How to Buy a Short-Term Rental in Another State

How to Buy a Short-Term Rental in Another State

The Quick Read: You can buy a short-term rental in a state where you don’t live, because a DSCR loan is reviewed primarily on property-level rental income covering the payment, subject to lender guidelines, not on where you live. What decides the deal is whether the rental is legal at that address, how the income gets documented, and whether your entity and tax setup work across state lines.

  • Your home state is not the underwriting variable. The property is.
  • Across our wholesale network, STR purchases go up to 75% LTV, with a 640+ score and a 1.00 coverage floor on select programs.
  • Check the local ordinance and HOA documents before you make an offer.
  • A loan that clears 1.00 is not the same as positive cash flow.
  • Rules, caps and permits can change after you close, and the loan does not cover that risk. Leverage, reserves, and pricing vary by lender and program; the final terms follow the full file review.

Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income. That one check shapes everything below.

Does Living Elsewhere Hurt Your Loan?

No. DSCR stands for debt service coverage ratio. It compares a property’s rent to its full monthly obligation: principal, interest, taxes, insurance, and any HOA dues (what lenders call PITIA). DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage.

Across the programs we place files with, the lender looks at the property’s value, its expected rent, and your credit and reserves. Your zip code is not a line item. No state-level LTV overlay is in force in the network, so the purchase tiers are the same everywhere. Our complete DSCR loans guide covers the basics if the term is new.

Key Terms Defined

STR (short-term rental): a property rented to guests for short stays, usually through a booking platform.

LTV (loan-to-value): the loan amount divided by the property’s value.

Preemption: a state law that limits what cities and counties can do about short-term rentals.

Seasoning: the waiting period a lender wants between two events, such as buying and refinancing.

Reserves: liquid savings a lender wants you to hold after closing, often counted in months of PITIA.

Foreign qualification: registering an LLC to do business in a state other than where it was formed.

Step 1: Check That the Rental Is Legal at the Address

Start here, before you fall for a listing. BiggerPockets lists the local items to check: licenses and business IDs, primary-residence requirements, lodging taxes, parking standards, and caps on operating days. Pull the actual ordinance from the municipal code. Don’t take the listing agent’s word for it.

If the code is hard to find, call the city planning department. The call also tells you how hard the city enforces its rules.

State law adds a layer. AirRoi explains that preemption laws override local governments’ ability to ban or cap short-term rentals, and it names Arizona and Florida among the states with them. Houfy also lists Texas, Idaho and Indiana, and calls Hawaii the most restrictive state.

Here’s the catch. Preemption is not total. Fire, building and health codes, noise rules and parking requirements still apply. HOA and condo covenants are private contracts, so an HOA can still restrict rentals in a preemption state.

Some cities limit short-term rentals to primary residences. That effectively shuts out non-owner investors. And a “friendly” state doesn’t make every city friendly.

Step 2: Underwrite the Income the Way a Lender Will

A long-term rental is judged on a lease or an appraiser’s market rent. A short-term rental is judged on a different set of evidence, and that is where out-of-state buyers get surprised.

Across our network, short-term rental files commonly lean on one or more of these:

  • An appraiser’s short-term rental income analysis.
  • Twelve months of platform or property-manager statements on a rental you already operate.
  • Twelve months of bank statements showing the deposits.
  • On a purchase, a projection from a rental-analytics report, subject to lender review.

Lenders rarely take a projection at face value. They discount it, and the size of the discount differs by lender. Overstated income is a common cause of a smaller loan or a decline.

Appraisal forms matter here too. Form 1007 is the rent schedule for single-family homes, and Form 1025 is the equivalent for two to four units. Both were built around long-term lease comparables. An appraisal firm notes the GSEs never changed policy to let short-term rentals inform market rent. So the same house can show different coverage depending on whether the file uses the 1007 long-term rent or a short-term income analysis. Learn the method, then run both versions.

An out-of-state buyer depends on a local appraiser and a local manager’s data. Pick people who know short-term rentals.

What the Numbers Look Like at the Lender

For a short-term rental, the programs in our network typically look like this. Subject to lender guidelines, these are ranges, not promises.

Factor STR Purchase STR Refinance
Max LTV Up to 75% Up to 70% on STR cash-out
Minimum score 640 640
Coverage floor 1.00 1.00
Experience No hosting history needed; projected income from a market data report About 12 months hosting

Loan sizes run up to $3,000,000 on standard programs. Reserves vary by lender, leverage, and loan size, commonly around six months of PITIA.

One more point. Clearing 1.00 does not mean positive cash flow. DSCR compares rent to PITIA only. Repairs, vacancy, management, utilities, and capex all sit outside the calculation. Short-term rentals carry heavy operating costs, so budget occupancy taxes, permits, and licenses as expense lines.

A larger down payment lowers the monthly obligation and can lift coverage. It won’t erase leverage caps, credit floors, or reserve rules. The strongest files have enough equity and enough rental coverage.

Properties the network doesn’t offer DSCR on include manufactured homes (single- and double-wide), log homes, and barndominiums. Check the property type before you fall in love with a cabin.

Step 3: Set Up the Entity Before You Close

Buying in an LLC is common, subject to lender program eligibility. The cross-state wrinkle is registration. Practitioner guides from registered-agent services say renting real estate usually counts as doing business, so an LLC formed in your home state generally needs foreign qualification where the property sits. CorpNet describes this, and InCorp notes that many investors simply form the LLC in the property’s state to avoid the extra layer.

Foreign qualification typically means a registered agent, a certificate of authority, and annual reports and fees. It doesn’t create a new entity. Rules differ by state.

Timing matters for the loan. Putting title in the LLC at closing is simpler than deeding it in afterward. Confirm the entity requirements with your lender before you sign a purchase contract.

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction. That is especially true across state lines, where you may owe tax in two places.

Where the General Rule Breaks

No hosting history. On a purchase you can often use projected income, since there’s no track record yet. Refinances lean on actual history, about 12 months in most short-term rental programs. Some lenders in the wider market don’t accept short-term income at all, which is why program selection matters.

Florida’s 2011 line. Luxe Haus Stays explains that Florida’s statute preempts local bans and frequency rules adopted after June 1, 2011, while older ordinances stay enforceable. Miami Beach is the usual example. A preemption state can still contain a city with strict rules.

HOA overrides. City permission means nothing if the bylaws forbid it. Read the covenants before you offer. BiggerPockets warns that violating them can lead to a lawsuit.

Silent cities. Some places have no short-term rental policy at all. Experienced hosts on BiggerPockets say they avoid these, because nobody knows what the city will adopt later.

Multi-unit properties. Two-to-four-unit short-term rentals shift to Form 1025, and income is analyzed unit by unit.

Rules that change after closing. Larger municipalities often grandfather existing permits, but not always. In one BiggerPockets thread, a host wasn’t grandfathered but could finish existing bookings. The same thread describes an investor who tests whether a deal would still cash flow as a long-term rental within three to five years. Steal that test. The loan can close on a property whose rules later change, and nothing in the DSCR math protects you.

The tax “loophole.” Practitioners describe a rule where a rental with an average guest stay of seven days or less may not count as a passive rental activity, if you materially participate. It’s narrower than social media suggests, and it’s tested every year, property by property. Material participation is harder to document from another state. It has no bearing on loan qualification. Ask your CPA.

The Decision in Practice: A Walk-Away Framework

Picture an investor in one state eyeing a four-bedroom house in another. The sequence that works:

1. Confirm the ordinance, permit status and HOA documents. Fail any, walk.

2. Confirm a local manager with real short-term experience. No manager, no deal.

3. Run coverage twice: once on long-term rent, once on an income projection after a heavy discount.

4. Check that the property type is eligible and that your score, reserves and experience fit the program.

5. Confirm the entity plan and whether foreign qualification is needed.

6. Write the offer with a regulatory contingency, and ask the seller for income and permit documentation.

If the deal only works on the optimistic projection, and a long-term-rental backup leaves coverage thin, that’s a signal. Thin coverage on a rental you can’t walk to is a risk worth sizing carefully. Sub-1.00 coverage is available through select lenders in the network, with leverage and terms adjusted. That path is a different program, not a lower floor on the standard one.

Frequently Asked Questions

Can I buy a short-term rental in a state where I don’t live?

Yes. A DSCR loan looks at the property, not your home address. The real hurdles are local legality, income documentation, and entity setup. Every file is underwritten individually, subject to lender guidelines.

Does my lender have to be in the property’s state?

Not in the way people expect. Lendmire is a broker arranging DSCR financing through select lenders in its wholesale network, across 41 markets including Washington, D.C. The network applies the same purchase tiers to every state, with no state-specific LTV overlay. Eligibility still depends on the file.

Can I use an LLC?

Often, subject to lender program eligibility. The added step is checking whether the LLC must register in the property’s state. Many investors form the LLC there from the start.

What if the city bans short-term rentals after I buy?

The loan stays in place, but the income may not. Grandfathering varies by city. Test whether the property would still cover its payment as a long-term rental before you commit.

Do I need a hosting track record?

Not always on a purchase, where projected income can be used. Short-term rental programs generally expect about 12 months of hosting experience, and refinances lean on actual history.

If you are buying or refinancing a rental property and want to see how the numbers work, Lendmire can help you compare DSCR loan options based on the property income, credit profile, leverage, and investor goals. Reach the team at 828-256-2183 or request a quote.
