How to Refinance Out of a Hard Money Loan in Montana

How to Refinance Out of a Hard Money Loan in Montana

The Quick Read: A refinance out of hard money works by closing a new long-term loan, usually a DSCR loan on a stabilized rental, whose proceeds pay off the old lien, so the new lender’s appraisal, rent figure, and seasoning rules decide what you can borrow. DSCR stands for debt service coverage ratio, which compares the property’s rent to its full monthly housing payment. Montana law shapes the lien-release paperwork. It does not change who qualifies.

  • Decide first whether the exit is payoff-only or cash-out, because the label sets your leverage and your waiting period.
  • The new lender uses its own appraisal and its own rent number, not your after-repair estimate.
  • On a DSCR cash-out refinance of an investment property, leverage tops out at 75% LTV, with about 6 months of seasoning from title recording.
  • Clearing a 1.00 coverage ratio does not mean the property cash flows.
  • After payoff, confirm that the old lien was actually released on the record. The exact numbers vary by lender and program and follow a full review of property, leverage, and credit.

What an Exit Refinance Actually Is

A hard money loan is short-term, interest-only money secured by the property. On the current hard money program, terms run 6 to 18 months with no prepayment penalty. Loan sizes vary by lender, property, and experience. The DSCR loan that pays it off runs up to $3,000,000 on standard programs, subject to lender guidelines.

The exit is not a conversion of that loan. It is a second, separate loan. A DSCR lender looks at the finished or stabilized property and decides what it will lend against it. Your hard money lender is simply repaid out of those proceeds.

Many investors refinance out of hard money into long-term DSCR financing once the property is stabilized. Lendmire brokers that path through its hard money exit refinance program, working with select lenders in its wholesale network. Lendmire’s complete DSCR loans guide covers the long-term product in full.

How the Exit Is Underwritten, Step by Step

1. Classify the exit. A payoff-only refinance covers the old balance and closing costs with no cash back. The moment proceeds exceed that, it becomes cash-out. A DSCR rate-and-term refinance of an investment property can go up to 85% LTV, subject to lender guidelines. A DSCR cash-out refinance of an investment property caps at 75% LTV. Across the network, those two limits are a common reason the label matters.

2. Request the payoff statement early. The payoff is more than the money you drew. It includes accrued interest, extension fees, exit fees, and any minimum-interest clause. The current hard money program carries no prepayment penalty, but older notes and lenders’ notes vary. Read your note. The number also grows each day, so get it before you set a closing date.

3. Order the new appraisal. The DSCR lender sizes the loan on its own appraised value. Your after-repair value (ARV, the value you projected after the rehab) is a plan, not a number the lender must accept. The break-even is simple: payoff plus exit costs, divided by the leverage cap, is the minimum appraisal you need.

4. Run the rent test. Coverage equals monthly rent divided by the full payment: principal, interest, taxes, insurance, and any HOA dues. The exit loan is usually larger than the bridge was, so coverage thins. Many select DSCR programs start at 1.00, and stronger ratios open better pricing and leverage. A separate select-lender path takes coverage below 1.00, with leverage and terms adjusted.

5. Build the file. Expect the purchase closing statement, rehab draw history or receipts, the lease, entity documents, insurance, and the payoff letter. The closing statement matters most. If the purchase price and the construction funding do not show up on it, the seasoning clock gets harder to prove.

6. Check credit and reserves. A 620 score is the floor in parts of the network, most programs want around 660, and 700 or higher unlocks the strongest leverage. A DSCR loan typically asks for about 6 months of PITIA in reserves, stepping up to about 9 months above $1,500,000. PITIA is principal, interest, taxes, insurance, and association dues. Standard DSCR programs run up to $3,000,000, subject to lender guidelines.

7. Close and release. The title company collects the payoff statement, and the new lender wires that amount to the old lender directly. You never handle the payoff money.

A Worked Example in Percentages

These inputs are modeled assumptions, not market data. Say the payoff plus exit costs equal 70% of what the new lender’s appraisal comes in at. A DSCR rate-and-term refinance of an investment property, with an 85% ceiling, fits that with room to spare. A cash-out refinance at the 75% ceiling leaves only a thin slice above the payoff.

Now say the appraisal comes in lower and payoff plus costs equal 80% of value. A DSCR cash-out refinance cannot cover it. A rate-and-term loan at that leverage might, though a lender reviews the file on its own terms. Either way, you either bring cash to close or the loan shrinks.

The rent side works the same way. If rent clears the full payment by a modest margin, coverage lands in low-1.2 territory, which is workable. If the bigger permanent loan pulls coverage near 1.00, pricing and leverage tighten. That is why you test coverage before the bridge matures, not after.

Your Exit Options Side by Side

Path Fits when Main hurdle
DSCR payoff-only refinance Rehab done, rent in place Appraisal must cover payoff plus costs
DSCR cash-out refinance You want capital for the next deal 75% LTV cap, about 6 months seasoning
Extension from current lender Seasoning not finished yet More fees, same cost clock
Two-step: payoff now, cash-out later Bridge matures early Two closings, two appraisals
Sale Numbers fail on any refinance Gives up the rental

Where the General Rule Breaks

Seasoning is a lender rule, not a law. The network expects about 6 months from title recording on a cash-out. Finishing the rehab or moving a tenant in does not start that clock. A payoff-only exit often carries a lighter clock, though each program sets its own.

If the bridge matures before seasoning ends, you have two moves. You can do a payoff-only exit sized to your cost basis, or pay for an extension. An extension costs more, but it keeps you from a forced sale.

Delayed financing rarely fits. That exception is built for cash purchases and waives only the waiting period. A hard money purchase is financed and secured by a lien on the same property, so it was not a cash purchase and does not qualify. The exception also recovers documented cost, not ARV.

Other debt in the payoff turns it into cash-out. If you want proceeds to clear rehab credit cards, the lender generally treats the file as cash-out, with the 75% cap and the seasoning that go with it.

The borrower entity has to fit the exit lender. If the bridge sits in an LLC, confirm the DSCR program accepts it before you close the exit. Many investors use a single-member LLC, subject to program eligibility.

Property type can end the conversation. The network does not offer DSCR financing on manufactured homes, whether single- or double-wide, on log homes, or on barndominiums. That matters in a state where log construction is common, so confirm the type before you start the rehab.

Owner-occupied properties are a different product. DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage. The CFPB’s Regulation Z, Section 1026.3 sets the business-purpose exemption. It turns on the purpose of the loan, not on whether the building is a rental, and it also addresses business credit later replaced by consumer-purpose debt. If any part of the property is your home, the exit follows different rules.

Closing in Montana: Getting the Lien Released

Montana is a deeds-of-trust state, which affects paperwork only. The refinance logic is identical to any other state. Once the payoff lands, the trustee reconveys the property, releasing the old lien, typically on the written request of the beneficiary or servicer.

When the beneficiary does not act, a title insurer can sometimes step in. An older version of the title-insurer reconveyance statute, MCA 71-1-308, describes a certified-mail notice of intent and a 90-day window for the beneficiary to object. That is the 2011 text, so check the current statute before you rely on the 90-day figure.

The practical rule is simple: do not assume the lien vanished at payoff. Ask the title company to confirm the reconveyance or release was recorded, and keep a copy. An open lien on the record can surface at your next sale or refinance.

Key Terms Defined

Seasoning: the waiting period a lender wants between buying a property and a cash-out refinance, counted here from title recording.

Payoff-only refinance: a refinance that repays the old balance and closing costs and returns no cash.

Payoff statement: the lender’s written figure for what clears the loan on a given date, including interest and fees.

Reconveyance: the recorded document in a deed-of-trust state that releases the lien after payoff.

LTV: loan-to-value, the loan amount as a percentage of appraised value.

The Decision in Practice

Pick the exit lender before the bridge closes, and size the bridge so the exit loan can repay it plus costs. Walk backward from maturity. Test coverage, test the appraisal, and decide whether you need cash out or only a clean payoff.

Keep one limit in mind. Clearing 1.00 coverage means rent covers the payment. It does not mean the property earns money, because repairs, vacancy, management, utilities, and capital spending sit outside the calculation. A bigger permanent loan also thins monthly cash flow. A larger down payment or smaller loan can lift coverage, but it never erases leverage caps, credit floors, reserve rules, or property eligibility. The strongest files clear both tests: enough equity and enough rent.

If the numbers fail, the honest answer may be an extension or a sale. Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction. Frequently Asked Questions

How long do I have to wait before I can refinance?

On a DSCR cash-out refinance, about 6 months of seasoning from title recording is the common expectation across the network. A payoff-only exit often has a lighter clock. Every program sets its own rule, and nothing in law fixes a number.

Does the new lender use my after-repair value?

No. The DSCR lender orders its own appraisal and uses its own rent figure. Your ARV is useful for planning, but the appraised value sets the loan.

What if my loan matures before I am seasoned?

You can ask for an extension, do a payoff-only exit sized to cost, or pay off now and cash out later. Each path adds cost, so start the conversation well before maturity.

Does an LLC change anything?

It can, because the entity must match what the exit lender accepts, subject to program eligibility. Clear the structure with the lender before you close the bridge so you avoid re-vesting title late.

What if the appraisal comes in short?

You bring cash to closing, or the loan amount shrinks. A DSCR cash-out refinance of an investment property stops at 75% LTV, so a short appraisal hits cash-out files first. Final terms depend on the lender’s guidelines, the property type, and the borrower’s complete credit picture.
