Does Every Airbnb LLC Owner Have to Sign the DSCR Loan Guaranty?

Does Every Airbnb LLC Owner Have to Sign the DSCR Loan Guaranty?

The Quick Read: Usually no. Most programs we place files with ask for a guaranty only from members who hold at least a set ownership percentage, so a small passive investor often does not sign, though a 50/50 partnership typically means both partners do. Airbnb use does not change this, because the guaranty attaches to the loan, not to the rental strategy.

  • The LLC is the borrower; individuals sign the guaranty.
  • No federal rule sets a minimum ownership percentage. Each lender sets its own trigger.
  • Every signer is credit-checked and counts toward reserves.
  • Non-signing members are usually still disclosed.
  • Short-term-rental files add their own tests: a 640+ score and about 12 months of hosting history.

Why Doesn’t the LLC Remove the Guaranty?

An LLC protects the owners from property-level claims, such as a guest injury or a vendor dispute. It does not turn the mortgage into a no-recourse loan. The LLC signs the note and the mortgage. A person then signs a separate guaranty that puts personal liability back on the file. That is one signature in two capacities: once for the entity, once for yourself.

As of Oct 15, 2026 · General Freddie Mac market benchmark, not a Lendmire loan offer. Nightly rate, occupancy, taxes, and insurance are editable estimates. Qualifying income for short-term rentals varies by program — some use appraisal market rent, others use documented STR history or projections — and is confirmed in underwriting. Not a Loan Estimate, approval, or commitment to lend. Program availability and eligibility are subject to lender guidelines, credit approval, property review, and underwriting.

DSCR loans qualify primarily on property-level rental income covering the payment, subject to lender guidelines. But the property’s income decides whether the loan works. The guarantors’ credit, reserves, and background decide who stands behind it. Those are two separate tests, and the second one is why the guaranty exists.

How Do Lenders Decide Who Signs?

Across our wholesale network, three models show up. Which one applies depends on the lender and program, so get it in writing before you pay for an appraisal.

Model Who signs 2-owner LLC Question to ask
Ownership trigger Every member above a set % Both, if each is above the trigger What is the cutoff?
Majority or aggregate Members who together control the LLC One may be enough Do signers need to total a majority?
Strong guarantor One member with the credit and reserves One Can one guarantor carry the file?

Treat that as a pattern, not a rule. The numbers move by program.

A reasonable question is whether the law sets the threshold. It does not. The only federal rule touching this is the Equal Credit Opportunity Act’s implementing rule, Regulation B. Its current text says a lender may require guarantees from a business’s owners, but the requirement has to rest on each person’s relationship to the business, not on a prohibited basis like sex or marital status. How far that rule reaches into business-purpose credit is a legal question for your attorney.

What Does Ownership Look Like on an Airbnb?

Short-term rentals tend to have messier ownership than long-term rentals. Couples, friends pooling money, and co-hosts with a small stake are all common. Here is how the signer question usually plays out. No dollar figures or fixed thresholds are implied; the trigger depends on the program.

Structure Likely signers Credit-checked Confirm with lender
Single-member LLC The owner The owner Nothing unusual
50/50 partners Often both Each signer Whether one can sign alone
Majority owner plus passive investor The majority owner The signer Whether the passive investor is disclosed
Co-host with a small stake Often not the co-host Signers only Whether the stake clears the trigger
Holding company owns the property LLC The individuals behind it Each individual Look-through ownership
Five equal members Depends on trigger Each signer Whether anyone clears it

Two edge cases deserve a closer look. With five equal 20% members, a trigger at 20% pulls in all five. A trigger at 25% means nobody is reviewed on percentage alone, so some lenders still ask for the managing member. And with layered entities, lenders look through to the people at the top.

What Are You Actually Signing?

Most DSCR guaranties are unlimited and joint and several. That is the part minority owners miss. Each guarantor is independently liable for the full amount, not a share. If your partner becomes insolvent, the lender can pursue you for the balance.

Say you hold 25% of an LLC and sign alongside a 75% partner. Your signature does not limit your exposure to 25%. Any contribution or indemnity agreement between the two of you governs only what you owe each other. It does not bind the lender. Some lenders negotiate a capped guaranty, but that is the exception and program-specific.

Guaranteed debt can also show up when you later apply for other financing, and a default can reach your personal record. Plan for that before you sign.

What If a Partner Won’t Sign or Has Weak Credit?

A weak-credit partner above the trigger is pulled into the file, and with two guarantors some programs price off the lower score, so the weaker partner may set the terms. Credit requirements vary by program; most want around 660, a 620 floor exists in parts of the network, and 700+ opens the strongest leverage tiers. Short-term-rental files expect 640 or better.

You have a few options:

  • Ask whether one guarantor with stronger credit and reserves is acceptable.
  • Ask whether the lender uses a majority test instead of a per-owner trigger.
  • Adjust ownership percentages before applying, with your attorney and CPA involved.

That last one carries a warning. Do not restructure ownership only to dodge a guaranty. Lenders review the documents, and a mid-file change can create problems. Ownership changes also carry tax and operating-agreement consequences, so those belong with a professional.

Do Spouses Have to Sign?

Not just for being married. Under Regulation B, a lender generally cannot require a spouse who is not an owner to guarantee based on marital status alone, and that principle extends to guarantors. FDIC guidance on spousal signatures explains that the rules vary with whether the credit is joint, whether the collateral is jointly owned, and whether community property applies.

A spouse may still be asked to sign the mortgage or deed of trust where state law requires it to make the collateral available. That is a lien signature, not a guaranty. Courts have voided some spousal guaranties under the ECOA, as one law-firm summary describes, so treat this as a legal-risk area and ask counsel.

Who Signs What at Closing?

Document Signer
Note LLC, through its authorized member
Mortgage or deed of trust LLC (a spouse may also sign under state law)
Guaranty Each required guarantor, personally
Borrowing resolution and entity certificate LLC, per the operating agreement

Expect to provide formation documents, the EIN letter, and the operating agreement. The operating agreement shows who the members are, who has signing authority, and whether other members must consent.

Exceptions and Edge Cases

Some investors never face the question. On many programs, an individual can borrow in their own name, though some structures require entity vesting. Non-recourse and limited-guaranty variants exist but are rare and program-specific. Be skeptical of any page claiming LLC loans need no guaranty. On full-recourse DSCR files, that is generally wrong.

After closing, adding or removing a guarantor, a buyout, or a member’s exit usually needs lender consent. A later refinance or sale is the cleanest point to release a guarantor.

What Do Short-Term-Rental Files Add?

Airbnb status does not change who signs. It changes the property test. Across the network, short-term-rental purchases reach up to 75% LTV, while refinances and cash-outs run up to 70%. Expect about 12 months of hosting history and a 1.00 coverage floor on both purchases and refinances, subject to lender guidelines. Reserves vary by lender, leverage, and loan size, commonly around 6 months of PITIA.

Clearing 1.00 is not the same as positive cash flow. DSCR compares rent to the full payment only. Repairs, vacancy, management, utilities, and capex sit outside it. Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.

DSCR vs. conventional financing

There are two common ways to finance an investment property, and they qualify you differently — here’s how investors weigh them.

DSCR loan

Why investors choose it

  • Qualifies on the property’s rental income — no personal tax returns, W-2s, or pay stubs needed to document income.
  • No personal debt-to-income ceiling to clear, so existing mortgages and obligations don’t cap your borrowing the same way.
  • Can be closed in an LLC, keeping the property inside a business entity.
  • Built for scaling — not held to the limit on number of financed properties that conventional financing applies.
  • Underwriting centers on the deal: generally qualifies when the rent covers the payment, a 1.00x coverage ratio being a common baseline (confirmed in underwriting).
  • Designed specifically for investment property, including long-term and, where the program allows, short-term rentals.
Conventional loan

Where it’s strong

  • Often the lowest ongoing financing cost for a buyer who fully qualifies on personal income — a fit for a first property or a cost-first purchase.

Trade-offs for investors

  • Requires full personal income documentation and must fit within a debt-to-income limit — salary, existing debts, and other mortgages all count.
  • Typically held in your personal name rather than a business entity.
  • Caps how many financed properties you can carry, which can become a ceiling as a portfolio grows.
  • Evaluates you as a borrower as much as the property, which usually means more paperwork.

How investors usually choose: a first or single property often optimizes for the lowest financing cost; portfolio builders often optimize for leverage, vesting in an LLC, and scaling past conventional caps. The right answer depends on your goals, the property, and current guidelines — both paths run through select lenders in Lendmire’s wholesale network, with eligibility and terms confirmed in underwriting.

Questions to Ask Your Lender Before You Apply

1. Which members must sign, and at what ownership percentage?

2. Can one guarantor with strong credit and reserves carry the file?

3. Is the guaranty unlimited and joint and several, or capped?

4. Are non-signing members still disclosed?

5. How is pricing set when two guarantors have different scores?

6. What does a guarantor release look like after closing?

This article is for general information and is not legal or tax advice. Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction. Consult an attorney and CPA about your own structure.

Frequently Asked Questions

Does every member have to sign?

No. Most programs set an ownership trigger or a majority test, so members below it often do not sign. Members above it typically do. The cutoff varies by lender, which is why you should ask early.

Can a silent investor avoid signing?

Often, yes, if their stake is below the lender’s trigger. They are usually still identified in the file, and they remain exposed to the capital they put into the LLC if it loses the property.

Can one owner sign alone?

Sometimes. Under a majority or strong-guarantor model, one member with enough credit and reserves may carry the file. Under a per-owner trigger, every member above the cutoff signs.

Does the LLC protect me from the lender?

No. The LLC shields you from property-level claims, but the guaranty reattaches personal liability for the loan. On most files it is unlimited and joint and several.

Can I be removed as guarantor later?

Possibly, but it needs lender consent. A refinance or sale is the usual route, and a release usually depends on the remaining guarantor’s credit and reserves.
