Can You Rent a Super Jumbo DSCR Home to a Family Member?

Can You Rent a Super Jumbo DSCR Home to a Family Member?

The Quick Read: It depends on which relative and which program. A relative who lives in your household makes the home owner-occupied, and that does not fit a DSCR loan. A relative in a separate household who pays market rent is a related-party lease, which some programs allow with extra proof and others bar outright. Super jumbo size does not change that occupancy rule. It does make every other part of the file stricter.

  • A relative in your household is an occupancy problem, and no lease fixes it.
  • A relative in a separate household is a gray zone, and treatment is program-specific.
  • Rent counts at the lower of the signed lease or the appraiser’s market rent.
  • Above $3,000,000 the coverage and credit requirements tighten, and the sub-1.00 path is not available at those sizes.
  • Disclose the family tenant before you pick a lender, not after.

Why Does a DSCR Loan Care Who the Tenant Is?

DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage. The loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. The borrower signs an occupancy affidavit, and that affidavit is the first document in the file. Everything after it gets checked against it.

Short-term rental figures are estimates only and vary significantly by season, property type, management approach, and local short-term-rental rules — confirm local regulations before relying on them. Qualifying income for short-term rentals varies by program — some use appraisal market rent, others use documented STR history or projections — and is confirmed in underwriting. Not a Loan Estimate, approval, or commitment to lend. Program availability and eligibility are subject to lender guidelines, credit approval, property review, and underwriting.

The restriction usually covers the borrower and family tied to the ownership. It does not reach an unrelated tenant. Across the wholesale network, the strictest overlays exclude related-party leases outright. Moderate overlays allow them with market rent and proof of payment. Occupancy-only programs bar only family who live in the property. Most investors learn this the hard way, so check the related-party rule before choosing a program. The rule lives in the program guidelines and the documents signed at closing. It is not a statute.

Lendmire’s explainer Renting to a Parent vs a Stranger on a DSCR Loan walks through the same split from the tenant side.

Living There vs. Renting to a Relative

The line is household. A relative who lives with you is occupancy. A relative in their own household, with their own lease and their own money, is a tenant. Lenders still look hard at the second case.

Scenario Typical treatment What the lender checks
Borrower lives there Not eligible Occupancy affidavit
Relative in borrower’s household Not eligible Household and occupancy
Relative, separate household, market rent Program-specific Lease, payment trail, disclosure
Relative, discounted rent Counts at the lower figure Lease vs. market rent
Relative’s business as master tenant Program-specific Arm’s-length look
Rent-free relative No rent to count Occupancy question
Unrelated tenant Standard Lease and market rent

An LLC does not change the first two rows. The occupancy statement and the guarantee still reach the members. A 2-4 unit building does not help either: if you live in one unit, the file does not fit a DSCR program.

How Do Lenders Treat a Family Tenant?

Think of it as a spectrum. At one end, strict programs exclude any related-party lease. In the middle, programs allow it if the rent is at market and the payments are documented. At the other end, programs only bar family who actually live in the property. A few lenders in the network sit at each point.

The practical consequence is that a family-tenant plan has to be disclosed up front. It should shape which program you choose. Investors who disclose late tend to find out the program they picked is the strict one.

One analogy helps explain the underwriting instinct. Federal foreclosure-tenant law treats a lease as bona fide only when the tenant is not the borrower or the borrower’s child, spouse, or parent, the lease is arm’s length, and the rent is not substantially below fair market. The OCC Comptroller’s Handbook on protecting tenants at foreclosure covers that test. It governs eviction rights after foreclosure, not DSCR underwriting. Its family list is narrow, and a lender’s definition of related is set by the program. Still, it shows why arm’s-length status and below-market rent draw questions.

How Does a Family Lease Change the Coverage Ratio?

A family lease changes the coverage number when the rent is below market. Programs count the smaller of the signed lease and the appraiser’s market rent. That is a program convention, not a law. Market rent comes from the appraiser’s rent schedule: Form 1007 for single-family and Form 1025 for 2-4 units.

Two results follow:

  • A discounted family lease lowers coverage.
  • An above-market lease adds nothing, because market rent is the cap.

Run it as a modeled comparison. Say a property clears about 1.2x on market rent. A family lease set well below market could pull the same file toward or under 1.00x. Coverage of 1.00 or higher earns full leverage on the ladder. A ratio of 0.75 to 0.99 is a real path through select programs to $2,000,000, but LTV and terms adjust, subject to underwriting. At that point the discount is no longer a family favor. It is a smaller loan or lower leverage.

Why Super Jumbo Size Makes This Harder

At large balances, rent does not scale with price. Coverage is what limits the loan, so a below-market lease hits harder. The appraiser’s rent figure carries as much weight as the sales value.

The network’s ladder, through select wholesale programs and subject to underwriting, steps leverage down as the loan grows. On a purchase of investment property:

Loan size Purchase LTV Cash-out LTV
$1M-$1.5M 75% 70%
$1.5M-$2M 75% 60%
$2M-$3M 75% 60%
$3M-$4M 65% —
$4M-$6M 60%, on review —
$6M-$10M 60%, on review —

Scores matter here too. The top cell at $1,000,000 to $1,500,000 needs 700 or better, and the top cells from $1,500,000 to $3,000,000 need 720 or better. Above $3,000,000 the floor is 700, with a 0x30x24 housing history, 48-month event seasoning, citizens and permanent residents only, and no rural property (and no more than ten acres on a non-rural one). Two appraisals apply above $2,000,000. Reserves run six months on the subject property, twelve for first-time investors, and cash-out proceeds never satisfy them. Above $4,000,000 every request is reviewed case by case before submission, purchase or rate-and-term only.

“Super jumbo” has no regulatory definition. It is an industry label, and each lender sets its own threshold. The standard program stops at $3,000,000 and the portfolio ladder carries qualified investors to $10,000,000.

Here is the catch for family leases. The sub-1.00 and no-ratio paths top out at $2,000,000. A super jumbo balance cannot lean on them. If the family lease drags coverage under 1.00, a file above that size has nowhere to go but a smaller loan or a different tenant.

Entities, Trusts, and Family Offices

Entity vesting is welcome, with no layered entities. A relative who is a member of the entity, or a guarantor, is inside the occupancy restriction. A relative who is only a beneficiary is a case the program has to rule on. Disclose the relationship and let the program answer.

For wealthy families holding property through an entity, the question is rarely “can the LLC avoid this?” It cannot. The better question is which program’s related-party language fits the family structure.

Documenting a Relative’s Lease

Documentation does not guarantee the rent counts as written. It gives the lender fewer gaps to review. A related-party package typically includes:

Document What it shows
Signed fixed-term lease Real tenancy, defined term
Payment history from tenant’s own funds Rent is actually paid
Security-deposit record Normal landlord practice
Written relationship disclosure Nothing hidden
Rent comparison to local listings Rent is at market

No lease overrides a product restriction. A market-rent lease and a clean ledger do not fix a program that bars family tenants.

Edge Cases That Derail Files

  • Life estate for a parent. The occupancy certification covers family, and a life estate gives the parent a right to live there. That usually means no arm’s-length lease and no usable rent.
  • Rent-free relative. No rent exists to count, and it becomes an occupancy question.
  • Vacant or rent-ready property. Market rent sets income. Leasing to a relative after closing is a loan-document and occupancy question, so read the covenants first.
  • Blanket or portfolio loans. One family lease can pull down pooled coverage. A house at 0.90x pooled with others at 1.20x lands near 1.14x. If a program excludes the family house, it drops out of the loan.
  • After closing. A relative who moves in or stops paying changes the facts the affidavit described. Treat that as a covenant issue, not a landlord issue.

If the Plan Is Really Family Occupancy

If a relative will live in a home you partly or fully control as their household, a DSCR loan is the wrong product. Say so early and move to a primary-residence or second-home product. Lendmire’s piece on jumbo versus super jumbo DSCR for a second home you rent out draws the line between a rental and a personal-use property. For the full product picture, see the complete DSCR loans guide.

Short-term rentals add another layer. They qualify on documented operating history at a discount to gross rent, and short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.

Key Terms Defined

DSCR: Monthly rent divided by the full monthly obligation, covering principal, interest, taxes, insurance, and association dues.

Related party: A tenant tied to the borrower or the ownership by family or business, as the program defines it.

Arm’s length: A lease negotiated as unrelated parties would, at market terms.

Market rent: The rent the appraiser’s schedule supports for the property.

Lower-of convention: The program practice of counting the smaller of the signed lease and market rent.

DSCR vs. conventional financing

There are two common ways to finance an investment property, and they qualify you differently — here’s how investors weigh them.

DSCR loan

Why investors choose it

  • Qualifies on the property’s rental income — no personal tax returns, W-2s, or pay stubs needed to document income.
  • No personal debt-to-income ceiling to clear, so existing mortgages and obligations don’t cap your borrowing the same way.
  • Can be closed in an LLC, keeping the property inside a business entity.
  • Built for scaling — not held to the limit on number of financed properties that conventional financing applies.
  • Underwriting centers on the deal: generally qualifies when the rent covers the payment, a 1.00x coverage ratio being a common baseline (confirmed in underwriting).
  • Designed specifically for investment property, including long-term and, where the program allows, short-term rentals.
Conventional loan

Where it’s strong

  • Often the lowest ongoing financing cost for a buyer who fully qualifies on personal income — a fit for a first property or a cost-first purchase.

Trade-offs for investors

  • Requires full personal income documentation and must fit within a debt-to-income limit — salary, existing debts, and other mortgages all count.
  • Typically held in your personal name rather than a business entity.
  • Caps how many financed properties you can carry, which can become a ceiling as a portfolio grows.
  • Evaluates you as a borrower as much as the property, which usually means more paperwork.

How investors usually choose: a first or single property often optimizes for the lowest financing cost; portfolio builders often optimize for leverage, vesting in an LLC, and scaling past conventional caps. The right answer depends on your goals, the property, and current guidelines — both paths run through select lenders in Lendmire’s wholesale network, with eligibility and terms confirmed in underwriting.

Pre-Application Checklist

1. Decide whether the relative lives in your household. If yes, stop and pick a different product.

2. Ask the program for its related-party rule in writing.

3. Get a market-rent opinion before setting the lease.

4. Set the lease at market, with a fixed term and deposit.

5. Build a payment trail from the tenant’s own account.

6. Disclose the relationship at the start.

Frequently Asked Questions

Can a family member be my tenant on a super jumbo DSCR loan?

Sometimes. A relative in a separate household paying market rent may be allowed under moderate programs, with a lease and payment proof. Strict programs exclude related-party leases entirely. Size does not change the rule, but it raises the stakes on coverage.

Does charging market rent fix the problem?

Only on programs that allow family tenants. Market rent and a clean ledger help where the program permits the lease. They do not override a product restriction.

What happens if the family lease is below market?

The file counts the lower of the lease or the appraiser’s market rent. Coverage drops, which can reduce the loan amount or the allowed leverage. Fixes include renewing at market, reducing the loan, placing an unrelated tenant, or choosing another loan type.

Does an LLC let a relative live there?

No. Occupancy limits typically reach the members and their families, so holding title in an entity does not remove them.

Can I use the sub-1.00 coverage path on a super jumbo loan?

Not above $2,000,000. Select programs offer coverage from 0.75 to 0.99 to that size at reduced leverage, and LTV and terms adjust, subject to underwriting. Larger balances need coverage of 1.00 or better.

Will the lender really check who the tenant is?

Yes, expect it. One lender replying in a BiggerPockets thread on renting to family at market rate disagreed with a broker’s claim that the tenant would not be asked about, and said lenders care who rents. Treat that as one anecdote, not a rule.
