSCR cash-out refinance
Underwritten to Your personal income and debts The property’s rent
Property in an LLC Not eligible Eligible, subject to program terms
Sole income during a case Often thin Rent drives qualification
Court restraints and title Still apply Still apply

A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. The ratio is rent divided by PITIA, which is principal, interest, taxes, insurance, and any association dues. Many select programs start at 1.00. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted. Clearing 1.00 is not the same as positive cash flow, since repairs, vacancy, and management sit outside the calculation.

A DSCR cash-out does not dodge the court problem. It needs the same clean title and spousal consent. For the full mechanics, see the complete DSCR loans guide.

Leasing out a home is a separate question from qualifying. Read the HELOC agreement before you use a primary-residence line on a property you plan to lease, since its terms may restrict renting.

Key Terms Defined

  • Automatic orders: Court restraints that take effect in many states when a divorce is filed, limiting new debt or liens on marital property.
  • Lien: A legal claim on a property that secures a loan. A HELOC typically adds a second lien.
  • Title: The record of who legally owns the property. Everyone on title usually has to sign.
  • Joint obligor: A person named on a loan along with another borrower. Each can be collected from, regardless of a decree.
  • CLTV: Combined loan-to-value, meaning all loans against the property divided by its value.
  • Lis pendens: A recorded notice that a property is part of a legal dispute.

Your Pre-Application Checklist

  • Ask your attorney whether any automatic or temporary order is in force.
  • Ask whether written consent or a court order will be needed for a new lien.
  • Pull the deed and confirm exactly who is on title and how.
  • Confirm whether your state requires a non-borrowing spouse to sign the lien.
  • Confirm you qualify alone on your own income and debts.
  • Know the property type, since manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural zoning are not eligible.
  • Count your existing lines and financed properties. A borrower is limited to three lines on this network, and owning more than 15 financed properties is not eligible.

Sequence matters: check for orders, confirm title, secure consent or a court order where needed, then apply. A decree is not required first, but any restraint in force must be cleared.

If you are considering a home equity line and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals.

Frequently Asked Questions

Can I get a HELOC while my divorce is pending?

Sometimes. No federal law bans it, but automatic orders and state law often block new liens on marital property. Written consent or a court order can change that. A lender will want that document in the file.

Do both spouses have to sign?

Usually, if both are on title. A spouse can’t be forced to sign the note when you qualify alone. But a spouse with title or homestead or community-property rights often must sign the lien itself.

Does a divorce decree release me from a joint line?

No. A decree can assign who pays, but the lender can still collect from everyone named on the loan.

Does bank statement income remove the court problem?

No. Documenting income a different way does not change title or court restraints. It is reviewed on documented income under the applicable program, subject to lender guidelines.

What if the rental is in an LLC?

A HELOC will not work, because LLCs cannot hold title on these lines. Investors usually look at a DSCR cash-out refinance, subject to program terms, or a vesting change.
