Is There a Rescission Period on an Investor Cash-Out Refinance?

Is There a Rescission Period on an Investor Cash-Out Refinance?

The Quick Read: No, not on a true non-owner-occupied rental, because the federal three-business-day right to cancel only covers consumer loans secured by the borrower’s principal dwelling, and a business-purpose loan on a rental the borrower does not live in falls outside both limits. Funds disburse when the lender’s own closing and funding steps finish, with no mandatory cancellation wait built in. What matters on the file is that occupancy and business purpose are documented cleanly.

  • A non-owner-occupied rental is treated as business purpose, so the cancellation window does not apply.
  • An owner-occupied 1-4 unit cash-out is a different file and can keep the right.
  • Occupancy intent, not the property label, decides how the loan is classified.
  • Cash-out on a standard rental tops out around 75% LTV, with about 6 months of seasoning.
  • No cooling-off right means the diligence happens before you sign. Exact terms depend on the lender’s guidelines, property type, leverage, and a full review of the borrower’s file.

Investors who have done a refinance on their own home expect a three-day pause after signing. On a rental, that pause usually isn’t there. This piece walks through why, where the exceptions sit, and what to do with the missing safety net. DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage.

Why Investor Cash-Out Loans Usually Have No Cancellation Period

The cancellation right needs two things at once: consumer credit, and a security interest in the borrower’s principal dwelling. A rental fails the second test, and the loan purpose fails the first. Both are required, so missing either one ends the question.

The rule text, 12 CFR 1026.23, ties the right to a security interest in a consumer’s principal dwelling. A “consumer” is a natural person receiving consumer credit. Credit used to acquire, improve or maintain a non-owner-occupied rental is deemed business purpose, per the federal consumer-finance regulator’s official commentary on loan purpose. That holds regardless of the number of units.

So the classification happens first. The lender decides the loan is business purpose, and once it is, the cancellation rule never switches on. No factor test is needed for a plain rental.

Owner-Occupied Refinance vs. Investor Cash-Out: Side by Side

Factor Primary-home cash-out Investor cash-out (rental)
Right to cancel Three business days None under this rule
Loan purpose Consumer credit Business purpose
Funds disburse After window ends After lender funding steps
Occupancy paperwork Owner-occupancy certification Non-owner-occupancy certification
Standard consumer disclosure package Applies Generally not used
Who the rule protects Homeowner Not applicable

Two rows deserve a closer look. On the disclosure package: DSCR loans are business-purpose and exempt from the federal consumer-mortgage disclosure regime, so the consumer disclosure package that sets the owner-occupied timeline does not drive an investor closing. The investor relies on the note, the closing documents and the lender’s own disclosures. On who the rule protects: the cancellation right is built for homeowners borrowing against the home they live in, which is why it has no application to a rental held for business.

Where Cancellation Does Apply (and Why Investors Get Confused)

Most of the confusion comes from carrying habits over from a personal refinance. A cash-out on the home you live in keeps the three-business-day right, and the federal consumer-finance regulator’s consumer explainer describes it: a refinancing borrower has until midnight of the third business day to cancel. If notices or disclosures were missing or wrong, that right can stretch to three years.

Here is a quick reference for the common cases:

  • Primary-home refinance, consumer purpose: the right applies.
  • Rental you do not live in: it does not.
  • Business-purpose loan secured by your own home: the commentary says the loan’s purpose controls, so it is not rescindable even with a principal dwelling as collateral.
  • Purchase loans: not covered by the cancellation right.

Two misconceptions show up repeatedly. First, “every refinance gets a three-day window.” It doesn’t, because the rule follows the collateral and the purpose. Second, “if my house is the collateral, it’s always rescindable.” Also no. Purpose controls.

Edge Cases That Change the Answer

This is where files go sideways. The general answer holds for a rental the owner does not occupy. These cases break it.

House hacks and 2-4 unit owner-occupied properties. The commentary sets different tests for rental property the owner occupies or will occupy within the coming year. Credit to acquire is deemed business purpose only if the property has more than two units. Credit to improve or maintain is deemed business purpose only if it has more than four. Falling under those counts does not automatically make the loan consumer credit, but it removes the safe presumption. Since a dwelling covers one to four units, a cash-out on an owner-occupied 1-4 unit is not presumptively exempt.

The 14-day test. If the owner expects to occupy the property more than 14 days in the coming year, it cannot be treated as non-owner-occupied. A vacation-use rental the owner stays in for a month fails that test. The automatic business-purpose presumption goes with it.

Cross-collateralizing with your home. Adding a lien on a principal dwelling to an existing obligation can be rescindable, even when the original obligation was exempt. An investor who pledges a primary residence alongside a rental needs a purpose analysis before closing, not after.

Ambiguous purpose. When purpose isn’t obvious, the Federal Reserve’s Regulation Z guidance lists five factors, all evaluated together, with no single factor normally enough. They include occupation, personal management of the property, and income from the property relative to the borrower’s total income.

Entity borrowers. A rental held in an LLC fits the business-purpose frame naturally, though entity-title eligibility is subject to lender program requirements. The entity documents travel with the file, and the occupancy certification still has to match reality.

What an Investor Closing Looks Like Without a Window

No cancellation window means signing day and funding day sit closer together, driven by the lender’s own steps rather than a federal clock. For investors recycling equity into the next purchase, that helps. It also means the closing package carries more weight.

Think of the file in this order:

1. Occupancy and business-purpose certifications get signed with the loan documents.

2. Title clears and the lien position is confirmed.

3. The settlement statement is reconciled against the figures the lender approved.

4. The lender completes its own funding steps, and proceeds disburse.

Other steps can still sit between signing and funding, such as title requirements or lender conditions. Those are file mechanics, not a rescission period. Lendmire’s piece on the conventional cash-out refinance timeline with the rescission period shows the contrast on an owner-occupied file.

The Cash-Out Terms That Actually Drive the File

Since the cancellation question is settled, the real gating items are leverage and coverage. Across the wholesale network, cash-out on a standard rental tops out around 75% LTV on an investment property, with about 6 months of seasoning measured from title recording. Short-term-rental collateral sits lower, around 70% on a cash-out. Most programs want a credit score near 660, a 620 floor exists in parts of the network, and 700+ opens the strongest leverage tiers, all subject to lender guidelines.

On coverage, 1.00 is where many select programs start, comparing rent used for lender review to PITIA. A separate select-lender path goes below 1.00, with leverage and terms adjusted. Clearing 1.00 does not mean positive cash flow, since repairs, vacancy, management and capex sit outside the calculation. Reserves commonly run around 6 months of PITIA, and about 9 months on loans above $1,500,000. Loan sizes run up to $3,000,000 on standard programs. Manufactured homes, log homes and barndominiums are not offered.

Cash-out is not a guaranteed figure. It depends on rent used for lender review, PITIA, reserves and the 75% ceiling. The complete DSCR loans guide covers the full qualification picture.

What to Do When You Can’t Cancel

With no cooling-off right, the diligence moves earlier. This is a practitioner habit more than a rule. Files that treat signing as a final step, not a first review, tend to run cleaner.

  • Review the numbers before signing day. Compare the settlement figures with the approved terms line by line.
  • Confirm the prepayment structure. Know what an early payoff costs before the note is signed.
  • Check how proceeds will be used. Documented use of funds supports the business-purpose record.
  • Confirm title and lien position. Clearing title issues after funding is a worse place to be.

How to Confirm How Your Loan Is Classified

Ask the lender two things: how it classified the loan, and which certifications it requires. A borrower’s statement of purpose helps a lender decide whether a loan is business purpose, and a bare checked box with no documentation of how proceeds will be used may not be enough evidence. That is the basis for the business-purpose and occupancy certifications that investor files carry. The specific forms vary by program.

The risk of getting it wrong is real. A misrepresented occupancy intent could leave a loan classified as consumer credit with the required notices missing, and the extended right to rescind can reach up to three years in that case. Certify what is true. Lenders vary too, and some apply consumer-style practices voluntarily, so confirm with yours. State-level rules vary and should be checked separately.

Key Terms Defined

Right of rescission: the borrower’s right to cancel certain home-secured consumer loans by midnight of the third business day.

Principal dwelling: the home a borrower actually lives in, which can include a one-to-four unit building.

Business-purpose loan: credit used for a commercial or investment goal, such as acquiring or maintaining a rental.

Non-owner-occupied: a property the borrower does not live in and does not expect to use more than 14 days in the coming year.

Seasoning: the ownership period, measured from title recording, before cash-out is available.

DSCR: rent used for lender review compared with PITIA, used to gauge whether the property’s income covers its monthly obligation.

Frequently Asked Questions

Can I waive a rescission period on a rental refinance?

There is nothing to waive on a true non-owner-occupied rental, since the right never attaches. Waiver rules matter only on consumer-purpose, primary-residence loans.

Does an LLC change the answer?

Generally it supports the business-purpose classification, subject to lender program requirements. The occupancy and business-purpose certifications still have to be accurate, and the entity documents become part of the file.

What about a duplex I live in?

That is the edge case. Owner-occupied rental property follows different unit-count tests, and a cash-out on an owner-occupied 1-4 unit is not presumptively exempt. Treat it as a separate file and get the classification confirmed before closing.

Does no rescission mean no borrower protections?

No. It means no federal three-day rescission period. Other laws and lender disclosures can still apply, and state rules should be checked separately.

Is there any other waiting period before funds disburse?

Not a federal cancellation period. Title requirements, lender conditions and the lender’s own funding steps still apply, and those vary by file.
