Bank Statement HELOC Lien Position Rules for a Paid-Off Home

The Quick Read: On a paid-off home, a new home equity line is normally the first lien, because nothing recorded against the title sits ahead of it. The bank statement part only changes how your income is documented, not where the loan ranks.

  • Lien position follows what is recorded on the title, not the product name.
  • A clean title, a recorded release of the old mortgage, and no stray liens are what confirm first position.
  • With no existing mortgage, the whole allowed combined leverage is available to the new line.
  • On this network, investment-property lines cap at 70% CLTV (defined below), while primary residences and second homes can reach higher tiers.
  • A line is not always the right tool. A DSCR cash-out refinance often fits a rental better, especially one held in an LLC.

Key Terms Defined

Lien is a recorded legal claim against a property that secures a debt.

Lien position is the order in which recorded claims get paid if the property is sold or foreclosed. First lien is paid first.

HELOC means home equity line of credit, a revolving credit line secured by the home.

CLTV is combined loan-to-value, which is all loans against the property divided by its value.

Release or satisfaction is the recorded document showing a mortgage was paid and the lender’s claim is removed.

Subordination is a written agreement where one lienholder agrees to rank behind another.

DSCR is debt service coverage ratio, the property’s rent divided by its full monthly housing obligation (principal, interest, taxes, insurance, and any HOA dues).

Bank statement qualification means income is judged from deposits in your statements instead of traditional personal-income documentation.

Editable Equity Scenario

How large a line the equity supports.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

How Is Lien Position Decided on a Paid-Off Home?

Lien position is decided by recording order. Nolo’s lien priority explainer says that, in general, the claim recorded first gets paid first. A paid-off home has no mortgage on record, so a new line recorded against it goes to the front of the line.

That is the whole mechanism. The word second in second mortgage describes a position, not a product. A HELOC becomes a second only when a first mortgage already sits on the title. Bankrate’s first-lien HELOC explainer describes the first-lien version as the primary loan on the property, sometimes called an open-end mortgage.

Recording order has exceptions. The same Nolo explainer notes that property tax liens, special assessments, and some HOA liens can outrank an earlier-recorded mortgage under state law. So a paid-off home usually gives the new line first position among mortgages, but not necessarily first among every claim.

Does the Bank Statement Method Change Lien Position?

No. Documentation and lien position are independent. The income method decides whether you qualify. The title decides where the line ranks.

Bank statement qualification is a way to document income for self-employed owners whose traditional personal-income documentation understates their cash flow. Scotsman Guide describes it as analysis of 12 to 24 months of personal or business statements, and notes that non-QM underwriting is mostly manual. Non-QM means a loan that falls outside standard agency guidelines. The lender looks at your deposits, removes transfers and one-time items, and averages what remains. Business accounts often get an expense factor applied.

None of that touches the recorded order of liens. A bank statement line on a paid-off home is first position for the same reason any other line on that home would be. The file still gets a full review of credit, valuation, debt ratio, and title.

On this network, the line is reviewed on documented income under the applicable program, subject to lender guidelines. The lender caps your total debt-to-income ratio at 50%, and it measures the payment on the interest-only amount for the maximum draw. A large line is judged as if you drew all of it.

What a Lender Checks Before Confirming First Position

Lenders do not take paid off at face value. A zero balance on your last statement is not proof. Here is the sequence on a typical file:

1. Title search. The lender orders a search to see every recorded claim against the property, including mortgages, judgments, and tax or HOA liens.

2. Evidence of release. Each old mortgage should show a recorded release. A payoff letter alone does not remove the claim from the record.

3. Old open lines. A previous HELOC that was paid down to zero but never closed can still show as a lien. It needs a formal closure and release.

4. Vesting. The title must be held by you as an individual or by your revocable living trust. More on this below.

5. Valuation. Lines at or below $500,000 ordinarily use an automated valuation. Any line above $500,000 requires a full appraisal, and you can request one on smaller lines too.

6. Recording. The lender records the new security instrument, and the line takes its place at the front of the chain.

If step one or two turns up a problem, the fix is usually paperwork: a recorded release from the old lender, a payoff of a judgment, or a closed-out old line. Better to find it before you apply than during review.

The Equity Math When Nothing Is Ahead

When no mortgage exists, the line is the only loan, so its CLTV equals its own loan-to-value. The entire leverage allowance goes to the new line. The CFPB’s HELOC booklet defines equity as value minus what you owe. On a free-and-clear home, you owe nothing, so equity is the full value.

Compare two homes with the same value. One has an existing first mortgage at 40% of value. The other is paid off. On an investment property with a 70% ceiling, the first home has 30 points of room, and the paid-off home has all 70. The ceiling depends on occupancy and credit. These are the network’s top tiers:

Occupancy Top CLTV tier Credit pairing Line size
Primary residence 90% 720+ Up to $500,000
Primary residence 75% 700+ Up to $750,000
Second home 90% 720+ Up to $500,000
Investment property 70% 700+ Up to $500,000

Those top tiers are not general availability. A 90% ceiling appears only at a 720 or better profile, and lower scores step down to lower ceilings. Investment lines start at a 700 minimum credit profile. Pricing and available terms vary by lender, borrower profile, property type, and full underwriting review. Everything is subject to lender guidelines and full file review.

One more point matters for investors. A line above $500,000 is primary-residence only. It requires a credit profile of 700 or better (720 on the longer-runway program, described in the next section), caps at 75% CLTV, and needs a full appraisal. An investment property never gets that tier.

Market surveys report that some home equity lenders reach 85% or 90% of value, per Bankrate’s HELOC overview. On this network, an investment line stops at 70% CLTV.

How the Line Itself Is Built

A HELOC is open-end credit. The CFPB’s HELOC explainer says you can borrow against it repeatedly during a draw period, and that falling behind could cost you the home. Pricing floats. It never converts to a fixed structure.

Two wholesale programs sit behind these lines. A higher-leverage program offers a 3-year interest-only draw followed by a 17-year repayment on primary residences and second homes. A longer-runway program uses a 5-year draw followed by a 25-year repayment. Investment lines run the 5-year draw and 25-year repayment structure only.

The line is a standalone loan in first or second position. A borrower can hold up to three lines, and anyone with more than 15 financed properties is not eligible.

Here is the catch for anyone planning to keep the line in reserve. At least 75% of the line must be drawn at closing. A line you plan to use a little at a time doesn’t fit that design well. If you want most of the capital sitting unused, a different structure may suit you better.

Lendmire brokers these lines through select wholesale partners and is never the lender. The bank statement HELOC is available only in Lendmire’s 16 full-service states, which is narrower than its 41-market DSCR footprint, Washington, D.C. included.

Where the First-Lien Rule Breaks

The general rule holds in most files. These are the named cases where it doesn’t.

Paid off but never released. The old lender was paid, but the satisfaction was never recorded. On the public record, that mortgage may still sit ahead of your new line. A recorded release fixes it.

A zero-balance old HELOC. Many owners forget a line they paid down years ago. If it was never closed and released, the title search will find it.

Tax, assessment, and HOA liens. As Nolo explains, statutory liens can jump ahead regardless of recording date. A lender will want these cleared or accounted for before it treats your line as first.

LLC-titled property. The line requires title in your own name or in a revocable living trust. LLCs, corporations, partnerships, and irrevocable, blind, or land trusts cannot hold title. A home already deeded to an LLC needs a vesting change, or it points toward a DSCR cash-out refinance instead, subject to program terms.

Inherited or recently gifted homes. The title must show you as the owner, and the vesting should be cleaned up before you apply. A home recently listed for sale is ineligible in several states.

Ineligible property types. Manufactured homes, co-ops, condotels, log homes, commercial properties, mixed-use, and agricultural-zoned properties are not eligible for the line. Single-family homes, 2-4 units, PUDs, townhomes, and condominiums, including non-warrantable condos, are eligible. Modular factory-built homes are eligible on the longer-runway program only.

A later refinance. First position is not permanent. If you later want a new first mortgage, the lender will want to be first. Nolo’s subordination explainer says a junior lienholder moves up when a senior one is paid off, and a new lender then needs a subordination agreement to keep first position. In practice, you either pay off the line or ask its lender to subordinate. Neither is automatic.

First-Lien Line or DSCR Cash-Out Refinance?

The decision for most investors comes down to what the money is for and how the property is held. DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage.

Factor Bank statement line DSCR cash-out
Reviewed on Documented deposit income Property rent vs. payment
Title holder Individual or revocable trust LLC allowed per program
Structure Revolving, floating pricing Closed-end lump sum
Investment ceiling 70% CLTV 75% LTV (70% on short-term rentals)
Credit floor 700 on investment 620 in parts of network

A DSCR cash-out qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. Many select programs start at 1.00 coverage. A separate select-lender path goes below 1.00, with leverage and terms adjusted. Cash-out usually expects around 6 months of seasoning, which is the time you have owned the property. Most programs want a credit score near 660, and 700 or better opens the strongest leverage tiers. Reserves commonly run around 6 months of PITIA, meaning the full monthly housing payment, though they vary by lender, leverage, and loan size.

Clearing 1.00 coverage does not mean the rental produces positive cash flow. DSCR compares rent to the housing payment only. Repairs, vacancy, management, utilities, and capital expenses sit outside the calculation.

The pattern that fits the bank statement line is an owner whose personal income is the story. The pattern that fits DSCR cash-out is a rental owner who wants the property’s rent to carry the loan, or who holds title in an LLC, or who needs a long fixed structure. Terms such as 30-year fixed, 40-year, interest-only periods, and ARMs are available through select lenders in the network.

Tax treatment can depend on how the funds are used and how the property is held. Investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

The complete DSCR loans guide covers the full program.

What Investors Should Do Before Applying

Pull your own title report before any lender does. Confirm every old mortgage shows a recorded release. Look for an old HELOC that was never closed. Check for judgments, tax liens, or HOA claims.

Then match the structure to the goal. If you need a lump sum for a purchase or rehab and the property sits in an LLC, run DSCR cash-out first. If your income is easier to document through deposits and you hold title personally, price the line. If you want the capital in reserve, remember the 75% draw at closing.

Frequently Asked Questions

Is a bank statement HELOC on a paid-off home a first or second lien?

It is a first lien when nothing else is recorded against the title. The bank statement method documents income and has no effect on ranking. A line takes second position only when a first mortgage already exists.

Can an unreleased old mortgage block the line?

Yes. If a title search still shows an old mortgage as an open claim, the lender will not treat your line as first. The fix is usually a recorded release from the old lender. A zero-balance old HELOC that was never closed can cause the same problem.

Can I hold the home in an LLC and still get the line?

Not directly. The title must be held by you as an individual or by a revocable living trust. If the home is already deeded to an LLC, you would need a vesting change, or a DSCR cash-out refinance may fit better, subject to program eligibility.

Will a first-lien line block a later refinance?

It can complicate one. A new first mortgage lender will want first position. You would either pay off the line at that refinance or ask its lender to subordinate, and subordination is not guaranteed.

Does first position make the line safer for me?

It affects who gets paid first, not whether your home is at risk. The line is secured by the home, and falling behind could cost you the property. Pricing floats during both the draw and repayment periods, so the obligation can change.

Run the Numbers on Your Own File

If you are considering a home equity line and want to see how the numbers work, Lendmire can help you compare HELOC options based on the property, the equity available, credit profile, combined leverage, and your goals. Programs change, and every file is underwritten individually; this is not a commitment to lend.

A free-and-clear property is the cleanest starting point for a first-lien line, and the title report will tell you whether it is as clean as you think.
