How to Refinance Out of a Hard Money Loan in Maryland

How to Refinance Out of a Hard Money Loan in Maryland

The Quick Read: The exit works by replacing a short-term, asset-based bridge note with a long-term DSCR loan that pays the hard money lender off in full. That new loan has to clear two separate gates: ownership seasoning and rental coverage, both subject to lender guidelines and not a commitment to lend.

  • A payoff-only refinance generally reads as rate-and-term. Any cash back above payoff and closing costs makes it a cash-out refinance.
  • On a DSCR cash-out refinance, leverage tops out at 75% LTV on a standard rental, with about 6 months of seasoning from title recording.
  • A DSCR rate-and-term refinance has no cash back at closing and a higher ceiling, up to 85% LTV, subject to lender guidelines.
  • The new appraisal sizes the loan, not your after-repair projection.
  • Maryland adds closing mechanics: a lien release from the old lender and recordation tax on the new deed of trust.

Plan the exit before you close the bridge. The investors who struggle are the ones who start looking for permanent financing when the maturity date is already close.

What Does “Refinancing Out” Actually Mean?

Refinancing out means a new long-term loan pays off everything owed on the property: principal drawn, accrued interest, extension fees, and any exit fee. After closing, one mortgage replaces the bridge debt.

Hard money is built for the short run. Under Lendmire’s hard money program, terms run 6-18 months, interest-only, with no prepayment penalty, though all figures vary by lender, property, and experience. There are no multi-year options on that program. Investors who need longer runway move into rental financing. Many refinance into a DSCR loan once the property is stabilized, and Lendmire brokers that path through its hard money exit refinance program.

A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. That is why it suits investors with several properties or income that doesn’t show cleanly on a W-2. Lendmire’s complete DSCR loans guide covers the basics in more depth.

Key Terms Defined

  • Seasoning: the ownership period a lender wants before it will size a cash-out loan on appraised value instead of cost.
  • Rate-and-term refinance: a new loan that covers payoff, accrued interest, and closing costs, with no cash back.
  • Cash-out refinance: a new loan that returns cash above payoff and costs, so cash-out underwriting applies.
  • DSCR: monthly rent divided by the full monthly obligation (principal, interest, taxes, insurance, and HOA dues).
  • Exit fee: a charge some bridge lenders add at payoff, in addition to accrued interest.

How Does Underwriting Treat the Exit, Step by Step?

Underwriting runs as a sequence of gates, and clearing one does not clear the next. Here is how a file typically moves.

1. Work backward from the maturity date. The bridge term must outlast rehab, lease-up, seasoning, appraisal, and underwriting. Payoff grows with every month of delay, since interest and extension fees keep accruing.

2. Start the seasoning clock at title recording. The clock runs from the recorded deed. It does not run from rehab completion or from a tenant moving in. Seasoning is lender policy, not law, and it varies across a wholesale network. On a DSCR cash-out refinance, about 6 months from recording is the common expectation. Some lenders look at files inside that window; many size on cost instead.

3. The new appraisal sets the loan. Your after-repair projection doesn’t. The loan must at least equal the payoff plus exit costs, or you bring cash to closing. For rentals, appraisers typically use the 1007 rent schedule or the 1025 small residential income form, named here only as form types.

4. Rental coverage is a separate gate. The rent has to cover the new, larger obligation. 1.00 is where select programs start, and stronger ratios open better pricing and leverage. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted. Clearing 1.00 is also not the same as positive cash flow, because repairs, vacancy, management, and capex sit outside the calculation.

5. Credit and reserves. A 620 floor exists in parts of the network, most programs want around 660, and 700+ opens the strongest tiers. Reserves commonly run about 6 months of PITIA, stepping up to about 9 months above $1,500,000, and they vary by lender and transaction.

6. Documents. Gather the payoff letter, entity documents if an LLC holds title, the lease, rehab and draw history, reserve verification, and the title commitment.

Payoff-Only or Cash-Out: Which One Are You?

Paying off the bridge with a loan that covers only payoff, interest, and closing costs generally reads as rate-and-term. Cash back above that makes it a cash-out refinance, and the stricter test applies.

Factor Rate-and-term DSCR Cash-out DSCR
Cash back None at closing Yes, above payoff
Max LTV Up to 85% 75% on a standard rental
Seasoning Lender-dependent About 6 months from recording
Best fit Rehab done, equity not needed Seasoned, equity to redeploy

Short-term rental collateral works differently, with a 70% cash-out ceiling, about 12 months of hosting history, and a 640+ score. Select programs reach those figures, subject to lender guidelines.

Agency purchase-money rules do not govern DSCR files, and each DSCR lender sets its own seasoning policy. That cuts both ways. A lender with a shorter window can help you, but a stricter one can leave your created equity trapped until the clock runs out.

Where the General Rule Breaks

Inside the seasoning window. Many lenders size on cost, meaning price plus documented rehab. The equity you created is trapped. A two-step path is possible: payoff-only now, cash-out later. Each step carries its own closing costs and its own recordation-tax math. A single refinance after seasoning avoids the second closing but costs more bridge interest. This is a genuine toss-up, and the break-even depends on your monthly bridge carry versus two sets of closing costs.

Delayed financing. It waives only the clock, never coverage, reserves, appraisal, or leverage. It is narrow and generally doesn’t fit a hard money purchase, because the property itself secured the bridge loan.

LLC borrowers. Bridge lenders often require an LLC, which can complicate the exit. Entity eligibility varies by program, so confirm that your LLC structure fits the DSCR lender’s guidelines before the first closing. Moving title into or out of an entity mid-process can also disturb the seasoning clock.

Ineligible property types. Manufactured homes, log homes, and barndominiums are not offered through the network’s DSCR programs, so a hard money loan on one of those has no DSCR exit.

Low appraisal. If value lands under the break-even number, you bring cash or hold the bridge longer. That is why leaving room in the maturity window matters.

What Changes at the Maryland Closing Table?

Maryland adds a couple of items worth raising with your title company early: the lien release and recordation tax.

Lien release. Under Maryland Real Property § 7-106, a lienholder paid in satisfaction must furnish the original executed release on written request. If the bridge lender doesn’t deliver a recordable release, Real Property § 3-105.2 lets a licensed settlement agent, title insurer, or Maryland lawyer record a statutory release affidavit with the same effect. The practical takeaway: get the payoff letter early, and know that the law gives the settlement agent a backstop.

Recordation tax. Maryland charges recordation tax on instruments that create a security interest, such as a new deed of trust. Its separate state transfer tax applies to documents conveying title, not to mortgages. As The Daily Record’s Maryland tax guide explains, a refinance exemption covers amounts up to the unpaid principal of the mortgage being refinanced. A 2013 change extended it to rental properties, and a refinance affidavit is required. Cash-out above that principal is taxable. That makes the second step of a two-step exit carry a real tax cost. Whether accrued interest and fees rolled into the new loan count as exempt principal is a question for your title company, not an assumption.

County quirks. County practice varies. Prince George’s County’s finance affidavit instructions show the county transfer tax can reach security instruments, with exemptions claimed by affidavit. Its qualifications reference a principal residence, so ask title early how a rental is treated. Baltimore City adds a yield tax on transactions above $1,000,000.

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

What Does the Decision Look Like in Practice?

Picture an investor whose rehab is finished, whose tenant is in place, and whose bridge matures in a few months. Two questions decide the path.

  • Do you need cash out? If not, a payoff-only DSCR refinance sidesteps the seasoning question and the Maryland tax on new money.
  • Does the appraisal cover payoff plus costs? If so, you’re clear. If not, you need cash or an extension.

An investor who owns a property just past 6 months of recorded ownership, with rent comfortably covering the full obligation, is in the strongest position. Cash-out at up to 75% LTV on a standard rental, with reserves in order, is the usual target. An investor still inside the window should weigh a short extension against a two-step path. These specifics are subject to lender guidelines and a full review of property, leverage, and credit.

A word on honest limits. A DSCR loan can’t rescue a property that hasn’t been leased, appraised, or seasoned. If the numbers don’t work at any lender, selling may be the better exit. Larger down payments and equity can lift coverage, but they never erase leverage caps, credit floors, or reserve rules. The strongest files clear both tests: enough equity and enough rental coverage.

Frequently Asked Questions

When should I start the refinance process?

Before the bridge closes, if possible. Work backward from the maturity date and leave room for rehab, lease-up, appraisal, and a possible low valuation. Bridge interest and extension fees keep growing while you wait, so earlier planning protects your margin.

Does Maryland charge transfer tax on a refinance?

No. Transfer tax applies to conveyances of title, not to mortgages or deeds of trust. Recordation tax applies to the new deed of trust, with an exemption up to the old principal and an affidavit required. Confirm county treatment with your title company.

Can I take cash out when I pay off the hard money loan?

Yes, on a DSCR cash-out refinance. Leverage tops out at 75% LTV on a standard rental, with about 6 months of seasoning from title recording and reserves of around 6 months of PITIA. Cash above payoff and costs is also the taxable portion for Maryland recordation, and eligibility depends on lender guidelines.

What if I can’t refinance before the loan matures?

Ask the bridge lender about an extension, and weigh its cost against the alternatives, including selling. Run a parallel track with a DSCR broker so the paperwork is ready when seasoning and coverage clear. Qualification remains subject to lender guidelines and credit review.

Does strong rent shorten the seasoning period?

No. Coverage and seasoning are separate gates. Strong rent helps with the DSCR test and pricing, but a lender that sizes on cost inside its window will still do so.
