The Quick Read: No single provider is the best for every buyout, because the right program depends on the keeping spouse’s credit, the combined leverage after every lien, and how the rental is titled. Lendmire is a mortgage broker, not a lender. It shops a wholesale network of HELOC lenders and matches the file to the program that fits.
- On an investment property, the network ceiling is 70% combined loan-to-value (CLTV), with a 700 minimum credit score and a maximum line of $500,000.
- The keeping spouse qualifies alone, on personal credit and debt-to-income, not on rent.
- A HELOC pays the ex-spouse. It does not remove anyone from the first mortgage.
- LLC-titled rentals are not eligible. A vesting change or a DSCR cash-out refinance is the usual fix.
- If the decree requires a refinance of the first lien, a HELOC alone may not satisfy it.
What Does “Top Provider” Mean for a Spousal Buyout?
Lendmire does not rank or name lenders, because the right lender for these lines is determined by your file, not by a ranking. It places files with wholesale lenders whose guidelines fit the property type, credit profile, leverage need, and documentation.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
Investment-property lines are a narrow product. NerdWallet notes the lender pool is smaller than for primary homes, requirements are stricter, and multiple appraisals may be required. Some lenders also restrict lines by location or by how the home is used.
That is why a broker helps. Across a wholesale network, guidelines differ on credit history, exposure limits, and property types, so a file that does not fit one lender may fit another. Programs change, and every file is underwritten individually, subject to lender guidelines.
Key Terms Defined
Buyout: one spouse pays the other for their share of the property’s equity, so one person ends up owning it.
CLTV (combined loan-to-value): all liens on the property added together, divided by its value.
Deed versus debt: a deed shows who owns the property. The mortgage note shows who owes the money. Changing one does not change the other.
Successor in interest: a person who receives a property interest through a transfer such as a divorce.
DSCR: debt service coverage ratio, meaning rent divided by the full monthly housing payment (principal, interest, taxes, insurance).
How Does an Investment HELOC Buyout Work?
A HELOC lets the keeping spouse borrow against the rental’s equity and hand the cash to the ex-spouse. The first mortgage stays in place. The steps run in this order.
1. Read the settlement or decree. Does it award the rental to one spouse, set a buyout figure, or demand a refinance?
2. Size the buyout. Take the property value, subtract every lien, and multiply by the departing spouse’s share. Adjust for any separate-property contribution.
3. Confirm the keeping spouse can borrow alone. The line is underwritten on personal credit, personal debt-to-income, and combined leverage.
4. Check title and vesting. The property must be held by an individual or a revocable living trust. Whether the ex-spouse’s consent or a court order is needed for a new lien depends on the title and the decree, so have the attorney confirm.
5. Value the property. An investment line caps at $500,000, so it ordinarily uses an automated valuation rather than a traditional appraisal, though a higher CLTV may call for a secondary valuation, and a borrower may request a full appraisal in any case.
6. Fund the buyout. The draw goes to the ex-spouse. Then look at what remains, because the first mortgage may still list both names.
What Do Network Lenders Look For?
On an investment property, the network’s lenders work to a tight box, subject to lender guidelines and full file review.
| Factor | Investment property line |
|---|---|
| Max CLTV | 70% |
| Minimum credit | 700 |
| Line size | $25,000 to $500,000 |
| Structure | 5-year interest-only draw, 25-year repayment |
| Max DTI | Up to 50% |
Several details matter here:
- Credit above 700 buys eligibility, not leverage. Both the 700 and 720 tiers top out at 70% CLTV on an investment line.
- The DTI test uses the interest-only payment on the full line. Lenders calculate it as though the maximum draw were taken.
- At least 75% of the line is drawn at closing. Pricing floats and never converts to fixed.
- Exposure is limited. A borrower may hold up to three lines, and a borrower with more than 15 financed properties is not eligible.
- A listed property is a problem in some states. A property listed for sale, or listed in the past 60 days, is ineligible in NC, PA, TN, TX, and WA.
- Availability is narrower than the DSCR footprint. This product is offered only in Lendmire’s 16 full-service states.
Ineligible property types are manufactured homes, co-ops, condotels, log homes, and commercial, mixed-use, or agricultural-zoned properties. Eligible types include single-family, 2-4 units, PUDs, townhomes, and condominiums, including non-warrantable ones.
What Does a Buyout Look Like in Percentages?
Picture a rental worth $400,000 with a first mortgage at 40% of value. The network’s 70% CLTV ceiling leaves room for a second lien up to 30% of value. That is the most a HELOC could add, and the departing spouse’s share has to fit inside it.
Now suppose the decree gives the ex-spouse half of the equity. Equity here is 60% of value, so their share is 30% of value. That lands exactly at the ceiling. It leaves no cushion for appraisal variance, closing costs, or a separate-property adjustment.
Change one input and it breaks. If the first mortgage sits at 50% of value, only 20% of value is available, and the buyout falls short. The fix is a larger first lien through a cash-out, a smaller buyout negotiated in the decree, or a different structure.
Run this math with the attorney before the decree is final, not after.
Why Does the Ex-Spouse Stay on the First Mortgage?
A divorce decree does not change the lender’s contract. The CFPB reports that servicers often push refinancing and that the 2016 servicing rule expansion covers successors in interest who receive property through divorce or legal separation. Those protections address communication and information. They do not create cash, and they do not release the ex-spouse.
A quitclaim deed has the same limit. It moves ownership but not the loan obligation.
Assumption is the other route. Fannie Mae’s consumer guidance says assuming a loan does not automatically release an existing borrower, and the keeping spouse must be credit-qualified by the servicer. Assumption also produces no cash for the buyout.
So a HELOC solves the equity payout and leaves the liability question open. If the decree requires the first lien to be refinanced, that is the decisive check before borrowing.
Which Option Fits: HELOC, Cash-Out, or DSCR Cash-Out?
The right tool depends on who the keeping spouse is as a borrower.
| Option | Best fit | Main tradeoff |
|---|---|---|
| Investment HELOC | Strong personal credit and DTI, low first lien worth keeping | Personal underwriting, floating pricing, ex stays on the first |
| Cash-out refinance on personal income | W-2 borrower with clean DTI | Replaces the whole first lien |
| DSCR cash-out refinance | Self-employed, multi-property, LLC-held, or DTI-constrained | Reviewed on rent coverage, replaces the first lien |
| Assumption | Servicer allows it | No cash for the buyout |
| Sale | Neither spouse can carry the property | Ends the investment |
A DSCR cash-out replaces the old loan, so both spouses come off the note at payoff. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Leverage, credit, seasoning, and reserve requirements on a cash-out refinance vary by lender, loan size, and property, so confirm them on the specific file before relying on any one number.
Coverage works like this: 1.00 is where select programs start, not a universal standard. Stronger ratios open better pricing and leverage. A separate select-lender path goes below 1.00, with leverage and terms adjusted. No-ratio qualification is available only through select lenders, generally for borrowers who already own a primary residence.
One caution. Clearing 1.00 does not mean the property cash flows. Repairs, vacancy, management, and capital expenses sit outside the calculation. Lendmire’s complete DSCR loans guide walks through the full qualification picture.
The tradeoff is real. A HELOC lets the keeping spouse hold a low first mortgage and borrow only the buyout. Compare the blended cost of the old first lien plus the line against one new first lien before choosing.
Where Does the HELOC Route Break Down?
LLC-titled rentals. The network’s HELOC lenders require title in an individual’s name or a revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title. A property in an LLC needs a vesting change or a DSCR cash-out instead, and DSCR loans to entities are subject to program terms.
A decree that requires refinancing. A line alone may not meet that term.
Weak credit or high DTI. Below 700 on an investment property, this product is closed. A property-income refinance becomes the fallback.
Thin equity. If the buyout exceeds the room under 70% CLTV, the line falls short.
Large portfolios. A borrower with more than 15 financed properties is not eligible, and the three-line exposure cap applies.
Bankruptcy or foreclosure history. A bankruptcy needs 4 years of seasoning from discharge or dismissal. Investment files follow a 7-year seasoning path for foreclosure, and 4 years for a deed-in-lieu, pre-foreclosure, or short sale.
Large buyouts. An investment line cannot exceed $500,000. Bigger lines are primary-residence only.
Federal law may also touch the transfer itself, since some divorce-related transfers carry protections against a lender calling the loan due. How far any such protection reaches on an investment property is a question for counsel, not an assumption.
What Should You Prepare?
- The signed settlement, or the draft decree with the buyout figure and any refinance deadline
- A current payoff for the first mortgage
- Recent credit information for the keeping spouse
- Proof of income, including any support payments, and a list of every financed property
- Title documents showing how the rental is vested
- The property’s current estimated value

Frequently Asked Questions
Can an investment property HELOC pay for a spouse buyout?
Yes, when the keeping spouse qualifies alone and the property is titled in an individual or revocable trust name. The line must fit under the 70% CLTV ceiling after the first mortgage, and the keeping spouse needs at least a 700 credit score. The line pays the ex-spouse but does not release them from the first mortgage. Final terms depend on lender guidelines, property type, leverage, and the borrower’s complete credit picture.
Does a HELOC remove my ex from the original mortgage?
No. The first mortgage is a separate contract, and the lender is not bound by the decree. Release usually requires a refinance or a servicer-approved assumption with a release of liability.
Can I qualify for the line on my own after separation?
Possibly. The line is underwritten on personal credit, personal DTI up to 50%, and combined leverage. DTI is calculated on the interest-only payment of the full line, so a large draw can strain the ratio.
What if the rental is held in an LLC?
The HELOC route is closed until title changes. LLCs cannot hold title on these lines. A DSCR cash-out refinance can work for an entity-held property, subject to program terms, and it is reviewed on rent rather than personal income.
When does a DSCR cash-out fit better than a HELOC?
When the decree requires refinancing the first lien, personal DTI is tight, the keeping spouse is self-employed, or the buyout is larger than the HELOC room. A DSCR cash-out replaces the old loan and releases both spouses at payoff.
