The Quick Read: A Texas homeowner clears two separate tests: the lender proves income from bank deposits instead of tax returns, and the line plus every existing lien on a primary-residence homestead stays at or under 80% of the home’s value, which leaves the first mortgage untouched. The income test belongs to the lender’s program. The collateral test belongs to Texas law.
- Bank statements change how income is proven. They do not change the Texas homestead rules.
- The line sits behind your existing first mortgage, so you keep that loan as it is.
- On a Texas primary residence, combined leverage tops out at 80%, no matter your credit score.
- A prior Texas cash-out or equity loan on the same home can block a new line.
- Rentals and second homes are separate, non-homestead deals with their own limits.
What Is a Bank Statement HELOC?
A bank statement HELOC is a home equity line of credit where qualifying income comes from your deposit history. It is built for self-employed borrowers whose tax returns show little income after write-offs. A HELOC is a revolving line secured by your home. You draw what you need, up to a limit.
How large a line the equity supports in Texas.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 80% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
The borrower is reviewed on documented income under the applicable program, subject to lender guidelines. That is alternative documentation, not no documentation. Scotsman Guide’s overview of non-QM lending describes self-employed borrowers supplying 12 to 24 months of personal or business bank statements. It also notes that these lenders must still confirm you can repay the debt.
Lendmire is a mortgage broker, not a lender. It places these files with select wholesale lenders in its network. Each lender sets its own statement window and income method, so the exact paperwork depends on the program that fits your file.
Why Does It Work Without Refinancing in Texas?
It works because the line sits behind your first mortgage instead of replacing it. A refinance swaps your whole loan for a new one. A standalone line, in first or second lien position, adds borrowing power on top of what you already owe.
The Texas Real Estate Research Center at Texas A&M groups Texas equity borrowing into three types: cash-out refinance, home equity loan, and HELOC. It also notes that Texas was the last state to allow home equity lending. That history explains why the rules are strict.
A homestead line has one limit that matters here. The new line plus the first mortgage and any other liens cannot exceed 80% of the home’s value. Your line size is roughly 80% of value, minus what you owe on the first mortgage, further limited by your credit tier and income.
Here is the math in percentages. Say your first mortgage equals 50% of the home’s value. That leaves about 30% of value as the most the line can reach. If your first mortgage is already near 75% of value, the room shrinks to about 5%, and the line may not be worth doing.
This only works if your existing first mortgage is not itself a Texas equity-type loan. Texas allows one equity lien on a homestead at a time. A prior cash-out refinance or home equity loan on the same home can block a new line, and a 12-month seasoning wait applies on primary residences.
Test One: How Do Deposits Become Qualifying Income?
Lenders turn deposits into income by cleaning them up, adjusting them, and averaging them. The steps below are the typical pattern. Each program sets its own details.
1. Choose the statement window. Many programs look at 12 to 24 months of statements. A longer window smooths out lumpy months.
2. Strip out non-income deposits. Transfers between your own accounts, loan proceeds, refunds, and one-off credits do not count. Large deposits usually need a written source.
3. Apply an expense factor on business accounts. Business deposits are not all profit, so the lender trims them with an expense factor. Each program sets its own. A profit-and-loss statement or an expense statement from a third-party tax professional can sometimes replace a flat factor.
4. Average across the window. The adjusted total is divided by the number of months. If you own less than 100% of the business, only your ownership share counts.
5. Compare income to debts. The lender checks your monthly debts, including the new line, against that average income.
Mixed accounts are the common snag. If personal and business money flow through one account, the lender has to sort which deposits are business income. Clean, separate accounts make that sorting much easier.
Between-business gaps cause trouble too. The statement method needs a recent run of deposits to average. If your income stopped months ago, the method has little to work with.
The debt-to-income piece
Across the wholesale programs Lendmire works with, the maximum debt-to-income ratio (DTI) is 50%. DTI is your monthly debts divided by your monthly income. For credit profiles from 600 to 679, the limit is 45%. Going above 45% requires a score of at least 680. The lender reviews your file on the interest-only payment calculated on the maximum draw, not on what you plan to draw.
Federal income rules are not the box here
Standard mortgage income rules do not box this product in. The CFPB’s ability-to-repay and qualified mortgage guide says the rule covers closed-end consumer mortgages and excludes HELOCs, which are open-end credit. That is why deposit-based underwriting is available on a line. It still has to show you can repay, and the lender decides how it checks.
Test Two: What Do Texas Homestead Rules Control?
Texas law controls the collateral and the procedure. The lender’s program controls income, credit, and pricing. Keeping those two columns apart prevents most confusion.
| Item | Set by Texas law | Set by lender program |
|---|---|---|
| Combined leverage on a primary home | 80% cap | Credit-based tiers below that |
| Equity liens at one time | One at a time | Program may add its own limits |
| Waiting period | 12 days from application or notice | Documentation and credit review |
| Income method | Not restricted | Bank statements, window, expense factor |
| Property use | Homestead rules apply to primary home | Eligible property types |
The Texas Bankers Association’s compliance checklist describes a waiting period that applies before an equity loan can close, measured from the application or the required notice, whichever is later. Overall timing varies by file and lender. That wait comes on top of a separate three-day rescission period after closing. Rescission is your right to cancel the loan after signing.
Texas also rules out some products on a homestead. Lines tied to a card, and lines with annual or inactivity fees, are not allowed.
Texas properties in these programs are limited to 10 acres. A home listed for sale, or listed within the past 60 days, is ineligible in Texas. All homestead owners and spouses receive the disclosures and sign.
How Much Line Can You Get on a Texas Primary Home?
On a Texas primary residence the ceiling is 80% combined loan-to-value (CLTV). CLTV adds your first mortgage and the new line together and divides by the home’s value. The matrix tiers above 80% that exist in other states never apply to a Texas primary.
Credit still sets where you land under that cap. On a Texas primary residence, a score of 640 or higher supports up to 80% CLTV on a line up to $500,000. A 620 score drops that to 70% CLTV with a line up to $400,000. A 600 score drops it to 60% CLTV, also up to $400,000. The program floor is 600.
Lines at or below $500,000 ordinarily use an automated valuation instead of a traditional appraisal. You can request a full appraisal in any case. A primary-residence line above $500,000 requires one and carries a lower CLTV cap.
Two draw structures exist for primary residences and second homes. Lendmire’s network offers a 3-year interest-only draw with a 17-year repayment period, and a 5-year interest-only draw with a 25-year repayment period. The lender wants at least 75% of the line drawn at closing. Pricing floats during both the draw and the repayment period and does not convert to fixed.
A larger equity cushion helps the file but does not override the other tests. It never erases credit floors, DTI limits, or property eligibility. The strongest files clear both: enough equity and enough documented income.
What Does the Texas Sequence Look Like Step by Step?
The sequence runs in a set order, and the Texas notice is the step people overlook. Here is the typical path:
1. Gather statements and sort accounts. Separate business and personal deposits and flag any large one-off credits.
2. Pull credit and set the target. The credit report must be no more than 90 days old at closing, and there are no rescores. The score model keys to the primary wage earner.
3. Apply and receive the Texas notice. This starts the 12-day clock described above.
4. Complete the valuation. Most lines at or below $500,000 use an automated valuation.
5. Review income and DTI. The lender runs the deposit math and the debt test.
6. Sign with all owners and spouses. Texas closing-location rules apply.
7. Pass the rescission window. The three-day cancellation right runs after signing.
8. Draw funds. After closing, draws follow the program’s minimum.
Title must be held by you personally or by a revocable living trust. An LLC cannot hold title on these lines.
Where Does the General Rule Break?
Several edge cases change the answer. This table sorts the common ones.
| Your situation | What happens |
|---|---|
| Existing first mortgage is a regular purchase or rate-term loan | Room for a line, up to the 80% cap |
| Prior Texas cash-out or equity loan on the home | Often blocked until seasoning is met |
| Home is a rental or second home | Non-homestead rules, not Texas primary limits |
| Home deeded to an LLC | Needs a vesting change first |
| No recent deposits or short history | Statement method has little to average |
| Manufactured home, log home, co-op, condotel | Not offered |
A rate-and-term refinance of a previously encumbered homestead may still be treated as cash-out. If you refinanced recently, ask early whether the prior loan counts as an equity-type loan.
Rentals and second homes sit outside the homestead rules. The 12-day wait, the one-lien rule, and the 12-month seasoning bind primary residences only, and Texas second homes and investment properties are eligible as non-homestead transactions. A second home needs a score of at least 640, and the program ceiling is 90% CLTV with a line up to $500,000. That 90% ceiling exists only at a 720 credit profile. Lendmire’s piece How to Qualify for an Investment Property HELOC in Texas Without Refinancing covers the rental side in detail.
What About Equity in a Rental Property?
A rental HELOC is possible but narrower. NerdWallet’s explainer says an investment-property HELOC is possible, with fewer lenders and lower borrowing capacity than a primary home. It also notes the line is secured by the property, so missed payments put the property at risk.
In Lendmire’s network, an investment line requires a score of at least 700. The ceiling is 70% CLTV and the maximum line is $500,000. Investment lines use only the 5-year interest-only draw with a 25-year repayment. Title must be held by you or a revocable living trust.
Many investors find a DSCR cash-out refinance fits better when the rental itself should carry the loan. DSCR is the debt service coverage ratio, meaning rent compared with the property’s monthly payment. A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. Cash-out tops out around 75% LTV across most of the network on standard rentals, and about 6 months of seasoning is the common expectation. A coverage ratio of 1.00 is where many select programs start. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted. Clearing 1.00 does not equal positive cash flow, since repairs, vacancy, and management sit outside the calculation. Lendmire’s complete DSCR loans guide walks through those programs.
What Mistakes Sink These Files?
Most problems come from the documents, not the law. These come up often:
- Running business income through a personal account without a clear paper trail.
- Leaving large unexplained deposits in the statement window.
- Forgetting that a recent Texas equity loan blocks a new line.
- Assuming the 80% cap is a starting point instead of a hard ceiling.
- Taking a high DTI into the application without checking the 45% and 50% limits.
- Holding the property in an LLC, which these lines do not allow.
Fix those before applying, and the file is simpler to place.
Key Terms Defined
Bank statement HELOC: A home equity line of credit where income is proven from deposit history instead of tax returns.
CLTV (combined loan-to-value): Your first mortgage plus the new line, divided by the home’s value.
Homestead: Your primary residence, which Texas protects with extra rules on equity borrowing.
Expense factor: The percentage a lender subtracts from business deposits to estimate real income.
DTI (debt-to-income): Your monthly debts divided by your monthly income.
Seasoning: The waiting period a lender or the law wants between two loan events.
Rescission: Your legal right to cancel certain home-secured loans shortly after signing.
Is This the Right Move for You?
It fits a self-employed Texas homeowner who has a first mortgage worth keeping, enough equity under the 80% cap, and clean deposits. It fits less well if your home already carries a Texas equity loan, if title sits in an LLC, or if your real need is rental equity. The right program depends on your property, credit profile, leverage need, and documentation.
If you are weighing a home equity line against a cash-out refinance and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals. Lendmire serves these lines in 16 full-service states, Texas among them. Every figure here is subject to lender guidelines and full file review, and nothing here is a commitment to lend.
Frequently Asked Questions
Can I get a bank statement HELOC in Texas without refinancing my first mortgage?
Usually yes, if your first mortgage is not itself a Texas equity-type loan. The line sits behind that mortgage, and only the combined balance must stay at or under 80% of the home’s value on a primary residence. The lender still reviews your income, credit, and property.
Does Texas ban bank statement income for a HELOC?
No. Texas limits the collateral and the procedure, not the way income is proven. The lender’s program decides whether bank statements work and how they are averaged.
How long must I wait in Texas before closing?
The Texas Bankers Association checklist says an equity loan cannot close until 12 days after you apply or receive the required notice. A separate three-day rescission period follows closing. These waits bind primary residences, not Texas second homes or investment properties.
Can I use this on a rental property in Texas?
Rentals are non-homestead transactions on lender guidelines. In Lendmire’s network, an investment line requires a score of at least 700, has a 70% CLTV ceiling, and tops out at $500,000. Title cannot sit in an LLC.
Does a larger down payment or more equity guarantee approval?
No. More equity helps, but credit floors, DTI limits, reserves, and property eligibility still apply. The strongest files clear both the income test and the equity test.
