DSCR HELOC Requirements on a Vacant Rental Without a Lease

DSCR HELOC Requirements on a Vacant Rental Without a Lease

The Quick Read: A fully vacant rental does not qualify for a DSCR HELOC, because the program requires a lease in place and a market-rent study cannot stand in for one. The line qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. A vacant property usually belongs in a different loan lane until it is leased.

  • A lease in place is required; a fully vacant rental fails the test.
  • Rent must reach at least 1.10x a stress payment on the entire credit limit, not just the drawn amount.
  • Two six-month clocks apply: one on recent purchases or refinances, one on time held on title.
  • A two-to-four-unit building may have at most one vacant unit.
  • A DSCR purchase or first-lien cash-out may fit an empty, rent-ready property instead.

What Is a DSCR HELOC, Exactly?

A DSCR HELOC is a revolving line of credit on a non-owner-occupied one-to-four-unit rental. It is written as a standalone second lien behind the first mortgage the owner keeps, or as a standalone first lien on a rental with no mortgage. The rent qualifies the line. Through select programs, no traditional personal-income documentation, W-2s, pay stubs or debt-to-income ratio come into play, and the owner’s LLC can hold title, subject to program terms.

That structure is why the lease matters so much. With no personal income in the file, the property’s income is the whole case. No tenant means no income to test.

Key Terms Defined

DSCR: the debt service coverage ratio, meaning gross monthly rent divided by the qualifying monthly payment.

Second lien: a loan recorded behind the first mortgage, which stays in place.

CLTV: combined loan-to-value, meaning the first mortgage balance plus the new line, divided by value.

Form 1007: the appraiser’s market rent schedule, an attachment to the appraisal. Fannie Mae’s form page describes it as the way a lender obtains market rent from the appraiser, and Freddie Mac publishes the same document as Form 1000.

Draw period: the stretch when the borrower can draw on the line and pays interest only on the drawn balance.

Why Does the Lease Matter More on a Line Than on a Purchase?

Many DSCR purchase files count the appraiser’s market rent on a rent-ready vacant property. The HELOC does not work that way. Across Lendmire’s wholesale network, the line is sized on today’s value and today’s rent, and a second lien sits behind a mortgage already on the property. The lender wants proof the property is producing income now, not a projection.

This is also why the same keyword gets two answers online. Purchase and cash-out pages often say no lease is needed. HELOC pages treat the lease as a hard gate. Both can be right, because they describe different products. When someone quotes a vacant property “no lease needed,” ask which loan they mean.

The agency forms are contrast only. DSCR loans are not agency products. Lenders borrow Form 1007 as a standard way to document market rent.

How Does Underwriting Treat a Rental, Step by Step?

1. Eligibility gates. The property must be a non-owner-occupied one-to-four-unit rental with a lease in place. A rental bought or refinanced inside the last 6 months is not eligible (that clock runs from the last note date to the new note date), and the owner must have held title for 6 months (settlement date to note date).

2. Rent selection. Rent is the lesser of the appraisal’s market rent and the lease, unless three months of receipts support a lease above market.

3. Coverage test. Gross monthly rent must reach at least 1.10x a fully amortizing payment on the entire credit limit, run at a stressed rate. Taxes and insurance are not part of that qualifying payment. Confirm on the file how the lender treats the first-mortgage payment on a second lien, because the lender’s own calculation governs.

4. Leverage. Through select programs, a second lien runs up to 70% CLTV at a 720 score or better, on lines from $50,000 to $500,000. A first lien on a rental with no mortgage runs up to 75% LTV at 740 or better, and 70% LTV from 700 to 739, on lines up to $500,000. First-lien lines above $500,000, to $1,000,000, carry a 65% LTV ceiling at 720 or better. Terms vary by lender guidelines, property type, leverage, credit profile, and full file review.

5. Valuation. Lines to $400,000 use an automated valuation with a property inspection report, or a full interior appraisal. Larger lines take a full interior appraisal. Appraisal waivers are not accepted.

6. Structure. The rate is variable. The draw period is 5 years of interest-only payments, then a 25-year repayment period, with a 30-year maturity. At least 80% of the line is drawn at closing, and later draws are at least $5,000.

Everything is subject to underwriting. The figures are ceilings and floors, never offers.

Which “No Lease” Situation Are You In?

Vacant is not one condition. The spectrum looks like this.

Situation How the line treats it
Fully vacant Fails; no lease, no rent to test
Newly leased at market Lesser of lease or market rent applies
Lease above market Counts at market, or at lease with 3 months of receipts
Lease below market Lease governs; ratio stays low
2-4 units, one vacant Allowed; at most one unit vacant
2-4 units, several vacant Fails the vacancy limit
New build Lease still required; Form 1007 is the market side

The unit rule is simple. A fully vacant two-to-four-unit building has no rent evidence at all, so it fails the same way a vacant single-family does.

Where Does the General Rule Break?

Several edge cases shift the answer.

Recently purchased rentals. The six-month clock applies on the HELOC. Many DSCR purchase files carry no such seasoning on a vacant, rent-ready property. An investor who just bought an empty rental is in the purchase lane, not the line lane.

Short-term rentals. DSCR underwriting for a short-term rental calls for monthly-lease comparables, and multiplying a nightly rate by 30 is incorrect. Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.

Heavy rehab. A property needing real construction work is typically bridged first, then refinanced once stabilized. The HELOC is not a rehab tool.

Below-market leases. A lease set low for a friendly tenant drags the ratio down until the lease resets. Rent that barely covers the stress payment may support only a smaller line, since the test runs on the full limit.

Property types outside the lane. Rural-designated property, condotels, row homes, leaseholds, land trusts and a property listed for sale in the prior 2 months are not eligible here.

What Does the Decision Look Like in Practice?

Consider an investor who just finished a light turn on a single-family rental and wants equity out. Without a lease, the line is off the table. Sequence is the strategy.

1. Sign a market-supported lease.

2. Let both six-month clocks run.

3. Apply for the line, sized so rent clears 1.10x on the full limit.

Now picture a second investor who needs capital sooner and owns the property free and clear. A DSCR first-lien cash-out may fit an empty, rent-ready property instead, with the appraiser’s market rent carrying the file. That path trades the revolving structure for a closed loan.

Compare the options at a glance.

Option Lease needed? Best fit
DSCR HELOC Yes Leased, stabilized rental; keep the first mortgage
DSCR purchase Often no, if rent-ready Buying an empty rental
DSCR first-lien cash-out Often no, if rent-ready Paid-off vacant rental
Bridge, then lease-up No Heavy rehab or lease-up gap

The flip point is the first mortgage. An owner who wants to keep a low-balance first mortgage in place needs the second-lien line, and that requires a lease. An owner with no mortgage has more lanes open.

One pattern shows up often across files in this lane. Coverage that looks comfortable on the lease alone shrinks once the test runs on the whole credit limit rather than the amount drawn. Investors who size the line backward from the rent, not forward from the cash they want, avoid the most common surprise.

Documents to Gather Before Applying

Expect the lease and rent evidence, with receipts if the lease is above market. The file also needs the credit report and mortgage history, with no 30-day late in the last 12 months. A second lien adds the first-mortgage statement. LLC-held rentals add entity documents, subject to lender program eligibility. Insurance, title and the valuation complete the file. Net worth does not substitute for rent: brokerage and retirement balances do not raise the coverage number.

Borrowers must be US citizens, permanent residents or non-permanent residents with a Social Security number. This program is offered in 15 of Lendmire’s 16 licensed states, every licensed state except Tennessee. Lendmire’s complete DSCR loans guide covers the broader product family.

Common Misconceptions

“DSCR loans never need a lease.” True for many purchase files, false for this line.

“A market-rent study replaces a lease.” It carries many vacant purchases. It does not carry the HELOC.

“A high lease raises my ratio.” The excess is ignored unless three months of receipts support it.

“Form 1007 works for Airbnb-style rentals.” It was not designed for them.

Frequently Asked Questions

Can I get a DSCR HELOC if my tenant just moved out?

Not until a new lease is in place. A unit between tenants has no lease to test, so the line waits. In a two-to-four-unit building, one vacant unit is allowed if the other units are leased.

Does a month-to-month tenancy count?

A lease in place is the requirement, so the lender’s review of the lease documents decides it. Confirm with the lender how a month-to-month or expired lease is treated before applying, since it is subject to program terms.

How long must I own the rental first?

Two six-month clocks apply: the line is not available on a rental bought or refinanced in the last 6 months (last note date to new note date), and title must have been held for 6 months (settlement date to note date).

What if the lease is above or below market?

Rent counts at the lesser of the lease and the appraiser’s market rent, unless three months of receipts support a lease above market. A below-market lease stays at the lease figure and lowers the ratio.

Can an LLC hold title on the line?

Yes, on investment property, subject to program terms. The members sign as guarantors, and the borrowers on the line need not match the borrowers on the first mortgage.
