How Much Can You Borrow on a DSCR HELOC While a Divorce Is Pending?

How Much Can You Borrow on a DSCR HELOC While a Divorce Is Pending?

The Quick Read: It depends on whether a court restraint blocks the new lien, because the legal layer can set your limit at zero before the program math even starts. When no restraint applies, or you hold your spouse’s written consent or a court order, the line is capped by combined loan-to-value, the $500,000 line ceiling on a second lien, and a 1.10x rent-coverage test, all subject to underwriting.

  • Many states restrain both spouses from encumbering property once a divorce is filed, and that can include a rental.
  • On a second lien, combined leverage tops out at 70% CLTV at a 720 credit score or better.
  • A rental with no mortgage can take a first-lien line at up to 75% LTV at 740 or better.
  • Rent qualifies the line, not personal income, which helps when household income is unsettled.
  • A non-borrowing spouse on title may still sign the lien document. Terms depend on the lender’s guidelines, the property type, the leverage, and a full review of the credit profile.

Who Sets the Limit First: The Court or the Lender?

The court sets it first. Program caps matter only after the legal gates are clear.

Nothing in federal law bans a home equity line during a divorce. The block comes from state automatic-order statutes and from any order entered in your case. California is the best-documented example. A California family-law firm quotes the order as restraining both parties from transferring, encumbering, hypothecating, concealing, or in any way disposing of any property without written consent or a court order. It binds the filing spouse on filing and the other spouse on service, and it reaches separate property, not just the family home. A rental you owned before the marriage can still be covered.

Other states differ. Many have similar rules, some do not. Your attorney should confirm the wording that applies to your case, and nothing here is legal advice.

If an order applies and you have neither consent nor a court order permitting the lien, assume the borrowing limit is zero. A lender cannot safely record the lien, and a court can challenge it later. Ask your attorney what a violation could mean for your case.

What Does the Program Itself Allow?

The program caps come from leverage, line size, and rent coverage, and the lowest of the three sets your number.

A DSCR HELOC is a revolving line secured by a non-owner-occupied one-to-four-unit rental. It is written as a standalone second lien behind a first mortgage you keep, or as a standalone first lien on a rental with no mortgage. Across Lendmire’s wholesale network, through select programs and subject to underwriting, the structure looks like this:

Factor Second lien First lien (no mortgage)
Max leverage 70% CLTV at 720+ 75% LTV at 740+; 70% at 700-739
Line size $50,000 to $500,000 To $500,000, then 65% LTV to $1,000,000
Credit floor 720 700

Second-lien leverage is combined: the first mortgage balance plus the new line, divided by value. That is the piece that surprises owners. A low-balance first mortgage leaves room. A large one leaves little. Run it as arithmetic, not a quote: with a 70% ceiling and a first mortgage at 50% of value, roughly 20% of value is left for the line, and the line cannot exceed the program maximum either.

The draw period runs 5 years interest-only on the drawn balance, followed by a 25-year fully amortizing repayment period and a 30-year maturity. The rate is variable. Most of the line, at least 80%, is funded at closing, and the closing draw is never less than $50,000. Any later draw is at least $5,000. Because drawn funds can be treated as marital debt or as buyout money in a settlement, work out with your attorney how much of the line you will take at closing.

How Is the Rent Test Calculated?

Coverage is gross monthly rent divided by a qualifying payment, and the payment is stress-tested on the entire credit limit, not just what you draw.

The qualifying payment is principal and interest on the full line at a stressed start rate, so a large line with modest rent can fail even if you plan to draw little. The 1.10x minimum applies on top of that. Taxes and insurance are not part of the qualifying payment. Confirm on the file how the lender treats the first-mortgage payment on a second lien before you size the line.

Rent is the lesser of the appraisal’s market rent and the lease, unless three months of receipts support a lease above market. A lease in place is required, and a two-to-four-unit property may have at most one vacant unit. A rental in the middle of a disputed rent figure or a tenant turnover has a harder time here. DSCR is built for non-owner-occupied investment property, not a primary home or second residence, so if the keeping spouse will live in the property, this is the wrong product.

For a longer walk through how the ratio works, see the complete DSCR loans guide. The formula itself is rent over the property’s full monthly obligation, and a DSCR loan is not a free pass on the borrower: credit, assets, and property still get reviewed.

Stage by Stage: When Can You Borrow?

Your stage in the case decides whether a draw is possible at all.

Stage Can a line close? What matters
Before filing Possibly No order exists, but a pre-filing draw can be examined later
Pending, with consent or order Possibly Documents must expressly permit the new lien
Pending, no consent Assume no Restraint likely blocks it
After the decree Yes, if title is clean Title and vesting must match the program

A pre-filing draw is not a loophole. Courts look at asset moves made shortly before a filing, and equity pulled during the case may be counted in the property division. Tell your attorney before you apply.

Who Signs What?

The borrower signs the note. A spouse on title may still need to sign the lien, and that does not make them a co-borrower.

Under Regulation B, a creditor generally cannot require a non-applicant spouse to sign a credit instrument when the applicant qualifies alone. There is an exception for secured credit: the creditor can require a signature on an instrument needed under state law to create a valid lien or pass clear title. The official commentary says that signature generally goes on the security agreement, not the note. In practice, a title holder who is not a borrower signs the security instrument and a non-borrowing owner acknowledgment.

Vesting matters. The program allows the rental to sit in your LLC, with members signing as guarantors, or in your name. If the deed still shows both spouses, expect the lender to want the ownership picture sorted out first. A recorded lis pendens against the rental clouds title, so ask your attorney and the title company how it would be cleared before you apply.

What Documents Does the File Need?

Clean files carry the legal papers and the property papers together.

1. A copy of any restraint, plus written consent or a court order that expressly permits the new lien.

2. Deed and vesting documents, with LLC papers if the rental sits in an entity.

3. The current lease and, where a lease exceeds market, three months of rent receipts.

4. The first-mortgage statement, so the combined leverage can be computed.

5. Evidence of seasoning: a rental bought or refinanced inside the last 6 months is not eligible (that clock runs from the last note date to the new note date), and the owner must have held title for 6 months (settlement date to note date).

6. Hazard insurance covering both liens, and flood coverage where required.

For valuation, lines up to $400,000 use an automated valuation with a property inspection report, or a full interior appraisal. Larger lines take a full appraisal. Appraisal waivers are not accepted. Credit history matters too: no 30-day mortgage late in the last 12 months, and 48 months since a bankruptcy, foreclosure, short sale, or deed-in-lieu. No reserves are required.

Key Terms Defined

CLTV: combined loan-to-value, the first mortgage plus the new line divided by the property’s value.

Restraint: a court order, often automatic on filing, that limits what either spouse can do with property.

Lien vs. note: the note is the promise to repay; the lien is the claim on the property that secures it.

Lis pendens: a recorded notice that a legal action affects the property, which can hold up title insurance.

DSCR: rent divided by the monthly obligation, here a stress payment on the full line.

When a Different Product Fits Better

A line does not fix everything a divorce decree asks for.

A decree binds the spouses, not the lender. A quitclaim moves title only. Only a payoff, a refinance, or a lender-approved assumption with a written release removes someone from the note. A HELOC can fund a payout, but it does not release an ex-spouse from the first mortgage.

Situation Better fit
Ex must come off the first note DSCR cash-out refinance
Rental sits in an LLC and you want a loan type that allows it The line allows LLC vesting; confirm program eligibility
Rental is the keeping spouse’s home A different, owner-occupied product
Restraint blocks any new lien Wait for consent, an order, or the decree

Variable rate and vacancy are the two risks to size honestly. The draw period is interest-only, and the repayment period amortizes the full balance. A rent figure still in dispute can also move the coverage ratio.

Rural property, condotels, row homes, and leaseholds are outside the program, and a declining-market flag lowers the leverage ceiling by 5 points.

Frequently Asked Questions

Can I get a DSCR HELOC while my divorce is pending?

Only if no restraint blocks the lien, or you have your spouse’s written consent or a court order permitting it. No national ban exists. The restriction comes from state automatic-order statutes and from orders in your case, so your attorney should confirm what applies.

Does my spouse have to sign if they are not a borrower?

Often a spouse on title signs the lien document but not the note. Regulation B allows a creditor to require that signature where state law needs it to create a valid lien. Signing the lien grants the security interest and does not make the spouse liable on the loan.

How is the maximum amount actually figured?

Take the lowest of three limits: the CLTV ceiling less your first-mortgage balance, the program line maximum, and the line size your rent can carry at 1.10x on the stress payment. A first-lien line on a rental with no mortgage can reach 75% LTV at 740 or better, subject to underwriting. The exact numbers vary by lender and program and follow a full review of property, leverage, and credit.

Does the line change who owes the first mortgage?

No. If the decree requires an ex-spouse to come off that loan, a payoff or refinance does it, not a home equity line.

How long must I own the rental first?

Two six-month clocks apply: the line is not available on a rental bought or refinanced in the last 6 months (last note date to new note date), and title must have been held for 6 months (settlement date to note date).
