Can a Partnership LLC Get a Portfolio DSCR Loan on Short-Term Rentals?

Can a Partnership LLC Get a Portfolio DSCR Loan on Short-Term Rentals?

The Quick Read: Usually yes, when the partnership is organized as a multi-member LLC that holds title, subject to lender guidelines. The owners are typically asked to sign a personal guarantee on the recourse structures, and the pool qualifies primarily on property-level rental income covering the combined payment. Short-term-rental (STR) income evidence and local STR permission decide how much the pool can support.

  • A portfolio DSCR loan is one note secured by several rentals. Lenders may also call it a blanket loan or a cross-collateralized loan.
  • On the 30-year portfolio DSCR loan, coverage is tested on the whole pool, so stronger properties can offset weaker ones.
  • The partnership’s operating agreement, signing authority and guarantor credit are reviewed alongside the properties.
  • Every STR needs documented income and documented permission to operate, property by property.

What Does “Partnership” Mean to a Lender?

In practice, a partnership borrower is almost always a multi-member LLC, including an LLC taxed as a partnership. Lenders lend to an entity that holds title and sign the note in that exact legal name. A true general or limited partnership is reviewed more slowly and fits fewer programs.

Here is how the three common forms compare on a typical file. Eligibility varies by program.

Structure Typical fit Who signs Documents
Multi-member LLC Most common Authorized members, guarantors Articles, operating agreement, good standing
General partnership Fewer programs Partners with authority Partnership agreement, authority proof
Limited partnership Fewer programs General partner, guarantors Agreement, certificate, authority proof

A special-purpose entity, typically an LLC that holds only rental real estate, is required on some structures. An LLC that also runs an operating business draws more review. Layered ownership, where one entity owns another, means the lender looks through to the individuals at the top. That adds documents and narrows the field of programs.

Programs are built for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage. That is the structural reason an entity can borrow at all. The CFPB’s text of § 1026.3 exempts business-purpose credit and credit extended to someone other than a natural person from the consumer-credit rules. Its commentary says the exemption holds even when a natural person guarantees the credit. That explains why a personal guarantee does not change the loan’s character. It does not mean any given lender must accept a partnership. That is a program-guideline question.

How Does a Portfolio DSCR Loan Work on Short-Term Rentals?

The network has two portfolio structures, and an STR partnership should know which one it is shopping. Both put several rentals under one note. Both are reviewed subject to lender guidelines.

The 30-year portfolio DSCR loan covers 2 to 20 properties under one note. Loan sizes run from $300,000 to $5,000,000, with larger balances on review. Leverage goes up to 80% of value on a purchase or rate-and-term refinance. The coverage floor is 1.00, measured on the pool: pooled rent against pooled debt service. Terms are 30 years, fixed or adjustable, with an interest-only period available. Eligible property types are single-family, 2-4 unit, condo and townhome.

The rental portfolio term loan is built for five or more rental properties or units. Loan sizes run from $500,000 to $50,000,000, with larger balances on review. Leverage goes up to 75% of value. Terms are fixed at 3, 5, 7 or 10 years with a balloon at maturity. Recourse and non-recourse versions exist, and prepayment runs on yield maintenance. Small multifamily is eligible only on this structure. It also lets properties in several markets sit under one loan.

A loan on one rental works differently. STR purchase leverage on a single-property DSCR loan tops out at 75%, with 70% on STR cash-out and refinance. The portfolio figures above govern the pool.

Coverage is rent divided by the full housing obligation: principal, interest, taxes, insurance and any HOA dues. On the 30-year portfolio structure, the pool must clear the floor in aggregate. A single STR that sits below 1.00 can ride in a pool whose pooled coverage still clears the floor, but underwriting tests the pooled coverage, the leverage and the terms. Every property still needs a lease or an appraiser-supported market rent.

One caution on the word “portfolio.” A bank’s portfolio loan is a loan the bank keeps on its own books. That is a different sense of the word. Lendmire’s network is wholesale non-QM and DSCR lenders, and the loans here are one note secured by several rentals.

How Is Short-Term Rental Income Documented in a Pool?

STR income evidence is where partnership files either move cleanly or stall. Across the network, programs generally accept some mix of the following:

1. Hosting history. Platform or property-manager statements. Most STR programs expect about 12 months of host experience.

2. An appraiser’s STR analysis. Used when history is thin.

3. A third-party market-data projection. Used on purchases with no operating history, usually with a haircut set by the lender.

4. Long-term market rent. The appraisal rent schedule, on form 1007 for single-family or form 1025 for 2-4 units, works as a conservative fallback.

In a mixed pool, properties with long history sit beside new ones on projections. Seasonality matters because lenders look at the income pattern, not a single strong month. The evidence method you choose drives how much loan the pool supports more than anything else.

Local permission is the other half. Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income. A property that cannot document legal STR use may need to be underwritten on long-term rent or dropped from the pool.

Who Signs the Guaranty?

Plan on the owners signing. The LLC borrows, and on the recourse structures people guarantee. The rental portfolio term loan also has a non-recourse version. That structure looks to the real estate, with recourse limited to carve-outs such as fraud and bankruptcy. Non-recourse is a program feature, not something an LLC creates on its own.

How many partners must sign depends on the program and on ownership percentages. Some programs ask only for members above an ownership threshold. Others want guarantors holding a majority of the membership interest in aggregate. A minority or silent investor may or may not be asked to sign. Treat that as illustrative, not a rule.

Credit, liquidity and experience are reviewed on the signing individuals, not on the LLC. The portfolio programs’ credit floor is 640, and 680 or 720 on some portfolio structures. Where partners hold different credit profiles, the program decides whose score counts. That is the point where partnership files get complicated, so settle who signs before the application.

What Documents Does a Partnership Need?

A clean file splits into three stacks. Missing items in any stack are the usual cause of a stalled review.

Entity

  • Articles of organization and the operating agreement
  • Good-standing evidence
  • Borrowing resolution naming who may sign
  • Ownership chart tracing to the individuals

Guarantors

  • Credit authorization for each signer
  • Liquidity and reserves documentation
  • Real estate experience, which STR files weigh heavily

Property

  • Leases, or an appraiser-supported market rent
  • STR platform statements or manager reports
  • Proof of local STR permission for each property
  • Insurance quotes with complete coverage details
  • HOA or condo questionnaires where they apply

Title and the note must carry the same legal name. A mismatch between the entity name on the deed and the name on the application is a preventable delay.

Worked Example: Pooled Coverage With One Weak Property

Run the numbers on a two-partner LLC holding four STRs, using illustrative coverage ratios and no dollar figures. Three properties test at roughly 1.25x, 1.20x and 1.15x on their own. The fourth, a newer listing underwritten on a market-data projection, tests near 0.90x.

Standing alone, that fourth property would struggle. In a pooled test under the 30-year portfolio DSCR loan, the pool’s combined rent against combined debt service lands comfortably above 1.00. The weak property rides inside a pool that clears the floor, and underwriting tests the pooled coverage, the leverage and the terms.

Now the other side. A cross-collateralized pool means a default on one property can reach every property in it. Pull the weak property out, and the pool coverage rises, but the LLC may need that property financed separately. The pooled test helps qualification. It does not remove the risk.

Cash flow is separate from coverage. DSCR compares rent to the full housing payment only. Clearing 1.00 does not mean positive cash flow, because repairs, vacancy, management, utilities and capex sit outside the calculation. Partners planning distributions should model those costs on their own.

Blanket Loan or Separate Loans?

The real choice for a multi-owner STR operator is one pooled note versus several single-property notes. Neither always wins.

Factor Portfolio (one note) Separate loans
Coverage test Pooled across properties Each property alone
Weak property Can ride in a strong pool Must qualify alone
Default risk Can reach the whole pool Contained per property
Selling one property Follows release terms Sell freely
Closings One One per property

Selling one property out of the pool follows the loan documents and the lender’s release terms. The release price runs above the property’s allocated balance, and the remaining portfolio must still cover its debt service. A release clause is a contract term, not a legal right, so read it before signing.

Pick the pool when the properties are similar, the partners agree on a long hold, and you want one test. Pick separate notes when you hold two or three properties, expect to sell individually, or want each partnership’s risk walled off. Mixing is common: pool the stable core and finance new acquisitions alone. Several LLCs sharing one note, which the rental portfolio term loan can accommodate across markets, undercuts the liability separation that separate entities provide.

Cash-Out and Seasoning on a Portfolio

Cash-out on a portfolio loan never exceeds 75% of pooled value, and never exceeds the structure’s own ceiling. On STR collateral, the single-property cash-out ceiling is 70%. Inside the first six months of ownership, the loan is also capped at 90% of total cost (purchase price plus documented improvements). From six to twelve months the cap is 100% of total cost. The leverage ceiling still applies, and the loan is the lower of the two. After twelve months, the appraised value alone is the basis. A rate-and-term refinance is not subject to the cost-basis cap.

What Breaks the General Rule?

  • Ineligible property types. Owner-occupied property, co-ops, mixed-use and commercial property are out of the pool. Manufactured and mobile homes are not reviewable on these programs.
  • Partner disputes and exits. A guarantee outlasts a falling-out. Settle buyout terms, transfers of interest and member changes in the operating agreement before applying.
  • Restricted STR jurisdictions. Legality can pull a property out of the pool or change how it is underwritten.
  • Small portfolios. The 30-year structure starts at two properties and $300,000. A partnership with a thin balance may fit separate notes better.
  • Trusts. Regulation Z treats certain consumer-purpose trusts like natural persons, as the CFPB’s § 1026.3 commentary explains. That differs from the treatment of LLCs and partnerships.

Frequently Asked Questions

Do all partners have to sign the guaranty?

Not always. Programs typically ask members above an ownership threshold, or enough members to cover a majority of the interest, to guarantee. A silent minority partner may be excluded. The operating agreement and the specific program decide.

Can partners be added or removed after closing?

That follows the loan documents. Changes to ownership generally need lender consent, so settle buyout and transfer terms in the operating agreement before applying.

What if one STR is below 1.00 coverage?

On the 30-year portfolio DSCR loan, a property below 1.00 can sit in a pool whose pooled coverage still clears the floor. Underwriting tests the pooled coverage, the leverage and the terms.

Can one property be released from the pool?

Yes, under the loan documents and the lender’s release terms.

Does an LLC make the loan non-recourse?

No. Recourse loans carry a personal guarantee. A non-recourse structure exists on the rental portfolio term loan, with carve-outs such as fraud and bankruptcy.
