Can You Close a DSCR Cash-Out Refinance With a Fraud Alert on Your File?

Can You Close a DSCR Cash-Out Refinance With a Fraud Alert on Your File?

The Quick Read: Yes, a fraud alert does not block a DSCR cash-out refinance; it adds an identity-verification step the lender has to clear before the loan can fund, and the file still turns on rent, appraised value, and credit. A credit freeze is different, because it stops the credit pull until you lift it.

  • An initial fraud alert lasts one year and can be renewed; an extended alert lasts seven years and is stricter.
  • The lender still pulls the guarantor’s personal credit on a DSCR file, so the alert shows up even when the borrower is an LLC.
  • Keep the phone number on the alert reachable. An unanswered verification call can stall the file until the lender confirms who it is dealing with.
  • Cash-out terms, including the loan-to-value ceiling and ownership seasoning, are covered in the DSCR math section below and remain subject to lender guidelines.
  • Fraud alerts and lender fraud screening are two different things. The first protects you, while the second reviews the appraisal, occupancy, ownership history, and leases.

What a Fraud Alert Actually Does to a Loan File

A fraud alert is a flag on your credit report that tells lenders to confirm who they are dealing with. It does not freeze the report and does not deny credit.

For a broker, that is the whole story. The pull happens. The alert comes back attached to the report. The lender then runs its identity checks before it moves forward.

One more mechanic matters on a file with several lenders in play. A fraud alert placed at one bureau must be passed to the other two, per the FTC’s comparison of alerts and freezes. You do not need to place it three times, and the lender will see it whichever bureau it pulls.

Does the Alert Apply to a Business-Purpose Loan?

Assume it does. The statute, 15 U.S.C. §1681c-1, speaks of a new credit plan or extension of credit in your name. It does not carve out business-purpose loans. A DSCR cash-out refinance is a new extension of credit, and the lender pulls the personal credit of the guarantor regardless of whether the borrower is an individual or an LLC.

No published guideline spells out how every lender treats the alert on investor loans, and this article makes no legal ruling. The working assumption in the wholesale network is simple: if the alert is on the guarantor’s report, the lender will run the verification step. Plan for it.

The LLC question comes up often. A loan closed in an entity name may not report to personal credit after closing, but that is a separate matter from the underwriting pull. The guarantor’s report is pulled, so the alert is seen. Borrowing through an LLC, subject to program terms, does not route around it.

Initial, Extended, and Active-Duty Alerts

The type of alert sets how hard the verification is. Here is how they compare.

Alert type Length What the lender must do Your action
Initial 1 year, renewable Use reasonable procedures to confirm identity Keep the listed phone reachable
Extended 7 years Contact you by phone, in person, or your designated method Answer promptly; have the report on hand
Active-duty 12 months Similar to an initial alert Same as initial

The initial alert is free and open to anyone who is or suspects they may be affected by identity theft. The statute asks the lender to use reasonable policies to form a reasonable belief it knows who is applying. If you left a phone number on the alert, expect a call to it.

The extended alert is stricter. It requires an FTC identity theft report or a police report, as Experian’s alert page explains, and the lender must contact you before extending new credit. For the active-duty version, Equifax lists a 12-month term.

Older material cites a 90-day initial alert. Current FTC guidance says one year. Use one year.

The Closing Sequence With an Alert in Place

The sequence is the same as any cash-out file, plus one gate. It helps to know who owns each step.

1. Tell the broker up front. Do not let the alert surface in the credit pull. State it at intake, along with the phone number or method listed on it.

2. Confirm the contact method. Check that the number on the alert is current and that voicemail is set up. An outdated number is an easy mistake to make and an easy one to prevent.

3. Credit pull. The lender pulls the guarantor’s report. The alert returns with it. The lender begins its identity verification.

4. Verification contact. On an initial alert, expect a call to the listed number. On an extended alert, expect direct contact by the method you designated. Answer it, and do it the same day the call comes in if you can.

5. Standard identity and entity documents. Government ID, entity documents for an LLC, and the usual property paperwork move in parallel. The alert does not replace any of them.

6. Underwriting on the property. The file still qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. The alert does not change the rent, the appraisal, or the coverage math.

7. Title and settlement. The title agent clears title and reconciles the settlement as on any cash-out file. Identity checks at signing follow the same logic as the verification step.

If you also hold a credit freeze, the freeze must be lifted before the pull. A freeze and an alert can coexist. Neither one by itself kills the loan.

What Decides Whether the File Clears

Three things decide it.

First, whether the lender reaches you at the designated method. Second, whether the identity checks match the application: name, address history, entity ownership, and the signer. Third, whether anything else on the file looks off.

That third point is where a precautionary alert and an unresolved identity-theft problem part ways. A flag you placed as a precaution is a protective step. If the alert came from real theft, with unauthorized accounts, mismatched addresses, or questions about title to the property, the lender will look harder before it extends credit. Clearing those items up before you apply, with the credit bureaus and the title company, is the cleaner path.

Score impact is not expected. Placing an alert does not itself lower a score.

Scenarios Investors Actually Face

Precautionary alert, reachable phone. An investor placed an initial alert after a data-breach notice. The file runs normally. The lender calls the listed number, confirms identity, and moves on. Rent coverage, reserves, and the 75% LTV ceiling on a standard rental cash-out still decide the loan.

Active identity theft. Say an investor discovers an unfamiliar account and places an extended alert with a police report. Expect the lender to contact the investor directly before extending credit, and expect more questions about address history. The better move is to resolve the fraudulent accounts first and bring a clean file to the lender.

LLC with a personal guarantor. The LLC owns the property. The guarantor holds the alert. The pull hits the guarantor, so the verification still runs. The entity documents go in alongside it, subject to lender program eligibility.

Alert plus freeze. The investor froze all three bureaus and placed an alert. The pull fails until the freeze lifts at the bureau the lender uses. Lift it, let the lender pull, and re-freeze afterward if you want.

Several applications at once. Applying to multiple lenders can mean multiple verification calls. Keep the phone on and track which lender called.

DSCR vs. conventional financing

There are two common ways to finance an investment property, and they qualify you differently — here’s how investors weigh them.

DSCR loan

Why investors choose it

  • Qualifies on the property’s rental income — no personal tax returns, W-2s, or pay stubs needed to document income.
  • No personal debt-to-income ceiling to clear, so existing mortgages and obligations don’t cap your borrowing the same way.
  • Can be closed in an LLC, keeping the property inside a business entity.
  • Built for scaling — not held to the limit on number of financed properties that conventional financing applies.
  • Underwriting centers on the deal: generally qualifies when the rent covers the payment, a 1.00x coverage ratio being a common baseline (confirmed in underwriting).
  • Designed specifically for investment property, including long-term and, where the program allows, short-term rentals.
Conventional loan

Where it’s strong

  • Often the lowest ongoing financing cost for a buyer who fully qualifies on personal income — a fit for a first property or a cost-first purchase.

Trade-offs for investors

  • Requires full personal income documentation and must fit within a debt-to-income limit — salary, existing debts, and other mortgages all count.
  • Typically held in your personal name rather than a business entity.
  • Caps how many financed properties you can carry, which can become a ceiling as a portfolio grows.
  • Evaluates you as a borrower as much as the property, which usually means more paperwork.

How investors usually choose: a first or single property often optimizes for the lowest financing cost; portfolio builders often optimize for leverage, vesting in an LLC, and scaling past conventional caps. The right answer depends on your goals, the property, and current guidelines — both paths run through select lenders in Lendmire’s wholesale network, with eligibility and terms confirmed in underwriting.

Don’t Confuse Your Alert With Lender Fraud Screening

An alert you placed is a consumer protection. Lender fraud screening is the lender’s own review of the deal. They are not the same thing and do not feed each other.

Cash-out refinances draw closer review across the industry. Trade press has covered schemes involving inflated appraisals on DSCR cash-out loans and questionable leases. Lenders look at deed transfers recorded shortly before origination, an LLC acting as both buyer and seller, and the consistency of the lease and rent evidence. Some lenders circulate do-not-use lists of appraisers and borrowers.

None of that has anything to do with a borrower who placed a fraud alert in good faith. But it explains why clean documentation matters on any cash-out file: ownership history, entity paperwork, a lease that matches the rent claimed, and an appraisal that holds up. An investor with an alert and a clean file is in a better position than an investor with no alert and a thin one.

How the DSCR Cash-Out Math Sits on Top

The alert is about identity. The loan is about the property. Across the wholesale network, a cash-out refinance on a standard rental tops out around 75% LTV, with about 6 months of seasoning measured from title recording. Short-term-rental collateral is more conservative, with cash-out at 70%. Terms depend on the lender’s guidelines, the property type, the leverage, and a full review of the credit profile.

Coverage of 1.00 is where select programs start. Stronger ratios open better pricing and leverage. A separate path through select lenders in the network goes below 1.00, with leverage and terms adjusted. Credit tiers run from a 620 floor in parts of the network to roughly 660 on most programs, with 700 and up opening the strongest leverage. Reserves commonly run around 6 months of PITIA, stepping up to about 9 months above $1,500,000. Loan sizes reach $3,000,000 on standard programs.

Remember what the ratio measures. DSCR compares rent to PITIA only. Clearing 1.00 is not the same as positive cash flow, because repairs, vacancy, management, and capex sit outside the calculation. Equity available depends on rent used for lender review, PITIA, reserves, and the leverage ceiling. It is not a guaranteed cash figure. All of this is subject to lender guidelines, and every file is reviewed individually.

Key Terms Defined

Fraud alert: A flag on your credit report that tells lenders to verify your identity before extending new credit.

Credit freeze: A lock that blocks anyone from pulling your credit report until you lift it.

Initial alert: A free, one-year, renewable alert that asks lenders to use reasonable procedures to confirm who is applying.

Extended alert: A seven-year alert that requires an identity theft or police report and direct contact before new credit.

Guarantor: The person who personally backs a loan made to an LLC, and whose credit is pulled.

Seasoning: The ownership period a lender expects before it allows cash-out on a property, measured from title recording.

Pre-Application Checklist

  • Confirm which alert you have, initial, extended, or active-duty, and when it expires.
  • Check that the phone number or contact method on the alert works today.
  • Know whether a freeze is also in place, and at which bureaus.
  • Tell your broker before the pull, not after.
  • Gather ID, entity documents, lease evidence, and ownership records for the property.
  • Resolve any open identity-theft items with the bureaus and the title company first.

Questions to put to any lender: How do you verify identity on an alert? Which contact method will you use? Who contacts me, and when? What happens if I miss the call?

Frequently Asked Questions

Will a fraud alert stop my DSCR cash-out refinance?

No. It adds a verification step before the lender extends credit. The loan still depends on the property’s rent coverage, the appraised value, and your credit profile, subject to lender guidelines.

Do I have to remove the fraud alert to refinance?

The sources describe verification, not removal. The alert can stay in place. A credit freeze is the item that has to be lifted for the pull, and you can re-freeze afterward.

Does a fraud alert lower my credit score?

Neither a freeze nor an alert is expected to affect your score. It is a notice on the file, not a negative mark.

Does borrowing through an LLC avoid the alert?

No. The lender pulls the personal credit of the guarantor on a DSCR file, so the alert still appears. Entity borrowing, subject to program terms, does not change that.

Is a fraud alert the same as the lender suspecting me of fraud?

No. Your alert is a protection you placed. Lender fraud screening looks at appraisals, occupancy, ownership history, and leases, and it is a separate process.
