How to Remove an Ex-Spouse From a First-Time Airbnb DSCR Loan

How to Remove an Ex-Spouse From a First-Time Airbnb DSCR Loan

The Quick Read: A divorce decree and a quitclaim deed do not take an ex-spouse off the loan; only a payoff, a refinance, or a lender-approved assumption with a written release does. For most first-time Airbnb owners, the practical route is a new DSCR refinance that pays off the joint note, with the keeping spouse or an LLC qualifying alone on the property’s rental income, subject to lender guidelines.

  • The decree binds the two spouses. The lender never signed it.
  • A deed moves title. The note carries the debt.
  • A buyout usually makes the file a cash-out refinance, so the leverage cap applies.
  • Short-term rental collateral tops out at 70% LTV on a cash-out and about 70% on a refinance.
  • The keeping spouse must show credit, reserves, and rent coverage alone.

Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.

Why Doesn’t the Decree Remove Your Ex?

A decree divides responsibility between two people. It does not rewrite the contract with the lender. If both names sit on the note, both stay liable until the loan is paid off, however the judge split the property.

Title and debt are separate instruments:

Document What it does What it does not do
Divorce decree Assigns duties between spouses Bind the lender
Quitclaim deed Moves ownership Release anyone from the note
Promissory note Carries the debt Change with title
Payoff or written release Ends liability Move title on its own

Here’s the catch on quitclaims. Record the deed first and the ex owns nothing, yet still owes the debt. Missed payments land on both credit files. Not ideal.

Federal law also limits the old lender’s main remedy. A due-on-sale clause lets the lender demand payoff if the property transfers without consent. The statute, 12 U.S.C. §1701j-3, makes those clauses enforceable and lists exempt transfers for residential property with fewer than five units, including a transfer to a spouse under a divorce decree. Practitioner summaries often tie that safe harbor to the protected spouse living in the home. An Airbnb is typically not owner-occupied, so the exemption may not cleanly cover it. Skip the standalone deed and confirm with counsel. A refinance that pays off the old note makes the question moot.

What Are the Release Routes?

Three routes actually end the ex’s liability, and each has a weak point.

Route Who is released Where it fails
Refinance into one name or an LLC Ex, once the old note is paid Keeper must qualify alone
Assumption with written release Ex, if the lender signs off Many non-QM notes bar assumption
Sale and payoff Both Gives up the asset
Keep ex on the loan Nobody Ex stays exposed to every late payment

For a DSCR borrower, refinance is the common route. The loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines, so a post-divorce income drop does not decide the file. Assumption depends on the existing note. The statute encourages assumptions but does not force them.

How Does a DSCR Refinance Fit a First-Time Airbnb Owner?

It fits well, with one wrinkle: “first-time” can mean three different things. First-time homebuyer status matters for owner-occupied programs. First-time investor is a mild factor. First-time host is the one that changes underwriting, because short-term rental programs usually expect about 12 months of hosting history. A property rented by the couple for a year may satisfy that. A brand-new listing may not.

The ratio itself is simple. Monthly rent divided by the full housing payment (principal, interest, taxes, insurance, and any HOA dues) gives the coverage number. Across the wholesale network, short-term rental files typically want a 1.00 floor on both purchase and refinance. Sub-1.00 coverage is available through select lenders in the network, with leverage and terms adjusted. Clearing 1.00 is not the same as positive cash flow. Repairs, vacancy, management, utilities, and capex sit outside the calculation.

Programs on short-term collateral typically look for a 640+ credit score, and the keeping spouse’s credit is the one that gets pulled. Reserves vary by lender, leverage, and loan size, commonly around six months of PITIA. Check the keeper’s liquid cash before listing the house for refinance, because the ex’s accounts no longer count.

For more on programs generally, see the complete DSCR loans guide.

Can the Ex Be Forced to Co-Sign?

Not if the keeper qualifies alone. Under Regulation B, a creditor generally may not require another person’s signature when the applicant qualifies alone for the credit requested. If the applicant does not qualify alone, the lender may ask for a cosigner or guarantor, but cannot require it to be the spouse. The Federal Reserve’s Consumer Compliance Outlook notes that examiners cite lenders for demanding a spouse’s signature from a creditworthy individual applicant.

There is a carve-out. On secured credit, a lender may require the spouse’s signature on the instruments needed to make the collateral available, such as a valid lien or clear title. That is not the note. Check it before promising a borrower the ex never needs to sign anything.

How Is First-Time Airbnb Income Counted?

With no operating history, the file leans on one of three methods: an appraiser’s short-term-rental analysis (the 1007 form on one unit, the 1025 on two to four), a third-party projection such as AirDNA, or the 1007 long-term market rent as a fallback. Which one a lender accepts differs by program. Across the network, some lenders haircut projections and others want the appraisal analysis only.

Joint history creates its own friction. Booking history may sit in an account the ex controls. Permits or licenses may carry the ex’s name. If STR income cannot be supported, coverage may fall short and the file may not pass. Pull the platform payout history early, and confirm the permit and insurance can move to the keeper or the LLC.

How Should the Deed, Buyout, and Payoff Be Sequenced?

Settle the order before anything is recorded. Each sequence leaves someone exposed:

Sequence Ex’s exposure Keeper’s exposure
Deed first Liable on note, no title Due-on-sale risk, title gap
Refinance first Off the note Holds the loan without title until deeded
Same closing Off the note and title Cleanest

The cleanest path vests title at the refinance closing. Counsel on both sides should agree on the order. Also check the court order: many courts restrain borrowing or transferring property while a divorce is pending, so get written consent or an order before applying.

What Happens When You Pay the Ex Out?

A buyout turns the refinance into a cash-out. The new loan must cover the old payoff, closing costs, and the equalization payment, so the cash-out cap and the rent test both apply, and the lower limit governs.

Run the numbers on a hypothetical Airbnb valued at $500,000 with a modest existing balance. On short-term collateral, cash-out tops out at 70% LTV. If the old payoff plus the equalization payment lands above 70% of value, the file is short, no matter how strong the rent looks. Strong rent does not lift the leverage cap. Equity and coverage are separate tests, and the file has to clear both. Terms vary by lender guidelines, property type, leverage, credit profile, and full file review.

Seasoning is a third test. It is lender policy, not law. After a court-awarded transfer, some programs count from the original purchase date and others restart at deed recording. About six months is the common cash-out expectation across the network. Delayed financing is built for documented cash purchases and generally does not fit a court award. Ask the question before recording a deed.

Personal Name or LLC?

Moving title to an LLC before the refinance is generally not an exempt transfer and can trigger due-on-sale and seasoning problems. Vesting at the refinance closing avoids that. LLC borrowers are accepted subject to lender program eligibility, and the entity documents (operating agreement, EIN letter, good standing) need to be complete before the file goes in.

An LLC does not erase personal liability. Lenders typically require a personal guarantee. It also does not separate you from an ex unless the title and the loan are both restructured. Tax and reassessment treatment of spousal transfers varies by state, so ask an attorney or CPA.

What Does the Operating Transition Look Like?

Closing is not the finish line. Move the pieces that carry the business:

1. Transfer the listing account and payout bank details to the keeper or LLC.

2. Change the named insured on the property policy.

3. Re-register the short-term rental permit or license.

4. Update utility, tax, and HOA records.

5. Get the servicer’s written payoff or release confirmation for the ex.

That last item is the proof. Once the old loan is paid, it should show as paid and closed on the ex’s credit report. Ask the ex to pull the report afterward and confirm the account is no longer reporting as open.

DSCR vs. conventional financing

There are two common ways to finance an investment property, and they qualify you differently — here’s how investors weigh them.

DSCR loan

Why investors choose it

  • Qualifies on the property’s rental income — no personal tax returns, W-2s, or pay stubs needed to document income.
  • No personal debt-to-income ceiling to clear, so existing mortgages and obligations don’t cap your borrowing the same way.
  • Can be closed in an LLC, keeping the property inside a business entity.
  • Built for scaling — not held to the limit on number of financed properties that conventional financing applies.
  • Underwriting centers on the deal: generally qualifies when the rent covers the payment, a 1.00x coverage ratio being a common baseline (confirmed in underwriting).
  • Designed specifically for investment property, including long-term and, where the program allows, short-term rentals.
Conventional loan

Where it’s strong

  • Often the lowest ongoing financing cost for a buyer who fully qualifies on personal income — a fit for a first property or a cost-first purchase.

Trade-offs for investors

  • Requires full personal income documentation and must fit within a debt-to-income limit — salary, existing debts, and other mortgages all count.
  • Typically held in your personal name rather than a business entity.
  • Caps how many financed properties you can carry, which can become a ceiling as a portfolio grows.
  • Evaluates you as a borrower as much as the property, which usually means more paperwork.

How investors usually choose: a first or single property often optimizes for the lowest financing cost; portfolio builders often optimize for leverage, vesting in an LLC, and scaling past conventional caps. The right answer depends on your goals, the property, and current guidelines — both paths run through select lenders in Lendmire’s wholesale network, with eligibility and terms confirmed in underwriting.

Documents in Order

1. Decree or settlement agreement, and any consent or court order.

2. Recorded deed (or the deed to be recorded at closing).

3. Payoff statement for the old note.

4. Title report.

5. Appraisal with the rent schedule or STR analysis.

6. Platform payout history, insurance, HOA, and permit proof.

7. LLC documents if vesting in an entity.

What If You Can’t Qualify Alone?

Options include selling, trading other assets for the ex’s share, staging the payout, or adding a new party to the loan. The lender may ask for an additional party, but not the ex-spouse specifically. Keeping the ex on voluntarily is the borrower’s choice, and it keeps them tied to the debt. If the ex refuses to cooperate, a court-ordered sale or partition is the fallback. A hard money bridge does not remove anyone by existing; only a payoff does.

Common Mistakes

  • Treating the decree as a release.
  • Signing the deed before the refinance is lined up.
  • Assuming strong rent shortens seasoning or lifts the value cap.
  • Forgetting the buyout converts the file to cash-out.
  • Ignoring permit and insurance names in the ex’s name.

Key Terms Defined

Note: the signed promise to repay the loan.

Release of liability: written lender confirmation that a person no longer owes the note.

Quitclaim deed: a deed that moves ownership without touching the debt.

Equalization payment: the amount one spouse pays the other to even out the property split.

DSCR: monthly rent divided by the full monthly housing payment, or PITIA.

Due-on-sale clause: a clause letting the lender demand payoff after an unapproved transfer.

Frequently Asked Questions

Does a quitclaim deed take my ex off the mortgage?

No. It moves title only. The ex stays liable on the note until a payoff or a written release, and missed payments hit both credit files.

Can I get a DSCR loan on my own right after divorce?

Often, yes. The file qualifies primarily on property-level rental income covering the payment, subject to lender guidelines, so a post-divorce income change matters less. Your credit, reserves, and the property still have to pass.

Will paying my ex out count as cash-out?

Usually. The new loan covers the old payoff plus the equalization payment, so the cash-out leverage cap applies. On short-term rental collateral, that cap is about 70% LTV.

Can the lender require my ex to co-sign?

Not if you qualify alone. If you don’t, the lender may ask for a cosigner or guarantor, but can’t insist it be your ex-spouse.

Can I use a brand-new Airbnb listing for qualification?

It depends on the program. Short-term rental files usually expect about 12 months of hosting history, and new listings may fall back on an appraiser’s rent analysis or the long-term market rent.
