How to Refinance Out of a Hard Money Loan in Delaware

How to Refinance Out of a Hard Money Loan in Delaware

The Quick Read: The exit works by lining up a long-term DSCR loan that pays the bridge off at closing, sized on a new appraisal and supported by rent that covers the full monthly obligation, with the hard money maturity date sitting safely past the new loan’s ownership and documentation requirements.

  • The new lender sizes the loan on its own appraisal, not on the after-repair value in your rehab plan.
  • A DSCR loan on an investment property typically caps cash-out refinance at 75% LTV, while rate-and-term (payoff only, no cash back) can reach 85% LTV, subject to lender guidelines.
  • The DSCR loan generally wants about 6 months of ownership measured from title recording, and the clock does not start when the rehab ends.
  • Coverage compares rent to the full housing payment only, so clearing 1.00 does not mean the property is cash-flow positive.
  • Run the break-even appraisal number before you buy the property, not after the rehab.

The title names Delaware. Nothing in the way a DSCR loan takes out a hard money loan changes at the state line. Underwriting looks at the same things everywhere: value, rent, credit, reserves, and a clean payoff. What changes by location is the closing mechanics, which a local title company or attorney handles. A short section near the end covers that.

Key Terms Defined

Hard money loan: A short-term, interest-only, asset-based loan used to buy or renovate an investment property. Terms on current programs typically run 6 to 18 months, with no prepayment penalty, and vary by lender, property, and experience.

Exit refinance: The long-term loan that pays the bridge off. For rental properties, that is usually a DSCR loan.

DSCR (debt service coverage ratio): Monthly rent divided by the full monthly housing payment: principal, interest, taxes, insurance, and any HOA dues.

Seasoning: The minimum time you must own the property before a lender will size a loan on appraised value instead of cost. On DSCR files it is measured from title recording.

Rate-and-term refinance: A new loan that covers the payoff and closing costs and returns no cash at closing.

Cash-out refinance: A new loan that returns cash above the payoff and costs. It has a lower leverage cap than rate-and-term.

Payoff statement: The hard money lender’s written figure, with a per-diem interest amount and a good-through date.

What Exactly Is the Exit Replacing?

The exit replaces a short, interest-only bridge with a long, amortizing loan. Those two products behave differently, and most failed exits trace back to that gap.

Hard money is underwritten on the asset: the property, the plan, and the exit. On the current programs the network sees, fix-and-flip leverage runs by experience tier and is capped at 75% of after-repair value, while cash-out and rate-and-term refinances on a bridge sit at up to 65% of value. Hard money loan sizes vary by lender, property, and experience, and none of it is a commitment to lend. The exit loan has its own ceiling. A DSCR loan on standard programs runs up to $3,000,000, so the bridge balance has to fit under that to be taken out.

Many investors refinance out of hard money into long-term DSCR financing once the property is stabilized. Lendmire arranges that path through the wholesale network, and the hard money exit refinance page covers the program.

The DSCR loan is a different animal. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. It is a 30-year fixed at its core. Extended terms and interest-only periods exist through select lenders, and ARM structures exist for investors who want them. The payment on a larger, amortizing loan is higher than the interest-only bridge payment, so the coverage number has to be tested on the new loan, not the old one.

How Does Underwriting Treat the Exit, Step by Step?

A DSCR file for a hard money takeout moves through six checks, and each one can stop the file. The order below is how a processor reads it.

1. Pick the exit type. Payoff-only means the DSCR loan covers the hard money balance and closing costs, with no cash back. Anything above that makes it a cash-out. The two carry different leverage ceilings, so decide before the appraisal is ordered. If rehab cards or other debts get paid from proceeds, the file generally becomes a cash-out.

2. Check the ownership clock. A DSCR cash-out refinance typically wants about 6 months of ownership, measured from the recorded deed. Market surveys show the spread: AirDNA’s BRRRR explainer notes that seasoning varies by lender and that some investor-friendly lenders waive it. Across the wholesale network, the working expectation for a DSCR cash-out is about 6 months from title recording. Inside that window, sizing may rest on cost basis rather than the post-rehab value.

3. Order the appraisal that does two jobs. It sets value, which drives LTV, and it sets market rent, which drives coverage. On single-family properties the rent comes from the appraiser’s Form 1007 comparable rent schedule. On 2-4 units the appraiser uses the companion operating income form. Your own after-repair estimate does not carry into the loan size.

4. Run the coverage test. The lender divides rent used for lender review by the full payment on the new loan. Rent used for lender review is generally the lower of the signed lease and the appraiser’s market rent. A 1.00 ratio is where many select programs start. A separate select-lender path takes coverage below 1.00 with leverage and terms adjusted. Stronger ratios open better pricing and leverage.

5. Verify credit and reserves. A 620 score is the floor in parts of the network, most DSCR programs want around 660, and 700 or above unlocks the strongest leverage tiers. Reserves are commonly around 6 months of PITIA on DSCR files, stepping up to about 9 months above $1,500,000. Reserve rules vary by lender, leverage, and loan size, and conservative rate-and-term files at modest leverage can see them waived.

6. Pay off at closing. The title company requests a written payoff statement from the hard money lender. The DSCR lender wires that amount, and the old lien is released. The payoff includes accrued interest, any extension fees, and any exit fee written into the note.

Payoff-Only or Cash-Out: Which Line Are You On?

The line between the two is the lender’s own policy, so it should be confirmed in writing. The leverage gap between them is large enough to decide the whole file.

Factor Rate-and-term DSCR exit Cash-out DSCR exit
What it covers Payoff plus closing costs Payoff plus cash back
Typical LTV ceiling Up to 85% on an investment property Up to 75% on an investment property
Ownership clock Varies by lender About 6 months from recording
Best fit Rehab done, no cash needed Pulling capital out for the next deal

The loan amount guide on standard DSCR programs runs up to $3,000,000, and balances at the small end route through select lenders. Above $2,500,000, the network generally holds to 30-year fixed structures. All of it is subject to lender guidelines and credit approval.

The Break-Even Appraisal Math

The break-even appraisal is the payoff plus exit costs, divided by the program’s LTV ceiling. Below that number, the borrower brings cash to closing. Run it before you buy.

Say you hold a hard money balance and expect exit costs, and the two together equal 70% of what you think the property will appraise for. On a DSCR rate-and-term refinance of an investment property, that sits comfortably under the 85% ceiling. On a DSCR cash-out, it sits under the 75% ceiling with a thin sliver of room, which means almost no cash back. If the same total equals 80% of the appraised value, the rate-and-term still fits, but a cash-out does not. If the appraisal lands 10% under plan, a file that looked like 70% now looks closer to 78% to 80%, and the cash-out path closes off while the rate-and-term path survives.

That is why appraised value does not equal borrowable value. The LTV ceiling limits it, and created equity is not all accessible.

The second test is coverage. Picture a rehabbed duplex with a signed lease that comfortably covers the bridge’s interest-only payment. The new loan is larger and amortizing. On the DSCR loan, the same rent might sit near 1.0x or just under. The property appraised fine, and the file still gets stuck. A larger down payment, a lower balance, or an interest-only period through a select lender can shift the number, but none of those erases credit floors, reserve rules, or property eligibility. The strongest files clear both tests: enough equity and enough rental coverage.

One more caution. A DSCR above 1.00 is not positive cash flow. Repairs, vacancy, management, utilities, and capital costs sit outside the calculation.

Where Do the General Rules Break?

Six edge cases come up repeatedly, and each one has a standard response.

Delayed financing usually does not fit a hard money buyer. This is an agency concept, not a DSCR one, so treat it as contrast only. The Fannie Mae Selling Guide on cash-out refinances generally requires at least one borrower to have been on title for six months before disbursement, and an existing first mortgage being paid off must be at least 12 months old. Its delayed financing exception skips the title clock, but it requires an arm’s-length cash purchase with no mortgage financing on the settlement statement. A hard money loan is secured by the property, so it counts as mortgage financing. The exception also returns documented cost, not created equity. None of these agency rules govern DSCR loans, which follow the wholesale network’s own guidelines.

The maturity squeeze. The bridge has to outlast the rehab, lease-up, seasoning, appraisal, and underwriting. Hard money terms run 6 to 18 months on the current program, and there are no multi-year options. If the note will mature before the DSCR file can finish, the choices are an extension from the hard money lender (priced against the extra cost), a payoff-only structure, or bringing cash. Plan the exit before signing the bridge.

The appraisal comes in below plan. The options are bringing cash, paying the bridge down first, or asking the hard money lender for more time. A reconsideration request with recent in-neighborhood sales and documented rehab scope can recover value when comps came in light, but it is not a given.

Short-term rental rents. The appraiser’s rent schedule documents rent supported by monthly leases. A nightly rate multiplied by 30 does not stand in for a market rent. Fannie Mae’s appraiser guidance describes the form as the way an appraiser documents estimated monthly market rent on a single-family investment property. Programs differ on how they treat short-term income. Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.

The two-step exit. Some investors pay off the bridge with a rate-and-term DSCR loan first and cash out later. That costs two closings. Whether the first refinance resets the seasoning clock is lender-specific, so confirm it before choosing this route.

Property type. DSCR loans through the network are not offered on manufactured homes (single- and double-wide), log homes, or barndominiums. A hard money rehab on one of those cannot take this exit.

What Does the File Need on the Table?

The processor wants each piece to prove one point. Missing items are the quiet reason files stall.

Document What it proves
Payoff letter with per-diem Exact amount owed and good-through date
Recorded deed and purchase settlement statement Title date and ownership clock
Rehab invoices or draw history Scope completed and cost basis
Signed lease In-place rent
Entity documents and vesting Who owns the property
Insurance binder Coverage at the full loan amount
Reserve statements Liquid funds for the reserve requirement

Title clearing is where files slip. A mechanic’s lien from rehab work, a mismatch between the deed and the entity name, or a stale binder can hold the file up. Resolve those before the appraisal, not during underwriting. Loans to entity-titled borrowers are subject to lender program eligibility, so confirm the entity structure early.

What About Delaware Specifically?

No rule specific to Delaware changes how a DSCR loan takes out a hard money loan. What is local is the closing: the title company or attorney in the county where the property sits runs the payoff and recording. Recording and transfer costs are county and state specific, so ask the settlement agent for an itemized estimate when the exit file opens. Investors often hold property in a Delaware-formed LLC even when the property is elsewhere, so confirm the vesting on the deed matches the entity named on the loan. Rental licensing and inspection requirements also vary by jurisdiction. Verify them with the local authority before leasing, since a lease that cannot be supported can weaken the rent evidence.

Which Path Fits Your Situation?

Match the situation to the structure, and decide before the appraisal is ordered.

Situation Likely path
Rehab done, leased, no cash needed Rate-and-term DSCR exit
Rehab done, leased, want capital back DSCR cash-out, after the ownership clock
Rehab unfinished or unleased Hold the bridge, finish work, then exit
Appraisal or coverage falls short Bring cash, pay down, or seek more time
Owns the property in an LLC Confirm entity eligibility first

Frequently Asked Questions

Can I use my own after-repair value to size the exit loan?

No. The new lender uses its own appraisal for value and market rent. Your after-repair estimate is useful for planning, but the loan is sized on what the appraiser supports, capped by the LTV ceiling for the transaction.

Does the ownership clock start when the rehab ends?

No. On DSCR cash-out refinances it is generally measured from title recording, with about 6 months the common expectation across the wholesale network. Some lenders treat a rate-and-term payoff differently, so confirm the start date in writing.

Does the hard money loan carry a prepayment penalty?

On the current program, hard money typically carries none, though it varies by lender. The new DSCR loan may carry its own prepayment terms, which matter if you plan a second refinance soon after the first.

What credit score does the exit loan need?

A 620 floor exists in parts of the network, most DSCR programs want around 660, and 700 or above opens the strongest leverage tiers. Qualification is subject to lender guidelines, credit approval, and property review.

What if rent does not cover the new payment?

Coverage below 1.00 is available through select lenders in the network, with leverage and terms adjusted. Other options include paying the balance down, bringing cash, or extending the bridge while the rent is improved.
