How to Get Gatlinburg STR Permits Before Your DSCR Cabin Loan Closes

How to Get Gatlinburg STR Permits Before Your DSCR Cabin Loan Closes

The Quick Read: Gatlinburg’s short-term rental permit is the Tourist Residency permit, issued by the city only after zoning and inspection checks, so you cannot assume nightly rental starts the day you close. Verify the parcel’s jurisdiction and zoning in writing before you commit, then line up the lender’s income method with what the city will actually allow.

  • Confirm the cabin sits inside city limits. A Gatlinburg mailing address can be county land.
  • Get zoning verified in writing by the city’s Building & Planning office.
  • Treat the seller’s permit as non-transferable until the city says otherwise in writing.
  • Build a zoning contingency into the contract.
  • Expect a lender to want rental income it can count, so legality drives the DSCR number.

A short-term rental loan is a DSCR loan underwritten on nightly-rental income instead of long-term rent. DSCR means debt service coverage ratio: the property’s rent divided by its full monthly payment of principal, interest, taxes, insurance and any HOA dues. If the cabin cannot lawfully be rented nightly, that income may not count. The coverage number can collapse, and so can the loan.

Qualifying income for short-term rentals varies by program — some use appraisal market rent, others use documented STR history or projections — and is confirmed in underwriting. Not a Loan Estimate, approval, or commitment to lend. Program availability and eligibility are subject to lender guidelines, credit approval, property review, and underwriting.

This guide walks the sequence start to finish. Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.

What Is the Gatlinburg Tourist Residency Permit?

The Tourist Residency (TR) permit is the city’s STR permit for properties inside Gatlinburg limits. The city’s Tourist Residency application sets the fee by bedroom count: a base amount for two bedrooms or fewer, plus an added charge per extra bedroom. Confirm current amounts with the city before you budget.

The form asks for bedroom count, stories, maximum occupants, gross square feet and the rental agent. It also has office-use blocks. The city planner records the zone. An inspector records a building-code inspection and an approve-or-deny decision.

Property-manager guides say the permit must be issued before the cabin operates as a rental and that it renews annually with a fire and safety inspection, per Haven Vacation Rentals. STR City Regs reports a limit of 89 days per stay with no annual night cap. Confirm that with the city too.

Is the Cabin Actually Inside City Limits?

Step one is jurisdiction. A parcel with a Gatlinburg address may sit in unincorporated Sevier County, which has its own regime. Properties inside Gatlinburg, Pigeon Forge or Sevierville follow that city’s ordinance, according to Haven Vacation Rentals’ county guide.

Outside city limits, a county short-term rental permit applies. A practitioner source says the county Fire Marshal’s Office administers it, per a Tennessee Realtor’s financing post. Ask the city and the county which one governs the parcel number, not the mailing address.

How Do You Check Zoning Before You Make an Offer?

Zoning is where deals die. The city’s own form tells the applicant to verify zoning with Building & Planning before submitting, as an earlier revision of the city application states.

Don’t rely on a third-party list of allowed districts. The guides disagree. The Short Term Shop reads the ordinance differently from several other guides and says some of them state the opposite. So skip the district lists and get the answer from the city.

Ask Building & Planning these questions, in this order:

1. What zone is this parcel, and is it inside city limits?

2. Does this zone allow a tourist residency with a permit?

3. Does the property hold a permit now?

4. If so, is it grandfathered through a sale, and will you confirm that in writing?

5. Is the parcel in a planned unit development with its own rental restrictions?

6. Can a buyer under contract apply or schedule an inspection before closing?

Question six matters most. Nothing published settles whether a buyer who does not yet own the property can apply. Get the city’s answer in writing, and never assume you can hold the permit at closing.

Will the Seller’s Permit Transfer?

Plan as if it won’t. One Realtor guide says the seller’s permit does not transfer and the buyer applies fresh, per that Realtor’s regulations post. Another source says transferability is not codified, according to GetChalet. Those two readings agree on the safe move: treat transfer as unconfirmed.

This matters for underwriting. A seller’s booking history shows what the cabin earned under the seller’s permit. It doesn’t prove you can keep earning it. Don’t underwrite income you may not be allowed to continue.

What the Inspection and Sprinkler Rules Mean

The city form includes an inspector block, where an inspector records the results of the property’s inspection.

The city form also flags larger cabins. A tourist residency with more than 3 stories, more than 5,000 gross square feet, or more than 12 occupants must have an approved sprinkler system. On a large cabin, that is a cost and timing risk to price in before you remove contingencies.

If the cabin fails inspection, you have four moves: renegotiate the price for the repairs, extend the contingency window, restructure the plan, or exit the contract. Which one makes sense depends on the cost of the fix and how much of the deal’s coverage rests on nightly income.

Business Licenses and Tax Accounts

The permit isn’t the only registration. The Short Term Shop lists a city business license, a county business license and a Tennessee Department of Revenue tax ID, plus lodging taxes charged to the guest.

Decide early which name goes on the permit, the licenses and the loan. If you buy through an LLC, subject to lender program eligibility, the entity name on the loan and the name on the permit application should be consistent. Settle that with your lender and title company before the application goes in.

Permit-to-Close Timeline: What Can Happen Before Closing

Here is the sequencing logic. The “pre-closing” column reflects what the published sources do and don’t confirm.

Stage Who acts Before closing? Risk
Jurisdiction check You, city, county Yes Wrong regime
Zoning verification City planner Yes Deal-killer
Existing permit question Building & Planning Yes False income
Permit application Buyer Unconfirmed Not yet owner
Fire/building inspection Inspector Unconfirmed Fails, repairs
Lender income review Lender, appraiser Yes Income not counted
Business and tax accounts Buyer Likely after Launch delay

Picture a buyer under contract on a cabin the city confirms is in a permitted zone. The buyer gets written zoning confirmation inside the due-diligence window. The lender orders its income review. The buyer asks the city whether an inspection can be scheduled early. If the answer is no, the buyer plans to apply right after closing and treats the first booking date as unknown.

Build slack into the contract around the closing date and the first booking. Don’t present any step’s duration as a city processing time. The city sets those, and the sources didn’t publish them.

How DSCR Underwriting Treats STR Income and Permit Status

Lenders in the network qualify short-term rentals on one of a few income methods: 12 months of platform history, a market projection such as AirDNA, an appraiser’s short-term rental analysis, or a long-term market rent fallback. A valuation firm argues that the standard rent schedule, Form 1007, can’t support STR income and that appraisers use a projected income analysis narrative instead, per Class Valuation.

Here is how the programs we place files with typically look for short-term rentals, subject to lender guidelines:

  • Purchase leverage up to 75% LTV on the strongest files.
  • Cash-out and refinance leverage up to 70% LTV on short-term-rental collateral.
  • A credit score of 640 or higher.
  • About 12 months of hosting or landlord history.
  • A 1.00 coverage floor on purchases and a 1.00 floor on refinances.
  • Loan sizes up to $3,000,000 on standard programs. Terms vary by lender guidelines, property type, leverage, credit profile, and full file review.

Those are guideline ranges, not promises. Coverage below 1.00 is available through select lenders in the network, with leverage and terms adjusted. A cabin that clears 1.00 on nightly income might fall short on long-term rent alone. That is why permit status matters so much: if nightly rental isn’t lawful, the fallback number is the one that counts.

Clearing 1.00 also isn’t the same as positive cash flow. DSCR compares rent to the full monthly payment only. Repairs, vacancy, management, utilities and capex sit outside it. Cabin owners know those costs well.

Not every cabin is reviewable. Manufactured homes, log homes and barndominiums aren’t offered through the network’s DSCR programs. If a mountain “cabin” is a log home, plan for a different path. Lendmire’s complete DSCR loans guide covers eligible property types and how the ratio is built.

What If Something Fails? A Short Decision Tree

Zoning fails. The city says nightly rental isn’t allowed. Exit under your zoning contingency, or reprice the deal around long-term or mid-term rental. Expect a much lower coverage number and possibly a smaller loan.

Zoning passes, inspection fails. Get a repair and sprinkler estimate. Renegotiate, extend, or walk.

Permit timing slips past closing. Decide in advance whether you can carry the property without nightly income. Lenders review reserves, which vary by lender, leverage and loan size and commonly run around 6 months of the payment. If the plan only works with immediate bookings, the plan is too thin.

Existing permit claimed. Don’t take the listing’s word for it. Ask the city.

Operating without a permit is the exposure to avoid. A buyer in the wrong zone cannot legally list the property, a point the Realtor’s regulations post makes plainly.

DSCR vs. conventional financing

There are two common ways to finance an investment property, and they qualify you differently — here’s how investors weigh them.

DSCR loan

Why investors choose it

  • Qualifies on the property’s rental income — no personal tax returns, W-2s, or pay stubs needed to document income.
  • No personal debt-to-income ceiling to clear, so existing mortgages and obligations don’t cap your borrowing the same way.
  • Can be closed in an LLC, keeping the property inside a business entity.
  • Built for scaling — not held to the limit on number of financed properties that conventional financing applies.
  • Underwriting centers on the deal: generally qualifies when the rent covers the payment, a 1.00x coverage ratio being a common baseline (confirmed in underwriting).
  • Designed specifically for investment property, including long-term and, where the program allows, short-term rentals.
Conventional loan

Where it’s strong

  • Often the lowest ongoing financing cost for a buyer who fully qualifies on personal income — a fit for a first property or a cost-first purchase.

Trade-offs for investors

  • Requires full personal income documentation and must fit within a debt-to-income limit — salary, existing debts, and other mortgages all count.
  • Typically held in your personal name rather than a business entity.
  • Caps how many financed properties you can carry, which can become a ceiling as a portfolio grows.
  • Evaluates you as a borrower as much as the property, which usually means more paperwork.

How investors usually choose: a first or single property often optimizes for the lowest financing cost; portfolio builders often optimize for leverage, vesting in an LLC, and scaling past conventional caps. The right answer depends on your goals, the property, and current guidelines — both paths run through select lenders in Lendmire’s wholesale network, with eligibility and terms confirmed in underwriting.

HOA, Covenants and PUDs

Private covenants can restrict rentals even where the city allows them, as GetChalet notes. The Short Term Shop also points to planned unit development wording that limits overnight rental in some residential districts. Pull the covenants and PUD documents during due diligence, not after.

After the Permit: Launch Order

Once the permit issues, register your tax accounts, confirm insurance fits nightly rental use, and publish the listing with the permit number. Then take bookings. Keep a log of each verification: who you spoke with, the date, and what they confirmed in writing. The sources conflict often enough that your own paper trail protects you.

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

If you plan to lean on interest-only structuring once the cabin is running, Lendmire’s piece How to Use Interest-Only on a Blanket STR Loan Before Reset covers that angle.

Key Terms Defined

Tourist Residency permit: Gatlinburg’s city permit that allows a property inside city limits to be rented nightly.

DSCR: the property’s rent divided by its full monthly payment, used to judge whether the income covers the loan.

LTV: loan-to-value, the loan balance as a percentage of the property’s value.

Seasoning: the waiting period a lender wants after a purchase before a cash-out refinance, commonly about 6 months.

Grandfathered permit: an existing permit that continues despite a rule change; whether one survives a sale is something the city must confirm.

PUD: a planned unit development, a neighborhood with its own rules that can restrict rentals.

Frequently Asked Questions

Can I get the Gatlinburg permit before my loan closes?

Not safely assumed. No published source settles whether a buyer under contract can apply or schedule an inspection. Ask Building & Planning directly and get the answer in writing. What you can finish before closing is the jurisdiction check, the zoning verification and the lender’s income review.

Does the seller’s permit come with the cabin?

Treat it as no. One Realtor guide says the buyer applies fresh, and another says transferability isn’t codified. Ask the city whether any existing permit is grandfathered through a sale, and get that confirmation in writing before relying on the seller’s history.

What if my cabin has a Gatlinburg address but sits outside city limits?

Then county rules may apply instead of the city’s. Sevier County has its own short-term rental permit for unincorporated parcels, reportedly administered through the Fire Marshal’s Office. Confirm by parcel number with both offices.

How does a missing permit affect my DSCR loan?

If nightly rental isn’t lawful, lenders may not count nightly income. The fallback is long-term market rent, which usually produces a lower coverage number and can reduce the loan amount. Select lenders in the network will review sub-1.00 coverage with leverage and terms adjusted.

What do short-term rental DSCR programs typically require?

Typically up to 75% LTV on a purchase, up to 70% on a short-term-rental cash-out or refinance, a 640 or higher credit score, and about 12 months of hosting history, with a 1.00 coverage floor, all subject to lender guidelines.
