The Quick Read: Yes, a veteran can usually put a HELOC on a Texas homestead. A HELOC is a non-VA second lien that can sit behind an existing VA mortgage, but it must follow Texas home-equity rules, including an 80% combined loan-to-value cap on a primary residence.
- The VA cash-out path is closed on a Texas homestead, and a non-VA equity line is the usual substitute.
- Texas allows only one home-equity loan on the homestead at a time, so the origin of your first mortgage matters.
- Combined loan-to-value (CLTV, meaning all liens added together against the home’s value) tops out at 80% on a Texas primary residence, whatever your credit profile.
- Lines run $25,000 to $750,000 through select wholesale lenders, subject to lender guidelines.
- A line on your home is personal debt. A DSCR loan on a rental qualifies primarily on property-level rental income covering the payment, subject to lender guidelines.
What Actually Changes for a Veteran in Texas?
You lose one product, not your access to equity. A HELOC (home equity line of credit) is a revolving credit line secured by your home. You draw what you need, and the payment follows the balance.
How large a line the equity supports in Texas.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 80% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
A VA cash-out refinance replaces your whole first mortgage with a new, larger VA-guaranteed loan. A HELOC does the opposite. Your first mortgage stays where it is, and the line goes behind it.
That difference matters for veterans with a low-payment VA loan. Keeping that first mortgage intact is often the whole point of choosing a line over a refinance. This article stays on what Texas adds to it.
| Factor | HELOC | VA cash-out | Home equity loan |
|---|---|---|---|
| Lien position | Second (or first) lien | Replaces first mortgage | Second lien or refinance |
| VA guaranty involved | No | Yes | No |
| On a Texas homestead | Generally available | Blocked | Generally available |
| Payout shape | Draws as needed | One lump sum | One lump sum |
| Texas combined cap | 80% CLTV | Not applicable | 80% CLTV |
Does Your First Mortgage Leave Room for a Line?
Often yes, but check the history of that first loan. Texas allows one home-equity loan on a homestead at a time. If your VA mortgage was your original purchase loan, the equity slot is open, and a line can usually sit behind it.
If your first mortgage came from an earlier cash-out refinance or a home equity loan, that loan already fills the slot. A new line behind it is generally blocked. The usual way out is refinancing out of the equity-loan status once the required conditions are met, and a title company or Texas attorney confirms whether you qualify.
One point stays case by case. A VA-guaranteed first mortgage sitting under a new non-VA line makes sense on paper, because the guaranty rides on the first lien and the line carries none. Lenders still confirm lien and subordination handling file by file, so ask early instead of assuming.
Texas also treats the home’s owner-occupied status as central. The homestead rules bind a primary residence. Second homes and investment properties in Texas are eligible as non-homestead transactions on their own tables.
How Big a Line Can You Get on the Homestead?
Your ceiling is the lower of the Texas cap and the lender’s credit tier. On a Texas primary residence, the combined debt on the home cannot exceed 80% of its value. Credit and income cannot waive that.
Here is how the math runs without any dollar conversion. Say your first mortgage already uses 60% of the home’s value. That leaves about 20 points of room, and the line has to fit inside it.
Across the wholesale network, the tiers for a primary residence step down with credit. A 640+ profile reaches 80% CLTV up to $500,000. A 620+ profile reaches 70% CLTV up to $400,000. A 600+ profile, the program floor, reaches 60% CLTV up to $400,000.
Higher tiers on the network’s matrix never apply to a Texas primary residence. A line above $500,000 is primary-residence only. It needs a credit profile of 700 or better (720 on the longer-runway structure, one of two wholesale line structures), caps at 75% CLTV, and requires a full appraisal.
Smaller lines at or below $500,000 ordinarily use an automated valuation. A higher CLTV may call for a second valuation, and you can request a full appraisal anyway.
Other guideline points worth knowing:
- Debt-to-income tops out at 50%, and drops to 45% for credit profiles from 600 to 679. The lender reviews your file on the interest-only payment calculated on the maximum draw.
- Texas properties are limited to 10 acres.
- A property listed for sale, or listed within the past 60 days, is ineligible in Texas.
- Title must sit with you personally or in a revocable living trust. An LLC cannot hold title to a home-equity line property.
At least 75% of the line is drawn at closing. Draws after closing come with a minimum, and in Texas that minimum is $4,000. The Texas A&M Real Estate Research Center also notes that Texas lines cannot be accessed with credit or debit cards or unsolicited checks.
Lines on primary residences use a 3-year interest-only draw followed by a 17-year amortizing repayment, or a 5-year draw followed by 25 years. During the draw, payments are interest-only. After it, payments are fully amortizing. Pricing floats and does not convert to fixed.
Why Does Texas Block VA Cash-Out?
The VA guaranty counts as extra collateral under Texas homestead law. The Texas Attorney General’s Opinion KP-0183 addressed this directly. It describes a Texas cash-out loan as a home equity loan under the state constitution. State rules do not permit a guaranty or surety on such a loan, because it counts as additional property beyond the homestead.
A VA cash-out refinance carries a federal guaranty. Under that reading, it cannot be made on a Texas homestead.
A HELOC carries no VA guaranty. It still falls under the same Texas home-equity framework. The Texas A&M center describes cash-out refinances, home equity loans, and HELOCs as three loan types under one section. That is why the 80% combined cap and the required notice apply to your line too.
Some online pages say VA cash-out exists in Texas at a reduced leverage cap. Do not plan around that. The attorney general’s reasoning points the other way, so treat the product as unavailable on a homestead.
What Is the Step-by-Step Path?
1. Check the slot. Confirm your first mortgage was a purchase or a standard rate-and-term loan, not a prior equity loan.
2. Check the cap. Add your first-lien balance and the line you want, then compare it to 80% of the home’s value.
3. Apply and wait. Texas law requires a 12-day wait after application, and the lender gives you a separate written notice of your rights, per the State Bar of Texas.
4. Close with both spouses. Both spouses must sign the loan documents, and the owner signs a notarized affidavit.
5. Use the cancellation window. You get a 3-day right to cancel after closing.
The State Bar also says prepayment penalties are not allowed, and the lender cannot require other collateral. Those protections apply to homestead equity lending.
Where Veterans Get Tripped Up
Most surprises come from three places. The first is the 12-month seasoning rule, which binds Texas primary residences. A recent cash-out or equity loan can block the new line, and the one-lien-at-a-time rule sits right behind it.
The second is credit tiers. The network’s rules vary between programs on past foreclosures. One treats a foreclosure after 7 years and a short sale or deed-in-lieu after 4 years as seasoned. The other declines that history entirely, regardless of age. Bankruptcy needs 4 years from discharge or dismissal on both.
The third is property type. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural-zoned properties are not eligible. Condos and townhomes are, including non-warrantable condos.
Should You Put the Line on the Home or the Rental?
A line on your home puts your residence behind an investment decision. That is the main tradeoff, and the numbers can look fine until a vacancy or repair stretches cash flow.
Using HELOC money as a down payment effectively leverages the new rental near 100%. The line’s payment is personal debt. It counts against your own debt-to-income and sits outside the rental’s coverage ratio.
Picture a veteran who draws on the homestead for a rental down payment. The DSCR loan on the rental can look comfortable at a coverage ratio near 1.2x. Their household cash flow still carries the line payment on top of everything else.
Here is the alternative. If you already own a Texas rental, it is not a homestead, so the Texas home-equity restrictions do not attach to it. The Texas A&M center states plainly that these loans may not be taken on a rental or investment property, but a different path exists. An investment-property line runs up to $500,000 at 70% CLTV with a 700 minimum credit score, on the 5-year draw and 25-year repayment structure only.
A DSCR cash-out refinance is often the cleaner tool for a rental. Most programs in the network cap cash-out at about 75% LTV, with about 6 months of seasoning common. A property held in an LLC can work for a DSCR cash-out, subject to lender program eligibility.
Why Do Rental Purchases Usually Move to DSCR?
A DSCR (debt service coverage ratio) loan compares a rental’s monthly rent to its monthly payment of principal, interest, taxes, insurance, and any HOA dues, known as PITIA. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. DSCR loans are business-purpose investor loans, so they are reviewed differently from owner-occupied mortgages.
Here are the ranges across the wholesale network, all subject to lender guidelines:
- Purchase leverage: most files land at 75% to 80% LTV, meaning 20% to 25% down. Select high-leverage programs reach 85% LTV with roughly a 700+ score.
- Coverage: 1.00 is where many select programs start. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted. Stronger ratios open better pricing and leverage.
- Credit: a 620 floor exists in parts of the network, most programs want around 660, and 700+ opens the strongest leverage tiers.
- Loan size: up to $3,000,000 on standard programs (smaller balances available through select lenders), and above $2,500,000 the network generally holds to 30-year fixed structures.
- Reserves: commonly around 6 months of PITIA, with variation by lender, leverage, and loan size.
Clearing 1.00 is not the same as positive cash flow. Repairs, vacancy, management, and utilities all sit outside the calculation. Our complete DSCR loans guide walks through the full qualification picture.
A larger down payment can lift the ratio. It never erases leverage caps, credit floors, or reserve rules. The strongest files have enough equity and enough rental coverage together.
Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.
Key Terms Defined
Homestead: the Texas home you live in as your primary residence, which carries special state protections.
CLTV: combined loan-to-value, which adds every loan on the property and compares the total to its value.
HELOC: a revolving line secured by your home, with an interest-only draw period followed by full repayment.
Seasoning: the waiting period a lender wants after a prior loan before allowing a new one.
DSCR: the ratio of a rental’s monthly rent to its monthly PITIA payment.
Frequently Asked Questions
Can a veteran do a VA cash-out refinance on a Texas homestead?
No, not under the Texas attorney general’s reading of homestead law. The VA guaranty counts as additional collateral, which Texas does not allow on a homestead equity loan. A HELOC, a fixed home equity loan, or a standard Texas cash-out loan are the usual substitutes.
Does a HELOC affect my VA loan?
It generally leaves the VA first mortgage in place, because the line is a separate second lien with no guaranty. Lenders confirm lien and subordination handling case by case. Raise it at the start of the application.
Can I have a HELOC and a cash-out loan on the homestead together?
Generally no. A prior cash-out refinance already counts as that loan, so a line behind it is typically blocked until you refinance out of that status.
What if I already have a Texas equity loan on my home?
The existing loan occupies the one slot. Your options are to wait for the conditions that let you refinance out of equity-loan status, or to pull equity from a rental through a DSCR cash-out instead.
Do these rules apply to my rental property?
No. The homestead restrictions apply only to your primary residence. Texas rentals follow standard investment-property tables, including a 70% CLTV ceiling on an investment line and about 75% LTV on a DSCR cash-out refinance. Terms depend on the lender’s guidelines, the property type, the leverage, and a full review of the credit profile.
