The Quick Read: A filed eviction does not automatically block a DSCR refinance, but it changes which rent the lender can count. A lender usually cannot rely on a lease the tenant is not honoring, so the file leans on appraiser market rent, and treatment varies by lender and by how far the case has progressed.
- Rent used for coverage is typically the lower of lease rent and market rent, and an open dispute weakens the lease.
- Cleaner files tend to come after possession is recovered and the unit is re-let or rent-ready.
- Expect requests for the lease, payment ledger, notice, and court case number.
- The appraiser still needs interior access, which a holdover tenant can block.
- Clearing 1.00 coverage is not the same as positive cash flow.
Key Terms Defined
DSCR (debt service coverage ratio): the property’s qualifying monthly rent divided by its monthly principal, interest, taxes, insurance, and HOA dues (PITIA).
Market rent: what an appraiser estimates the unit would rent for, based on comparable rentals, regardless of what this tenant pays.
Seasoning: the waiting period a lender wants after you buy a property before it will do a cash-out refinance.
Writ of possession: a court order directing a sheriff or constable to remove a tenant after a landlord wins.
Rent-ready: a unit in condition to be leased now, with no open repairs that would hold back an appraisal.
Reserves: liquid funds a lender wants you to hold after closing, commonly counted in months of PITIA.

Why an Eviction Complicates a DSCR File
A DSCR loan qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. That is the appeal for investors with complicated traditional personal-income documentation. It is also the problem here. The income evidence is exactly what an eviction damages.
An eviction filing usually means rent is unpaid and the lease is in dispute. Underwriters ask for proof of payment on an occupied unit. A tenant who is not paying cannot supply it.
No single rule sets a waiting period. DSCR loans are business-purpose investor loans, so each lender in a wholesale network sets its own treatment. Across the network we broker through, there is no single published answer. Some programs pause a file with an open case. Others treat the unit like a vacant one and underwrite on market rent. That variation is why the blunt “lenders won’t refinance” shortcut is wrong. The right answer is “it depends on the stage, the rent evidence, and the lender.”
For the full picture of how these loans work, see Lendmire’s complete DSCR loans guide.
What Rent Does the Lender Count?
Three rent numbers matter, and an eviction pulls them apart.
- Contract rent: what the lease says.
- Collected rent: what the tenant actually pays.
- Market rent: what an appraiser says the unit would rent for.
The common convention is to use the lower of lease rent and market rent. A lease above market does not raise qualifying income. A vacant unit relies on market rent alone. A unit with a non-paying tenant sits awkwardly between those two. Many lenders will lean on market rent, as they would for a vacant unit, if they proceed at all.
The appraiser’s opinion usually comes on a standard form. Fannie Mae’s appraiser resources list Form 1007, the single-family comparable rent schedule, and Form 1025, the small residential income property report. DSCR programs borrow these forms. Agency underwriting rules do not govern the loan.
How Each Eviction Stage Changes the File
The stage of the case shapes how a lender reads it. Treatment varies by lender, so read this as typical patterns, not promises.
| Stage | What the lender likely sees | Rent figure leaned on |
|---|---|---|
| Notice served | Dispute possible, unit still occupied | Lease, with payment proof |
| Suit filed | Open case, unpaid rent likely | Market rent, or a pause |
| Judgment entered | Possession awarded, tenant still in unit | Market rent |
| Writ executed | Unit vacant | Market rent, rent-ready needed |
| Dismissed or cured | Tenant paying again | Lease, with fresh ledger |
The sequence itself comes from state process. As the Texas State Law Library lays out, a case runs from notice to vacate, to suit, hearing, judgment, possible appeal, and then a writ of possession. Nothing here is legal advice.
Filed and resolved cases read differently. A dismissed or cured filing is generally easier to explain than an open one. A completed move-out followed by a new lease reads differently again.
Refinance Now, Wait, or Re-Let First?
This is the real decision, and it is a tradeoff, not a rule.
| Path | Upside | Downside | Best fit |
|---|---|---|---|
| Refinance mid-case | Starts the clock sooner | Fewest willing lenders, access problems | Existing loan has urgent pressure |
| Wait for possession | Unit becomes vacant, market-rent file | Carrying cost during the court process | Strong equity, patient investor |
| Re-let, then refinance | Cleanest file, lease plus ledger | Longest wait | Most files, in a typical case |
| Sell instead | Ends the problem | Gives up the hold | Thin coverage or heavy repairs |
In a typical case, resolving possession first and refinancing a stabilized unit gives the cleaner file. Mid-case is possible with some lenders but narrows your options.
A Worked Example
Say you own a single-family rental where the tenant stopped paying and a suit is open. The lease rent is above market. The appraiser’s market rent comes in lower. The lender uses the lower number, and that market rent covers the new loan’s full PITIA at roughly 1.15x.
Now compare. If the lender instead tried to rely on the lease and collected nothing, coverage on collected rent is effectively zero. The file only works because market rent is a usable path. This is the core mechanic, and it is why the eviction affects the numerator, not the formula.
On a cash-out, most programs in our network top out around 75% LTV on a standard rental, and about 6 months of seasoning is the common expectation. On a purchase, most files land at 75%-80% LTV. Where coverage sits below 1.00, a separate select-lender path exists, with leverage and terms adjusted. Credit floors start at 620 in parts of the network, most programs want around 660, and 700+ opens the strongest tiers. Reserves vary by lender and loan size, commonly around 6 months of PITIA, and step up to about 9 months above $1,500,000. All of it is subject to lender guidelines and individual underwriting.
One caution matters here. Coverage above 1.00 is not positive cash flow. Vacancy, legal fees, repairs, and management sit outside the calculation.
Documents Lenders Typically Request
Expect some version of this list, and confirm it with the lender.
- The lease and the payment ledger.
- The eviction notice and the court filing or case number.
- The appraisal with the rent schedule or income report.
- Entity documents, if an LLC holds title, subject to lender program eligibility.
- Insurance and tax figures.
- The payoff statement on the existing loan.
Disclose the filing. A pending case tends to surface through the ledger, the lease, and lender questions. Hiding it risks the file, and disclosure keeps the lender’s options open.
DSCR vs. conventional financing
There are two common ways to finance an investment property, and they qualify you differently — here’s how investors weigh them.
Why investors choose it
- Qualifies on the property’s rental income — no personal tax returns, W-2s, or pay stubs needed to document income.
- No personal debt-to-income ceiling to clear, so existing mortgages and obligations don’t cap your borrowing the same way.
- Can be closed in an LLC, keeping the property inside a business entity.
- Built for scaling — not held to the limit on number of financed properties that conventional financing applies.
- Underwriting centers on the deal: generally qualifies when the rent covers the payment, a 1.00x coverage ratio being a common baseline (confirmed in underwriting).
- Designed specifically for investment property, including long-term and, where the program allows, short-term rentals.
Where it’s strong
- Often the lowest ongoing financing cost for a buyer who fully qualifies on personal income — a fit for a first property or a cost-first purchase.
Trade-offs for investors
- Requires full personal income documentation and must fit within a debt-to-income limit — salary, existing debts, and other mortgages all count.
- Typically held in your personal name rather than a business entity.
- Caps how many financed properties you can carry, which can become a ceiling as a portfolio grows.
- Evaluates you as a borrower as much as the property, which usually means more paperwork.
How investors usually choose: a first or single property often optimizes for the lowest financing cost; portfolio builders often optimize for leverage, vesting in an LLC, and scaling past conventional caps. The right answer depends on your goals, the property, and current guidelines — both paths run through select lenders in Lendmire’s wholesale network, with eligibility and terms confirmed in underwriting.
Where the General Rule Breaks
Appraiser access. The appraiser needs to see the interior. A holdover tenant can block access or drag the condition rating down. That is a collateral problem separate from the rent problem.
Tenant bankruptcy. A bankruptcy filing can impose a stay. A BiggerPockets thread on a Chapter 13 case notes the landlord must go through bankruptcy court to lift it. That can freeze possession and delay re-letting.
Multi-unit properties. The 1025 report lists rent by unit. One troubled unit among several leased units is typically assessed on the pooled rent roll, though this varies by lender.
Blanket loans. One unit in dispute can pull down pooled coverage across the loan.
Short-term rentals. Form 1007 was not built for nightly rates, and those files use a different income path. For that route, see Lendmire’s piece How to Refinance a Short-Term Rental Once It Has a Year of Bookings.
Owner occupancy. If you expect to occupy the property for more than 14 days in the coming year, the business-purpose treatment can fail.
Property types outside the network. Manufactured homes, log homes, and barndominiums are not offered in these DSCR programs.
Mistakes to Avoid
- Forcing a lockout to hit a deadline. Follow the court process. Self-help evictions create legal exposure.
- Using the lease number. When the tenant is not paying, the lease is weak support.
- Applying before the file is ready. An open case with no documents burns time.
- Ignoring the existing loan. Check its prepayment terms before planning an exit.
- Assuming the filing hits your credit. An eviction is a civil suit against the tenant, and it would not report on the landlord’s personal credit.
Tax treatment varies; consult a qualified tax professional.
Frequently Asked Questions
Can I refinance while the eviction is still pending?
Sometimes, but the options are narrower. Some lenders pause an open case, and others underwrite on market rent as they would a vacant unit. Your best odds come with documented dispute history, a rent-ready unit, and enough equity to meet leverage limits.
Does the lender use my lease or market rent?
Typically the lower of the two. When the tenant is not paying, many files lean on appraiser market rent.
Do I have to tell the lender about the eviction?
Yes, treat disclosure as the safe path. The ledger, lease, and lender questions tend to surface a pending case, and concealing it can damage the file.
Will the eviction cloud my title?
Generally not. An eviction is a suit against the tenant, not a lien on your property. Judgments and liens from other matters are separate, so your title company can confirm.
Is waiting for possession always better?
Not always. Waiting usually gives a cleaner file, but you carry the existing loan meanwhile. If a maturing note or prepayment clock is running, the cost of waiting can outweigh the benefit.
Next Steps
Gather the lease, ledger, notice, and case number. Get a clear read on your equity against the leverage ranges above. Then decide whether to refinance now, wait, or re-let first.
