What a Lender Needs to Refinance Out of Hard Money on a Land Contract?

What a Lender Needs to Refinance Out of Hard Money on a Land Contract?

The Quick Read: Usually yes, once the deed has been delivered and recorded in your name or your LLC’s name, because a DSCR lender wants legal title, a clean first-position lien, a hard money payoff statement, an appraisal with a rent schedule, rent that covers the payment, acceptable credit, and reserves. The land contract is the part that complicates the file. A seller who still holds title, an unrecorded contract, or an old seller mortgage can stall everything.

  • Title comes first. The seller’s deed must be recorded in your name or your LLC’s name before the new lender’s lien goes on.
  • Rent has to cover the payment. Many select programs start at 1.00 coverage, and stronger ratios open better terms.
  • Leverage depends on the structure. The DSCR loan allows up to 85% LTV on a rate-and-term refinance and up to 75% on a cash-out refinance of an investment property, subject to lender guidelines.
  • The property must be finished. It needs to be insurable and rent-ready, with an appraisal that supports the payoff.
  • Hard money has a maturity date. Title cleanup and a seller’s signature take time, so start well before it arrives.

Why Title Decides Everything on a Land Contract

A land contract is seller financing. You get possession and equitable title, which is the right to the property once you finish paying. The seller keeps legal title until the contract is paid off. Wisconsin Legal Help explains that the buyer receives full legal title only when the contract is paid in full.

That split is why a refinance lender cares so much. A DSCR lender wants to record a first-position lien against the property, and it can only do that against legal title. Equitable title alone does not get you there.

In a layered deal, the order usually runs like this:

1. Hard money pays off the land contract seller.

2. The seller delivers a deed to you or your LLC.

3. The hard money lender’s lien records behind that deed.

4. The DSCR loan pays off the hard money lender and records in first position.

A break anywhere in that chain breaks the refinance. The most common break is step two, because it depends on the seller.

This article is about business-purpose investor loans. DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage.

Key Terms Defined

Land contract: A seller-financed sale in which the buyer pays over time and receives the deed only after the final payment. Other names include contract for deed, installment land contract, and agreement for deed.

Equitable title: The buyer’s right to own the property once the contract is satisfied, as opposed to the seller’s legal title on record.

Memorandum of land contract: A short recorded notice that a land contract exists. It is not a deed and does not convey title.

Seasoning: The waiting period a lender wants between acquiring a property and refinancing it. On a DSCR cash-out refinance, it is about 6 months of ownership measured from title recording.

Payoff statement: A written figure from your current lender showing exactly what it takes to retire the loan on a given date.

PITIA: Principal, interest, taxes, insurance, and association dues. This is the full monthly obligation a DSCR lender compares rent against.

DSCR (debt service coverage ratio): Monthly rent used for lender review divided by PITIA. At 1.00, rent equals the payment.

Rate-and-term refinance: A refinance that pays off the old loan and costs, with no cash back to you at closing.

What the New Lender Checks

The best program for your situation depends on your credit, the property, and how much leverage you need. The checklist underneath is consistent across Lendmire’s wholesale network of DSCR lenders. The broker’s job is to match the file to the program that fits.

Requirement Why it matters What proves it
Legal title in your name or LLC Lender needs a first-position lien Recorded deed, title report
Clean title Liens and judgments cloud the lien Title commitment
Payoff statement Sets the amount to retire Hard money lender’s letter
Appraisal and rent schedule Supports value and coverage Appraisal with rent data
Coverage of 1.00 or better Rent must carry PITIA Rent schedule, PITIA figures
Credit score Sets leverage tier Credit report
Reserves Cushion after closing Asset statements
Insurance Property must be insurable Binder or policy

Here is how the big numbers work on the DSCR side, as typical ranges from select lenders in the network:

  • Credit: A 620 floor exists in parts of the network. Tiers step up at 660, 680, and 700, and stronger scores open better leverage.
  • Coverage: 1.00 is where many select programs start. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted.
  • Reserves: About 6 months of PITIA is common, and loans above $1,500,000 typically step up to about 9 months.
  • Loan size: Up to $3,000,000 on standard programs.

Clearing 1.00 does not mean the property cash flows. DSCR compares rent to PITIA only. Repairs, vacancy, management, utilities, and capital expenses sit outside the calculation.

Borrowing through an LLC is common, subject to lender program eligibility. Name the entity that will own the property on the contract and the deed from the start. A deed in your personal name followed by a loan to an LLC adds a transfer step the lender will review.

Rate-and-Term or Cash-Out?

Most people leaving hard money want to pay it off and nothing more. That is a rate-and-term refinance. If you also want cash back, it becomes a cash-out refinance with a tighter ceiling.

Factor Rate-and-term Cash-out
LTV ceiling (investment property) Up to 85% Up to 75%
Cash back at closing None Yes, within the cap
Seasoning Varies by lender About 6 months from recording
Typical use Retire hard money only Retire it and pull equity

The seasoning clock deserves attention on a land contract. On the DSCR cash-out refinance, it is measured from title recording, which for you is the day the seller’s deed records. If the hard money loan just bought out the land contract, you may be inside the waiting period. Some lenders treat a recent land contract payoff as a purchase instead of a refinance, which changes leverage. The treatment varies by program, so ask before you assume.

Lendmire’s piece Can Hard Money Buy Out a Land Contract If the Seller Will Not Refinance? covers the front half of this structure. This article covers the exit.

For the full picture of how the long-term side works, see the complete DSCR loans guide.

A Worked Example in Percentages

Take a finished duplex bought through a land contract and taken out by hard money. Treat these as illustrative assumptions, not market data.

Say the appraisal supports the value, and the hard money payoff plus closing costs lands near 72% of appraised value. That sits under the 85% rate-and-term ceiling, so the DSCR loan can retire the hard money debt without you bringing cash. Say the rent schedule shows coverage near 1.2x. That clears the 1.00 starting point many select programs use.

Now change one input. Suppose the appraisal comes in lower, and the same payoff now equals about 88% of value. That is above the 85% ceiling. You would need to pay the difference in cash, or ask the hard money lender for time to find a better valuation path.

Change the goal instead. If you also want cash back, the 75% cash-out ceiling applies. A payoff that already equals 72% of value leaves very little room above it. In that case, a rate-and-term refinance is the realistic structure. Final terms depend on the lender’s guidelines, the property type, and the borrower’s complete credit picture.

If coverage came in slightly under 1.00, that is a different path. It is available through select lenders in the network, with leverage and terms adjusted. It is not the same program with a lower floor.

Land Contract Problems That Stall the File

The title company will surface these early. Knowing them first saves you from finding out near maturity.

The seller will not sign, or cannot. The seller’s deed is the pivot. If the seller changes their mind, dies, or has liens of their own, you may need an attorney and the title company involved early. A seller who still holds legal title controls the timing.

An old seller mortgage is still on the property. If the seller had a mortgage when the land contract started, that lien must be paid off at closing along with the contract. Whether the contract triggered a due-on-sale clause is a nuanced legal question, as one Michigan law-office blog points out. Your title report will show the lien either way.

The contract was never recorded. An unrecorded buyer’s interest has no priority in the public record. The same firm explains why recording a memorandum of land contract matters and notes that a clean memorandum smooths a later refinance. If one exists, it must be discharged at payoff.

The paperwork is missing. In a national survey, Pew Charitable Trusts found that 8% of land contract buyers never received a written copy of their arrangement. A lender wants the contract, the payment history, and proof of who is on it. Rebuild that trail early.

The entity does not match. If the contract names you personally but the loan goes to your LLC, expect questions about the transfer. Decide the owning entity before the deed is delivered.

On the regulatory side, the CFPB’s contract-for-deed report notes that this product can lack many of the consumer protections that apply to mortgages. That research is aimed at consumer home sales. It is background for your business-purpose deal, not the rulebook for your DSCR refinance.

What Else Can Sink the Exit

Even with perfect title, the property has to qualify.

It must be finished. A DSCR exit works on a stabilized rental. If the rehab is unfinished, the appraiser cannot support a rent schedule and the property may not be insurable. Finish the work first.

It must be an eligible property type. Manufactured homes (single- and double-wide), log homes, and barndominiums fall outside the network’s DSCR programs. If your collateral is one of those, a different exit is needed.

The appraisal must support the payoff. A low value squeezes the loan amount. That is the scenario where borrowers need cash at closing.

The rent has to be defensible. The lender relies on the appraisal’s rent schedule, not your hopes. Leases in place help the file.

Reserves must be documented. Statements showing about 6 months of PITIA, or about 9 above $1,500,000, are typical. Conservative rate-and-term files at modest leverage under that size can see reserves waived, which depends on the lender.

Short-term rental collateral has its own rules, including more hosting history and a different coverage floor. Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.

Working Backward From Maturity

Hard money is short by design. Terms on the program run 6 to 18 months, interest-only, with no prepayment penalty, though this varies by lender, property, and experience. The maturity date is the one you cannot move without extension costs.

Work backward from it in this order:

1. Confirm the deed. Make sure the seller’s deed is recorded and the contract or memorandum is discharged.

2. Order a title search. Look for seller liens, judgments, and any underlying mortgage.

3. Finish the property. Complete repairs and secure insurance.

4. Get leases in place. Rented units give the appraiser real rent evidence.

5. Request the payoff statement. Ask the hard money lender for it in writing.

6. Start the DSCR file. Submit credit, entity documents, and reserve statements.

7. Leave slack. Appraisals and title cleanup rarely run on your schedule.

Many investors refinance out of hard money into long-term DSCR financing once the property is stabilized, and Lendmire arranges that path through its hard money exit refinance program. The earlier you start, the more options you keep.

If You Cannot Qualify Yet

Not every file clears on the first pass. The usual levers are these:

  • Coverage short of 1.00. A path below 1.00 is available through select lenders in the network, with leverage and terms adjusted. Raising rent or lowering the loan amount can also help.
  • Seasoning too fresh. Waiting for more months of ownership may open a cash-out option.
  • Credit below the tier you need. The floor is 620 in parts of the network. Better scores unlock better leverage.
  • Appraisal short. Bring more cash, or reduce the payoff through a partial paydown.
  • Title unresolved. Work with an attorney and the title company before anything else.

If none of those fix it before maturity, talk to the hard money lender early about an extension. Asking before the deadline is far better than after.

Frequently Asked Questions

Can a DSCR loan pay off the land contract seller directly and skip hard money?

Sometimes. If the seller will deliver a deed at closing, a DSCR lender can pay the seller and record its lien after the deed. Many lenders treat a recent land contract payoff as a purchase, which follows purchase rules rather than refinance rules. The DSCR loan allows up to 85% LTV on a rate-and-term refinance and up to 75% on a cash-out refinance, subject to lender guidelines, so ask your broker which treatment applies to your file.

Does the new loan count as a purchase or a refinance?

It depends on the program’s seasoning rule and which date the lender counts from. On a DSCR cash-out refinance, seasoning is about 6 months from title recording. A land contract that was paid off recently may be treated differently from one held for a long time. Ask your broker to confirm the treatment before you commit to a structure.

Is there a prepayment penalty on the hard money loan?

On the hard money program Lendmire brokers, terms run 6 to 18 months, interest-only, with no prepayment penalty. Terms vary by lender, property, and experience, so read your own loan documents. Your payoff statement will show the exact amount owed on the date you plan to close.

What if the seller will not sign the deed?

Bring in an attorney and your title company right away. The seller keeps legal title until the contract is satisfied, so the refinance cannot move forward without a deed. If the seller cannot be reached or refuses, a court process may be the only route, and that is a question for your attorney.

What if rent does not cover the payment?

Many select programs start at 1.00 coverage. A separate path below 1.00 is available through select lenders in the network, with leverage and terms adjusted. You could also lower the loan amount, raise rent where the market supports it, or wait until the property is further along in lease-up.
