How to Document a Lease to Your Parents on a Super Jumbo DSCR Loan

How to Document a Lease to Your Parents on a Super Jumbo DSCR Loan

The Quick Read: A lease to your parents can work on a super jumbo DSCR loan only when the parent lives in a separate household and the specific program accepts related-party tenants. Paperwork cannot fix a program that bars family tenants, so eligibility comes first and documents second. Lenders generally count the lower of the signed lease and the appraiser’s market rent.

  • Check program eligibility for related-party tenants before you sign anything.
  • A parent living in your household makes the property owner-occupied, and no lease changes that.
  • Charge market rent. A discount lowers coverage, and an above-market lease adds nothing.
  • Build a clean payment trail from the parent’s own funds.
  • Disclose the relationship at the start, not mid-file.

Is a Parent Lease Allowed at All?

Sometimes. The answer turns on household and program, not on how good the lease looks.

Short-term rental figures are estimates only and vary significantly by season, property type, management approach, and local short-term-rental rules — confirm local regulations before relying on them. Qualifying income for short-term rentals varies by program — some use appraisal market rent, others use documented STR history or projections — and is confirmed in underwriting. Not a Loan Estimate, approval, or commitment to lend. Program availability and eligibility are subject to lender guidelines, credit approval, property review, and underwriting.

DSCR loans are designed for non-owner-occupied investment properties. Because they are business-purpose investor loans, they are reviewed differently from a standard owner-occupied mortgage. That distinction drives the whole family-tenant question.

Across the wholesale network Lendmire works with, programs fall into three camps. Strict programs exclude related-party leases outright. Moderate programs allow them when rent is at market and payments are proven. Occupancy-only programs bar family living in the property but say little about a separate-household tenant. Lendmire arranges these loans as a broker, so the first step on any family-tenant file is matching the borrower to a program in the second or third camp.

Situation How lenders typically view it What to do
Parent lives in your household Owner occupancy; ineligible as an investment loan Choose another tenant or another loan type
Parent in a separate household Related-party tenant; program-dependent Confirm the program allows it, disclose early
Parent plus spouse or sibling as co-tenants Same test, more names to document List every adult on the lease
Parent pays through a subsidy or third party Needs extra paper Add the voucher contract and a ledger

An LLC does not change this. Occupancy statements and guarantees reach the people behind the entity, subject to program terms.

Why Does Market Rent Cap the Lease?

Because the appraiser’s opinion sets the ceiling. On most files, lenders count the lower of the signed lease and the appraised market rent.

The appraiser builds that opinion from comparable rentals, using the rent schedule that accompanies the appraisal (Fannie Mae’s Form 1007 for single-family, and the rent analysis within Form 1025 for two-to-four units). Those comparables ignore your relationship to the tenant. So three outcomes follow:

  • Lease at market: the rent counts as written.
  • Discounted lease: the lower figure counts, and coverage drops.
  • Above-market lease: the appraisal caps it, so the extra rent helps nothing.

Coverage is monthly rent divided by the full monthly obligation, including principal, interest, taxes, insurance, and any HOA dues. At 1.00 or better, files typically earn full leverage. A family discount can push a file under that line. Select programs in the network review coverage from 0.75 to 0.99, but LTV and terms adjust, subject to underwriting.

Month-to-month tenancy gets the same lower-of treatment. A fresh written lease at market rent is the usual fix.

Step-by-Step: How to Document the Lease

Run the steps in this order. Sequence matters more than volume.

1. Screen the program. Ask whether it accepts a related-party tenant and how it defines family. Get the answer in writing.

2. Confirm separate households. The parent cannot live with you or share your primary residence.

3. Disclose the relationship. Tell your broker at the start. File trouble rarely comes from missing paper. It comes from a relationship that surfaces late.

4. Order the appraisal with the rent schedule. Let the market-rent opinion come in independent of the family tie.

5. Set rent from comparables. Match the lease rent to the appraisal’s market figure.

6. Sign a written lease with a current term. Name every adult occupant.

7. Collect a deposit and start the payment trail. Use bank transfers from the parent’s own account.

8. Hand over the package with the lease, ledger, and rent support aligned.

What Goes in the Lease?

A lease for family should read like any arm’s-length lease. That is the point.

Clause Why underwriting cares Common parent pitfall
Rent and due date Must match the appraisal Informal “pay when you can”
Term and renewal Shows a current, enforceable lease Expired lease left running
Deposit Signals a real tenancy Waived for family
Repairs and maintenance Shows arm’s-length allocation Left unstated
Occupants and guests Confirms household separation Spouse or sibling unlisted
Late fees and default Shows the lease is enforceable Struck out as awkward

What a Clean Payment Trail Looks Like

Clean means regular, traceable, and funded by the tenant. A monthly bank transfer in the same amount from the parent’s account, matched to a simple ledger, does the job.

Flags include cash payments (no trail), irregular amounts, and rent that appears to come from you first. Rent that circles back to the borrower tells a lender the income is not real. If a parent lives on Social Security or savings, that is fine, provided the funds are theirs and the transfers are visible.

A perfect history helps the file. It does not raise the rent that counts.

Super Jumbo Overlays: What Changes at Higher Balances

Bigger loans mean tighter review. The ladder below shows the leverage ceilings for DSCR of 1.00 or higher through select wholesale programs, subject to underwriting. Bands are loan amounts, not purchase prices, so multiply price by leverage first, then read the band.

Loan band Purchase Rate-term Cash-out
$150K–$1M 80% 80% 75%
$1M–$1.5M 75% 75% 70%
$1.5M–$2M 75% 75% 60%
$2M–$3M 75% 75% 60%
$3M–$4M 65% 65% —
$4M–$6M 60% on review 60% on review —
$6M–$10M 60% on review 60% on review —

The top cell in each band needs a stronger score than the program floor. The floor is 660 on loans to $3,000,000 and 700 above $3,000,000. A lower score takes a lower leverage cell inside the same band. Reserves typically run six months on the subject property, twelve for first-time investors. Loans above $2,000,000 require two appraisals, which means two market-rent opinions. If your family lease sits far from both, that gap becomes visible twice.

In practice, fewer programs welcome related-party tenants as balances climb. That makes early program matching more important at this size. Where the General Rule Breaks

Edge cases decide more files than the rule does.

  • Parent lives with you. This is owner occupancy. No lease overrides it.
  • Two-to-four units. You cannot occupy a unit. A parent in one unit is a related-party question, and you in another is an occupancy problem.
  • Rent by the room or a master lease. The appraiser’s whole-house market rent generally sets income. A master lease to a relative’s business must look arm’s-length.
  • Blanket or portfolio loans. Rent is pooled, so one weak family lease can be absorbed if the rest carry it. Picture two relatives’ houses at 0.80x inside a pool of five that blends to roughly 1.04x. That is an illustration, not a promise.
  • Vacant or new purchase. The appraiser’s market rent stands in for a lease, and the loan is reviewed on property income alone. For many investors this is the cleanest route.
  • Separation or split. A spouse or children staying in the property counts as occupancy by your household.

“Super jumbo” is not a legal term. The only official anchor is the conforming limit, which for 2026 sits at $832,750 for one-unit properties, with a high-cost ceiling of $1,249,125, per the FHFA announcement. Each program draws its own super jumbo line.

DSCR vs. conventional financing

There are two common ways to finance an investment property, and they qualify you differently — here’s how investors weigh them.

DSCR loan

Why investors choose it

  • Qualifies on the property’s rental income — no personal tax returns, W-2s, or pay stubs needed to document income.
  • No personal debt-to-income ceiling to clear, so existing mortgages and obligations don’t cap your borrowing the same way.
  • Can be closed in an LLC, keeping the property inside a business entity.
  • Built for scaling — not held to the limit on number of financed properties that conventional financing applies.
  • Underwriting centers on the deal: generally qualifies when the rent covers the payment, a 1.00x coverage ratio being a common baseline (confirmed in underwriting).
  • Designed specifically for investment property, including long-term and, where the program allows, short-term rentals.
Conventional loan

Where it’s strong

  • Often the lowest ongoing financing cost for a buyer who fully qualifies on personal income — a fit for a first property or a cost-first purchase.

Trade-offs for investors

  • Requires full personal income documentation and must fit within a debt-to-income limit — salary, existing debts, and other mortgages all count.
  • Typically held in your personal name rather than a business entity.
  • Caps how many financed properties you can carry, which can become a ceiling as a portfolio grows.
  • Evaluates you as a borrower as much as the property, which usually means more paperwork.

How investors usually choose: a first or single property often optimizes for the lowest financing cost; portfolio builders often optimize for leverage, vesting in an LLC, and scaling past conventional caps. The right answer depends on your goals, the property, and current guidelines — both paths run through select lenders in Lendmire’s wholesale network, with eligibility and terms confirmed in underwriting.

Why Lenders Treat Family Leases Carefully

Federal housing law offers a useful analogy, though not a DSCR rule. Nolo notes that one condition for a lease to be treated as a genuine arm’s-length arrangement is that the rent not be substantially below fair market. Reading that as the reason lenders trust family leases less is an inference, not an industry rule. It does explain the instinct: collateral backed by a related-party lease looks softer than one backed by a stranger.

A market-rent lease helps the lender file and keeps the arrangement looking like a business.

Common Mistakes

  • Assuming a signed lease overrides a program bar on family tenants.
  • Believing the lender will not ask who rents the property.
  • Charging a discount and expecting the rent to count as written.
  • Paying the “rent” yourself through the parent.
  • Changing lease terms after the loan is placed.
  • Signing occupancy and business-purpose affidavits that conflict with the lease.

Disclose accurately. If a program will not accept a family tenant, the options are a different program, a different tenant, or a market-rent vacant purchase.

Key Terms Defined

Related-party lease: a lease between the borrower and a close relative, such as a parent.

Separate household: a tenant who lives, budgets, and pays bills apart from the borrower.

Owner occupancy: the borrower or the borrower’s household living in the property.

Market rent: the rent the appraiser supports from comparable rentals.

Arm’s-length: terms an unrelated landlord and tenant would plausibly agree to.

DSCR: monthly rent divided by the full monthly housing obligation on the property.

Frequently Asked Questions

Can my parents rent my super jumbo DSCR property?

Only if they live in a separate household and the program accepts related-party tenants. Many programs do not. Confirm eligibility before the lease is signed, since paperwork cannot cure a program-level bar.

What rent should I charge a parent?

Charge market rent, supported by comparable rentals and matched to the appraisal’s rent opinion. A discount lowers coverage, and anything above market is capped.

Does a deposit matter?

Yes. A deposit, like a signed term and a ledger, signals a real tenancy rather than an informal arrangement. Skipping it for family weakens the file.

What if my lender excludes family tenants?

Move to a program that accepts them, choose a non-related tenant, or buy vacant so the appraiser’s market rent carries the file. Lendmire can compare programs across its network, subject to lender guidelines.

What if my parents sometimes pay late?

A visible ledger with occasional late payments is better than an untracked arrangement. Enforce the lease terms as written, and keep the record consistent with the loan file.
