Can You Get an STR Loan If the City Is Restricting Airbnbs?

Can You Get an STR Loan If the City Is Restricting Airbnbs?

The Quick Read: It depends on whether short-term rental use is legal at that exact address, because lenders only count projected Airbnb income the property can lawfully earn. If it is not legal, the file usually falls back to long-term rent, and the loan may still work on those numbers, subject to lender guidelines. A ban, a closed permit pool, or a permit that does not transfer to you can all take STR income off the table.

  • Legal use at the exact address decides whether STR income counts at all.
  • A live Airbnb listing next door proves nothing about your property.
  • Many permits end when the seller sells, so check transferability before you make an offer.
  • Run the coverage ratio on both short-term and long-term rent before you commit.
  • STR purchase loans on the network’s strongest files go up to 75% LTV, with a 640 credit score minimum and about 12 months of hosting history expected. Leverage, reserves, and pricing vary by lender and program; the final terms follow the full file review.

Why Legality Decides the Loan

A DSCR loan qualifies primarily on property-level rental income covering the payment, subject to lender guidelines. DSCR stands for debt service coverage ratio. It divides the property’s monthly rent by the monthly housing obligation: principal, interest, taxes, insurance, and any HOA dues. That obligation is called PITIA.

Here is the catch. Income that cannot be legally earned cannot support a loan. Underwriters know this, so they ask whether the rental use is lawful before they trust any STR projection. DSCR loans do not ignore local law.

Say a buyer finds a house with a busy Airbnb listing. The listing may have run without a permit for years. A lender cannot count that history as bankable income.

Short-term rental rules can vary by city, county, HOA, and property type, so investors should confirm local rules before relying on projected rental income.

How Restricted Is “Restricted”?

Most restrictions are partial, and each type changes what a lender can use. According to Housing Solutions Lab, local governments use a toolkit that includes registration, permits, permit caps, owner-occupancy requirements, minimum stays, and outright bans. Investor-targeted rules hurt most, because they can shut out anyone who does not live in the home.

Restriction type What it means Typical effect on the file
Registration only Sign up and pay fees STR income usually usable
Permit with cap Limited number issued Needs an active, transferable permit
Primary-residence rule Only residents can host Investors often cannot qualify on STR income
Zoning limit Allowed in some districts only Depends on the exact parcel
Outright ban No STR use Underwrite on long-term rent

The pattern across wholesale lenders is consistent. Where the rental is legal and documented, the program’s STR rules apply. Where it is not, long-term rent becomes the basis, if the program allows that.

Three Layers You Must Check

Rules stack on top of each other, and the strictest layer wins. Check all three before you go further.

City or county. Look at the zoning district, the permit rules, and whether new permits are even available. A city may allow STRs in one district and bar them two blocks away.

State. A handful of states have passed preemption laws that limit local caps on residential rentals. Rent Responsibly tracks these bills. Preemption does not mean no rules, though. AirROI notes that safety, inspection, and registration requirements can survive.

HOA, condo, or deed restrictions. An HOA can ban STRs even where the city allows them. Many investors miss this layer until the lender asks for the HOA documents.

Enacted, Proposed, or Litigated

The status of a rule changes your options, and the same ban can mean different things at different stages. Rules in flux are a real risk. Ordinances get enjoined, amended, or frozen mid-process.

Status What to do
Enacted and in force Treat STR income as unavailable unless you hold a valid permit
Enacted but blocked in court Underwrite on long-term rent; do not rely on the outcome
Proposed Test the deal on long-term rent as the worst case
Permit freeze Check whether the freeze has an end date and what happens to renewals

Some lenders treat pending restrictions as a reason to decline STR income. That is a lender-level overlay, so ask before you assume.

What a Lender Wants to See

Proof of legality at the exact address is the core of the file. In our experience placing STR files, a clean package usually includes the following:

  • A permit or registration certificate, or a written statement from the city that none is required.
  • Tax registration and zoning evidence where they apply.
  • HOA or condo rules showing STR use is allowed.
  • Matching names across the permit holder, the borrower, and the title holder.
  • Confirmation that the permit stays in force through closing.

If legality is proven, STR income can be documented with platform history, third-party market data, or an appraiser’s rent analysis, depending on the program. If it is not proven, the file usually reverts to a long-term rent schedule. Appraisers use Form 1007 for single-family rent schedules and Form 1025 for small multifamily.

The Permit Transfer Trap

This is a common trap on purchases. A permit can be real and active for the seller and worthless to you. In some jurisdictions, permits do not pass to a new owner at sale. Some end if the property moves into a new LLC.

That matters because the listing may be marketed as a turnkey STR. If the permit does not transfer, a new buyer may be paying for a property that is worth only its long-term rental value. It also shrinks your pool of future buyers to people who can obtain a permit.

Ask these questions before you make an offer:

1. Does the permit transfer on sale, or must I reapply?

2. Are new permits still being issued, or is the pool closed?

3. Does the permit require the owner to live there?

4. Does moving the property into an LLC cancel it?

5. Does the HOA allow nightly rentals?

Run this diligence during the contract period, before the appraisal and before your earnest money is at risk.

Qualifying When STR Income Can’t Count

Long-term rent can still carry the loan. If the property is legal as a standard rental, the lender runs the coverage ratio on supported long-term rent. Many files clear that test on their own.

Picture an investor looking at a three-bedroom house. The STR projection puts coverage near 1.4x. The long-term rent schedule puts it near 1.1x. The second number is the real coverage figure if the permit fails. It still clears 1.00, which is where many select programs start.

Coverage below 1.00 is a separate path. A select-lender path takes coverage below 1.00 with leverage and terms adjusted. Pricing and leverage adjust on those files, so they are not the same loan at a lower bar.

Clearing 1.00 does not mean positive cash flow. DSCR compares rent to PITIA only. Repairs, vacancy, management, utilities, and capital expenses sit outside the calculation. A deal that only works on Airbnb income is risky in a restrictive market, and the strongest files clear both the equity test and the coverage test.

What the STR Program Looks Like

On the STR programs across Lendmire’s wholesale network, these are the typical guideline ranges, subject to lender guidelines:

  • Purchases go up to 75% LTV on the strongest files.
  • Refinances run around 70% LTV, and STR cash-out stops at 70%. Standard long-term rentals cash out up to about 75%.
  • Expect a 640 minimum credit score.
  • Lenders usually want about 12 months of hosting history.
  • Coverage starts at 1.00 on purchases and refinances.
  • Loan sizes go up to $3,000,000 on standard programs.

Manufactured homes, log homes, and barndominiums are not offered in these programs. Reserves vary by lender, leverage, and loan size, and commonly sit around six months of PITIA. A larger down payment can lift the coverage ratio, but it does not erase leverage caps, credit floors, or property eligibility.

Lendmire is a broker, so it arranges these loans through select lenders. Lenders review eligibility and approve. Each file is underwritten individually, and programs change.

A Quick Contrast With Agency Rules

DSCR loans are not agency products, so agency rules do not govern them. They are useful context, though. Fannie Mae’s recent Selling Guide announcement added new STR income eligibility requirements, including compliance with local registration and licensing. TENA reported that the implementation date was pushed back. The direction is the same one DSCR lenders already follow: legal use comes first.

After Closing: Rule Changes and Stress Tests

A rule change after closing does not rewrite your loan terms. It can change your income. If a permit is revoked or a new cap blocks renewal, the rent that supported the file may shrink.

Stress-test the worst case before you buy. Ask whether the property still carries itself as a long-term rental. If the answer is no, you are betting on a permit, not on a property.

One more check: if you will use the home yourself for much of the year, it may not be an investment property at all. That changes which loan products apply.

When to Walk Away

Walk away if any of these are true:

  • The only path to profit is STR income, and the permit cannot transfer to you.
  • The HOA bans nightly stays and will not change.
  • The city has frozen permits and the freeze has no end.
  • The long-term rent does not cover the full monthly obligation.
  • You cannot get written confirmation of legality at the exact address.

Tax treatment can depend on how the funds are used and how the property is held; investors should keep clear records and speak with a qualified tax professional before relying on any deduction.

Frequently Asked Questions

Can I get an STR loan in a city that bans Airbnbs?

Not on projected STR income. If the rental is a legal long-term rental, the file can still be reviewed on long-term rent, subject to lender guidelines and credit approval. Coverage below 1.00 is available through select lenders in the network, with leverage and terms adjusted.

Can the HOA block it if the city allows it?

Yes. HOA rules, condo documents, and deed restrictions can prohibit STRs even where the city allows them. Get the HOA documents early, because a lender will ask for them.

Does a permit transfer when I buy?

Often it does not. Some jurisdictions end the permit at sale, and some end it when ownership moves to a new entity. Confirm transferability in writing before you make an offer.

Does a neighbor’s Airbnb listing prove I can operate?

No. Zoning districts, grandfathering, and unpermitted operators all differ from parcel to parcel. Lenders look at your address, not the street.

What if the rules change after I close?

Your loan terms stay the same, but your income can change. Underwrite the property on long-term rent as the fallback so a permit loss does not break the deal.
