How to Refinance Out of a Hard Money Loan in Connecticut

How to Refinance Out of a Hard Money Loan in Connecticut

The Quick Read: You exit a hard money loan by closing a long-term rental loan, usually a DSCR loan sized on the property’s rent, that pays the bridge lender off at the closing table. A Connecticut attorney runs that closing. The exit works when appraised value, rent coverage, credit, reserves and seasoning all clear before the note matures.

  • A payoff-only refinance generally faces a lighter waiting period than a cash-out refinance. On the DSCR loan, cash-out typically wants about 6 months of ownership, counted from the recorded deed.
  • On an investment-property cash-out, the DSCR network tops out around 75% of appraised value. The new lender’s appraisal sets that value, not your projected after-repair value.
  • Rent must cover the new payment. A 1.00 coverage ratio is where many select DSCR programs start, and stronger ratios open better terms.
  • Connecticut requires a licensed attorney for closings that involve a lender’s title policy.
  • A missed maturity date costs more in a fully judicial foreclosure state, so you map the exit backward from the balloon date.

What Does Exiting Hard Money Actually Mean?

Exiting means swapping a short-term, interest-only bridge note for permanent financing. The new loan funds, the title or closing agent wires the payoff, and the hard money lien is released. Nothing about the property changes. The debt on it does.

A hard money loan is a short-term, asset-based loan from a private or non-bank lender. It is sized on the property, the plan and the exit, not on your traditional personal-income documentation. On the current hard money program Lendmire brokers, terms run 6 to 18 months, interest-only, with no prepayment penalty. Terms vary by lender, property, and experience.

The short runway is the whole point. Hard money buys you the ability to close on a distressed or unfinished property. It does not buy you time to sit still. Most investors plan the exit before they sign the bridge note, and many refinance into long-term DSCR financing once the property is stabilized, which Lendmire arranges through its hard money exit refinance path.

A DSCR loan is a business-purpose investor loan that qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Lendmire’s complete DSCR loans guide covers the basics if the term is new to you.

How Does the New Lender Underwrite the Exit?

The new lender checks five things: the appraisal, the rent, your credit, your reserves, and how long you have owned the property. Your hard money payoff is just the amount the new loan has to cover. Here is the order those checks usually run in.

1. Map the clocks. Line up the hard money maturity date against the seasoning rule, the rehab schedule, lease-up, the appraisal and underwriting. Work backward from the balloon date and leave cushion. Nothing on that list moves because your note is about to mature.

2. Pick the exit type. A pure payoff retires the bridge debt and returns no cash. Anything above the payoff, accrued interest and closing costs is cash-out.

3. Appraisal sets value. The new lender orders its own appraisal. Your after-repair value was a projection. The appraisal is the number the loan is sized against.

4. Rent sets coverage. The lender divides qualifying monthly rent by PITIA, which is principal, interest, taxes, insurance and any association dues. That is the DSCR. It is a rent-versus-payment test, nothing more.

5. Credit and reserves. A 620 floor exists in parts of the wholesale network. Most programs want around 660, and 700 and above unlocks the strongest leverage tiers. Reserves commonly run about 6 months of PITIA, stepping up to about 9 months on loans above $1,500,000. Conservative payoff-only files at modest leverage can see reserves waived. It varies by lender, leverage, loan size and transaction type.

Here is the catch most first-time investors miss. Clearing 1.00 does not mean the property cash flows. Repairs, vacancy, management, utilities and capital expenses all sit outside the DSCR calculation. Run your own operating numbers separately.

The documents you will gather are predictable:

  • the purchase settlement statement
  • the hard money note and draw history
  • rehab invoices
  • the lease and rent schedule
  • bank statements showing reserves
  • entity documents if an LLC holds title
  • a payoff statement with lien-release language

An LLC can often hold title on a DSCR loan, subject to lender program eligibility. Banks and credit unions are often less open to lending to an entity, and that gap is one reason investors move to DSCR products.

Payoff-Only or Cash-Out? Seasoning Decides

A payoff-only refinance is usually the easier exit, and a cash-out refinance is where the waiting period bites. Seasoning is lender policy, not law. It is the waiting period a lender wants between buying a property and refinancing it, and each program sets its own.

Factor Payoff-only Cash-out
Cash back at closing None Yes, above payoff and costs
Waiting period Generally lighter; varies by lender About 6 months from recorded deed
Leverage ceiling Up to 85% (no cash back) Around 75% of appraised value
Best fit Retiring the bridge, nothing more Recycling capital into the next deal

Those ceilings describe DSCR programs on investment property, subject to lender guidelines. Your hard money loan was sized differently. Hard money is often tiered on project cost and capped against after-repair value, while the DSCR loan is sized on what the property appraises for today. That difference is why a bridge that felt modest can look heavy against a conservative appraisal.

Seasoning runs from the recorded deed, not from finishing the rehab or signing the first lease. Completing work does not restart or shorten the clock. A cash-out request before the clock clears is a common reason a hard money exit stalls.

Two other rules of thumb help. A payoff-only refinance can leave you with a larger loan than you want to carry, which lowers coverage. And a payoff-only exit now followed by a cash-out later means two closings.

The Connecticut Closing Layer

Connecticut changes the mechanics of closing, not the underwriting. The state requires a licensed Connecticut attorney to run any closing that involves a mortgage loan and lender’s title insurance. Alston & Bird explains that the statute defines a real estate closing as a mortgage loan transaction secured by Connecticut real property. It carves out home equity lines and loans that do not involve a lender’s title policy.

A title insurance agent has to be a practicing attorney, with a narrow exception for agents licensed long ago. Any closing involving title insurance therefore needs an attorney.

A refinance lender will require a lender’s title policy. In practice that means your closing attorney does the following:

  • runs a title search on the land records
  • runs a bring-down search just before funding, to confirm no new liens such as tax warrants or contractor liens attached since you bought
  • coordinates the payoff and discharge of the old mortgage
  • records the new mortgage with the town land records office

A bring-down search is a final, narrow title check at the end of the process. Contractor liens from a rehab are the usual surprise it catches, so collect lien waivers as the work finishes.

Each closing carries attorney and title costs. A two-step exit, payoff now and cash-out later, pays them twice. The second step has to justify itself.

Where the General Rule Breaks

The rules above hold for most files, and these are the places they bend.

Delayed financing is an agency exception, not a DSCR feature. It lets a cash buyer refinance right away and recover documented cost. It is generally unavailable when the subject property secured the purchase loan, which describes most hard money deals. It also recovers cost, not created equity. DSCR lenders set their own seasoning, so do not plan around it.

Maturity arrives before seasoning clears. The note’s maturity date does not move for you. Your realistic options are an extension from the bridge lender, a payoff-only exit, or a longer initial term next time. Ask early. Lenders extend more readily when you show a refinance in motion.

The appraisal comes in low. The loan may not cover the payoff plus costs, and you bring cash to closing.

Rent falls short. If the property has not leased up or rent is thin against the new payment, coverage fails regardless of equity. Strong files clear both tests: enough equity and enough rental coverage. A larger down payment or paydown lowers the payment and can lift coverage, but it never erases leverage caps, credit floors, reserve rules or property eligibility.

The property type is not eligible. Manufactured homes (single- and double-wide), log homes and barndominiums are not offered in the network’s DSCR programs. A rehab on one of those cannot exit into a DSCR loan, so confirm eligibility before you buy.

Licensing questions. Connecticut licenses people who make or broker residential mortgage loans, and the Department of Banking publishes who does not need a license. DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage. Confirm the classification of your specific loan with Connecticut counsel.

What Happens If You Miss the Maturity Date?

Connecticut makes the exit deadline matter more than it does in many states. Foreclosure here is fully judicial, meaning it runs through the courts, as Barclay Damon describes it. The court orders a foreclosure by sale if it finds enough equity. Otherwise it defaults to strict foreclosure.

Strict foreclosure is the harsher version. The court sets law days, and you must pay the debt in full on the assigned day or lose your interest in the property. Connecticut also allows deficiency judgments, which means the lender can pursue you for a shortfall. Nolo gives a plain overview of both paths.

This is not a prediction, and a lender who sees a refinance in progress usually prefers talking to suing. But the practical lesson is simple. Title can transfer on a court-set date, so a failed exit is costly. Build the exit plan with cushion before the bridge note ever funds.

How Do You Decide in Practice?

Choose the exit by asking which test is likely to fail first. If equity is the weak point, size the payoff-only route and keep coverage honest. If seasoning is the weak point, negotiate an extension rather than forcing a cash-out request that will be declined.

Brokers who place many files see a pattern. Investors who plan the exit when they sign the bridge note tend to get a smooth refinance. Investors who start hunting for a lender as the maturity approaches tend to end up with worse terms or a scramble for an extension. Across the wholesale network Lendmire places files with, programs differ on seasoning, reserves and how they treat recent rehabs, so comparing several lenders before the clock runs short is worth the effort.

Once you are in the DSCR loan, the spine of the network is the 30-year fixed. Extended terms such as 40-year and interest-only periods are available through select lenders, and ARM structures exist for investors who want them. Standard programs run up to $3,000,000, and above $2,500,000 the network generally holds to 30-year fixed structures. Hard money balances can run larger than that, so a very large bridge may not fit a standard exit.

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

Key Terms Defined

Hard money loan: a short-term, interest-only loan secured by the property and sized on the asset and the plan.

Seasoning: the waiting period a lender wants between buying a property and refinancing it, counted from the recorded deed.

Payoff-only refinance: a new loan that retires the old one and returns no cash. Lenders also call it a rate-and-term refinance.

Cash-out refinance: a new loan larger than the payoff, returning the difference to you after costs.

DSCR: debt service coverage ratio, the rent used for lender review divided by PITIA.

PITIA: principal, interest, taxes, insurance and association dues, the full monthly obligation the rent has to cover.

After-repair value (ARV): your projection of what the property is worth once the work is done. The appraisal, not your ARV, sets the new loan.

Law day: the date a Connecticut court sets in a strict foreclosure by which you must pay the debt in full or lose the property.

Frequently Asked Questions

Can I refinance before the hard money term ends?

Generally yes. The current hard money program Lendmire brokers carries no prepayment penalty, though that varies by lender, property, and experience, so check your own note. The real gate is the new lender’s seasoning rule, which matters most if you want cash back. A payoff-only refinance faces a lighter waiting period than a cash-out.

Do I need to finish the rehab before I refinance?

In most cases, yes. A DSCR loan is a rental loan, so lenders want a completed, rent-ready property with a lease or rent schedule. A half-finished rehab usually cannot support the appraisal or the coverage ratio. If the rehab is stalled, an extension on the bridge is typically the better first call.

Can my LLC take the new loan?

Often yes, subject to lender program eligibility. Entity documents are part of the file, and the principals’ credit is still reviewed. Some banks and credit unions decline entity borrowers, which is one reason investors move toward DSCR programs.

What if the appraisal comes in low?

A low appraisal shrinks the loan the ceiling allows. If the payoff plus costs no longer fits, you bring cash to closing, drop the cash-out portion, or pause and renegotiate the bridge term. Coverage must still clear on the final loan size.

What happens if I miss the maturity date?

Contact the bridge lender before it arrives and ask for an extension. The terms depend on your note. If the debt goes unpaid, Connecticut’s judicial foreclosure process applies, and strict foreclosure can end with a court-set law day.
