Best Short-Term Rental Cash-Out Refinance Program After a Quitclaim Deed

Best Short-Term Rental Cash-Out Refinance Program After a Quitclaim Deed

The Quick Read: The best program after a quitclaim deed is the one whose title, seasoning, vesting and hosting-history rules fit your file, and that answer changes from one lender to the next. A quitclaim changes who is on title, but it does not change the loan or decide approval. A broker that shops a wholesale network can match your deed timing to a program that counts ownership the way your file needs.

  • Short-term rental cash-out typically tops out at 70% LTV on the strongest files, subject to lender guidelines.
  • Expect a credit score of about 640 or higher and a 1.00 coverage floor on refinances.
  • About 12 months of hosting history is usually expected.
  • Seasoning after a deed is lender policy, and programs differ on whether the clock restarts.
  • Record the deed last, not first, and ask the lender in writing before you sign anything.

Investors deed property around for ordinary reasons. A spouse comes off title. A partner is bought out. A property moves into an LLC. Then the cash-out application goes in and the file stalls. This piece explains why, and how to sequence the steps so the file stays clean. Lendmire’s complete DSCR loans guide covers the loan type itself. This article covers only the deed problem on a short-term rental.

What “Best Program” Means After a Deed

The best program is the one that can say yes to your specific title history. A headline number matters less than four questions. Does the program count seasoning from the original purchase or from the new recording date? Will the title company insure the vesting you now have? Can the entity or person on title be the borrower? Does the hosting history carry over?

Across a wholesale network, programs answer these differently. Some look through the deed to the original purchase. Others restart the clock at the recording date. Which lenders will write the loan depends on your situation: property type, credit profile, leverage need and documentation. No single program wins for every file, and no broker should name one before reading the deed chain.

Lendmire is a mortgage broker. It arranges DSCR investor loans through select lenders in its wholesale network across 41 markets, including Washington, D.C. It does not lend, and lenders decide eligibility.

Key Terms Defined

Quitclaim deed: A deed that passes whatever interest the signer holds, with no warranty that the title is clean.

Recorded deed: A deed filed with the county, which is the date most lenders treat as the start of any new ownership clock.

Seasoning: The minimum time you must have held the property before a cash-out refinance is available.

Hosting history: The documented months a property has actually operated as a short-term rental.

DSCR: Monthly qualifying rental income divided by the full monthly obligation of principal, interest, taxes, insurance and any HOA dues.

Due-on-sale clause: A loan provision that lets the existing lender call the balance if the property is transferred without consent.

Vesting: The exact name or entity shown on title at closing.

What a Quitclaim Does and Does Not Change

A quitclaim moves title. It does not move the debt. Deed-preparation commentary from Deeds.com makes the point plainly: signing a quitclaim does not remove a person from the mortgage note. A former co-owner stays liable until the old loan is paid off. A cash-out refinance does exactly that. It pays off the old note, which is what releases the person who left title.

The deed also carries no warranty. That is why title companies look at it harder than a warranty deed.

Why a Deed on a Mortgaged Property Can Trip Due-on-Sale

If the property still carries a mortgage, deeding it can raise a due-on-sale question. The governing federal statute is 12 U.S.C. § 1701j-3, which lets a lender call a loan when the property or an interest in it is transferred without written consent. Subsection (d) bars enforcement for a listed set of transfers on residential property with fewer than five units. A transfer on the death of a joint tenant is one example.

Many lenders do not actively search land records. That is not a safe harbor. A lender can still act.

Free-and-clear properties carry no due-on-sale exposure. Seasoning and title insurance still apply.

The Two Clocks on a Short-Term Rental

A short-term rental file runs two separate clocks. They do not reset each other.

Clock What it measures Does a deed reset it?
Ownership seasoning Time held before cash-out Depends on the program
Hosting history Months operated as an STR No, if the same operation continues

Ownership seasoning is lender policy. No statute sets it, and a regulator does not either. On most programs in the network, about 6 months is the common expectation. A deed is where programs split. A look-through program counts from the original acquisition. A restart program counts from the new recording date.

Hosting history is different. Roughly 12 months of documented hosting is usually expected on short-term rental files. Only months of actual STR operation count. A property converted from a long-term rental starts its hosting clock on the conversion date, not the purchase date.

Deed First, Refinance First, or Vest at Closing

Sequencing is the decision with the most leverage. There are three ways to do it.

Sequence Benefit Risk
Deed first, then refinance Simple on paper May restart seasoning; due-on-sale if a loan exists
Refinance first, then deed Clock untouched during review Deed after closing may breach the new loan terms
Vest at the cash-out closing No stand-alone deed in the chain Entity must be eligible under the program

Vesting at closing is usually the cleanest route when an LLC will hold title. The new loan and the new vesting happen together, so no separate deed sits in the history for an underwriter to question. Whether the entity can be the borrower depends on the program, subject to lender program requirements. A personal guaranty is typically signed.

An attorney view on BiggerPockets leans toward a warranty deed where one works and toward getting the existing lender’s written consent first. That is general commentary, not legal advice for your file.

Where Files Actually Stall

The deed itself rarely kills a file. These gaps do.

1. Title insurance. A quitclaim carries no warranty, so some insurers will not insure over it or will want extra steps. Investor opinion on whether a quitclaim ends owner’s coverage is split. Ask the title company before you record.

2. Vesting mismatch. Whoever is on title must match who is on the new loan. A deed signed but not recorded creates a mismatch the title report will show.

3. Recording date confusion. Lenders typically count from the recording date, not the signing date and not the closing date. Investors often assume the earlier date helps. It usually does not.

4. Income evidence. The cash-out is underwritten like any short-term rental cash-out once title clears. That means booking or platform history, management statements and bank deposits. A market projection is mainly a purchase tool and is weak for a refinance.

5. Appraisal. Fannie Mae’s appraiser guidance says Form 1007 documents monthly market rent and was not designed for short-term rentals. Appraisers generally add short-term rental analysis as a separate narrative. This matters because value sets leverage. The agency reference is for the form only. It does not govern DSCR programs.

Edge Cases Where the General Rule Breaks

Spousal or divorce deed. Federal law protects some of these transfers from due-on-sale on small residential property, but conditions apply. Seasoning treatment still varies by program.

Deed into an LLC with a mortgage in place. This is the main trap. It can trigger due-on-sale and may restart seasoning.

Deed to a trust. Protection may apply only when the borrower remains a beneficiary and occupancy rights do not transfer.

Converted long-term rental. Only the actual STR months count as hosting history.

Two to four units. The appraisal uses Form 1025, and part of the income may come from long-term leases.

Short history or projection-only. The file may fall back to the long-term rent schedule, which can lower coverage.

Unpermitted use. Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income. Legality is a separate eligibility gate from the deed.

Ineligible property types. Manufactured homes, log homes and barndominiums are not offered in the network’s DSCR programs, no matter how clean the deed is.

How the Numbers Look Once Title Clears

After title settles, the file reads like any short-term rental cash-out. Typical parameters across the network, subject to lender guidelines:

  • Cash-out LTV on short-term rental collateral: up to 70% on the strongest files.
  • Credit score: about 640 minimum for short-term rentals.
  • Coverage: 1.00 is where select programs start on refinances, and stronger ratios open better terms.
  • Loan size: up to $3,000,000 on standard programs.
  • Reserves: vary by lender, leverage and loan size, commonly around 6 months of PITIA.

A larger equity cushion can lift coverage, but it does not erase leverage caps, credit floors or reserve rules. The strongest files clear both tests: enough equity and enough rental coverage.

Clearing 1.00 is not the same as positive cash flow. DSCR compares rent to PITIA only. Repairs, vacancy, management, utilities and capex sit outside the calculation. Coverage below 1.00 is available through select lenders in the network, with leverage and terms adjusted. A clean seasoning result only makes the file eligible for review. It does not decide the outcome.

When Not to Quitclaim First

Skip the stand-alone deed when any of these apply:

  • A mortgage is outstanding and you have not asked the lender.
  • A cash-out is planned and you have not asked how the target program counts seasoning.
  • An LLC will hold title and vesting at closing is available.
  • The title company has not confirmed it will insure the new vesting.

Recording first and asking later is the costliest mistake on these files. It is hard to undo. If a deed is already recorded, the practical path is to find a program that looks through it, or to wait until the clock clears under the stricter policy.

Questions to Put to the Lender in Writing Before Recording

1. Does seasoning count from the original purchase or from the recording date of the new deed?

2. Does the program treat a deed to an LLC or trust differently from a deed to an individual?

3. Will the program allow vesting at the closing table instead?

4. Does the hosting history carry over under a new owner of record?

5. What does the title company need to insure the new vesting?

Get the answers by email. Programs change, and each file is underwritten individually.

A Worked Timeline

Picture an investor who deeds a free-and-clear short-term rental from joint names into her own name after a divorce. The deed records in month one. The property has about 14 months of hosting history. A look-through program counts the original purchase date, so ownership seasoning is met, and the hosting history carries. The file goes to review at up to 70% LTV on the strongest files. Terms vary by lender guidelines, property type, leverage, credit profile, and full file review.

Same deed, same property, different answer. That gap is why the program choice matters more than the deed form.

This is a scenario for illustration, not a promise of any result.

Frequently Asked Questions

Does a quitclaim deed stop me from getting a short-term rental cash-out refinance?

Not by itself. The deed changes who is on title, and the lender then reviews seasoning, vesting and title insurability. Some programs restart the ownership clock at the recording date, while others count from the original purchase. The outcome depends on the program you target.

Does a quitclaim remove someone from the existing mortgage?

No. The deed moves title but leaves the note in place, so the former owner stays liable. A cash-out refinance pays off the old note, which is what ends that liability.

Is seasoning after a deed a legal requirement?

No. It is lender policy. No statute or regulator sets DSCR seasoning, which is why the same deed can leave one program eligible and another not.

Will my hosting history reset after a quitclaim?

Generally not, if the same short-term rental operation continues. Hosting history tracks months of actual operation, and about 12 months is usually expected. A property converted from long-term use counts only the months since conversion.

Is it better to deed into an LLC before or at the refinance?

Vesting at the cash-out closing is often cleaner, because no stand-alone deed sits in the chain. Whether an LLC can borrow depends on program requirements, so confirm in writing first.
