How to Refinance Out of a Hard Money Loan in Virginia

How to Refinance Out of a Hard Money Loan in Virginia

The Quick Read: The usual exit is a DSCR loan that pays off the short-term bridge, sized to the property’s appraised value and its rent. Start well before the balloon date, because both the value test and the rent test must pass before the old lender is paid.

  • Hard money runs 6-18 months, interest-only, so the exit has to be underwritten before maturity.
  • The new DSCR loan is sized to the lower of the value limit and the rent limit, not to what was paid or spent on rehab.
  • A DSCR loan rate-and-term refinance can go to 85% LTV with no cash back; a cash-out refinance tops out at 75% LTV, subject to lender guidelines.
  • Cash-out on a DSCR loan typically needs about 6 months of ownership, measured from title recording.
  • In Virginia, a payoff is not a release. The recorded certificate of satisfaction is what clears the deed of trust.

Business-purpose investment loans are reviewed differently from a standard owner-occupied mortgage. Everything below is subject to lender guidelines and is not a commitment to lend.

What Does Refinancing Out of Hard Money Actually Mean?

It means a new, long-term loan pays off the bridge. The bridge lender is paid in full at closing, records a release, and the new lender takes first position.

The hard money loan was priced for speed and flexibility, not for holding. Terms run 6-18 months, interest-only, and the program carries no prepayment penalty. That makes the payoff clean on the old side. The work is on the new side.

Most investors exit into long-term DSCR financing once the property is stabilized. Lendmire brokers that path through select lenders in its wholesale network, and the hard money exit refinance program page covers how it is set up. The loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines.

How Does Underwriting Treat the Exit?

The new lender runs two tests, and the loan is sized to whichever is smaller.

Test one is value. The appraisal sets the number. The old payoff and the purchase price do not. For 1-4 unit rentals the appraiser typically completes a single-family or small multifamily form plus a market rent schedule. The loan itself is not an agency product.

Test two is rent. DSCR compares monthly rent to the full housing payment: principal, interest, taxes, insurance and any HOA dues. Across the wholesale network, 1.00 is where select programs start. Stronger ratios open better pricing and leverage. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted.

One caution. Clearing 1.00 is not the same as positive cash flow. Repairs, vacancy, management, utilities and capex sit outside the calculation.

If either test fails, the refinance returns less cash than planned or leaves part of the bridge unpaid. Value is usually the one that bites, so the exit has to be sized backward from the appraisal, not forward from the rehab budget.

Which Exit Paths Exist?

Four paths cover almost every file. They differ in what must be true and how they fail.

Path Best for What must be true Main risk
Rate-and-term DSCR refinance Payoff only, no cash back Value and rent cover payoff plus costs Appraisal short of payoff
Cash-out DSCR refinance Recycling equity into the next deal 75% LTV cap, seasoning, reserves Seasoning clock not met
Extend or re-bridge Rent not yet documented Bridge lender agrees Added cost, same maturity risk
Sell Thin coverage or low value Buyer closes before maturity Sale stalls at the deadline

The line between the first two is cash. A refinance that returns cash at closing is a cash-out loan, and it takes the 75% ceiling. A hard money exit usually counts as cash-out once proceeds exceed payoff plus closing costs. Keep the proceeds at payoff plus costs and it stays rate-and-term, which allows up to 85% LTV on the network’s programs.

What Starts the Seasoning Clock?

Recording of title starts it. Finishing the rehab does not. Signing a lease does not. For a cash-out DSCR loan, about 6 months of ownership is the common expectation across the network, measured from the recorded deed.

Delayed financing rarely rescues a hard money purchase. The exception generally requires that the purchase funds were not secured by the subject property, and a bridge loan is exactly that. Where a lender does waive the clock, it waives only the clock. Coverage, reserves, appraisal and leverage still apply.

The practical read: if the bridge matures before the seasoning period ends, a cash-out exit is off the table and the file needs a rate-and-term structure, an extension, or a sale.

The Step-by-Step Process

1. Start 60-90 days before maturity. This is the working habit, not a legal rule. It leaves room for an appraisal reconsideration or a corrected title item without the maturity date driving decisions.

2. Pull the payoff statement and read the note. The CFPB’s payoff page explains that a payoff amount is not the same as the current balance. It includes interest through the payoff date and may include unpaid fees. Business-purpose investor loans often sit outside consumer rules, so do not assume a statutory deadline for the statement. Ask for a good-through date that leaves closing room, and request an updated statement if closing slips.

3. Stabilize the asset. Rehab done, unit leased or rent-ready, rent documented. The new lender compares program-approved rent to the new payment.

4. Order the appraisal and confirm entity documents. If the property sits in an LLC, the operating agreement, good standing and ownership documents need to be clean, subject to lender program eligibility.

5. Document reserves. Reserves vary by lender, leverage, loan size and transaction type. About 6 months of PITIA is common, and loans above $1,500,000 typically step up to about 9 months. Statements showing seasoned funds prevent a late scramble.

6. Clear title and set the payoff. The settlement agent pays the bridge lender from proceeds and the release gets recorded.

7. Record the new deed of trust. Recordation tax applies here, covered below.

Payoff Mechanics in Virginia

Virginia is a deed-of-trust state. Paying the bridge lender satisfies the debt, but the lien stays on the record until a release is recorded. Under Virginia Code § 55.1-339, a wire confirmation or canceled check can serve as evidence of payment. The statute sets deadlines for the lien creditor to provide the certificate of satisfaction, and which deadline applies depends on whether the settlement agent gives notice.

Treat the statutory deadline for releasing the lien as the outer legal limit, not a plan. On a file with a next purchase or a cash-out behind it, an unreleased deed of trust is a title defect that can hold up the next lender’s review. Ask the bridge lender early how and when the release will be recorded, and track it through the title company until the recorded copy shows up.

Virginia Recordation Tax: Where the Same-Lender Exemption Breaks

The state recordation tax on a deed of trust is 25 cents per $100 of the obligation secured, under Virginia Code § 58.1-803.

The edge case is the same-lender exemption. It exempts the existing debt only when refinancing with the lender that holds the original deed of trust, and Ruling 11-19 found that a refinance with a different lender did not qualify. A hard money payoff into a new DSCR lender generally is a different lender. Those rulings are older and the statute has been amended, so budget for the tax and confirm the current treatment with the closing attorney or title agent.

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

Where the General Rule Breaks

Appraisal comes in short. Ask the lender about appraisal reconsideration with recent in-neighborhood sales and condition adjustments. If value holds low, the options are bringing cash to closing, reducing the loan, or extending the bridge while the file is rebuilt.

No tenant in place. Standard DSCR programs need documented rent. Select programs offer a no-ratio path, generally for borrowers who already own a primary residence, and eligibility depends on the network’s guidelines. Expect leverage and terms to adjust.

Coverage under 1.00. A select-lender path in the network takes coverage below 1.00, with leverage and terms adjusted. Compare that against the cost of extending the bridge.

Property type. Manufactured homes, log homes and barndominiums are not offered in the network’s DSCR programs, so a bridge on one of those has no DSCR exit.

Cash-out too early. Files that assume the seasoning requirement away get kicked back. If the clock is the problem, restructure as rate-and-term.

Prepayment on the new loan. The hard money program carries none. Business-purpose DSCR loans often carry their own step-down structures, so read that term before choosing a loan size.

Practitioner Note: Where Bridge Exits Actually Stall

Across the wholesale network, hard money exits rarely fail on credit. They stall on three items: an appraisal below the payoff, a lease that is signed but not documented the way the program wants, and a release that was assumed rather than tracked. Credit tiers matter too. A 620 floor exists in parts of the network, most programs want around 660, and 700+ unlocks the strongest leverage. But the file that slips is usually the one built backward from the rehab budget.

Size the bridge around the exit. The two loans are built to be used in sequence.

Key Terms Defined

Payoff amount: The full sum needed to retire the loan on a given date, including per-diem interest and any fees.

Certificate of satisfaction: The recorded document that releases a Virginia deed of trust after payoff.

Seasoning: The ownership period a lender requires before it allows cash-out, measured from title recording.

DSCR: Monthly rent divided by the full housing payment, used to size the loan.

Rate-and-term refinance: A refinance that pays off the old loan and costs without returning cash.

Frequently Asked Questions

Can I refinance a hard money loan into a DSCR loan if the rehab just finished?

Yes, if rent is documented and the appraisal supports the payoff. A DSCR loan rate-and-term refinance can reach 85% LTV with no cash back. A cash-out DSCR refinance tops out at 75% LTV and typically needs about 6 months of seasoning, subject to lender guidelines.

Does the exit loan size off what I paid and spent?

No. The DSCR loan is sized off appraised value and rent, capped by program leverage. Purchase price and rehab spend only matter through their effect on the appraisal.

Does paying off the bridge clear my title in Virginia?

Not by itself. Only a recorded certificate of satisfaction removes the deed of trust, and the statute gives the lien creditor up to 90 days. Track the release through the title company.

What credit score do I need for the exit?

A 620 floor exists in parts of the network, with most DSCR programs wanting around 660 and 700+ for the strongest leverage tiers. Score, reserves, property type and coverage are reviewed together.

Will Virginia recordation tax apply to the new loan?

Plan on it. The same-lender exemption generally does not reach a payoff into a different lender, so confirm current treatment with the closing attorney or title agent.
