The Quick Read: Which provider you pick matters less than three gates: whether a court order restrains new liens, how the rental is titled, and whether you can qualify on your own. Clear those gates and a rental line is realistic. Miss one and no provider can fix it. Lendmire is a mortgage broker, so it ranks no companies; it matches your file to the wholesale lenders that fit.
- On the Lendmire network, an investment-property line tops out at 70% combined loan-to-value (CLTV), with a 700 minimum credit score and a maximum line of $500,000.
- Title must sit with you personally or in a revocable living trust. An LLC cannot hold title on this product.
- Where an automatic court order applies, a lender typically needs your spouse’s written consent or a judge’s permission.
- A joint loan assigned to your ex in the settlement still counts against you until it is paid off or refinanced.
- A DSCR cash-out refinance is the usual backup when a line does not fit.
Why “Top Providers” Is the Wrong First Question
No neutral source ranks home equity providers for people in the middle of a divorce, and a ranked list would not help you anyway. Two borrowers can apply to the same lender with the same credit score and get opposite answers. The difference is court posture and title, not the brand name.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
The best provider for your situation depends on your property type, credit, leverage need, title, and where the case stands. A broker answers that by shopping several wholesale lenders and matching the scenario to the program. That is Lendmire’s role. Lendmire is never the lender, and the lenders it works with decide eligibility after full file review.
So this guide skips the roundup and explains how these files work, start to finish. Then you can judge any provider, or any broker, against the right criteria.
Can You Get an Investment Property HELOC While a Divorce Is Pending?
Sometimes. The blunt answer you may hear, that it is flatly impossible, overstates it. The accurate answer is that it is blocked where a court restraint applies, unless there is consent or a court order. It also depends on your state and on how the property is titled.
Many states put an automatic restraining order in place when a divorce is filed. These orders bar new liens or borrowing against marital property without written consent or court permission. WomensLaw.org describes Montana’s version this way. Not every state works like this, so some borrowers face no automatic order at all. Even then, a lender may still require every title-holder to sign the lien.
A rental is often the biggest asset in a marriage. Orders in some states reach separate property too, not just the family home. Whether a rental line counts as ordinary business activity under a carve-out is an attorney question. Do not guess.
Rental lines also come with a thinner field. NerdWallet notes that investment-property lines come from a smaller pool of lenders, with stricter requirements and lower limits than lines on a primary home. That is why shopping through a broker helps.
How Underwriting Treats the File, Step by Step
Here is the order a lender works through, and the order you should work through it in.
1. Court posture. Has a petition been filed? Has the other spouse been served? Do any temporary orders or written agreements already allow a new lien? Your attorney signs off first.
2. Consent or order. If an automatic order applies, the lender needs written spousal consent, a stipulation, or a court order permitting the lien.
3. Title. The property must sit with you individually or in a revocable living trust.
4. Signatures. You qualify alone. A spouse still on title typically signs the mortgage or deed of trust, but not the note.
5. Your own underwriting. The lender reviews your personal credit, your income, and combined leverage after every existing lien.
6. Existing joint debt. Anything still in both names counts against you.
7. Documents. Expect the decree or settlement agreement, the deed or quitclaim, payoff statements for joint debt, income documents, and any court order or consent covering the new lien.
Step four trips people up. Under Regulation B, published by the CFPB, a creditor generally cannot require a spouse’s signature on the credit instrument if you qualify alone. The same rule lets a lender ask a spouse to sign whatever is reasonably needed to make the collateral available if you default, such as the lien document. The commentary adds that the spouse can sign a document making clear it only grants a security interest. In short, your spouse cannot be forced onto the note, but may be required on the mortgage.
What Wholesale Lenders Look For on an Investment Line
Across the select lenders in the network, the parameters for an investment-property line are tight and consistent. These are typical guideline ranges, subject to lender guidelines and full file review, not commitments to lend.
| Factor | Investment-property line |
|---|---|
| Max combined leverage | 70% CLTV |
| Minimum credit score | 700 |
| Line size | $25,000 to $500,000 |
| Debt-to-income | 50% maximum |
| Structure | 5-year interest-only draw, then 25-year repayment |
| Valuation | Usually automated, no traditional appraisal |
Some details matter more than the table shows:
- Credit above 700 buys eligibility, not leverage. A 720 score and a 700 score both reach 70% CLTV on an investment line. There is no tier below 700.
- Debt-to-income is measured on the interest-only payment calculated on the full line. Court-ordered support you pay goes on the debt side.
- At least 75% of the line is drawn at closing. Pricing floats through the draw and repayment periods and never converts to fixed. Plan for that.
- Valuation is usually automated. Because an investment line caps at $500,000, and full appraisals begin only above that, these lines commonly close with no traditional appraisal. You can still request one.
- Eligible property: single-family, 2-4 units, PUD, townhome, and condominium, including non-warrantable. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural-zoned properties are not eligible.
- Exposure limits: a borrower is limited to three lines and cannot own more than 15 financed properties.
- Availability: the home equity program is offered in Lendmire’s 16 full-service states, a narrower footprint than its DSCR lending.
Lenders also check credit history on all financed properties. A bankruptcy needs 4 years of seasoning from discharge or dismissal, and investment files follow a 7-year path for foreclosure and 4 years for a deed-in-lieu, pre-foreclosure, or short sale.
Before Filing, During the Case, After the Decree
Timing changes the file more than any lender choice. Each stage has a different upside and a different risk.
| Stage | Upside | Main risk |
|---|---|---|
| Before filing | No order yet, so a line is often possible | A large draw right before filing can draw scrutiny later |
| Filed, not served | Filer may be bound while the other spouse is not | Order status is unclear, so lenders hesitate |
| During the case | Possible with consent or a court order | Harder, needs attorney sign-off |
| After the decree | Clean title, you qualify as a single borrower | Joint debts and support now count against you |
The cleanest sequence is usually to wait for the decree and a recorded deed. Then the spouse keeping the rental is reviewed alone, on clear title. Funding that cannot wait points toward consent or a court order. That is possible, but it is the harder route. If you are weighing the two stages, Lendmire’s piece on the best program for an investment HELOC while a divorce is pending goes deeper on how the file is structured.
A word on the stage before filing. A big draw or a new lien just ahead of a filing can look like moving assets. Judges notice. Talk to a family-law attorney before you borrow, not after.
Title and Vesting: Who Can Hold the Property
The program requires fee simple or leasehold title held by you individually or by a revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title. This is the sharpest structural difference from a DSCR loan, which can usually close in an entity subject to lender program eligibility.
| If your rental is held… | Then… |
|---|---|
| In your name alone | Eligible, subject to any court restraint |
| In both names | Spouse likely signs the lien; consent rules apply |
| In a revocable living trust | Eligible, subject to lender review |
| In an LLC | Not eligible for this line; look at a DSCR cash-out |
Do not move title into or out of an entity mid-divorce without your attorney. It can raise restraint and due-on-sale questions. Federal law generally protects certain divorce-related transfers of small residential property from a lender calling the loan due. That protection does not cover a deed into an LLC. Whether it applies to your transfer is an attorney question.
Also understand what a quitclaim deed does. It changes ownership only. It does not take your ex off the loan.
Existing Joint Debt: Who Stays Liable
A divorce decree binds the spouses. It does not bind the lender. A Texas attorney answer on Justia makes the point that a lender is held to the original loan agreement. If a joint line or mortgage is assigned to your ex, both of you can stay liable until it is paid off, closed, or refinanced.
For underwriting, that debt counts against you. And your ex can keep drawing on a joint line unless it is frozen or closed. Where the agreement allows it, a joint borrower can usually ask the lender to stop further advances. Read the loan agreement before you assume you have that right, especially on a line made for investment purposes.
A bankruptcy by your ex adds another wrinkle. A debt assigned to the ex can be discharged for the ex but still collectible from you. Get attorney review on that one.
Where the General Rule Breaks
Several edge cases change the answer:
- Sole title does not mean free of restraint. The California order, as summarized by Mendes Law, reaches separate property as well as community property. Reach varies by state.
- Community-property states. A spouse’s signature is more likely to be required, especially where you rely on a spouse’s separate income.
- A frozen line is not permanent. If a lender froze a line, it can reverse the freeze once the cause is gone. A spouse-requested freeze often needs that person’s cooperation. A court block needs a court order or both spouses’ written consent.
- Bank-statement income does not fix title. Documenting your income helps you qualify. It does not change who owns the property or what a judge has frozen.
- Credit below 700. There is no investment-line tier below 700. That sends you toward other structures.
Violating a restraining order has consequences, and a judge can weigh a violation when dividing assets. Treat consent as a real requirement, not a formality.
A Worked Buyout Example
Say you are keeping a rental and need to buy out your ex’s half of the equity. Run the numbers as shares of the property’s value, using modeled assumptions rather than market data.
- Treat the property’s value as 100%.
- Assume the first mortgage is 45% of value. Equity is the other 55%.
- Your ex’s half of that equity is 27.5% of value.
- At a 70% CLTV ceiling on an investment property, the room above the first mortgage is 25% of value.
The line falls 2.5% of value short. You would need to negotiate the buyout, add cash, or pick a different structure. A line is a subtraction problem: the leverage ceiling minus existing liens.
Two more checks apply. The line must meet the $25,000 minimum, and at least 75% is drawn at closing. Because the draw is interest-only and floats, the payment can change. The lender reviews your file on the interest-only payment calculated on the maximum draw, so do not overlook that in your debt-to-income math.
When a HELOC Is the Wrong Tool
A line is a second lien that leaves your ex on the first mortgage. It is the wrong tool in several situations. A DSCR cash-out refinance often fits better, because it replaces the first lien and qualifies primarily on property-level rental income covering the payment, subject to lender guidelines.
| Your situation | Better route |
|---|---|
| Decree requires your ex off the first mortgage | DSCR cash-out refinance |
| Rental is held in an LLC | DSCR cash-out, subject to program terms |
| Credit below 700 | DSCR cash-out or a different structure |
| You want one new loan instead of two | DSCR cash-out refinance |
| Thin personal income after the split | DSCR cash-out |
| Case is active and no consent exists | Wait for the decree |
On a standard rental, cash-out refinances top out around 75% LTV across most of the network, with about 6 months of seasoning as the common expectation. Short-term rentals sit lower, at 70% on a cash-out. Most programs want a score around 660, and 700 or better unlocks the strongest leverage. DSCR measures rent against the full monthly obligation (principal, interest, taxes, insurance, and any association dues). Clearing 1.00 coverage is not the same as positive cash flow, since repairs, vacancy, and management sit outside the calculation. Lendmire’s complete DSCR loans guide walks through how that math works.
Key Terms Defined
Automatic restraining order: A court order, in many states, that takes effect on filing or service and bars new liens or large transfers without consent or a judge’s permission.
CLTV (combined loan-to-value): All loans secured by the property added together, divided by its value.
Vesting: How the property is titled, meaning who legally owns it.
Quitclaim deed: A deed that moves ownership between people without changing who owes the loan.
DSCR (debt service coverage ratio): Monthly rent divided by the full monthly obligation on the property.
Home equity line (HELOC): A revolving line of credit secured by the property, here drawn in an interest-only period and then repaid.
A Sequenced Checklist
1. Attorney first. Confirm whether a restraint applies and whether consent or a court order is needed.
2. Get the documents. Decree or settlement, deed, joint-debt payoffs, income documents.
3. Check your title. Individual or revocable trust, or plan for a DSCR cash-out.
4. Check your numbers. 700 credit, 70% CLTV, 50% debt-to-income.
5. Talk to a broker. Have it shop the lenders that write this and match your scenario.
Frequently Asked Questions
Can I take an investment HELOC while my divorce is pending?
Sometimes. It is blocked where a court restraint applies unless you have written consent or a court order. Without an automatic order, a lender can still require every title-holder to sign the lien. Your attorney should confirm your state’s rules first.
Does my spouse have to sign?
Your spouse generally cannot be forced onto the note if you qualify alone. A spouse who stays on title can still be asked to sign the mortgage or deed of trust. The signature grants the security interest and creates no personal liability.
Does the decree remove my ex from a joint line?
No. A decree binds the spouses, not the lender. Both borrowers stay liable until the line is paid off, closed, or refinanced.
Can I use an LLC-held rental?
Not for this line. Title must be held individually or in a revocable living trust. An LLC-held rental generally points to a DSCR cash-out refinance, subject to lender program eligibility.
What if my credit is below 700?
There is no investment-line tier below 700, so this program does not fit. Other structures, including a DSCR cash-out, may apply depending on your credit, leverage, and property.
Next Step
If you are considering a home equity line and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals.
Divorce timing shapes a rental financing file more than any lender’s name does, so the most useful step is sequencing: attorney, title, and documents first, then the provider conversation.
