STR Preemption vs Enforcement States for a DSCR Portfolio Operator

STR Preemption vs Enforcement States for a DSCR Portfolio Operator

The Quick Read: Preemption states reduce the odds that a short-term rental file fails the legality check, but they do not remove it, and enforcement states do not rule out STR income, they just make the check address-specific and harder to pass. For a portfolio operator, the loan question is the same in both: can the lender count the STR income at this address, and what is the fallback if it cannot?

  • Preemption states limit what cities can ban or cap. Fire, building, noise, parking, and tax rules still apply.
  • Enforcement states, as this article uses the term, leave cities free to restrict, so each address needs its own verification.
  • On STR files, select lenders in Lendmire’s wholesale network typically look at purchase leverage up to 75% LTV and cash-out or refinance leverage up to 70%, with a 640 minimum score.
  • Coverage starts at 1.00 on both STR purchases and refinances. DSCR measures rent against the housing payment only, so clearing 1.00 does not mean positive cash flow.
  • Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.

Here is the honest answer on who each option suits. A preemption state suits the operator who wants repeatable underwriting across many doors and can live with a thinner list of markets. An enforcement state suits the operator who has done the address-level work, holds a permit that can survive a sale, and accepts that one council vote can change the income. Neither is safe by label. Both are tested house by house.

As of Oct 15, 2026 · General Freddie Mac market benchmark, not a Lendmire loan offer. Nightly rate, occupancy, taxes, and insurance are editable estimates. Qualifying income for short-term rentals varies by program — some use appraisal market rent, others use documented STR history or projections — and is confirmed in underwriting. Not a Loan Estimate, approval, or commitment to lend. Program availability and eligibility are subject to lender guidelines, credit approval, property review, and underwriting.

Brokers see this from the loan side. Across the network, the legal-use question comes before the coverage math. If STR income cannot be counted, the file falls back to long-term rent, and the coverage ratio changes with it. For the full program picture, see the complete DSCR loans guide.

Key Terms Defined

Preemption: a state law that takes some regulatory power away from cities and counties.

Enforcement state: this article’s label for a state with no STR preemption, where local rules, permits, caps, and fines decide the outcome.

DSCR: debt service coverage ratio, meaning monthly rental income divided by the full housing payment (principal, interest, taxes, insurance, and any HOA dues).

Grandfathering: letting an existing permit or use continue after a new rule takes effect.

Legality gate: the lender’s check that STR use is lawful at the address before STR income counts.

Side-by-Side

Factor Preemption state Enforcement state
Who sets the limits State law caps local power City or county decides
Ban or cap risk Lower, but varies by statute Higher, address by address
Legality check Often answered by statute plus permit Zoning, permit, cap status per address
Income basis STR history or appraiser rent schedule Same, with long-term rent as live fallback
Property types Statute scope can exclude some (e.g., five-plus units in Florida) Set by local code
Entity vesting Permit rules may still tie to owner Ownership limits exist in some cities
Reserves Vary by lender, leverage, loan size Same, and lenders may ask for more cushion
Biggest surprise HOAs, local safety and tax rules Caps, non-owner-occupied bans, permit transfer

The financing columns match because the loan does not change by state. Only the odds of clearing the legality gate change. Pricing is outside this comparison and lives in the calculator.

What Preemption Actually Means

Preemption is a spectrum. The Local Solutions Support Center lists Arizona, Florida, Idaho, Indiana, Iowa, Nebraska, Nevada, New Hampshire, North Carolina, Tennessee, Utah, Virginia, and Wisconsin as states that preempt local STR regulation. Treat that as one advocacy group’s snapshot, not an official register.

The statutes differ in what they take away:

  • Arizona bars cities from prohibiting STRs or restricting them by classification, use, or occupancy, except as the statute allows.
  • Nebraska bars ordinances that expressly or effectively prohibit STRs.
  • Idaho is described as the broadest. One tracker, StartBusinessByState, says a 2026 bill bars local licensing, fees, permits, and registration. Rent Responsibly, an STR industry advocacy group, describes it more simply as requiring equal treatment with other residential uses. The two differ on whether any registration survives, so read the statute text.
  • Indiana is narrower. Its 2026 law stops cities and counties from capping rental properties, but registration, inspections, and safety standards can remain if they do not work as a cap. Two cities keep existing caps until January 1, 2028, per Rental Scale-Up.
  • Florida is partial. State law bars local bans and limits on duration or frequency, but not for ordinances adopted on or before June 1, 2011, per STR Law Map. Florida’s vacation-rental definition also stops at four-family houses, so a five-unit building sits outside it.

Texas gets misread here. One compliance guide, Staystra, says Texas has no STR-specific preemption statute. A pro-host reputation is not a law.

What Counts as an Enforcement State

California is the clean example. State law does not preempt local STR ordinances, and SB 346 lets local governments require platforms to report listing addresses and show license numbers, per the StartBusinessByState tracker above. Big-city regimes run from effective bans on investor units to primary-residence-only rules to capped or lottery systems, according to Lofty’s city guide. Caps are enforced through platform data sharing, and exceeding them can cost fines or the registration.

Smaller markets are joining. Madison, Wisconsin has a proposed cap of 190 permits, and non-resident-owner investment units sit at the front of the line to be locked out, per AirROI. Decatur, Alabama fines unpermitted hosts $500 a day, per Revenue Naire.

Enforcement does not mean hostile everywhere. It means the answer sits in a city code, not a state statute.

When a Preemption State Is the Better Fit

Choose preemption states when repeatability matters more than market selection. Four situations favor them:

  • You are scaling fast. Statute-level answers shorten the diligence list per address, which suits a portfolio adding doors.
  • You rely on STR income to clear coverage. A file that needs the STR figure to reach 1.00 is fragile where a cap or ban can appear. Preemption lowers that risk.
  • You want permits that follow the property. Statutes that bar local permit barriers reduce transfer surprises on a sale or refinance.
  • You hold non-owner-occupied units. These are the units enforcement cities target first.

Preemption is not immunity. Local fire, building, noise, parking, and tax rules stay enforceable. HOAs and CC&Rs sit outside preemption too, and Indiana’s 2026 law shifts rental governance toward HOAs. Laws also move. Arizona officials are pushing to reform the 2016 law, per BiggerPockets. A pro-STR statute can change.

When an Enforcement State Is the Better Fit

Choose enforcement states when the local market is strong enough to justify the work, and when you can show the address is lawful today. They fit operators who:

  • Already hold a permit that is documented, transferable, and tied to the property.
  • Buy where established rules exist. One BiggerPockets article calls established regulations a positive sign, and says places with no rules at all make the author nervous, since one vote could shut everything down, per BiggerPockets.
  • Have a long-term-rent fallback if the permit fails. The deal should still make sense there.
  • Want to be in markets with supply limits, where permits are scarce and existing hosts have an edge.

Grandfathering helps but is not a guarantee. Posts on BiggerPockets say changes typically affect only new permits, “But not always,” per a BiggerPockets thread. That is anecdote, not law. Some municipalities write rules that block permit transfer, which matters on a purchase or refinance.

How the Legality Gate Hits a DSCR File

Lenders in the network commonly want proof that STR use is lawful before they count STR income. Typical documents include the local permit or registration, the state lodging-tax account, HOA confirmation, platform and property-manager statements, and insurance that covers STR use. The income itself may come from host history, an appraiser’s rent schedule, or a third-party projection. Appraisers commonly use Form 1007 for single-family and Form 1025 for two-to-four units.

If the gate fails, the file does not necessarily die. It usually reverts to long-term rent, and coverage is recalculated on that number. Select lenders in the network offer coverage below 1.00 with leverage and terms adjusted, which is a separate path from programs that start at 1.00.

On STR collateral, the network typically allows purchases up to 75% LTV and cash-out or refinance up to 70%. Expect a 640 or better score and about 12 months of hosting history. Reserves vary by lender, leverage, loan size, and transaction type. Standard programs reach $3,000,000. These are typical ranges, subject to lender guidelines, and not a commitment to lend. Properties such as manufactured homes, log homes, and barndominiums are not offered.

For a portfolio, run each address on its own. A modeled example: say one door in a preemption state clears roughly 1.25x on STR income and the next, in a capped city, drops to near 1.0x if long-term rent is used. Those are illustrative ratios, not market data. The second door is the one to underwrite on the downside case.

DSCR counts rent against the payment only. Repairs, vacancy, management, utilities, and capex sit outside it, so a file that clears 1.00 can still lose money. Entity and Portfolio Notes

Holding properties in an LLC does not sidestep permit rules, subject to lender program eligibility on vesting. Some ordinances tie permits to the owner or require a local contact, and ownership-count limits exist in some cities, per Staystra’s permit-cap guide. A pending Kentucky bill would ban caps on the number of properties an operator may manage. Pending bills also sit in Ohio and Pennsylvania. Entity vesting for short-term rental files varies by lender program, so check both the local code and the lender’s guidelines.

A practical order of operations: confirm state law, then county and city rules, then zoning, then HOA documents, then the tax account, then the permit’s transferability. Do it before the contract goes hard, not after.

DSCR vs. conventional financing

There are two common ways to finance an investment property, and they qualify you differently — here’s how investors weigh them.

DSCR loan

Why investors choose it

  • Qualifies on the property’s rental income — no personal tax returns, W-2s, or pay stubs needed to document income.
  • No personal debt-to-income ceiling to clear, so existing mortgages and obligations don’t cap your borrowing the same way.
  • Can be closed in an LLC, keeping the property inside a business entity.
  • Built for scaling — not held to the limit on number of financed properties that conventional financing applies.
  • Underwriting centers on the deal: generally qualifies when the rent covers the payment, a 1.00x coverage ratio being a common baseline (confirmed in underwriting).
  • Designed specifically for investment property, including long-term and, where the program allows, short-term rentals.
Conventional loan

Where it’s strong

  • Often the lowest ongoing financing cost for a buyer who fully qualifies on personal income — a fit for a first property or a cost-first purchase.

Trade-offs for investors

  • Requires full personal income documentation and must fit within a debt-to-income limit — salary, existing debts, and other mortgages all count.
  • Typically held in your personal name rather than a business entity.
  • Caps how many financed properties you can carry, which can become a ceiling as a portfolio grows.
  • Evaluates you as a borrower as much as the property, which usually means more paperwork.

How investors usually choose: a first or single property often optimizes for the lowest financing cost; portfolio builders often optimize for leverage, vesting in an LLC, and scaling past conventional caps. The right answer depends on your goals, the property, and current guidelines — both paths run through select lenders in Lendmire’s wholesale network, with eligibility and terms confirmed in underwriting.

A Balanced Verdict

Choose preemption states for repeatable underwriting and lower legality risk. Choose enforcement states for specific, verified addresses where the local market justifies the work. A mixed portfolio is normal. The discipline is the same in both: underwrite each address on its own, keep the long-term-rent fallback in view, and never lean on a state label.

If you are buying or refinancing a rental property and want to see how the numbers work, Lendmire can help you compare DSCR loan options based on the property income, credit profile, leverage, and investor goals. Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

Frequently Asked Questions

Which states have STR preemption?

One advocacy group lists Arizona, Florida, Idaho, Indiana, Iowa, Nebraska, Nevada, New Hampshire, North Carolina, Tennessee, Utah, Virginia, and Wisconsin. Scope differs widely, and classifications vary by source, so check the statute for the state you care about.

Does preemption stop HOA bans?

No. HOAs and CC&Rs operate outside state preemption, so an association can still restrict rentals. Get the governing documents before you rely on STR income.

Can a lender count STR income if a city later imposes a cap?

It depends on the lender and the file. Legal use is generally tested at underwriting. If a later cap blocks the income, the property may need to be underwritten on long-term rent. Grandfathering for existing permits varies by city.

Does Texas have STR preemption?

Not an STR-specific statute. Treat Texas as a local-rules market.

What if the coverage ratio falls below 1.00 on long-term rent?

Select lenders in the network offer coverage below 1.00, with leverage and terms adjusted. Eligibility depends on the lender, credit profile, reserves, and property review.
