How to Refinance Out of a Hard Money Loan in New Mexico

How to Refinance Out of a Hard Money Loan in New Mexico

The Quick Read: You apply for a long-term debt service coverage ratio (DSCR) loan whose proceeds pay off the short-term lender at closing, and the new lender’s appraisal, your time on title, the property’s rent coverage, and a maturity date that outlasts all of those steps decide whether the exit works. Planning the exit before the hard money loan closes keeps the clock on your side.

  • A DSCR cash-out refinance on a standard rental tops out around 75% LTV (loan-to-value), subject to lender guidelines.
  • A DSCR rate-and-term refinance on an investment property can reach up to 85% LTV, with no cash back at closing.
  • A DSCR cash-out refinance typically expects about 6 months of seasoning, measured from the date your deed is recorded.
  • A DSCR loan on a standard program generally starts at 1.00 coverage, and a separate select-lender path goes below 1.00 with leverage and terms adjusted.
  • The new lender sizes the loan on its own appraisal, not on the after-repair value you planned around.

What Does It Mean to Refinance Out of Hard Money?

A hard money exit refinance is a new long-term loan that repays a short-term, property-secured bridge loan. Hard money is built to be temporary. On the program Lendmire brokers, terms run 6 to 18 months, interest-only, with no prepayment penalty, and those terms vary by lender, property, and experience.

The bridge buys you time to buy, rehab, and lease the property. The refinance is the planned repayment source. If no takeout loan is lined up when the term ends, the balloon payoff becomes a problem you solve under pressure.

Many investors refinance out of hard money into long-term DSCR financing once the property is stabilized, and Lendmire arranges that path through select lenders in its wholesale network across 41 markets, including Washington, D.C. The hard money exit refinance program page covers that route in more detail.

DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage. The loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. For the full picture of how these loans work, see the complete DSCR loans guide.

How Does the New Lender Underwrite the Exit?

Underwriting follows a fixed sequence, and each step can stop the file. Nothing here is set by a government agency. Each DSCR lender sets its own seasoning, leverage, and cash-out rules, which is why a broker who sees many lenders’ guidelines can match a file to the right one.

Step 1: Get the real payoff. The payoff is not the original loan amount. It is principal drawn, accrued interest, any extension fees, and any exit fee. Ask your hard money lender for a written payoff statement with a valid-through date. Confirm the maturity date, extension terms, default provisions, and daily interest charges. The number grows the longer you wait.

Step 2: Decide the exit type. A payoff-only refinance covers the payoff and closing costs and nothing more. That is a rate-and-term refinance, and a DSCR rate-and-term loan on an investment property can run up to 85% LTV. If you take cash back at closing, the lender treats it as a cash-out refinance, and a DSCR cash-out loan on a standard rental tops out around 75% LTV. Lender policy draws that line, not federal law.

Step 3: Check the seasoning clock. Seasoning is the waiting period a lender wants between buying a property and refinancing it. On a DSCR cash-out refinance, the clock typically runs about 6 months from title recording. It does not start when the rehab ends. A payoff-only DSCR refinance often carries lighter seasoning, though it varies by lender. Inside the window, a lender may size the loan on your purchase price rather than the new value.

Step 4: Let the appraisal set value. The new lender orders its own appraisal and rent figure. Your after-repair value (ARV), the estimated value once the work is done, is a planning number, not an underwriting number. Appraisers typically use the 1007 rent schedule form and, on small multifamily, the 1025 form for small residential income properties.

Here is the break-even test. Take the payoff plus exit costs, then divide by the LTV cap. The result is the appraised value you need. Below that value, you bring cash to closing.

Step 5: Prove rent coverage. DSCR compares rent to PITIA, which is principal, interest, taxes, insurance, and any association dues. Test it on the new, larger loan, not your old bridge balance. Lenders want a signed lease and deposit documentation, and the asking rent in your listing is not the rent they use. A DSCR loan on a standard program generally starts at 1.00 coverage. Stronger ratios open better pricing and leverage. A separate select-lender path takes coverage below 1.00 with leverage and terms adjusted.

Step 6: Meet credit, reserves, and size rules. Across the wholesale network, a 620 credit floor exists in parts of the network, most DSCR programs want around 660, and 700+ unlocks the strongest leverage tiers. Reserves are commonly around 6 months of PITIA, stepping up to about 9 months above $1,500,000. Reserves vary by lender, leverage, and transaction type. Standard DSCR loans run up to $3,000,000.

Step 7: Close and release. The new lender pays off the old lender through title, and the old lien is released.

A word on what 1.00 coverage does not mean. Clearing it does not mean the property makes money. Repairs, vacancy, management, and utilities all sit outside the calculation.

Which Exit Fits Your Situation?

Hard money gives you several ways out. The right one depends on the property’s condition, your equity, and how much runway you have left.

Exit route Best when Main drawback
DSCR refinance Rented, stabilized, seasoned Needs rent, value, and seasoning to line up
Sale Equity is clear, hold plan is gone Ends the rental thesis
Extension Rehab or lease-up ran late Fees, and lenders may decline
New bridge loan Property is not yet rentable Another round of short-term costs
Conventional loan Borrower profile is strong Income documents, slower underwriting

Extensions are discretionary, not automatic. Treat one as a backup, not the plan.

Where the General Rule Breaks

Delayed financing rarely fits hard money. Conventional lending has a carve-out for cash buyers that waives the seasoning clock. It generally requires that purchase money was not secured by the subject property. A hard money loan is secured by the property, so most hard money buyers do not qualify. Even where it applies, it caps the new loan near your documented cost, which means you give up pulling out created equity.

The property is mid-rehab or unleased. Most DSCR lenders want a rentable property with supportable rent. If the work is unfinished or the unit can’t legally operate as intended, a DSCR refinance is premature. An extension, another bridge loan, or a sale may be the better move.

The appraisal comes in low. Say your payoff plus costs equal 88% of the appraised value. That sits above the 85% ceiling for a DSCR rate-and-term loan on an investment property. You can bring cash to closing, shrink the payoff, extend, or choose another exit.

You want cash out but have owned for three months. A two-step path exists. You do a payoff-only DSCR refinance now and a DSCR cash-out later. That means two sets of closing costs and two appraisals, and whether the first closing restarts the seasoning clock depends on the lender. The second step only pays off if the extra cash outweighs the second closing.

You miss maturity. The note typically triggers extension fees or default provisions. Extensions are the lender’s choice. A borrower who is already late has less leverage in that conversation than one who asks early.

The property type is ineligible. The network’s DSCR programs do not offer manufactured homes (single- and double-wide), log homes, or barndominiums. If your hard money collateral is one of those, a DSCR exit is not available, and you should plan a sale or another structure from the start.

What Are the New Mexico Wrinkles?

Two New Mexico facts affect how much pressure your maturity date carries and how you judge value.

First, foreclosure is a lawsuit in most cases. According to Nolo, most New Mexico foreclosures are judicial, and nonjudicial foreclosure is permitted only in limited circumstances and is rare. A separate Nolo summary of New Mexico’s foreclosure process describes a statutory redemption period of nine months, which the contract can shorten.

That slower process does not make a missed maturity safe. Which rules apply to a business-purpose hard money loan depends on the loan documents and the property type, so a real estate attorney should read yours.

Second, New Mexico is a non-disclosure state, so sale prices are not public record, as BatchData explains. Per the Santa Fe New Mexican, prices are available mainly through the multiple listing service (MLS).

The practical effect is simple. You can’t verify your ARV comps from public records the way you can elsewhere. The appraiser’s MLS-based comps decide value, which reinforces the rule that you underwrite to the lender’s appraisal, not your own.

What Does the Decision Look Like in Practice?

Picture an investor with a finished fourplex, signed leases, and a recorded deed well past the 6-month mark. Payoff plus costs sit at about 70% of the expected appraised value. A DSCR rate-and-term refinance clears easily on leverage, and a DSCR cash-out refinance, capped around 75% LTV on a standard rental, would leave only a thin slice of cash. The investor has to decide whether that sliver is worth the cash-out structure and its tighter limits. Every figure here varies by lender and program — guidelines, property type, leverage, and credit profile all apply.

Now take an investor whose rehab finished late. The bridge term is nearly spent, the lease is just signed, and the deed is only three months old. Here the choices narrow to an extension, a payoff-only DSCR refinance, or a sale. The investor who asked the hard money lender about extensions early has options. The one who waited has fewer.

Across the wholesale network Lendmire places files with, the exits that go smoothly share one trait. The borrower treated the maturity date as the end of a sequence, not a single event. That sequence covers rehab, lease-up, seasoning, appraisal, and underwriting. Build a cushion into the term, because one slipped step can push the next one past the deadline.

Equity is not a guaranteed cash figure either. Cash-out proceeds equal the new loan, less the payoff, less closing costs, less any reserves funded from proceeds. A larger down payment or stronger equity position can lower the payment and lift the DSCR. It never erases leverage caps, credit floors, reserve rules, or property eligibility. The strongest files clear both tests: enough equity and enough rental coverage.

Hard money works best as a bridge, not a hold. Closing twice costs two sets of fees and two appraisals, so the cleanest plan is one bridge and one exit. Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

Frequently Asked Questions

Can I refinance a hard money loan into a long-term DSCR loan if I just finished the rehab?

It depends on the type of refinance and how long you have owned the property. A DSCR cash-out refinance typically expects about 6 months from title recording. The property also needs to be rentable, with supportable rent and a lease or deposit documentation.

How much can I borrow on a DSCR refinance out of hard money?

On an investment property, a DSCR rate-and-term refinance can reach up to 85% LTV, and a DSCR cash-out refinance on a standard rental tops out around 75% LTV. Both are measured against the new lender’s appraised value, and both are subject to credit, reserves, and coverage. Final terms depend on lender guidelines, property type, leverage, and the borrower’s complete credit picture.

What if the appraisal comes in below my after-repair value?

Your options are to reduce the payoff, bring cash to closing, restructure, extend the hard money loan, or choose another exit. To see where you stand, divide the payoff plus exit costs by the LTV cap. If the appraised value falls below that number, you are short.

Does paying off hard money count as a cash-out refinance?

Only if you take cash back. A payoff that covers the old loan and closing costs is a rate-and-term refinance. When proceeds exceed the payoff and costs, the DSCR lender classifies the loan as cash-out, which carries the lower leverage cap and the seasoning expectation.

What happens if my hard money loan matures before I can refinance?

Missing maturity typically triggers extension fees or default provisions written into the note. Extensions are the lender’s choice, not a right. Talk to your hard money lender well before the deadline, and read your loan documents with an attorney if foreclosure risk is real.

If you are buying or refinancing a rental property and want to see how the numbers work, Lendmire can help you compare DSCR loan options based on the property income, credit profile, leverage, and investor goals.
