Does a Florida Homeowner Pay Documentary Stamps on the Whole HELOC?

Does a Florida Homeowner Pay Documentary Stamps on the Whole HELOC?

The Quick Read: Yes. When a Florida mortgage secures the line, the state’s documentary stamp tax is figured on the maximum line, not on the balance you draw. A second one-time tax follows the same full-line logic.

  • Doc stamps run 35 cents per $100 of the maximum line, paid once at recording.
  • A separate nonrecurring intangible tax of 2 mills (0.2%) also applies to the full line.
  • The $2,450 cap on notes does not shield a recorded mortgage.
  • No deed is recorded on a HELOC, so deed-side taxes never enter the picture.
  • Your income documentation changes qualification, not the tax.

What Does the Tax Actually Attach To?

The tax attaches to the recorded mortgage, not to your spending. Florida taxes the lien that secures the debt. A HELOC records a lien for the full credit limit, so the full limit is the taxable amount.

Editable Equity Scenario

How large a line the equity supports in Florida.

An equity line is sized by combined loan-to-value, occupancy, and credit — not by rental coverage. Switch the occupancy or the credit band and the ceiling moves with it.

70%Max combined LTV, this tier
$500K maxLine cap, this tier

Investment-property lines require a 700 minimum credit score; second-home lines start at a 640 minimum and primary-residence lines at 600, and the combined-LTV ceiling steps down as the credit band drops on primary-residence and second-home lines and holds on investment-property lines; the line cap steps down on primary-residence lines and holds at every tier on investment-property and second-home lines.

A debt-to-income ratio above 45% requires 680+ credit. Profiles under 640 are limited to single-family homes. At least 75% of the approved line is drawn at closing. Ceilings, floors, and caps update from Lendmire’s centralized guideline source.

Illustrative estimate only — not a quote, Loan Estimate, approval, or commitment to lend. The rate is an editable assumption; equity-line pricing is variable through both the draw and repayment periods and never converts to fixed. Occupancy and credit drive the ceiling together: an investment property tops out at 70% combined LTV (minimum credit 700, line cap $500,000); a second home tops out at 90% combined LTV (minimum credit 640, line cap $500,000), with the ceiling stepping down as the credit band drops (the cap holds at every tier); a primary residence tops out at 90% combined LTV (minimum credit 600), and its $750,000 maximum line is available only at 75% combined LTV or below with a 700-or-better credit profile (720 on the longer-runway program) and a full appraisal. Lines above $500,000 require a full appraisal. Credit, debt-to-income, property type, and full underwriting review all affect the final line.

Florida’s Chapter 201 taxes recorded mortgages and other liens, including future-advance mortgages. The Department of Revenue’s advisement on mortgage taxability sets the tax at 35 cents on each $100 of the indebtedness. It also says taxability comes from the form and face of the document, plus anything the document expressly incorporates. In plain terms, the maximum line written in the mortgage or the credit agreement it points to sets the tax base.

That is the whole mechanism. You can borrow nothing for ten years and the tax still landed on day one.

Why Is an Undrawn Balance Taxed?

Because the state taxes the obligation the mortgage secures, even a contingent one. Whether you ever draw it does not change what the lien secures. The rule on revolving lines of credit points the same direction: the tax is computed on the maximum amount of the secured line.

Here is a practical wrinkle from the investment side. On the equity lines Lendmire places through its wholesale network, at least 75% of the line is drawn at closing. So the whole-line-versus-drawn question is partly academic. Most of the line is already borrowed on day one.

The Second Tax Most People Forget

The intangible tax is a separate one-time charge, and it also follows the whole line. Chapter 199 of the Florida Statutes provides that for a line of credit, the nonrecurring tax is paid on the maximum amount of the line. No further tax is due on borrowing under it. It also says the lender is the taxpayer but may pass the cost to the borrower.

Two details matter:

  • The tax is collected when the mortgage is recorded. If it is not recorded in a timely manner, the tax is paid directly to the Department of Revenue.
  • The tax is capped at the property’s fair market value. The line itself would rarely exceed that on a home-equity product.

The annual intangible tax people remember from years ago has been repealed. The tax discussed here is one-time.

The Math at Several Line Sizes

The combined state tax is about 0.55% of the maximum line, paid once. Doc stamps round up to the next $100. The figures below are arithmetic from the published tax rates, not quotes from any source, so your closing statement controls.

Maximum line Doc stamps (0.35%) Intangible (0.2%) Total
$100,000 $350 $200 $550
$250,000 $875 $500 $1,375
$500,000 $1,750 $1,000 $2,750

Doc stamps are calculated at 0.35% of the secured obligation. The larger figures in the table above are the outer edge of what these products will carry, because lines on this network top out at $750,000 on a primary residence and $500,000 on an investment property.

Does the $2,450 Cap Save You?

No. That cap exists for notes and other written obligations. A free-floating calculator built around the cap will understate your cost badly on any sizable line.

An unsecured credit agreement might avoid the tax on its own. That does not help here. The moment a mortgage is recorded to secure the line, the recorded document is taxable.

Do Later Draws or an Unused Line Change Anything?

On a true revolving line, later draws and repayments inside the stated maximum do not trigger new intangible tax. The full line was taxed once. Raising the maximum later creates new tax on the increase.

The doc stamp side has a wrinkle. Older advisements treat a future-advance mortgage differently, with tax due when each advance is made and only on that advance. The rules distinguish a true revolving line, taxed up front on the maximum, from a future-advance clause that raises the secured amount over time. Which one your documents are is a drafting question. Ask the title agent or closing attorney to confirm how your lien is written. Some older advisements on this point conflict with the current statute, and the current statute controls.

As for refunds: nothing in the sources suggests the tax is returned if you never use the line. Size the line for what you will really use.

Why Deed Taxes Do Not Apply

A HELOC on a home you already own records no deed. The deed doc stamp rate and the Miami-Dade deed surtax apply to deeds. They have no role here. The tax on the debt side is a statewide figure, so it reads the same in Miami-Dade as anywhere else.

Who Pays?

The lender is the legal taxpayer on the intangible tax, but it can pass the amount to you. In practice, expect it on your closing statement as a borrower cost. Ask for both taxes itemized. A lender fee waiver does not erase them, since they are state taxes, not lender fees.

Does Rental Status or Documentation Change It?

Neither one changes the tax. No rental exemption applies, and income documentation only affects whether you qualify for the loan. The tax follows the recorded mortgage.

That said, rental and investment status matters for the loan itself. Here is how the equity-line terms differ on the wholesale network Lendmire works with:

  • On an investment property, the combined loan-to-value ceiling is 70%. That ceiling is not higher on any tier.
  • The investment line caps at $500,000 total, with a 700 minimum credit profile, per lender guidelines.
  • On a primary residence, the ceiling reaches 90% CLTV only at a 720 credit profile and only on lines up to $500,000. Lines up to $750,000 are capped lower, at 75% CLTV.
  • Investment lines run a five-year interest-only draw followed by a 25-year repayment.
  • The title must sit with the individual borrower or a revocable living trust. A property already deeded to an LLC needs a vesting change, or a DSCR cash-out instead, per lender program requirements.

All of that is subject to lender guidelines and full file review. It is not a commitment to lend.

HELOC Tax vs. a DSCR Cash-Out Refinance

The tax alone should not decide this. A DSCR cash-out refinance, which is a new first mortgage that pays off the old one and hands you the difference, is taxed on the full new balance. A HELOC is taxed on the full line. Renewals that merely extend an existing obligation can be exempt from additional tax, but tax can be due on any increase in the secured amount. The exemption turns on how the deal is structured.

The real comparison is about sizing and structure. A DSCR cash-out on standard rentals tops out around 75% LTV across most of the network, with about 6 months of seasoning as the common expectation. It qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. A HELOC is reviewed on your personal income, with a 50% maximum debt-to-income ratio. Details are in Lendmire’s complete DSCR loans guide. Different tools. Different tradeoffs.

How to Size the Line

Treat the line size as a cost decision, because the state tax scales with it. A practical checklist:

1. Decide what you will really use. An oversized line raises day-one closing cost and the tax never comes back.

2. Remember that 75% of the line is drawn at closing on these programs, so match the line to a real need.

3. Ask the closing agent whether your documents create a revolving line or a future-advance structure.

4. Request both taxes itemized on the closing statement.

5. If you plan to raise the limit later, expect new tax on the increase only.

Consider a landlord comparing a $250,000 line against a $500,000 line. The larger one adds roughly $1,375 in state tax at closing, on top of everything else, whether or not that money gets used. That cost belongs in the sizing decision.

Myths, Quickly Cleared Up

“I only pay on what I draw.” Wrong for a typical recorded line. The tax follows the maximum secured amount.

“Doc stamps cap at $2,450.” That cap is for notes, not recorded mortgages.

“Doc stamps are a seller’s deed tax.” That is a different charge. The mortgage tax applies to the lien.

“Every draw triggers new tax.” On a true line, intangible tax is paid once on the full line.

“My income documentation changes the bill.” It changes whether you qualify, not what the state taxes.

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

Key Terms Defined

Documentary stamp tax: A Florida tax on certain recorded documents, charged here at 35 cents per $100 of the secured amount.

Nonrecurring intangible tax: A one-time Florida tax on debt secured by a mortgage, charged at 2 mills on the full line.

Recorded mortgage: The lien filed with the county clerk that secures the debt and sets the tax base.

Future-advance clause: Mortgage language that secures additional borrowing later, which can be taxed differently from a true revolving line.

CLTV: Combined loan-to-value, meaning all liens on the property divided by its value.

Frequently Asked Questions

Do I pay on the whole line or only what I draw?

The whole line. Florida taxes the maximum amount the recorded mortgage secures, even if you never draw it. The intangible tax follows the same full-line logic, and later draws inside the maximum do not add to it.

Can I get a refund if I never use the full line?

Nothing in the sources reviewed provides one. Treat the tax as a sunk cost at closing, and size the line to your real need rather than hoping to recover it.

Can the lender waive these charges?

No. Both are state taxes. A lender can waive its own fees, but that does not remove the doc stamp or intangible tax, though the lender may decide whether to pass the intangible tax to you.

Does the Miami-Dade rate apply to my HELOC?

No. The Miami-Dade surtax applies to deeds, and a HELOC records no deed. The mortgage tax is a statewide figure.

Does it matter if the property is a rental rather than my home?

Not for the tax. There is no rental exemption. It matters for the loan terms, though: investment lines top out at 70% CLTV and a $500,000 line, as covered above.
