Is a Non-Recourse Super Jumbo DSCR Loan Available for a Rental Pool?

Is a Non-Recourse Super Jumbo DSCR Loan Available for a Rental Pool?

The Quick Read: Sometimes, but not by default. Non-recourse treatment exists in the network mainly on the rental portfolio term loan, which covers five or more properties or units under one note, and it almost always comes with carve-outs. A standard DSCR loan carries a personal guarantee, and size alone does not remove it, subject to lender guidelines.

  • DSCR describes how the file qualifies. Recourse describes what the lender can pursue after a default. They are separate questions.
  • The rental portfolio term loan runs from $500,000 up to $10,000,000 at up to 75% of value, with recourse and non-recourse versions, subject to underwriting.
  • Non-recourse almost always includes a “bad boy” carve-out guaranty. Certain bad acts can bring personal liability back.
  • A condo-hotel pool, where owners share unit revenue, is a different animal. Non-recourse there is rare and case by case.
  • An LLC does not make a loan non-recourse on its own.

DSCR and Recourse Are Two Different Questions

Qualifying on the rent is one decision. Deciding who is liable if the loan fails is another. A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. It says nothing about the guaranty.

Most DSCR loans we place carry a personal guarantee from the borrower. Non-recourse is the exception. The Federal Reserve’s staff paper on bank commercial real estate lending found that non-bank commercial lenders overwhelmingly provide non-recourse loans, and that the average recourse loan is much smaller than the average non-recourse loan. Size and scale tend to move a loan toward non-recourse. That fits what a wholesale network sees every week.

Think of it as a spectrum:

  • Full recourse: a personal guarantee covers the whole balance.
  • Non-recourse with carve-outs: the lender looks to the real estate, and the guarantor answers only for specified bad acts.
  • Limited recourse: a partial guarantee, sometimes stepping down over time.

Pure non-recourse with no guarantor of any kind is not something to plan around.

What “Super Jumbo” and “Rental Pool” Mean Here

Neither term is an official category. Lenders set their own tiers, so the label matters less than the loan amount and the structure.

Super jumbo here means balances past the standard DSCR program’s $3,000,000 stopping point. Across our wholesale network, the portfolio investor program runs from $150,000 to $10,000,000, and leverage steps down as the balance grows. Above $4,000,000, every request is reviewed case by case before submission, purchase or rate-and-term only.

Rental pool has two meanings, and they behave very differently:

1. Several rentals under one loan. This is a blanket or portfolio DSCR loan: one note secured by several properties. The terms portfolio DSCR loan, blanket loan and cross-collateralized loan all describe this same thing.

2. A condo-hotel revenue pool. Owners of units in a resort-style building combine rental income and split it by formula.

The first is a financing structure. The second is an ownership program, and it changes who will lend at all.

Where Non-Recourse Exists in a Multi-Property Pool

Two structures cover pooled rentals in our network. Only one offers non-recourse.

Feature 30-year portfolio DSCR loan Rental portfolio term loan
Properties 2 to 20 under one note 5 or more properties or units
Loan size $300,000 to $5,000,000 (larger on review) $500,000 to $10,000,000 (larger on review)
Leverage Up to 80% purchase and rate-and-term Up to 75% of value
Term 30-year, fixed or adjustable 3, 5, 7 or 10-year fixed, with balloon
Recourse Personal guarantee Recourse or non-recourse, with carve-outs

All figures are program ceilings and floors through select wholesale programs, subject to underwriting. They are not quotes.

The term loan is where non-recourse lives. The tradeoffs are real. Terms are fixed for 3 to 10 years and end in a balloon, meaning a lump-sum balance due at maturity. Prepayment uses yield maintenance, a charge that compensates the lender for lost interest if you pay off early. Reserves are held for taxes, insurance and capital expenditures. The Corporate Finance Institute notes that non-recourse loans are harder to qualify for and carry higher costs than recourse loans. That matches what we see.

Small multifamily, meaning five or more units, is eligible only inside the rental portfolio term loan. It is not eligible on the 30-year structure or on a single-property DSCR loan.

What Carve-Outs Do to the Word “Non-Recourse”

A carve-out guaranty is signed in place of a full guaranty. It keeps you personally liable for specific bad acts. The Corporate Finance Institute says the bad boy carve-out is a clause attached to almost all non-recourse loans. Adventures in CRE adds that the original list of bad acts, such as theft or voluntary bankruptcy, has grown to include acts like not paying real estate taxes.

Typical trigger categories, in plain language:

Category What it looks like
Fraud or misrepresentation False statements in the loan file
Voluntary bankruptcy The borrower files on purpose
Entity violations Breaking special-purpose entity rules
Unauthorized transfer Moving the property without consent
Unpaid obligations Skipped taxes or liens on the property

The practical lesson: non-recourse can be conditional. A technical slip, like moving a property into a family trust without lender consent, can spring full personal liability. Read the guaranty before you sign it, and have counsel read it too.

How a Pool Gets Underwritten

Coverage is measured on the whole pool. Underwriting adds up the pooled rent and divides it by pooled debt service: principal, interest, taxes, insurance and association dues (PITIA). Stronger rentals can offset weaker ones. On the 30-year portfolio structure, the pooled floor is 1.00.

Run the numbers on a five-property pool. Four properties each cover their payment at roughly 1.25x. One covers at roughly 0.85x. The pool lands comfortably above 1.00. The weaker property can sit in the pool because underwriting tests the pooled coverage, the leverage and the terms. These ratios are modeled assumptions, not market data.

Two cautions. First, a passing ratio is not cash flow. Vacancy, repairs and management fees sit outside it. Second, every property still needs a lease or an appraiser-supported market rent. Single-family homes use the Form 1007 rent schedule, and two-to-four unit buildings use Form 1025.

Credit floors on the portfolio programs start at 640, and some structures want 680 or 720. Cash-out on a portfolio loan never exceeds 75% of pooled value. Inside the first six months of ownership, the loan is also capped at 90% of total cost (purchase price plus documented improvements). That rises to 100% of total cost from six to twelve months. The leverage ceiling still applies, and the loan is the lower of the two. A rate-and-term refinance is not subject to the cost-basis cap.

Entity and Collateral Mechanics

Pooling saves effort but costs flexibility. Four things deserve attention before you sign.

Cross-collateralization. Every property secures the whole note. Trouble on one can put the others at risk. That is the cost of the convenience.

Special-purpose entity. Some structures require one, typically an LLC. Entity documents are reviewed, and housekeeping mistakes can matter under a carve-out guaranty.

An LLC is not a shield. Holding title in an LLC does not make a loan non-recourse. On a guaranteed loan, the member who signs still answers personally. Entity vesting is welcome in the network, subject to program terms, but it is a title decision, not a liability decision.

Release terms. A release clause is a contract term, not a legal right. It sets how one property leaves the pool. Partial releases, substitutions and the sale of one property follow the loan documents. The release price runs above the property’s allocated balance, and the remaining pool must still cover its debt service.

For deeper detail on how the size tiers interact with structure, see Lendmire’s piece on how super jumbo non-recourse thresholds work by portfolio size and structure.

One more practical point. Manufactured homes, log homes and barndominiums fall outside these programs, so plan the pool without them.

The Condo-Hotel Pool Is a Different Question

A condo-hotel rental pool, as Even’s rental pool explainer describes it, merges rental income from every participating unit and pays owners by formula. The same guide notes that US securities guidance has long treated pooled rental income as something that can turn a condo purchase into an investment contract. That is a big reason many US programs use rotation instead.

Lenders see this too. A mandatory pool narrows the lender field. An optional management program usually needs only documentation. Condotel-style projects are often flagged as non-warrantable or restricted.

Within the program figures we work from, condotels run up to 75% on a purchase and 65% on a refinance, with a $1,500,000 cap and $250,000 cash-in-hand, subject to underwriting. That is a long way from a super jumbo non-recourse portfolio. A non-recourse super jumbo product built for pooled-revenue condo-hotel units should be treated as rare and case by case, never as something to assume.

Also note that an advertised 50/50 revenue split often nets the owner less after deductions taken before the split, per LegalClarity’s condotel explainer. Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

Which Structure Fits Which Investor

The stronger play depends on the portfolio, not the label. This is a genuine judgment call for many files.

Your situation Likely fit
2 to 4 rentals, want one note 30-year portfolio DSCR loan
5+ properties, want liability limited to the real estate Rental portfolio term loan, non-recourse with carve-outs
Mixed quality properties, may sell one soon Separate loans, or a pool with clear release terms
One super jumbo rental Single-property DSCR ladder, usually with a guaranty
Condo-hotel pooled units Case by case, narrow lender field

On a single high-balance rental, the leverage ladder matters. Through select wholesale programs, loans up to $1,000,000 can reach 80% on a purchase. From $1,000,000 to $3,000,000, leverage tops out at 75% on a purchase. From $3,000,000 to $4,000,000 it is 65%, then 60% from $4,000,000 to $10,000,000, with everything above $4,000,000 on review. Above $3,000,000, the overlay wants a 700 credit score, no rural property, and no more than ten acres on a non-rural one. Two appraisals are required above $2,000,000. Terms vary by lender guidelines, property type, leverage, credit profile, and full file review.

The files that move toward non-recourse at larger sizes are the ones with seasoned sponsors, clean entity structures, solid pooled coverage and moderate leverage. A thin track record usually keeps the guaranty in place.

Mistakes That Undo the Protection

  • Assuming a DSCR label means non-recourse.
  • Assuming an LLC or trust equals non-recourse.
  • Transferring a property for estate planning without lender consent.
  • Ignoring balloon and prepayment terms until the exit.
  • Pooling a property you plan to sell soon without negotiating the release.
  • Treating a short-term bridge product marketed as a portfolio loan as the same thing. It is underwritten differently.

Questions to Ask Before You Choose

  • Is the guaranty full, limited, or a carve-out guaranty?
  • Which acts trigger full liability?
  • How is pooled coverage tested, and how are weaker properties treated?
  • What does a partial release require?
  • What are the prepayment and balloon terms?
  • Does the structure require a special-purpose entity?

Frequently Asked Questions

Is a DSCR loan non-recourse?

Not automatically. DSCR is the qualification method, and most DSCR loans carry a personal guarantee. A non-recourse version exists on the rental portfolio term loan, with carve-outs, subject to underwriting.

Does an LLC make a DSCR loan non-recourse?

No. The LLC holds title, but a lender can still require a guaranty from one or more members. Whether a guaranty is required depends on the lender and the loan structure, not on the entity alone.

Can a rental pool be non-recourse?

A pool of five or more properties or units can be, on the rental portfolio term loan. It still carries bad boy carve-outs and balloon and prepayment terms. A condo-hotel revenue pool is rare and handled case by case.

Can a loan turn recourse after closing?

Generally the structure is set at closing. The exception is a carve-out trigger, where a breach such as an unauthorized transfer or voluntary bankruptcy can spring personal liability.

Does a higher balance make non-recourse easier to get?

Larger, portfolio-scale loans tend to be where non-recourse appears, but size alone is not enough. Sponsor experience, pooled coverage, leverage and entity structure all matter, subject to lender guidelines.
