Investment Property HELOC Rules After a Divorce Decree Before the Title Changes

The Quick Read: A divorce decree awards a rental property to one spouse, but a home equity line is underwritten against the recorded title, so the line generally cannot move forward until a deed puts the property in your name alone. Most lenders also want a single borrower who qualifies without the ex-spouse’s income and a first mortgage that is resolved or clearly understood. Each file is reviewed individually, subject to lender guidelines.

  • The decree is a court order between the spouses, and the county record changes only when a deed is recorded.
  • A deed moves ownership but does not remove anyone from the loan.
  • Investment lines in Lendmire’s network cap at 70% CLTV and $500,000, with a 700 minimum credit score.
  • Title must sit with an individual or a revocable living trust, never an LLC.
  • If the title is in an LLC or the decree demands a refinance, a DSCR cash-out is often the cleaner tool.

What Does a Divorce Decree Actually Change?

A decree divides property and debts between the spouses. It does not edit the county record. If the decree says the duplex is yours, the recorded owners are still whoever the last recorded deed names, often both of you.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Think of two separate documents. The decree is a court’s instruction to two people. The deed is the public record a lender reads when it takes a lien on the property.

The usual way to close the gap is a quitclaim deed from the departing spouse. It passes along whatever interest the signer holds, with no warranties. It does not need the lender’s involvement to be valid as a transfer of title.

A signed deed that has not been recorded does not move title in a lender’s eyes. Some decrees only order a deed to be signed later, which leaves the record unchanged until it happens. Some title companies will accept a decree that vests title in one party if it carries the full legal description. That is an exception to confirm with the title company, not something to plan around.

Key Terms Defined

Vesting: the legal form in which a person or entity holds title, such as an individual or a revocable trust.

Quitclaim deed: a deed that transfers whatever interest the signer holds, without promising the title is clean.

CLTV: combined loan-to-value, which adds the first mortgage and the new line together and divides by the property’s value.

Seasoning: how long a borrower must have owned a property, or held a loan, before a lender will count it for a new transaction.

Due-on-sale clause: a mortgage term that lets a lender demand full repayment if the property is sold or transferred.

DSCR: the ratio of monthly rent to the full monthly obligation of principal, interest, taxes, insurance, and any HOA dues.

How Underwriting Treats a Post-Decree Rental, Step by Step

A lender reads this file in a predictable order. Working through the same order yourself shows where a file is not yet ready.

1. Read the decree and settlement. Confirm who is awarded the property and who is assigned each debt. Check whether it requires a refinance by a set date and whether it orders a deed to be signed.

2. Record the deed. The recorded deed, not the decree, tells the lender who owns the property.

3. Order a title report. Lenders look at the full chain of title, not only the most recent deed. Ask the title insurer whether the owner’s policy survives the transfer, because that depends on the insurer.

4. Check the vesting form. Investment lines in Lendmire’s network require title in an individual’s name or in an inter vivos revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title.

5. Account for the first mortgage and any joint line. The decree does not bind the lender, because the lender never signed it. If your ex remains on the first mortgage, that fact does not disappear from the file.

6. Qualify alone. After the decree you are reviewed as the only borrower. Support you pay counts as a debt, and your DTI is measured against your income alone.

7. Understand seasoning. No law sets a waiting period after a deed. Seasoning is lender policy, and lenders commonly measure ownership from the recorded date. A recent decree-driven quitclaim can therefore look like a new acquisition on some files.

A line is secured by the property, so the lender wants one clean decision-maker. When two names remain on the record, the lender may ask for the second name’s signature on the new lien. That can include an ex-spouse who was supposed to be out of the picture.

What the Network’s Investment Lines Look Like

Lendmire is a broker. It places home equity lines with select wholesale partners and does not lend directly. Across that network, an investment-property line has tight, specific limits, and every figure here is subject to lender guidelines and full file review.

  • Leverage: The ceiling is 70% CLTV on an investment property, whether your credit score is 720 or 700. Credit above 700 buys eligibility, not extra leverage.
  • Credit: 700 is the minimum on an investment line. There is no tier beneath it.
  • Line size: An investment line tops out at $500,000. The minimum line across the network is $25,000, with a lower floor in Michigan.
  • Structure: A standalone line in first or second lien position. Investment lines use a 5-year interest-only draw followed by a 25-year fully amortizing repayment. At least 75% of the line is drawn at closing.
  • Valuation: Because investment lines stop at $500,000, they usually run on an automated valuation instead of a traditional appraisal. A full appraisal can still be requested.
  • DTI: 50% maximum, qualified on the interest-only payment calculated on the maximum draw.
  • Property types: Single-family, 2-4 unit, PUD, townhome, and condominium, including non-warrantable. Manufactured homes, co-ops, condotels, log homes, commercial, mixed-use, and agricultural zoning are not offered.
  • Exposure: A borrower can hold up to three lines, and anyone owning more than 15 financed properties is not eligible.
  • Availability: Equity lines are offered only in Lendmire’s 16 full-service states. That is narrower than the 41-market DSCR footprint.

The 700 floor matters most after a divorce. Divorce often dents credit through closed joint accounts and late payments on shared debts. A 700 requirement makes that a binding constraint on an investment line in a way it is not on a primary residence line, where the floor is lower.

Bankruptcy needs 4 years of seasoning from discharge or dismissal. Investment files with a foreclosure-family event follow a 7-year seasoning path for a foreclosure and 4 years for a deed-in-lieu, pre-foreclosure, or short sale.

Where Federal Law Helps and Where It Stops

Federal law protects the transfer, not the debt. Under 12 U.S.C. § 1701j-3, a lender generally cannot call a loan due because of certain listed transfers on residential property with fewer than five dwelling units. One listed transfer is a transfer under a divorce decree, legal separation agreement, or incidental property settlement where a spouse becomes an owner. Another is the creation of a junior lien that does not transfer occupancy rights, which is relevant when you add a second-position line behind an existing first mortgage.

The federal bank regulation at 12 CFR § 34.5 confirms the other side. Due-on-sale clauses remain enforceable except for the transfers on that list, regardless of contrary state law.

Several limits are worth stating plainly:

  • The exemption does not release anyone. It stops the lender from accelerating the loan. It does not force the lender to remove a name from the note.
  • Calling the deed a quitclaim creates no exception. As UpCounsel explains, a deed required by a decree may fall within an exception if the statutory conditions are met, but the label alone does nothing.
  • An LLC transfer is not covered. Moving a rental into an LLC is generally not on the exempt list, so it can trigger the clause even when the real owner is unchanged. Larger multifamily with five or more units is outside the exemptions altogether.

The Deed Is Not the Debt

Debt and title are two separate tracks. Only a lender action releases someone from the note: a refinance, an assumption with an express release, or a payoff.

Action Changes title? Releases ex from loan?
Decree signed No No
Quitclaim recorded Yes No
Refinance into one name Depends Yes
Payoff or closure of line n/a Yes

A Justia attorney Q&A makes the same point. After a deed transfer, both people remain liable unless the loan is refinanced or modified. It also notes that many decrees require the spouse keeping the property to refinance by a set date.

That has a practical consequence for a joint line already open on the rental. Both spouses stay liable until it is paid off, closed, or refinanced into one name. A new line on top of an old joint one adds exposure, and your ex’s credit file keeps reflecting the old one.

Where the General Rule Breaks

The rule of thumb is simple: record the deed, qualify alone, then apply. These situations bend it.

The decree orders a future deed. The record still shows both owners. The file is not ready until the deed is signed and recorded.

Ownership is still contested. While the divorce is pending and ownership is disputed, there is no settled borrower and no settled title. Waiting for the decree is the sensible course. That is a narrower statement than the claim that you can never borrow during a divorce. A line may be possible earlier with a court order or written spousal consent permitting a new lien, if the property sits in your name or a revocable trust and you qualify alone.

The decree requires a refinance. A HELOC does not satisfy that order because it leaves the first mortgage in place. When the decree calls for the old loan to be paid off, the product to use is a cash-out refinance, which can include a DSCR cash-out that underwrites the property’s rent and pays off the existing debt.

The rental is in an LLC. The divorce exemption does not cover a move into an LLC, and investment HELOC programs require individual or revocable-trust vesting. A rental already held in an LLC needs a vesting change before an equity line, or it needs a different product altogether.

A community-property state. Adding or removing a spouse’s name may only make an existing interest explicit. Which interest each person holds is a legal question for the divorce attorney, not the lender.

A third-party signature. One credit union in the attorney Q&A above required an ex-spouse’s sign-off because his name remained on the deed. That is a single anecdote, but it shows why a lingering name on title can stop a file.

Properties near the unit limit. The federal exemptions reach only residential property with fewer than five units. A larger multifamily asset sits outside them.

HELOC or DSCR Cash-Out: Which Fits Your Decree?

A HELOC works for a narrow profile. You hold title individually or in a revocable trust. You want to keep the first mortgage in place. You qualify on personal income and credit at 700 or better. And your equity supports a combined 70% CLTV on an investment property, up to a $500,000 line.

A DSCR cash-out refinance works from a different premise. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Across Lendmire’s network, a standard rental cash-out generally tops out around 75% LTV, with about 6 months of seasoning as the common expectation. Many select programs start at a 1.00 coverage ratio. A separate select-lender path goes below 1.00 with leverage and terms adjusted. Most programs want a score near 660, and 700 or better unlocks the strongest tiers. Loan sizes run up to $3,000,000 on standard programs (smaller balances available through select lenders).

DSCR compares rent to the full monthly obligation. It is not a measure of positive cash flow, because repairs, vacancy, management, utilities, and capital expenses sit outside the calculation. The complete DSCR loans guide walks through how the ratio is built.

Situation Usually fits
Clean individual title, keep first mortgage HELOC
Rental held in an LLC DSCR cash-out (subject to lender program eligibility)
Decree requires a refinance DSCR cash-out or refinance
Credit below 700 DSCR cash-out
Income hard to document alone DSCR cash-out

The tradeoff is real. A HELOC leaves the existing first mortgage untouched, which can be valuable if that loan has terms you want to keep. A cash-out replaces it. On the other hand, a HELOC puts the decision on your solo credit and DTI, while DSCR files lean on the property’s income. A borrower with a strong post-divorce credit profile and clean title may prefer the line. A borrower with an LLC deed or a refinance order usually does not have that option.

Common Misconceptions

The decree gives me the house, so the title is mine. The decree is not the recorded title. A deed has to carry it into the county record.

A quitclaim takes my ex off the loan. It moves title only. The note stays joint until the lender releases it.

The decree binds the lender. The lender never signed it, so the lender is not bound by it.

A divorce quitclaim triggers due-on-sale. For qualifying residential transfers, federal law blocks that. It does not release anyone from the note.

A deed always starts a long waiting period. No law sets one. Seasoning is lender policy and varies by program.

What the Investor Decision Looks Like in Practice

Start with the recorded record. Pull the deed, confirm who is named, and compare it to the decree’s language. If the two do not match, the first job is recording a deed, not applying for credit.

Next, separate the debts. List the first mortgage, any joint line, and any support obligation. Know which ones your ex still shares with you, because those shape what a lender sees.

Then pick the tool. A clean individual title with credit at 700 or better points toward a HELOC. An LLC deed, a refinance mandate, or a score below 700 points toward the DSCR cash-out path.

Last, talk to your divorce attorney about state-specific effects. Community property rules, restraining orders, and the exact language of the decree vary, and a lender cannot interpret them for you.

Frequently Asked Questions

Can I get a HELOC on a rental while my divorce is still pending?

Sometimes, but it is harder than most people expect. A lender typically needs a court order or written spousal consent permitting a new lien. The property must sit in your name or a revocable trust, and you must qualify alone. If ownership is contested, waiting for the decree is usually the cleaner path.

Does a quitclaim deed remove my ex from the mortgage?

No. A quitclaim moves title and nothing else. Both of you stay liable on the note unless the lender releases one through a refinance, an assumption with an express release, or a payoff. Many decrees order the keeping spouse to refinance by a set date.

Why does the vesting form matter for an investment HELOC?

Investment lines in Lendmire’s network require title in an individual’s name or an inter vivos revocable living trust. A rental already in an LLC needs a vesting change first, or a DSCR cash-out instead.

Does the deed restart a lender’s seasoning clock?

It can, because no law sets a waiting period after a deed, but seasoning is lender policy. Lenders commonly measure ownership from the recorded deed, so a recent decree-driven quitclaim can look like a new acquisition. Confirm the specific program’s treatment before assuming the older ownership counts.

What is the leverage limit on an investment property line?

On an investment property, the ceiling is 70% CLTV, with a 700 minimum credit score and a $500,000 maximum line. Credit above 700 does not raise the ceiling. Every figure is subject to lender guidelines and full file review.
