Do Fintech Rental HELOC Lenders Allow LLC-Owned Condos?

Do Fintech Rental HELOC Lenders Allow LLC-Owned Condos?

The Quick Read: Usually no. A home equity line is built as a loan to a person, secured by property that person owns, so a condo deeded to an LLC fails the title check before credit or rent is ever reviewed. The fintech label changes the application experience, not the title rules.

  • Across Lendmire’s wholesale network, an investment-property line requires title in an individual’s name or an inter vivos revocable living trust.
  • LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title on these lines.
  • Condos are eligible, including non-warrantable ones, when title is personal. Condotels and co-ops are not offered.
  • Investment lines cap at 70% CLTV and $500,000 total, subject to lender guidelines.
  • A condo already in an LLC needs a vesting change or a DSCR cash-out refinance instead.

The rest of this piece covers why title is the first gate, what changes for condos, and which routes exist when an LLC owns the unit.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

What “Fintech HELOC” Actually Changes

An online application and automated valuation change how you apply. They do not change who is allowed to own the collateral. A fintech lender still sells or funds a consumer-style product built on one assumption: the borrower and the owner of record are the same person. The brokerage sees this across many lenders’ guidelines. When an LLC holds the deed, that match breaks.

One more point on valuation. Because an investment line caps at $500,000, it sits in the automated-valuation lane, and a traditional appraisal is commonly not ordered. That is convenient. It does nothing for the title problem.

Brokered through Lendmire’s wholesale network, these lines are available only in Lendmire’s 16 full-service states, which is narrower than its 41-market DSCR footprint (40 states plus Washington, D.C.).

Why Title Is the First Gate

Title comes first because everything else in the file hangs on it. The lender compares the recorded deed’s vesting to the applicant. If the LLC is the owner, the file stops there.

Underwriting is also personal. A HELOC file is judged on the borrower’s credit and debt-to-income, not on the property’s rent. An LLC has no personal credit history and no DTI of its own. A personal guarantee does not repair this. It helps only with commercial lenders that underwrite the entity itself.

Is this law? No. It is product design. Business-purpose credit is generally carved out of the federal consumer-credit rules. The CFPB’s Regulation Z page lists the exemption, and the Cornell Legal Information Institute text of 12 CFR 1026.3 also covers credit extended to someone other than a natural person. Nothing there bars an LLC-owned property from securing a line. A loan to an LLC is simply business credit, a different product from a consumer HELOC. That is why “LLC allowed” and “LLC not allowed” can both be true, depending on which product someone is describing.

What Changes When the Property Is a Condo

A condo adds paperwork, not a new ban. On the network’s investment lines, condominiums are eligible, including non-warrantable projects, as long as title is personal. Warrantability is an agency-standard label. These lenders use their own guidelines, so the label matters less than the file’s completeness.

For a personal-title condo line, expect to document:

  • The recorded vesting
  • The current mortgage statement
  • HOA dues, budget, and rental rules
  • A completed HOA questionnaire
  • Proof of insurance

HOA questionnaire completeness is where condo files stall. A questionnaire returned half-filled, or HOA financials that are out of date, leaves a gap the lender has to chase. Order both early.

Not offered: condotels and co-ops. If the building rents like a hotel, or the unit is a co-op share, this product is off the table.

Title Type and Likely Outlook

Title held by HELOC outlook Realistic route
Individual Eligible Standard investment line
Revocable living trust Eligible with trust papers Standard investment line
Irrevocable, blind, or land trust Not eligible DSCR cash-out
Single-member LLC Not eligible Retitle or DSCR cash-out
Multi-member LLC Not eligible DSCR cash-out

Subject to lender guidelines in every row.

Your Routes When an LLC Owns the Condo

Four routes exist. None is free.

Route Who borrows First mortgage Main catch
Retitle, then HELOC You personally Stays in place Gives up LLC liability separation
DSCR cash-out refinance The LLC Replaced New first-mortgage terms
Entity-level commercial line The LLC, with guarantee Stays Personal guarantee weakens the shield
HELOC on another property you own personally You personally Stays Adds personal debt; funds go to the LLC as a member contribution

Retitling. Moving the condo out of the LLC to get a line puts it in your personal name. That gives up liability separation on that unit. There is also a lending-side risk: transferring a mortgaged property can trigger the existing loan’s due-on-sale clause. Federal protection under the Garn-St Germain Act covers certain transfers to an inter vivos trust. It does not clearly extend to transfers into or out of an LLC, and rental property treatment is less certain still. Talk to an attorney before moving any deed.

DSCR cash-out. This is the route built for entity title. DSCR cash-out generally allows LLC vesting, subject to program terms. Qualification runs primarily on property-level rental income covering the payment, subject to lender guidelines. Across the network, cash-out tops out around 75% LTV on a standard rental, with about 6 months of seasoning as the common expectation. Pricing and available terms vary by lender, borrower profile, property type, and full underwriting review. Reserves commonly run around 6 months of PITIA, though they vary by lender, leverage, and loan size.

On a condo, the DSCR ratio is rent divided by principal, interest, taxes, insurance, and HOA dues. High dues can pull a unit below 1.00. Coverage of 1.00 is where many select programs start. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted. Clearing 1.00 is not the same as positive cash flow, because repairs, vacancy, management, and capex sit outside the calculation.

The entity file needs articles of organization, the operating agreement, the EIN letter, and a good-standing certificate. The HOA questionnaire, HOA financials, and master insurance come on top. The insurance policy generally has to name the LLC.

Entity-level lines. Some community banks and credit unions lend to LLCs, usually as commercial lines with a member’s personal guarantee. That weakens the liability shield you formed the LLC to get.

Borrowing against another property. A HELOC on a property you own personally can fund the LLC through a member contribution. An investor thread on BiggerPockets describes this approach. It is old commentary, so treat it as a concept rather than current guidance.

Which Route Fits?

Run the decision in this order.

1. Do you want to keep the first mortgage? If its terms are good, a line behind it preserves them. That points to a retitle or another personal property.

2. Do you want to keep the LLC on title? If yes, the line is off the table and DSCR cash-out is the path.

3. How much personal debt is already financed? HELOC underwriting counts personal DTI, so every financed property weighs on the file. A 50% maximum DTI applies, lower at weaker credit. DSCR sidesteps personal DTI.

4. How many properties and lines do you hold? A borrower is limited to three lines on the network, and owning more than 15 financed properties makes a borrower ineligible for this product.

Picture an investor with a condo in a single-member LLC, a first mortgage they like, and strong credit. Retitling and a line behind the mortgage keeps that loan, but the unit loses entity separation. The same investor who values the LLC more than the existing loan is better served by cash-out.

How to Verify a Lender’s LLC Position

Published guidelines are often silent on entities. Do not assume. Ask these, and get the answers in writing:

  • Who must be named on the recorded deed at closing?
  • Is an LLC, a revocable trust, or an LLC owned by a trust acceptable as vesting?
  • Does the product treat a personal guarantee as a substitute for title?
  • Are non-warrantable condos and HOA rental restrictions reviewed under your own guidelines?
  • Does the line count toward my personal DTI?

An email from a loan officer saying “we do LLCs” is not a guideline. Ask whether that answer applies to a consumer-style line or a commercial one.

Multi-condo owners should ask about per-borrower line limits up front, since the network caps a borrower at three lines.

Common Misconceptions

“A fintech label means looser entity rules.” It does not. The label changes the interface.

“Federal law bans LLC HELOCs.” It does not. The barrier is how the product is designed.

“A personal guarantee gets an LLC a standard HELOC.” It helps only with commercial lenders.

“Putting the loans in an LLC removes the debt from my DTI.” On a personal HELOC file, lenders can still count the mortgage payments against you.

“Retitling is always safe.” Due-on-sale risk exists, and the federal protections are narrow.

Frequently Asked Questions

Can a fintech lender give a HELOC to my LLC?

Not on the consumer-style lines the network brokers. Those require title in an individual’s name or a revocable living trust. Commercial lines to LLCs exist at some community banks and credit unions, usually with a personal guarantee.

Can I keep the condo in my LLC and still pull equity?

Yes, through a DSCR cash-out refinance, which generally allows LLC vesting subject to program terms. It replaces the existing first mortgage, and cash-out leverage tops out around 75% on a standard rental.

Are non-warrantable condos eligible for a rental HELOC?

Yes, when title is personal. Non-warrantable condos are eligible on the network’s investment lines, which cap at 70% CLTV and $500,000 total. Condotels and co-ops are not offered.

Does a personal guarantee fix the LLC title problem?

No. A guarantee helps only with entity-level commercial lenders. A consumer-style HELOC still compares the deed to the borrower.

Will moving my condo out of an LLC cause problems with my mortgage?

Yes, it can. A transfer may trigger the due-on-sale clause, and federal protection for transfers into an LLC is unclear. Get attorney advice and lender consent before recording a new deed.
