Will Student Loans in Default Block a Bank Statement HELOC?

Will Student Loans in Default Block a Bank Statement HELOC?

The Quick Read: A defaulted student loan has a way of turning a routine equity-line request into a harder conversation. Here is the direct answer.

It depends on the lender and the credit damage, but a defaulted student loan is a serious hurdle rather than an automatic bar, because a bank statement HELOC changes how your income is documented while leaving the credit review, the debt picture, and the lien position exactly where they were.

  • A default shows up as a derogatory item on your credit report, and the score it leaves behind drives eligibility and leverage.
  • Bank statements replace tax-return income proof only. They do not hide or soften the credit and debt review.
  • Defaulted federal loans can limit access to some mortgage programs. Private equity lines follow each lender’s own guidelines.
  • On an investment property, the network we broker through starts at a 700 credit score, so a default that drags you below that line is the real obstacle.
  • Rehabilitating or paying off the loan before you apply is one way to remove the default from the file.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

What Does a Bank Statement HELOC Actually Change?

A bank statement HELOC changes one thing: how your income is documented. Instead of leaning on tax returns, the lender reviews a stretch of your business or personal deposits. The file is reviewed on documented income under the applicable program, subject to lender guidelines.

Everything else stays standard. The lender still pulls your credit, still reviews your debts, and still checks the property, the equity, and how you hold title. A self-employed borrower often picks this route because tax returns understate real cash flow. That choice does nothing for a credit report with a default on it.

Lendmire is a mortgage broker, not a lender. It places these files with wholesale HELOC lenders and matches the scenario to the program. The lenders that write bank statement lines each set their own rules for student debt, so the answer here is a range, not a single yes or no.

When Does a Student Loan Count as Defaulted?

Most federal student loans reach default after more than 270 days without a payment, according to the UCCS financial aid office. Before that point the loan is delinquent, which is a late status that begins the day after a missed payment. A delinquent loan hurts your credit. A defaulted loan hurts it more, and the whole balance can become payable at once.

The difference matters for your file. A lender looking at a loan that is a few months late sees a payment problem. A lender looking at a defaulted loan sees a debt the servicer has given up on collecting normally.

Private student loans follow the contract with the lender rather than federal timelines. A private default can end in a lawsuit and a judgment, which is a separate risk. A judgment can attach to the property you want to borrow against, and lenders pay close attention to anything that could sit ahead of their lien.

How Does a Default Hit a HELOC File?

The damage arrives through four doors: the score, the tradeline, the payment counted in your debt ratio, and any collection activity.

The score. The lender pulls a credit score, and the default pushes it down. On this network, investment-property lines carry a 700 minimum credit score. Second homes start at 640. Primary residences can start as low as 600, with tighter leverage in the lower tiers. A default that drops you under the relevant floor can stop the file before income is even reviewed.

The tradeline. The default sits on your report as a negative item. Each lender decides how heavily to weigh it beyond the score. Some want it resolved before closing. Others focus on the score and the recent payment history.

The debt ratio. Your debt-to-income ratio (DTI) compares monthly debt payments to monthly income. On the programs we see, the maximum DTI is 50%, but that full limit is not open to every profile. Credit profiles from 600 to 679 are held to 45%, and any ratio above 45% requires at least a 680 score. The lender also qualifies the line on the interest-only payment calculated on the maximum draw, so the new payment is counted at a high level.

Collection activity. Wage garnishment shows up as lower deposits or payroll withholding. A federal collection payment shows up as an outflow in your statements. Either one changes the cash picture the underwriter reads.

Market surveys report that consumer HELOC lenders typically want a credit score around 640 and a DTI between 43% and 50%, according to NerdWallet. On this network, an investment-property line needs a 700 score and carries a 50% DTI ceiling. The investment tier is stricter on credit than the typical consumer line.

What Does a Payment on a Defaulted Loan Look Like in DTI?

Underwriters have to pick a payment to count. They may use the amount on the credit report, a servicer statement, or a documented plan figure. A rehabilitation agreement gives a clear, documented number, which is one reason that path helps a file.

Run the numbers on a simple example. These percentages are modeled assumptions, not market data. Say your DTI before the student loan payment sits at 40%, and the counted student payment adds 6 points. Your ratio lands at 46%. That crosses the 45% line, so the file now needs a 680 score minimum, and any score between 600 and 679 fails that test.

Now say the loan has been rehabilitated and the documented payment adds only 3 points. Your ratio lands at 43%, under 45%, and the extra credit-score requirement falls away. The loan balance did not change. The documented payment and status did.

The takeaway: the lender decides which payment figure to use, so a clear, current servicer document is worth gathering before you apply.

How Do Different Loan Statuses Get Treated?

Treatment varies by lender, so the table below is a general guide rather than a rule.

Loan status Typical treatment What to document
Current Payment counted in DTI Recent servicer statement
Delinquent Score damage; may need cure Payoff or catch-up proof
Defaulted Hardest case; often must resolve first Servicer status letter
Rehabilitating Payment documented; status improving Agreement and payment history
Deferred or forbearance Payment may be estimated Servicer letter confirming status

Lenders differ on mid-cure files. A borrower in the middle of rehabilitation may be eligible with one lender and told to wait by another. That is where a broker who sees several programs earns the fee: the same file can read very differently against different guidelines.

What Can You Fix Before You Apply?

The two main exits from federal default are rehabilitation and consolidation. They work differently, and the difference matters for a credit-driven lender.

Rehabilitation means making a run of on-time payments under an agreement with the servicer. According to the Department of Education’s rehabilitation guidance, it removes the default status, and collections stop once you complete it. The department also asks credit bureaus to remove the default record. That is the cleaner outcome for a lender reading your report.

Consolidation is faster to complete, but a nonprofit counselor group, EDCAP, notes that the default stays on the credit report. Lenders still see the history, even though the loan is no longer in default.

Simply resuming payments does not cure a default. You have to rehabilitate, consolidate, or discharge the loan. Also, collection pauses on garnishment and tax-refund offset have happened at times, but a paused loan is still a defaulted loan, and collections can resume.

A practical sequence looks like this:

1. Pull your credit report and confirm which loans are marked defaulted and how.

2. Get a current status letter from the servicer for each student loan.

3. Choose rehabilitation if the credit damage is what is holding you back.

4. Keep your deposit history clean during the process, since bank statement income reads those deposits.

5. Re-check your score after the update posts, then apply.

Does a Federal Default Block Every Mortgage?

No. The hard federal block applies to government-backed loans, and a confirmed delinquency on a federal debt makes you ineligible for an FHA loan until it is resolved with the creditor agency.

Private equity lines and non-QM products have no such federal screen, so a private HELOC lender is not bound to run that check. That does not make a default harmless. The score and tradeline do the damage that the database check would have done elsewhere.

What If the Property Is Held in an LLC?

This is the sharpest structural trap for investors. These HELOC programs require title held by the individual borrower or a revocable living trust. LLCs, corporations, partnerships, and irrevocable or land trusts cannot hold title. A property already deeded to an LLC needs a vesting change first, or a different product altogether.

Availability is also narrower than most investors expect. HELOC programs through the network operate in a limited set of states, a smaller footprint than the DSCR investor platform. Investment-property lines top out at 70% CLTV (the combined loan-to-value of all liens against the property) and run up to $500,000, with a 5-year interest-only draw followed by a 25-year repayment period.

When Does a DSCR Loan Beat the HELOC?

If a default has pulled your score under the HELOC floor, or your property sits in an LLC, a DSCR cash-out refinance may be the better route. A DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines. Your personal income documents matter less, though credit still counts.

Credit still sets the ceiling here too. A 620 floor exists in parts of the network, most programs want around 660, and 700 or better unlocks the strongest leverage. Cash-out on a standard rental tops out around 75% LTV across most of the network, with about six months of seasoning being the common expectation. A short-term rental cash-out caps at 70%.

Be honest about what DSCR does and does not measure. It compares rent to the full payment of principal, interest, taxes, insurance, and any association dues. Clearing 1.00 does not mean positive cash flow, because repairs, vacancy, management, and utilities sit outside that calculation. One path to the same destination is also worth weighing against paying the loan off from proceeds, which Lendmire covers in its piece When a Bank Statement HELOC Makes Sense to Pay Off Student Loans.

For the full mechanics, the complete DSCR loans guide walks through coverage, leverage, and reserves in detail.

Key Terms Defined

Default: the status a federal loan reaches after more than 270 days without a payment, when the full balance can become due.

Delinquency: the status that starts the first day after a missed payment, before the loan reaches default.

Rehabilitation: an agreement with the servicer, completed through on-time payments, that removes default status.

Consolidation: rolling defaulted federal loans into a new loan, which exits default but leaves the history on the credit report.

CLTV: combined loan-to-value, which compares all loans against the property to its value.

DTI: debt-to-income, the share of monthly income that goes to debt payments.

CAIVRS: a federal database of people with delinquent or defaulted federal debt, which government loan programs check on their applications. A DSCR loan is a different product: it qualifies primarily on property-level rental income covering the payment, subject to lender guidelines.

What Documents Should You Gather?

A clean package helps the lender read a messy credit story. Bring:

  • Servicer status letters for every student loan
  • Any rehabilitation or repayment agreement and proof of payments
  • Recent bank statements covering the period the program requires
  • A credit report no more than 90 days old at closing, since reports older than that are not accepted
  • Title documents showing how the property is vested
  • Proof of any garnishment, offset, or judgment, and its release if cleared

Frequently Asked Questions

Can I get a bank statement HELOC while my student loan is still in default?

Sometimes, but the score and the lender decide it. If the default has pulled you below the program’s credit floor, you will be declined regardless of your deposits. A 700 score is the minimum on an investment-property line through this network. Some lenders want the default resolved first, so ask your broker to screen several programs.

Does paying my defaulted loan back in full fix the problem?

It helps, but the history can remain on your credit report. Payoff removes the debt from your DTI. The report may still show the default for a while, so your score may lag behind your new reality. Rehabilitation is the path that asks the bureaus to remove the default record.

Will a federal default stop me from using a DSCR loan instead?

Not automatically. DSCR files qualify primarily on property-level rental income covering the payment, subject to lender guidelines. Credit still matters, and a default that damages your score can limit leverage or eligibility. A 620 floor exists in parts of the network, with most programs wanting around 660.

Does a private student loan default work the same way?

Not exactly. A private loan does not appear in the federal CAIVRS database, but it does hit your credit report. It can also lead to a lawsuit and a judgment, which can attach to your property. Lenders weigh a judgment heavily because it can compete with their lien.

Can I use my LLC to get around the credit problem?

No. The HELOC programs here require individual or revocable trust title, and the lender reviews the guarantor’s credit regardless. An LLC-held property would need a vesting change first, or a DSCR cash-out refinance instead.

If you are considering a home equity line and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals. Programs change and every file is reviewed individually, so nothing here is a commitment to lend.
