The Quick Read: To qualify, you first need clear title in your own name or your revocable trust’s name. Then your deposits have to support your personal income, and the combined loan-to-value has to fit under the investment-property cap. The tenants matter for lease and insurance paperwork, but their rent does not qualify you on this product.
- Title comes first. No lien can be placed until the estate transfers the property to an eligible borrower.
- Your deposits qualify you. The bank statement method changes how income is proven. Credit, equity and property review stay the same.
- Investment lines cap at 70% CLTV, with a 700 minimum credit score and a $500,000 maximum line, subject to lender guidelines.
- Rent is reviewed around a different product. If your personal income is thin but the rent is solid, a DSCR loan may fit better.
What Is a Bank Statement HELOC on an Inherited Rental?
An inherited rental gets no special line of credit. It is underwritten like any other investment-property equity line. The only difference is how your income is documented: deposits instead of tax returns.
How large a line the equity supports.
An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.
Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.
A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.
Line estimate
Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.
Across the wholesale network Lendmire works with, this product suits self-employed heirs, 1099 earners and owners with heavy write-offs. Their tax returns understate what actually moves through their accounts. NerdWallet notes that investment-property lines are not offered by every lender and carry strict requirements. That matches what brokers see on the desk.
Lendmire is a broker. It arranges these lines through select wholesale lenders and does not lend, so the lender reviews and approves each file. The line is available only in Lendmire’s 16 full-service states (AL, CA, CO, FL, GA, IN, MI, MT, NM, NC, OH, PA, TN, TX, VA, WA). That is narrower than its 41-market DSCR footprint, which covers 40 states plus Washington, D.C.
Gate 1: Can You Prove Title?
Title is where most inherited-rental files stall. While the estate holds the property, no eligible borrower exists to sign a lien.
Iowa State’s Center for Agricultural Law and Taxation explains that without probate, heirs may hold a property but lack the clear title needed to prove ownership. Probate can also take a long time. Iowa State Extension describes it as the court procedure that transfers clear title and says it can run two years or more in complex estates. Rules vary by state, so treat that as context, not a forecast.
Here is how common title situations look to a lender:
| Title situation | What the lender sees |
|---|---|
| Recorded deed in your name | Eligible to proceed |
| Funded revocable trust you control | Eligible, if title company confirms |
| Probate open, executor has letters | Not yet. Estate is not an eligible borrower |
| Multiple heirs on title | Co-owners generally must sign the lien |
| Property deeded to an LLC | Not eligible for this line |
Vesting is a hard line on this product. Title must be held by you as an individual or by your inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind or land trusts cannot hold title. If an heir already moved the house into an LLC, the options are a vesting change or a DSCR cash-out refinance instead.
A will alone does not skip probate, because probate is what validates the will. A funded trust or a survivorship or transfer-on-death deed may avoid it. Even then, the title company decides whether title passed cleanly. Start title work early. Equity stays locked until it is done.
Gate 2: How Bank Statement Income Is Built
Underwriting turns deposits into a monthly income figure in a fixed sequence:
1. Pick the account type. Personal statements are usually counted in full. Business statements take an expense factor set by the lender.
2. Collect the statement window. Programs commonly ask for 12 to 24 months, depending on the lender.
3. Strip out non-income. Transfers between your own accounts, loan proceeds, refunds and one-off deposits come out.
4. Source the large deposits. Anything unusual needs a paper trail.
5. Average the result. The adjusted total becomes monthly qualifying income.
6. Test debt-to-income. Your personal debts, plus the new line, are measured against that income.
On debt-to-income, the maximum is 50%. It drops to 45% for credit profiles from 600 to 679, and anything above 45% needs a 680 score. The new line is qualified on the interest-only payment at the maximum draw, so the test is stricter than the first payment suggests.
Inherited money creates a twist. Estate distributions and buyout payments from siblings will land in your statements. The underwriter will treat them as one-time funds, not income, and will want them sourced. Rent deposited into the same account as business receipts muddies the picture too. Keep rent and operating income in separate accounts before you apply.
Business accounts need a 680 minimum for the deposit analysis. Investment lines already floor at 700, so the statement method is never the binding constraint on an investment file. Credit and equity are.
Gate 3: What the Tenants Change (and What They Don’t)
The tenants do not qualify you here. Rent is the property’s income, and this product tests yours. What tenants change is documentation.
| Tenancy situation | File impact |
|---|---|
| Signed lease, tenant paying | Lease and proof of payment support the file |
| Month-to-month tenant | Acceptable, but expect questions on how rent is paid |
| Relative paying below market | Document the actual rent. The valuation does not assume more |
| Vacant house | No lease to show. Rental treatment depends on placing a tenant |
| Heir living in the home | Occupancy changes. It is no longer an investment line |
Occupancy matters most in that last row. Primary-residence and second-home lines carry higher CLTV ceilings than investment lines, but those tiers do not apply to a rented property. Investment ceilings govern any house that is rented to tenants.
Two practical items. Security deposits generally stay owed to the tenant after title changes hands, and an inheritance has no settlement statement to show how they were handled. Get a written record. A tenant statement confirming lease terms, rent and deposit paid is a clean way to lock that down. Also confirm the insurance policy is in the right name. A policy still listing the decedent is a common stall.
Gate 4: Liens, Leverage and Property Review
An investment line caps at 70% CLTV. Both the 720+ and 700+ credit tiers reach that same 70%. Credit above 700 buys comfort, not extra leverage, and 700 is a hard floor with no tier beneath it. The maximum line is $500,000.
Count every lien. If the decedent left a first mortgage, it stays in place and the new line sits behind it, or the line can take first position if the property is free and clear. Add the balances together, then divide by the current value. The tax step-up in basis is not lending value, and the lender’s own valuation controls.
Because investment lines top out at $500,000, they sit in the automated-valuation lane. Most close without a traditional appraisal, though a higher CLTV may require a secondary valuation, and you can request a full appraisal. A full appraisal is mandatory on lines above $500,000, but those are primary-residence only.
Other file facts worth knowing:
- Draw structure. Investment lines run a 5-year interest-only draw followed by a 25-year repayment period. At least 75% of the line is drawn at closing. Pricing floats and never converts to fixed.
- Exposure. A borrower is limited to three lines, and an owner with more than 15 financed properties is not eligible.
- Property types. Single-family, 2-4 units, PUDs, townhomes and condos, including non-warrantable condos, are eligible. Manufactured homes, co-ops, condotels, log homes, commercial and mixed-use properties are not offered.
- Listing status. In NC, PA, TN, TX and WA, a property listed for sale, or listed within the past 60 days, is ineligible. If your siblings are weighing a sale, that matters.
- Credit report. The report cannot be more than 90 days old at closing, and there are no rescores.
A Worked Example
Picture an heir who is self-employed, holds a 720 score, and has the deed recorded in a revocable trust. The inherited duplex has a leftover first mortgage near 40% of current value. A new line sized at 25% of value brings combined leverage to 65%, under the 70% investment cap with room left. Deposits average out to income that clears the 50% debt-to-income test on the interest-only payment at maximum draw.
Change one input and the file changes. If the first mortgage sat near 55%, that same 25% line would reach 80% and exceed the cap. The line would have to shrink to about 15% of value or less. This is the math to run before you apply.
Bank Statement HELOC or DSCR: Which Lane Fits?
Many heirs choose the wrong product at this fork. The two loans test different things.
| Factor | Bank statement HELOC | DSCR loan |
|---|---|---|
| What qualifies you | Your deposits and personal debt-to-income | The property’s rent against its payment |
| Existing first mortgage | Stays in place | Cash-out refinance replaces it |
| Title held by | Individual or revocable trust | LLC allowed, subject to lender program eligibility |
| Draw behavior | Revolving, interest-only draw | One-time funds |
| Investment leverage | Up to 70% CLTV | Cash-out refinance tops out near 75% LTV |
If your personal income is thin but rent covers the payment, the DSCR path is usually the better fit. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Many select programs start at 1.00 coverage, a floor for specific programs rather than a universal standard. Sub-1.00 coverage is available through select lenders in the network, with leverage and terms adjusted. Cash-out refinances commonly expect around 6 months of seasoning, and reserves of about 6 months of PITIA are typical, though they vary by lender and file. Credit floors run from 620 in parts of the network to roughly 660 at most programs, with 700+ unlocking the strongest leverage.
One caution on DSCR: clearing 1.00 is not the same as positive cash flow. Repairs, vacancy, management and capex sit outside the calculation. Lendmire’s complete DSCR loans guide walks through the full qualification model.
If the choice is still open, Lendmire’s article Best Bank Statement HELOC Program on an Inherited Rental With Tenants in Place covers how to match the scenario to the program.
Why Inherited-Rental Files Stall
Files rarely fail on credit. They stall on paperwork:
- Title gap. A recorded deed does not exist yet, or one co-heir will not sign.
- Commingled deposits. Rent, business receipts and estate cash sit in one account.
- LLC vesting. The property was moved to an entity before the application.
- Ineligible property. A manufactured home or mixed-use building is not offered.
- Stale lease evidence. An expired lease, or no proof of rent being paid.
- Missing insurance update. The policy still shows the previous owner.
A final point on how these lines behave. A HELOC is revolving, and lenders can freeze or reduce it. The Federal Reserve’s HELOC guidance says the lender must send written notice no later than 3 business days after a freeze or reduction. An undrawn line is not committed capital. Do not plan a sibling buyout or a down payment around money you have not drawn.

Probate: The court process that validates a will and transfers clear title to heirs.
Frequently Asked Questions
Can I get a bank statement HELOC while the estate is still in probate?
Generally no. The estate holds title, and an executor is not the same as a titled borrower. Estate-level borrowing is a different product. The line becomes available once the deed is recorded in your name or your revocable trust’s name.
Does the tenants’ rent count as my income?
Not on a bank statement HELOC. The lender reviews your file on your deposits and personal debts. Rent supports the file through leases and proof of payment, but it does not replace your income. If rent is your strongest asset, a DSCR loan is the better fit.
What is the maximum leverage on an inherited rental?
An investment line caps at 70% CLTV, with a 700 minimum credit score and a $500,000 maximum line. The higher ceilings that reach 90% CLTV apply only to primary residences and second homes at 720 or better. They do not apply to a rented property.
What if my brother and I both inherited the house?
Every owner on title generally has to sign the lien, even if only one of you is the borrower. A sibling who will not sign stops the file. Settle the buyout or title arrangement first, since equity is not accessible until ownership is clean.
Can the property be in my LLC?
Not for this line. LLCs and corporations cannot hold title on a bank statement HELOC. A DSCR cash-out refinance accepts entity vesting, subject to lender program eligibility.
